8 General Description:
9 This bill enacts provisions regarding the reimbursement of a law enforcement officer's
10 training costs.
11 Highlighted Provisions:
12 This bill:
13 ▸ requires a governmental agency that hires a law enforcement officer from another
14 agency within a certain time period to reimburse the initial agency for certain costs.

23 Be it enacted by the Legislature of the state of Utah:
24 Section 1. Section 53-13-117 is enacted to read:
25 53-13-117. Reimbursement for training costs.
26 (1) As used in this section:
27 (a) "Governmental entity" means the same as that term is defined in Section
28 63G-7-102.
29 (b) "Initial agency" means a governmental entity that employs and pays an individual
30 during that individual's mandatory training to become a law enforcement officer.
31 (c) "Law enforcement officer" means the same as that term is defined in Section
32 53-13-103.
33 (d) "Mandatory training" means the time a law enforcement officer spends, up to a total
34 of six months, participating in any combination of the following:
35 (i) training at a certified police academy within this state; or
36 (ii) training required for new employees provided by the initial agency.
37 (e) "Subsequent agency" means a governmental entity that hires a law enforcement
38 officer who has completed mandatory training while being paid by an initial hiring entity.
39 (2) Except as provided in Subsection (3) or (4), if a law enforcement officer
40 satisfactorily completes mandatory training while employed by an initial agency, and is hired
41 by a subsequent agency as a law enforcement officer, the subsequent agency shall reimburse
42 the initial agency for:
43 (a) 100% of the retirement contributions and salary paid to the officer by the initial
44 agency during mandatory training if the officer is hired by the subsequent agency within one
45 year after the day on which the officer completed the training; or
46 (b) 50% of the retirement contributions and salary described in Subsection (2)(a) if the
47 officer is hired by the subsequent agency after the one-year period described in Subsection
48 (2)(a), but within two years after the day on which the officer completes mandatory training.
49 (3) An initial agency may waive the initial agency's right to all of, or a portion of, the
50 reimbursement required under Subsection (2).
51 (4) Subsection (2) does not apply if the initial agency:
52 (a) terminates the employment of the law enforcement officer during or after
53 completion of mandatory training and the officer is hired by a subsequent agency; or
54 (b) contractually obligates the law enforcement officer to pay any amount if the officer
55 leaves employment within a specified period of time after completing the mandatory training.
