8     LONG TITLE
9     General Description:
10          This resolution modifies joint legislative rules related to convening the Legislature into
11     session.
12     Highlighted Provisions:
13          This resolution:
14          ▸     provides that when conducting a poll to determine whether the Legislature will
15     convene in a veto override session or a special session, the president and speaker
16     shall:
17               •     provide each member a list of items to be considered during the session; and
18               •     post on the Legislature's website the list of items provided to each member and
19     an account of how each member responded to the poll; and
20          ▸     makes technical and conforming changes.

27     Be it resolved by the Legislature of the state of Utah:
28          Section 1. JR2-1-201 is enacted to read:
29          JR2-1-201. Poll for the president and speaker to convene a special session.
30          (1) The president of the Senate and the speaker of the House of Representatives may
31     convene the Legislature into session as provided in Utah Constitution, Article VI, Section 2.
32          (2) (a) When conducting a poll required under Utah Constitution, Article VI, Section 2,
33     the president and speaker shall provide each of their respective members a list that specifies
34     each item of business for which the president and speaker intend to convene the Legislature.
35          (b) Each member shall respond to the poll.
36          (c) Neither the president nor the speaker may require a member to respond to the poll
37     before the member receives the list described in Subsection (2)(a).
38          (3) No later than three business days after the day on which the president and speaker
39     complete a poll described in this rule, the president and speaker shall ensure that the following
40     information is available to the public on the Legislature's website:
41          (a) the list described in Subsection (2)(a); and
42          (b) an itemized list of how each member responded to the poll.
43          Section 2. JR2-2-201 is amended to read:
44          JR2-2-201. Poll to convene and calling a veto override session.
45          (1) (a) If the Legislature is prevented by adjournment sine die from reconsidering any
46     vetoed bill or appropriation item [of appropriation] vetoed by the governor, the president of the
47     Senate and the speaker of the House of Representatives shall poll their respective members [by
48     mail or other means] to determine if the Legislature shall convene in a veto override session to
49     reconsider any vetoed legislation.
50          (b) Each member shall respond to the poll [in writing, by telephone, or other available
51     means].
52          [(2) (a) The president and speaker shall notify the governor about the results of the
53     poll.]
54          [(b) The sponsor of a bill being considered for the veto override shall be provided,
55     upon request, the itemized list of how each legislator responded to the poll.]
56          (2) (a) When conducting a poll described in Subsection (1), the president and speaker
57     shall provide each of their respective members a list of each vetoed bill and vetoed

58     appropriation item that the president and speaker intend to reconsider in the veto override
59     session.
60          (b) Neither the president nor the speaker may require a member to respond to the poll
61     before the member receives the list described in Subsection (2)(a).
62          (3) (a) If two-thirds of the members of each house are in favor of convening a veto
63     override session, the Legislature shall convene in a veto override session [not to exceed five
64     calendar days,] at a time agreed upon by the president and speaker.
65          (b) A veto override session[, if called, shall be convened prior to]:
66          (i) shall begin within 60 days after the adjournment of the session at which the
67     Legislature passed the bill or appropriation item under consideration [was passed.]; and
68          (ii) may not exceed five calendar days.
69          (4) (a) The [presiding officers] president and speaker shall issue [the] a call of the veto
70     override session of the Legislature to their members.
71          (b) The call shall contain [a list of each bill and appropriation item vetoed by the
72     governor and]:
73          (i) the date and time for convening the veto override session[.]; and
74          (ii) a list of each vetoed bill and each vetoed appropriation item that the Legislature
75     will reconsider in the veto override session.
76          (5) No later than three business days after the day on which the president and speaker
77     complete a poll described in Subsection (1), the president and speaker shall ensure that the
78     following information is available to the public on the Legislature's website:
79          (a) the list described in Subsection (2)(a); and
80          (b) an itemized list of how each member responded to the poll.
81          [(5)] (6) The Legislature shall consider the vetoed bills and appropriation items
82     according to the process outlined in JR2-2-101.
