7     LONG TITLE
8     General Description:
9          This bill creates the Great Salt Lake Preservation support special group license plate.
10     Highlighted Provisions:
11          This bill:
12          ▸     creates the Great Salt Lake Preservation support special group license plate;
13          ▸     directs revenue generated by the support special group license plate to be deposited
14     into the Sovereign Lands Management Account to enhance preservation of the
15     Great Salt Lake watershed and ecosystem; and
16          ▸     makes technical changes.

28     Be it enacted by the Legislature of the state of Utah:
29          Section 1. Section 41-1a-418 is amended to read:
30          41-1a-418. Authorized special group license plates.
31          (1) The division shall only issue special group license plates in accordance with this
32     section through Section 41-1a-422 to a person who is specified under this section within the
33     categories listed as follows:
34          (a) disability special group license plates issued in accordance with Section 41-1a-420;
35          (b) honor special group license plates, as in a war hero, which plates are issued for a:
36          (i) survivor of the Japanese attack on Pearl Harbor;
37          (ii) former prisoner of war;
38          (iii) recipient of a Purple Heart;
39          (iv) disabled veteran;
40          (v) recipient of a gold star award issued by the United States Secretary of Defense; or
41          (vi) recipient of a campaign or combat theater award determined by the Department of
42     Veterans and Military Affairs;
43          (c) unique vehicle type special group license plates, as for historical, collectors value,
44     or other unique vehicle type, which plates are issued for:
45          (i) a special interest vehicle;
46          (ii) a vintage vehicle;
47          (iii) a farm truck; or
48          (iv) (A) until Subsection (1)(c)(iv)(B) or (4) applies, a vehicle powered by clean fuel as
49     defined in Section 59-13-102; or
50          (B) beginning on the effective date of rules made by the Department of Transportation
51     authorized under Subsection 41-6a-702(5)(b) and until Subsection (4) applies, a vehicle
52     powered by clean fuel that meets the standards established by the Department of Transportation
53     in rules authorized under Subsection 41-6a-702(5)(b);
54          (d) recognition special group license plates, which plates are issued for:
55          (i) a current member of the Legislature;
56          (ii) a current member of the United States Congress;
57          (iii) a current member of the National Guard;
58          (iv) a licensed amateur radio operator;

59          (v) a currently employed, volunteer, or retired firefighter until June 30, 2009;
60          (vi) an emergency medical technician;
61          (vii) a current member of a search and rescue team;
62          (viii) a current honorary consulate designated by the United States Department of
63     State;
64          (ix) an individual supporting commemoration and recognition of women's suffrage;
65          (x) an individual supporting a fraternal, initiatic order for those sharing moral and
66     metaphysical ideals, and designed to teach ethical and philosophical matters of brotherly love,
67     relief, and truth;
68          (xi) an individual supporting the Utah Wing of the Civil Air Patrol; or
69          (xii) an individual supporting the recognition and continuation of the work and life of
70     Dr. Martin Luther King, Jr.; or
71          (e) support special group license plates, as for a contributor to an institution or cause,
72     which plates are issued for a contributor to:
73          (i) an institution's scholastic scholarship fund;
74          (ii) the Division of Wildlife Resources;
75          (iii) the Department of Veterans and Military Affairs;
76          (iv) the Division of Outdoor Recreation;
77          (v) the Department of Agriculture and Food;
78          (vi) the Guardian Ad Litem Services Account and the Children's Museum of Utah;
79          (vii) the Boy Scouts of America;
80          (viii) spay and neuter programs through No More Homeless Pets in Utah;
81          (ix) the Boys and Girls Clubs of America;
82          (x) Utah public education;
83          (xi) programs that provide support to organizations that create affordable housing for
84     those in severe need through the Division of Real Estate;
85          (xii) the Department of Public Safety;
86          (xiii) programs that support Zion National Park;
87          (xiv) beginning on July 1, 2009, programs that provide support to firefighter
88     organizations;
89          (xv) programs that promote bicycle operation and safety awareness;

90          (xvi) programs that conduct or support cancer research;
91          (xvii) programs that create or support autism awareness;
92          (xviii) programs that create or support humanitarian service and educational and
93     cultural exchanges;
94          (xix) until September 30, 2017, programs that conduct or support prostate cancer
95     awareness, screening, detection, or prevention;
96          (xx) programs that support and promote adoptions;
97          (xxi) programs that support issues affecting women and children through an
98     organization affiliated with a national professional men's basketball organization;
99          (xxii) programs that strengthen youth soccer, build communities, and promote
100     environmental sustainability through an organization affiliated with a professional men's soccer
101     organization;
102          (xxiii) programs that support children with heart disease;
103          (xxiv) programs that support the operation and maintenance of the Utah Law
104     Enforcement Memorial;
105          (xxv) programs that provide assistance to children with cancer;
106          (xxvi) programs that promote leadership and career development through agricultural
107     education;
108          (xxvii) the Utah State Historical Society;
109          (xxviii) programs that promote motorcycle safety awareness;
110          (xxix) organizations that promote clean air through partnership, education, and
111     awareness;
112          (xxx) programs dedicated to strengthening the state's Latino community through
113     education, mentoring, and leadership opportunities;
114          (xxxi) organizations dedicated to facilitating, connecting, registering, and advocating
115     for organ donors and donor families;
116          (xxxii) public education on behalf of the Kiwanis International clubs;
117          (xxxiii) the Live On suicide prevention campaign; [or]
118          (xxxiv) the Division of State Parks to advance the Utah State Parks dark sky
119     initiative[.]; or
120          (xxxv) the Division of Forestry, Fire, and State Lands to protect the Great Salt Lake.

121          (2) (a) The division may not issue a new type of special group license plate or decal
122     unless the division receives:
123          (i) (A) a private donation for the start-up fee established under Section 63J-1-504 for
124     the production and administrative costs of providing the new special group license plates or
125     decals; or
126          (B) a legislative appropriation for the start-up fee provided under Subsection
127     (2)(a)(i)(A); and
128          (ii) beginning on January 1, 2012, and for the issuance of a support special group
129     license plate authorized in Section 41-1a-422, at least 500 completed applications for the new
130     type of support special group license plate or decal to be issued with all fees required under this
131     part for the support special group license plate or decal issuance paid by each applicant.
132          (b) (i) Beginning on January 1, 2012, each participating organization shall collect and
133     hold applications for support special group license plates or decals authorized in Section
134     41-1a-422 on or after January 1, 2012, until it has received at least 500 applications.
135          (ii) Once a participating organization has received at least 500 applications, it shall
136     submit the applications, along with the necessary fees, to the division for the division to begin
137     working on the design and issuance of the new type of support special group license plate or
138     decal to be issued.
139          (iii) Beginning on January 1, 2012, the division may not work on the issuance or design
140     of a new support special group license plate or decal authorized in Section 41-1a-422 until the
141     applications and fees required under this Subsection (2) have been received by the division.
142          (iv) The division shall begin issuance of a new support special group license plate or
143     decal authorized in Section 41-1a-422 on or after January 1, 2012, no later than six months
144     after receiving the applications and fees required under this Subsection (2).
145          (c) (i) Beginning on July 1, 2009, the division may not renew a motor vehicle
146     registration of a motor vehicle that has been issued a firefighter recognition special group
147     license plate unless the applicant is a contributor as defined in Subsection
148     41-1a-422(1)(a)(ii)(D) to the Firefighter Support Restricted Account.
149          (ii) A registered owner of a vehicle that has been issued a firefighter recognition
150     special group license plate prior to July 1, 2009, upon renewal of the owner's motor vehicle
151     registration shall:

152          (A) be a contributor to the Firefighter Support Restricted Account as required under
153     Subsection (2)(c)(i); or
154          (B) replace the firefighter recognition special group license plate with a new license
155     plate.
156          (3) Beginning on July 1, 2011, if a support special group license plate or decal type
157     authorized in Section 41-1a-422 and issued on or after January 1, 2012, has fewer than 500
158     license plates issued each year for a three consecutive year time period that begins on July 1,
159     the division may not issue that type of support special group license plate or decal to a new
160     applicant beginning on January 1 of the following calendar year after the three consecutive year
161     time period for which that type of support special group license plate or decal has fewer than
162     500 license plates issued each year.
163          (4) Beginning on July 1, 2011, the division may not issue to an applicant a unique
164     vehicle type license plate for a vehicle powered by clean fuel under Subsection (1)(c)(iv).
165          (5) (a) Beginning on October 1, 2017, the division may not issue a new prostate cancer
166     support special group license plate.
167          (b) A registered owner of a vehicle that has been issued a prostate cancer support
168     special group license plate before October 1, 2017, may renew the owner's motor vehicle
169     registration, with the contribution allocated as described in Section 41-1a-422.
170          Section 2. Section 41-1a-422 is amended to read:
171          41-1a-422. Support special group license plates -- Contributor -- Voluntary
172     contribution collection procedures.
173          (1) As used in this section:
174          (a) (i) except as provided in Subsection (1)(a)(ii), "contributor" means a person who
175     has donated or in whose name at least $25 has been donated to:
176          (A) a scholastic scholarship fund of a single named institution;
177          (B) the Department of Veterans and Military Affairs for veterans programs;
178          (C) the Division of Wildlife Resources for the Wildlife Resources Account created in
179     Section 23-14-13, for conservation of wildlife and the enhancement, preservation, protection,
180     access, and management of wildlife habitat;
181          (D) the Department of Agriculture and Food for the benefit of conservation districts;
182          (E) the Division of Outdoor Recreation for the benefit of snowmobile programs;

183          (F) the Guardian Ad Litem Services Account and the Children's Museum of Utah, with
184     the donation evenly divided between the two;
185          (G) the Boy Scouts of America for the benefit of a Utah Boy Scouts of America
186     council as specified by the contributor;
187          (H) No More Homeless Pets in Utah for distribution to organizations or individuals
188     that provide spay and neuter programs that subsidize the sterilization of domestic animals;
189          (I) the Utah Alliance of Boys and Girls Clubs, Inc. to provide and enhance youth
190     development programs;
191          (J) the Utah Association of Public School Foundations to support public education;
192          (K) the Utah Housing Opportunity Restricted Account created in Section 61-2-204 to
193     assist people who have severe housing needs;
194          (L) the Public Safety Honoring Heroes Restricted Account created in Section 53-1-118
195     to support the families of fallen Utah Highway Patrol troopers and other Department of Public
196     Safety employees;
197          (M) the Division of Outdoor Recreation for distribution to organizations that provide
198     support for Zion National Park;
199          (N) the Firefighter Support Restricted Account created in Section 53-7-109 to support
200     firefighter organizations;
201          (O) the Share the Road Bicycle Support Restricted Account created in Section
202     72-2-127 to support bicycle operation and safety awareness programs;
203          (P) the Cancer Research Restricted Account created in Section 26-21a-302 to support
204     cancer research programs;
205          (Q) Autism Awareness Restricted Account created in Section 53F-9-401 to support
206     autism awareness programs;
207          (R) Humanitarian Service and Educational and Cultural Exchange Restricted Account
208     created in Section 9-17-102 to support humanitarian service and educational and cultural
209     programs;
210          (S) Upon renewal of a prostate cancer support special group license plate, to the
211     Cancer Research Restricted Account created in Section 26-21a-302 to support cancer research
212     programs;
213          (T) the Choose Life Adoption Support Restricted Account created in Section 80-2-502

214     to support programs that promote adoption;
215          (U) the National Professional Men's Basketball Team Support of Women and Children
216     Issues Restricted Account created in Section 26B-1-302;
217          (V) the Utah Law Enforcement Memorial Support Restricted Account created in
218     Section 53-1-120;
219          (W) the Children with Cancer Support Restricted Account created in Section
220     26-21a-304 for programs that provide assistance to children with cancer;
221          (X) the National Professional Men's Soccer Team Support of Building Communities
222     Restricted Account created in Section 9-19-102;
223          (Y) the Children with Heart Disease Support Restricted Account created in Section
224     26-58-102;
225          (Z) the Utah Intracurricular Student Organization Support for Agricultural Education
226     and Leadership Restricted Account created in Section 4-42-102;
227          (AA) the Division of Wildlife Resources for the Support for State-Owned Shooting
228     Ranges Restricted Account created in Section 23-14-13.5, for the creation of new, and
229     operation and maintenance of existing, state-owned firearm shooting ranges;
230          (BB) the Utah State Historical Society to further the mission and purpose of the Utah
231     State Historical Society;
232          (CC) the Motorcycle Safety Awareness Support Restricted Account created in Section
233     72-2-130;
234          (DD) clean air support causes, with half of the donation deposited into the Clean Air
235     Support Restricted Account created in Section 19-1-109, and half of the donation deposited
236     into the Clean Air Fund created in Section 59-10-1319;
237          (EE) the Latino Community Support Restricted Account created in Section 13-1-16;
238          (FF) the Allyson Gamble Organ Donation Contribution Fund created in Section
239     26-18b-101;
240          (GG) public education on behalf of the Kiwanis International clubs, with the amount of
241     the donation required to cover the costs of issuing, ordering, or reordering Kiwanis support
242     special group plates, as determined by the State Tax Commission, deposited into the Kiwanis
243     Education Support Fund created in Section 53F-9-403, and all remaining donation amounts
244     deposited into the Uniform School Fund;

245          (HH) the Governor's Suicide Prevention Fund created in Section 62A-15-1103 to
246     support the Live On suicide prevention campaign administered by the Division of Integrated
247     Healthcare; [or]
248          (II) the State Park Fees Restricted Account created in Section 79-4-402 to support the
249     Division of State Parks' dark sky initiative[.]; or
250          (JJ) the Sovereign Lands Management Account created in Section 65A-5-1 to support
251     the Division of Forestry, Fire, and State Lands' efforts to benefit and conserve the Great Salt
252     Lake watershed and ecosystem.
253          (ii) (A) For a veterans special group license plate described in Subsection (4) or
254     41-1a-421(1)(a)(v), "contributor" means a person who has donated or in whose name at least a
255     $25 donation at the time of application and $10 annual donation thereafter has been made.
256          (B) For a Utah Housing Opportunity special group license plate, "contributor" means a
257     person who:
258          (I) has donated or in whose name at least $30 has been donated at the time of
259     application and annually after the time of application; and
260          (II) is a member of a trade organization for real estate licensees that has more than
261     15,000 Utah members.
262          (C) For an Honoring Heroes special group license plate, "contributor" means a person
263     who has donated or in whose name at least $35 has been donated at the time of application and
264     annually thereafter.
265          (D) For a firefighter support special group license plate, "contributor" means a person
266     who:
267          (I) has donated or in whose name at least $15 has been donated at the time of
268     application and annually after the time of application; and
269          (II) is a currently employed, volunteer, or retired firefighter.
270          (E) For a cancer research special group license plate, "contributor" means a person who
271     has donated or in whose name at least $35 has been donated at the time of application and
272     annually after the time of application.
273          (F) For a Utah Law Enforcement Memorial Support special group license plate,
274     "contributor" means a person who has donated or in whose name at least $35 has been donated
275     at the time of application and annually thereafter.

276          (b) "Institution" means a state institution of higher education as defined under Section
277     53B-3-102 or a private institution of higher education in the state accredited by a regional or
278     national accrediting agency recognized by the United States Department of Education.
279          (2) (a) An applicant for original or renewal collegiate special group license plates under
280     Subsection (1)(a)(i) must be a contributor to the institution named in the application and
281     present the original contribution verification form under Subsection (2)(b) or make a
282     contribution to the division at the time of application under Subsection (3).
283          (b) An institution with a support special group license plate shall issue to a contributor
284     a verification form designed by the commission containing:
285          (i) the name of the contributor;
286          (ii) the institution to which a donation was made;
287          (iii) the date of the donation; and
288          (iv) an attestation that the donation was for a scholastic scholarship.
289          (c) The state auditor may audit each institution to verify that the money collected by the
290     institutions from contributors is used for scholastic scholarships.
291          (d) After an applicant has been issued collegiate license plates or renewal decals, the
292     commission shall charge the institution whose plate was issued, a fee determined in accordance
293     with Section 63J-1-504 for management and administrative expenses incurred in issuing and
294     renewing the collegiate license plates.
295          (e) If the contribution is made at the time of application, the contribution shall be
296     collected, treated, and deposited as provided under Subsection (3).
297          (3) (a) (i) Except as provided in Subsection (3)(a)(ii), an applicant for original or
298     renewal support special group license plates under this section must be a contributor to the
299     sponsoring organization associated with the license plate.
300          (ii) An applicant for a historical special group license plate is not required to make a
301     donation to the Utah State Historical Society if the historical special group license plate is for a
302     vintage vehicle that has a model year of 1980 or older.
303          (b) This contribution shall be:
304          (i) unless collected by the named institution under Subsection (2), collected by the
305     division;
306          (ii) considered a voluntary contribution for the funding of the activities specified under

307     this section and not a motor vehicle registration fee;
308          (iii) deposited into the appropriate account less actual administrative costs associated
309     with issuing the license plates; and
310          (iv) for a firefighter special group license plate, deposited into the appropriate account
311     less:
312          (A) the costs of reordering firefighter special group license plate decals; and
313          (B) the costs of replacing recognition special group license plates with new license
314     plates under Subsection 41-1a-1211(13).
315          (c) The donation described in Subsection (1)(a) must be made in the 12 months before
316     registration or renewal of registration.
317          (d) The donation described in Subsection (1)(a) shall be a one-time donation made to
318     the division when issuing original:
319          (i) snowmobile license plates; or
320          (ii) conservation license plates.
321          (4) Veterans license plates shall display one of the symbols representing the Army,
322     Navy, Air Force, Marines, Coast Guard, or American Legion.
323          Section 3. Section 65A-5-1 is amended to read:
324          65A-5-1. Sovereign Lands Management Account.
325          (1) There is created within the General Fund a restricted account known as the
326     "Sovereign Lands Management Account."
327          (2) The Sovereign Lands Management Account shall consist of the following:
328          (a) the revenues derived from sovereign lands, except for revenues deposited into the
329     Great Salt Lake Account under Section 65A-5-1.5;
330          (b) that portion of the revenues derived from mineral leases on other lands managed by
331     the division necessary to recover management costs;
332          (c) revenues derived from the Great Salt Lake Preservation support special group
333     license plate described in Sections 41-1a-418 and 41-1a-422;
334          [(c)] (d) fees deposited by the division; and
335          [(d)] (e) amounts deposited into the account in accordance with Section 59-23-4.
336          (3) (a) The expenditures of the division relating directly to the management of
337     sovereign lands shall be funded by appropriation by the Legislature from the Sovereign Lands

338     Management Account or other sources.
339          (b) Money in the Sovereign Lands Management Account may be used only for the
340     direct benefit of sovereign lands, including the management of sovereign lands.
341          (c) In appropriating money from the Sovereign Lands Management Account, the
342     Legislature shall prefer appropriations that benefit the sovereign land from which the money is
343     derived unless compelling circumstances require that money be appropriated for sovereign land
344     other than the sovereign land from which the money is derived.
345          (4) The division shall use the amount deposited into the account under Subsection
346     (2)(d) for the Great Salt Lake as described in Section 65A-10-8 as directed by the Great Salt
347     Lake Advisory Council created in Section 73-30-201.
348          Section 4. Effective date.
349          This bill takes effect on November 1, 2023.
