7     LONG TITLE
8     General Description:
9          This bill amends provisions related to the purchasing, leasing, or replacement of a state
10     vehicle.
11     Highlighted Provisions:
12          This bill:
13          ▸     requires the Division of Fleet Operations to implement a total cost of ownership
14     calculator that:
15               •     assesses and compares the total cost of ownership of certain types of vehicles;
16     and
17               •     evaluates certain criteria to determine the total cost of ownership;
18          ▸     directs the Division of Fleet Operations to regularly review the use of state vehicles;
19          ▸     when prudent, requires the Division of Fleet Operations to replace a state vehicle
20     with a low or zero emissions vehicle;
21          ▸     prioritizes certain low or zero emissions vehicles to replace state vehicles; and
22          ▸     makes technical changes.

33     Be it enacted by the Legislature of the state of Utah:
34          Section 1. Section 63A-9-401.5 is amended to read:
35          63A-9-401.5. Vehicle fleet cost efficiency plans -- Requirements -- Contents --
36     Submission by agencies.
37          (1) The division shall develop and coordinate the implementation of a statewide
38     vehicle fleet cost efficiency plan to ensure continuing progress toward statewide overall cost
39     reduction in government vehicle costs[. The plan shall include:], including:
40          (a) goals for vehicle fleet cost efficiency;
41          (b) a summary of agency submitted plans, statistics, and progress;
42          (c) standard measures of cost including:
43          (i) vehicle cost per mile;
44          (ii) total vehicles;
45          (iii) (A) total fuel used; [and] or
46          (B) total electricity used; and
47          (iv) (A) miles per gallon of fuel; or
48          (B) miles per kilowatt of electricity;
49          (d) goals for purchasing the most economically appropriate size and type of vehicle for
50     the purposes and driving conditions for which the vehicle will be used;
51          (e) cost reduction measures which may include:
52          (i) reducing vehicle engine idle time;
53          (ii) driving fewer miles;
54          (iii) using car pools when possible;
55          (iv) avoiding rush hour traffic;
56          (v) reducing aggressive driving;
57          (vi) providing proper preventative maintenance including properly inflated tires; and
58          (vii) purchasing from state fuel sites and using the lowest octane fuel needed for the

59     altitude;
60          (f) reducing inventories of underutilized vehicles; [and]
61          (g) education to inform drivers of their accountability on implementing cost reduction
62     measures[.]; and
63          (h) utilizing the total cost of ownership calculator described in Subsection (2).
64          (2) (a) The division shall implement a total cost of ownership calculator that assesses
65     and compares the total cost of purchasing, leasing, and operating the types of vehicles
66     described in Subsection 63A-9-403(2).
67          (b) The calculator shall evaluate the following criteria to calculate the total cost of
68     ownership:
69          (i) the vehicle's make, model, and age;
70          (ii) the average miles traveled per year for a similar vehicle;
71          (iii) the life expectancy of the vehicle;
72          (iv) the average annual depreciation;
73          (v) the initial and annual costs of purchasing, leasing, and maintaining the vehicle; and
74          (vi) all costs the agency will incur to install or maintain infrastructure necessary for the
75     vehicle type.
76          (c) The division shall maintain and make the calculator available to all state agencies
77     and political subdivisions.
78          [(2)] (3) The division shall assist agencies to develop and implement their own plans in
79     accordance with this part.
80          [(3)] (4) Each agency that owns or leases vehicles shall develop, implement, and
81     submit to the division under Section 63A-9-402, a vehicle fleet cost efficiency plan for their
82     agency in accordance with the provisions under Subsection (1). The plan shall include agency
83     goals and statistics, and a report of agency progress.
84          Section 2. Section 63A-9-403 is repealed and reenacted to read:
85          63A-9-403. Review of state vehicle use -- Replacement.
86          (1) The division shall regularly review the use of all state vehicles to:
87          (a) reallocate underutilized state vehicles;
88          (b) remove unnecessary state vehicles; and
89          (c) assign new or replacement state vehicles to an agency.

90          (2) In accordance with the division's statewide vehicle fleet cost efficiency plan
91     described in Section 63A-9-401.5, and in consultation with the agency using or needing the
92     state vehicle, the division shall, when prudent, replace or obtain a state vehicle with one of the
93     following low or zero emissions vehicles in the following order of priority:
94          (a) an electric vehicle as defined in Section 19-1-402;
95          (b) an electric-hybrid vehicle as defined in Section 19-1-402;
96          (c) any other alternative fuel vehicle as defined in Section 41-1a-102; or
97          (d) a vehicle that is not a vehicle type described in Subsections (2)(a) through (c).
