13          This bill addresses issues related to radon gas.
14     Highlighted Provisions:
15          This bill:
16          ▸     defines terms;
17          ▸     directs the Division of Waste Management and Radiation Control to develop an
18     online radon gas test data collection mechanism and map;
19          ▸     addresses testing and mitigation in public buildings, including reporting; and
20          ▸     repeals the study requirement that has been completed.

31     Be it enacted by the Legislature of the state of Utah:
32          Section 1. Section 19-1-208 is enacted to read:
33          19-1-208. Radon -- Public buildings -- Reports -- Assistance.
34          (1) As used in this section:
35          (a) "Division" means the Division of Waste Management and Radiation Control.
36          (b) "Federal indoor radon gas action limit" means a level of radon gas greater than or
37     equal to 4.0 pCi/L.
38          (2) (a) By no later than July 1, 2024, the division shall:
39          (i) develop an online radon test data collection mechanism; and
40          (ii) map online, in a manner that is accessible by the public, the radon test data that the
41     division collects.
42          (b) In developing the online data collection mechanism and map, the division may not
43     require testing for radon.
44          (3) (a) A state agency that owns, operates, or oversees a public building is encouraged
45     to test for radon and mitigate radon levels in the public building that are above the federal
46     indoor gas action limit.
47          (b) If by June 30, 2023, the Division of Facilities Construction and Management has
48     not provided for testing and any necessary mitigation of radon levels in the state's public
49     buildings, the Division of Facilities Construction and Management shall:
50          (i) (A) prepare a plan to test the state's public buildings for radon and to mitigate radon
51     levels that are above the federal indoor gas action limit; or
52          (B) document the reason why testing for radon or mitigation of radon levels is not
53     necessary for a specific state public building; and
54          (ii) report the information described in Subsection (3)(b)(i) to the Natural Resources,
55     Agriculture, and Environment Interim Committee by no later than the 2023 November interim
56     meeting of the Natural Resources, Agriculture, and Environment Interim Committee.
57          (c) The State Board of Education in relation to public schools within the state shall:
58          (i) (A) prepare a plan for testing public school buildings for radon and for mitigating

59     radon levels that are above the federal indoor gas action limit; or
60          (B) document the reason why testing for radon or mitigation of radon levels is not
61     necessary for a specific public school building; and
62          (ii) report the information described in Subsection (3)(c)(i) to the Natural Resources,
63     Agriculture, and Environment Interim Committee by no later than the 2023 November interim
64     meeting of the Natural Resources, Agriculture, and Environment Interim Committee.
65          (4) The division may upon request assist efforts to test public buildings for radon and
66     mitigate radon levels in public buildings that are above the federal indoor gas action limit.
67          Section 2. Repealer.
68          This bill repeals:
69          Section 79-2-405, Radon study.
