8 General Description:
9 This bill modifies the Utah Consumer Privacy Act.
10 Highlighted Provisions:
11 This bill:
12 ▸ defines terms;
13 ▸ obligates a social media company and a controller to provide a readily-apparent
14 process for deletion of a post; and
15 ▸ allows a controller to verify age of the requesting party.

24 Be it enacted by the Legislature of the state of Utah:
25 Section 1. Section 13-61-201.5 is enacted to read:
26 13-61-201.5. Definitions -- Minor rights -- Deletion of social media.
27 (1) As used in this section:
28 (a) "Controller" means the same as that term is defined in Section 13-61-101.
29 (b) "Minor" means an individual who is under 18 years old.
30 (c) "Post" means the same as that term is defined in Section 13-63-101.
31 (d) "Social media company" means the same as that term is defined in Section
32 13-63-101.
33 (e) "Social media platform" means the same as that term is defined in Section
34 13-63-101.
35 (f) "Youth" means an individual who is under 16 years old.
36 (2) A social media company shall provide a readily-apparent process for a minor, the
37 parent of a minor, or the legal guardian of a minor to delete posts.
38 (3) A controller shall comply with a request from a minor, a minor's parent, or a
39 minor's legal guardian to delete posts:
40 (a) created by the minor while a youth;
41 (b) uploaded to a social media platform by a minor while a youth; or
42 (c) uploaded by the minor while a youth, to a website, including a website outside the
43 definition of a social media platform.
44 (4) The controller may verify the age of the minor when the request to delete the
45 youth's posts is submitted.
46 Section 2. Effective date.
47 This bill takes effect on May 1, 2024.
