12          This bill clarifies language related to the Road Usage Charge Program Special Revenue
13     Fund.
14     Highlighted Provisions:
15          This bill:
16          ▸     clarifies that the Road Usage Charge Program Special Revenue Fund is an
17     expendable special revenue fund; and
18          ▸     removes language requiring appropriation by the Legislature in order for the
19     Department of Transportation to administer the Road Usage Charge Program
20     Special Revenue Fund.

29     Be it enacted by the Legislature of the state of Utah:
30          Section 1. Section 72-1-213.2 is amended to read:
31          72-1-213.2. Road Usage Charge Program Special Revenue Fund -- Revenue.
32          (1) There is created [a] an expendable special revenue fund within the Transportation
33     Fund known as the "Road Usage Charge Program Special Revenue Fund."
34          (2) (a) The fund shall be funded from the following sources:
35          (i) revenue collected by the department under Section 72-1-213.1;
36          (ii) appropriations made to the fund by the Legislature;
37          (iii) contributions from other public and private sources for deposit into the fund;
38          (iv) interest earnings on cash balances; and
39          (v) money collected for repayments and interest on fund money.
40          (b) If the revenue derived from the sources described in Subsection (2)(a) is
41     insufficient to cover the costs of administering the road usage charge program, subject to
42     Subsection 72-2-107(1), the department may transfer into the fund revenue deposited into the
43     Transportation Fund from the fee described in Subsections 41-1a-1206(1)(h) and (2)(b) in an
44     amount sufficient to enable the department to administer the road usage charge program.
45          (3) (a) Revenue generated by the road usage charge program and relevant penalties
46     shall be deposited into the Road Usage Charge Program Special Revenue Fund.
47          (b) Revenue in the Road Usage Charge Program Special Revenue Fund is nonlapsing.
48          (4) [Upon appropriation by the Legislature, the] The department may use revenue
49     deposited into the Road Usage Charge Program Special Revenue Fund:
50          (a) to cover the costs of administering the program; and
51          (b) for state transportation purposes.
