8 General Description:
9 This bill addresses construction groundbearing equipment requirements.
10 Highlighted Provisions:
11 This bill:
12 ▸ defines terms; and
13 ▸ requires a real property owner to:
14 • obtain a geotechnical report before using groundbearing equipment as part of a
15 construction project; and
16 • develop a solution to ensure groundbearing equipment soil and subgrade support
17 before using groundbearing equipment as part of the project.

26 Be it enacted by the Legislature of the state of Utah:
27 Section 1. Section 15A-6-301 is enacted to read:

29 15A-6-301. Groundbearing equipment geotechnical report.
30 (1) As used in this section, "groundbearing equipment" means a power-operated
31 machine used in construction, demolition, or excavation work.
32 (2) Before using groundbearing equipment for a construction project on real property,
33 the owner of the real property shall:
34 (a) obtain a geotechnical report detailing whether the existing soil and subgrade
35 conditions of the real property are able to support the groundbearing equipment in addition to
36 the other equipment or materials to be used or structures to be built as part of the project; and
37 (b) if the owner determines from the geotechnical report that the soil and subgrade
38 conditions on the real property are unable to support the groundbearing equipment in addition
39 to the other equipment, materials, and structures, develop or design a solution to ensure the
40 support.
