22 Be it enacted by the Legislature of the state of Utah:
23 Section 1. Section 4-11-106 is amended to read:
24 4-11-106. Hives to have a moveable frame or a functional equivalent -- Consent of
25 county bee inspector to sell or transport diseased bees.
26 (1) A person may not house or keep bees in a hive unless:
27 (a) the hive is equipped with a movable [
28 of a moveable frame that allows access without difficulty, to all the hive's parts [

30 (b) the hive has, within one year before the day on which the department inspects the
31 hive, received a negative test for terminal disease, parasites, or pests, by means of a beehive
32 testing method approved by the department.
33 (2) No person who owns or has possession of bees (whether queens or workers) with
34 knowledge that they are infected with terminal disease, parasites, or pests, or with knowledge
35 that they have been exposed to terminal disease, parasites, or pests, shall sell, barter, give away,
36 or move the bees, colonies, or apiary equipment without the consent of the county bee
37 inspector or the department.
