7 LONG TITLE
8 General Description:
9 This bill supplements or reduces appropriations otherwise provided for the support and
10 operation of state government for the fiscal year beginning July 1, 2022 and ending June 30, 2023.
11 Highlighted Provisions:
12 This bill:
13 ▸ provides appropriations for the use and support of higher education and certain state
14 agencies;
15 ▸ authorizes full time employment levels for certain internal service funds;
16 ▸ provides appropriations for other purposes as described; and
17 ▸ provides intent language.
18 Money Appropriated in this Bill:
19 This bill appropriates $1,445,817,800 in operating and capital budgets for fiscal year 2023,
20 including:
21 ▸ ($382,802,100) from the General Fund;
22 ▸ $425,524,400 from the Income Tax Fund; and
23 ▸ $1,403,095,500 from various sources as detailed in this bill.
24 This bill appropriates $5,852,400 in expendable funds and accounts for fiscal year 2023.
25 This bill appropriates $53,004,700 in business-like activities for fiscal year 2023, including:
26 ▸ $64,987,000 from the General Fund; and
27 ▸ ($11,982,300) from various sources as detailed in this bill.
28 This bill appropriates $12,151,300 in restricted fund and account transfers for fiscal year
29 2023, including:
30 ▸ ($1,948,700) from the General Fund; and
31 ▸ $14,100,000 from various sources as detailed in this bill.
32 This bill appropriates $10,536,500 in transfers to unrestricted funds for fiscal year 2023.
33 This bill appropriates $17,904,400 in capital project funds for fiscal year 2023.
34 Other Special Clauses:
35 This bill takes effect immediately.

39 Be it enacted by the Legislature of the state of Utah:
40 Section 1. FY 2023 Appropriations. The following sums of money are appropriated for the
41 fiscal year beginning July 1, 2022 and ending June 30, 2023. These are additions to amounts
42 otherwise appropriated for fiscal year 2023.
43 Subsection 1(a). Operating and Capital Budgets. Under the terms and conditions of
44 Title 63J, Chapter 1, Budgetary Procedures Act, the Legislature appropriates the following sums of
45 money from the funds or accounts indicated for the use and support of the government of the state of
46 Utah.

59 funds is limited to purchase of computer hardware and
60 software, specific program development/operation, pass-thru
61 funds appropriated by the Legislature, and other one-time
62 operational and capital expenses.
63 The Legislature intends that the Attorney General's Office,
64 Investigations Division, may purchase two additional vehicles
65 with department funds in Fiscal Year 2023 and Fiscal Year
66 2024.

137 The Legislature intends that, if the Department of
138 Corrections is able to reallocate resources internally to find
139 additional Adult Probation & Parole Agents and AP&P
140 Supervisors, for every two agents and for every one supervisor
141 hired or reassigned to field supervision duties, the Legislature
142 grants the authority to purchase one vehicle with Department
143 funds.
144 The Legislature intends that the Department of Corrections,
145 Facilities Bureau/Adult Probation and Parole Programs, is
146 granted authority to purchase two trucks with plow & spreader
147 with Department funds.
148 The Legislature intends that the Department of Corrections
149 report on progress during the 2023 Interim on the audit
150 recommendations found in "A Performance Audit of the
151 Oversight and Effectiveness of Adult Probation and Parole";
152 "A Limited Review of the Coordination Between Public Safety
153 Entities."

172 Year 2023. The use of any unused funds is limited to housing
173 additional inmates, and treatment and vocational programming
174 for inmates housed at the county jails.
175 The Legislature intends that $1,032,400 of the
176 appropriations in SB3 Appropriation Adjustments, item 90
177 from the 2021 General Session, to implement provisions of
178 SB249 County Jail Amendments to cover program costs until
179 the repeal date of June 30, 2024 stated in Section 1 of SB249,
180 and under Section 63J-1-603 of the Utah Code, not lapse at the
181 close of Fiscal Year 2023.

361 The Legislature intends that up to $7,000,000 provided by
362 this item be used to replace the Department of Transportation's
363 (UDOT) two existing King Air airplanes with a single aircraft
364 of similar capability. The Legislature further intends that
365 UDOT transfer the existing King Airs to Utah Valley
366 University (UVU) for use in state aviation instruction
367 programs. UVU shall partner with other institutions to provide
368 training and experience in twin engine fixed-wing aviation
369 throughout the state. UVU shall also occasionally offer the use
370 of these aircraft to UDOT and the State of Utah as back-up to
371 the new state plane. The Legislature intends that UDOT and
372 UVU report progress on the above transactions to the
373 Executive Appropriations Committee before October 1, 2023.
374 Under terms of Utah Code Annotated Section 63J-1-603,
375 the Legislature intends that up to $7,000,000 of appropriations
376 provided for Aeronautics related to purchasing a state aircraft
377 not lapse at the close of fiscal year 2023.
