9 LONG TITLE
10 General Description:
11 This resolution extends the state of emergency declared by the Governor to address
12 flood risks throughout the state.
13 Highlighted Provisions:
14 This resolution:
15 ▸ recognizes the Governor's executive order issued on April 18, 2023, declaring a
16 state of emergency due to risks of flooding;
17 ▸ acknowledges the ongoing risk of flooding due to record breaking snow fall;
18 ▸ recognizes that the risks of flooding and other dangerous conditions and effects will
19 likely persist for several months;
20 ▸ extends the state of emergency until August 15, 2023; and
21 ▸ requires that the Governor provide a report every 30 days on the status of the
22 emergency.

26 Be it resolved by the Legislature of the state of Utah:
27 WHEREAS, on April 18, 2023, pursuant to Utah Code Section 53-2a-206, Governor
28 Spencer J. Cox issued an executive order declaring a state of emergency due to flood risks
29 throughout the state;
30 WHEREAS, Utah Code Section 53-2a-206 provides that a state of emergency may not
31 continue for longer than 30 days unless extended by joint resolution of the Legislature;
32 WHEREAS, high snowpack levels remain, and runoff will likely result in flooding in
33 various parts of the state;
34 WHEREAS, avalanches, mudslides, rockslides, and other dangerous conditions are
35 likely to occur and persist for several months;
36 WHEREAS, flood damage mitigation and infrastructure rehabilitation efforts will be
37 necessary for several months;
38 WHEREAS, on May 5, 2023, the Governor requested that the Legislature extend the
39 state of emergency; and
40 WHEREAS, the Legislature finds that it is necessary to extend the state of emergency
41 until August 15, 2023, to ensure that appropriate response and recovery action is taken to
42 ensure the safety, health, and welfare of the citizens of the state of Utah:
43 NOW, THEREFORE, BE IT RESOLVED by the Legislature of the state of Utah that
44 the state of emergency declared by Governor Spencer J. Cox on April 18, 2023, due to flood
45 risks and related conditions, is extended to August 15, 2023.
46 BE IT FURTHER RESOLVED that the Legislature requires that the Governor provide
47 a report to the Speaker of the House of Representatives and the President of the Senate every
48 30 days for the duration of the state of emergency regarding the status of the emergency
49 conditions, any actions taken by the Governor to address the emergency conditions, and the
50 expenditure of funds to respond to the emergency conditions.
