8 General Description:
9 This bill creates a labeling and disclosure requirement for genetically modified meat
10 products.
11 Highlighted Provisions:
12 This bill:
13 ▸ defines terms;
14 ▸ requires a genetically modified meat product be conspicuously labeled;
15 ▸ requires a producer of a genetically modified meat product to disclose certain
16 information to an individual who requests the information;
17 ▸ authorizes the Department of Agriculture and Food to impose a civil fine for a
18 violation of the labeling and information provisions; and
19 ▸ requires the Department of Agriculture and Food to enforce the provisions.

31 Be it enacted by the Legislature of the state of Utah:
32 Section 1. Section 4-5-601 is enacted to read:

34 4-5-601. Definitions.
35 As used in this part:
36 (1) "Genetically modified meat product" means a meat product that:
37 (a) comes from an animal:
38 (i) with a genetic modification; or
39 (ii) vaccinated with an mRNA vaccine; or
40 (b) is produced by cultivating or culturing animal cells in vitro.
41 (2) "Genetic material" means a gene, deoxyribonucleic acid, or chromosome.
42 (3) "Genetic modification" means the modification of genetic material:
43 (a) through modern biotechnology, directed evolution, or other mechanism; and
44 (b) in a way that does not occur naturally or that does not occur at a natural rate.
45 Section 2. Section 4-5-602 is enacted to read:
46 4-5-602. Product labeling requirements.
47 A genetically modified meat product sold in the state shall be conspicuously labeled:
48 (1) with the words "genetically modified meat product"; and
49 (2) in a place on the packaging that is reasonably certain to notify a consumer that the
50 product is a genetically modified meat product.
51 Section 3. Section 4-5-603 is enacted to read:
52 4-5-603. Consumer information request.
53 (1) Upon written request, a producer of a genetically modified meat product shall
54 provide information relating to:
55 (a) any known harm or side-effect of a genetically modified meat product on an
56 individual; and
57 (b) the production or creation of the genetically modified meat product.
58 (2) A producer of a genetically modified meat product shall provide the information
59 described in Subsection (1) no later than 21 days after the day on which the producer receives
60 the written request.
61 Section 4. Section 4-5-604 is enacted to read:
62 4-5-604. Enforcement -- Penalty.
63 (1) The department shall adopt rules in accordance with this part and Title 63G,
64 Chapter 3, Utah Administrative Rulemaking Act, as necessary to:
65 (a) enforce the labeling requirements described in Section 4-5-602;
66 (b) establish the procedure for a consumer to request information from a meat producer
67 under Section 4-5-603; and
68 (c) establish the procedure for imposing and collecting a fine on a meat producer in
69 violation of this part.
70 (2) (a) The department may impose an administrative fine against a meat producer in
71 violation of this part:
72 (i) upon first violation, a fine of no more than $100;
73 (ii) upon second violation, a fine of no more than $250; and
74 (iii) upon third or subsequent violation, a fine of no more than $500.
75 (b) The department shall deposit a fine imposed under this Subsection (2) into the
76 General Fund as a dedicated credit to be used by the department for enforcement of this part.
77 Section 5. Effective date.
78 This bill takes effect on May 1, 2024.
