8 General Description:
9 This bill creates a tuition waiver program for dependents of disabled veterans who
10 enroll at a state institution of higher education.
11 Highlighted Provisions:
12 This bill:
13 ▸ provides the conditions under which a state institution of higher education is
14 required to waive tuition for the dependent of a disabled veteran.

23 Be it enacted by the Legislature of the state of Utah:
24 Section 1. Section 53B-8-107.5 is enacted to read:
25 53B-8-107.5. Disabled veterans' dependent tuition waiver.
26 (1) As used in this section, "qualifying disabled veteran" means a veteran who has a
27 100% service-connected disability rating by the Veterans Benefits Administration that is
28 permanent and total.
29 (2) A state institution of higher education shall waive undergraduate tuition for a
30 dependent of a qualifying disabled veteran under the following conditions:
31 (a) the state institution of higher education has accepted the dependent in accordance
32 with the state institution of higher education's admissions guidelines;
33 (b) the dependent is a resident student determined in accordance with Section
34 53B-8-102;
35 (c) the dependent has not completed a course of studies leading to an undergraduate
36 degree;
37 (d) the dependent may utilize the waiver only for courses that apply toward the degree
38 or certificate requirements of the program in which the dependent is enrolled; and
39 (e) the dependent may not be excluded from the waiver if the dependent has previously
40 taken courses at or has been awarded credit by a state institution of higher education.
41 (3) (a) The tuition waiver described in this section applies only to tuition associated
42 with undergraduate studies.
43 (b) The tuition waiver described in this section does not apply to fees, books, or
44 housing expenses.
45 (4) The Department of Veterans and Military Affairs, after any necessary consultation
46 with the adjutant general, shall certify to the state institution of higher education in which the
47 student is enrolled that the student is a dependent of a qualifying disabled veteran.
48 (5) The board may request reimbursement from the Legislature for costs incurred in
49 providing the tuition waiver described in this section.
