7     LONG TITLE
8     General Description:
9          This bill creates the Office of Student Health Affairs (office) within the Department of
10     Health and Human Services (department).
11     Highlighted Provisions:
12          This bill:
13          ▸     defines terms;
14          ▸     creates the office within the department;
15          ▸     creates a director to oversee the office;
16          ▸     establishes the office's duties;
17          ▸     creates a reporting requirement; and
18          ▸     establishes a repeal date for some of the office's duties.
19     Money Appropriated in this Bill:
20          This bill appropriates in fiscal year 2024:
21          ▸     to the Department of Health and Human Services - Operations - Office of Student
22     Health Affairs, as an ongoing appropriation:
23               •     from the General Fund, $436,500.
24     Other Special Clauses:
25          This bill provides a special effective date.

33     Be it enacted by the Legislature of the state of Utah:
34          Section 1. Section 26B-4-412 is enacted to read:
35          26B-4-412. Office of Student Health Affairs -- Creation -- Duties.
36          (1) As used in this section:
37          (a) "Director" means the director of the office appointed under Subsection (3).
38          (b) "Office" means the Office of Student Health Affairs created in this section.
39          (2) There is created within the department the Office of Student Health Affairs.
40          (3) (a) The executive director of the department shall appoint a director of the office
41     who:
42          (i) has a bachelor's degree in a health related field from an accredited university or
43     college;
44          (ii) is experienced in administration; and
45          (iii) is knowledgeable about education and health practices.
46          (b) The director is the administrative head of the office and shall serve under the
47     supervision of the executive director.
48          (c) The executive director may hire staff as necessary to carry out the duties of the
49     office described in Subsection (4).
50          (4) The office shall:
51          (a) oversee health services provided by the department for Utah's public education
52     system;
53          (b) coordinate with the State Board of Education and local health departments to
54     improve student access to parent approved health services including:
55          (i) physical wellness services;
56          (ii) mental health services; and
57          (iii) programs for the management of chronic health conditions;
58          (c) develop policies described in Subsection 53G-9-402(1)(a);

59          (d) assist schools in obtaining reimbursement for parent approved health care service
60     provided by the school to students who are enrolled in the Medicaid program; and
61          (e) establish a cooperative plan between the State Board of Education and local health
62     departments to minimize redundancy of service delivery and maximize coordination and access
63     to school health services.
64          (5) On or before November 1 of each year, the director shall provide a report to the
65     Health and Human Services Interim Committee and the Education Interim Committee
66     regarding:
67          (a) activities and accomplishments of the office; and
68          (b) recommendations for improving the delivery of student health services.
69          Section 2. Section 63I-1-226 is amended to read:
70          63I-1-226. Repeal dates: Titles 26 through 26B.
71          (1) Section 26-1-7.5, which creates the Utah Health Advisory Council, is repealed July
72     1, 2025.
73          (2) Section 26-1-40 is repealed July 1, 2022.
74          (3) Section 26-1-41 is repealed July 1, 2026.
75          (4) Section 26-1-43 is repealed December 31, 2025.
76          (5) Section 26-7-10 is repealed July 1, 2025.
77          (6) Subsection 26-7-11(5), regarding reports to the Legislature, is repealed July 1,
78     2028.
79          (7) Section 26-7-14 is repealed December 31, 2027.
80          (8) Section 26-8a-603 is repealed July 1, 2027.
81          (9) Title 26, Chapter 9f, Utah Digital Health Service Commission Act, is repealed July
82     1, 2025.
83          (10) Subsection 26-10-6(5), which creates the Newborn Hearing Screening Committee,
84     is repealed July 1, 2026.
85          (11) Section 26-10b-106, which creates the Primary Care Grant Committee, is repealed
86     July 1, 2025.
87          (12) Subsection 26-15c-104(3), relating to a limitation on the number of
88     microenterprise home kitchen permits that may be issued, is repealed July 1, 2022.
89          (13) Subsection 26-18-2.6(9), which addresses reimbursement for dental hygienists, is

90     repealed July 1, 2028.
91          (14) Section 26-18-27 is repealed July 1, 2025.
92          (15) Section 26-18-28 is repealed June 30, 2027.
93          (16) Title 26, Chapter 18, Part 2, Drug Utilization Review Board, is repealed July 1,
94     2027.
95          (17) Subsection 26-18-418(2), the language that states "and the Behavioral Health
96     Crisis Response Commission created in Section 63C-18-202" is repealed July 1, 2023.
97          (18) Section 26-33a-117 is repealed December 31, 2023.
98          (19) Title 26, Chapter 33a, Utah Health Data Authority Act, is repealed July 1, 2024.
99          (20) Title 26, Chapter 36b, Inpatient Hospital Assessment Act, is repealed July 1,
100     2024.
101          (21) Title 26, Chapter 36c, Medicaid Expansion Hospital Assessment Act, is repealed
102     July 1, 2024.
103          (22) Title 26, Chapter 36d, Hospital Provider Assessment Act, is repealed July 1, 2024.
104          (23) Section 26-39-201, which creates the Residential Child Care Licensing Advisory
105     Committee, is repealed July 1, 2024.
106          (24) Section 26-39-405, Drinking water quality in child care centers, is repealed July 1,
107     2027.
108          (25) Section 26-40-104, which creates the Utah Children's Health Insurance Program
109     Advisory Council, is repealed July 1, 2025.
110          (26) Section 26-50-202, which creates the Traumatic Brain Injury Advisory
111     Committee, is repealed July 1, 2025.
112          (27) Title 26, Chapter 54, Spinal Cord and Brain Injury Rehabilitation Fund and
113     Pediatric Neuro-Rehabilitation Fund, is repealed January 1, 2025.
114          (28) Title 26, Chapter 66, Early Childhood Utah Advisory Council, is repealed July 1,
115     2026.
116          (29) Title 26, Chapter 68, COVID-19 Vaccine Restrictions Act, is repealed July 1,
117     2024.
118          (30) Section 26-69-406 is repealed July 1, 2025.
119          (31) Subsection 26B-1-204(2)(i), related to the Residential Child Care Licensing
120     Advisory Committee, is repealed July 1, 2024.

121          (32) Subsection 26B-1-204(2)(k), related to the Primary Care Grant Committee, is
122     repealed July 1, 2025.
123          (33) Subsections 26B-4-412(d) and (e), related to the Office of Student Health Affairs'
124     duties regarding Medicaid reimbursement and establishing a cooperative plan, are repealed July
125     1, 2028.
126          Section 3. Appropriation.
127          The following sums of money are appropriated for the fiscal year beginning July 1,
128     2023, and ending June 30, 2024. These are additions to amounts previously appropriated for
129     fiscal year 2024. Under the terms and conditions of Title 63J, Chapter 1, Budgetary Procedures
130     Act, the Legislature appropriates the following sums of money from the funds or accounts
131     indicated for the use and support of the government of the state of Utah.
