8     LONG TITLE
9     General Description:
10          This joint rules resolution directs creation of the Criminal Code Evaluation
11     Subcommittee.
12     Highlighted Provisions:
13          This resolution:
14          ▸     directs the chairs of the Law Enforcement and Criminal Justice Interim Committee
15     to seek approval to establish the Criminal Code Evaluation Subcommittee
16     (subcommittee);
17          ▸     establishes the purpose of the subcommittee;
18          ▸     recognizes individuals who may advise the subcommittee;
19          ▸     requires the subcommittee to report to the Law Enforcement and Criminal Justice
20     Interim Committee; and
21          ▸     terminates the subcommittee on July 1, 2028.

28     Be it resolved by the Legislature of the state of Utah:
29          Section 1. JR7-1-412 is enacted to read:
30          JR7-1-412. Criminal Code Evaluation Subcommittee.
31          (1) In accordance with JR7-1-411, the chairs of the Law Enforcement and Criminal
32     Justice Interim Committee shall seek approval to establish a subcommittee of the Law
33     Enforcement and Criminal Justice Interim Committee, known as the Criminal Code Evaluation
34     Subcommittee.
35          (2) If established, the subcommittee shall review the state's criminal code and related
36     statutes and make recommendations regarding:
37          (a) the proper classification of crimes by degrees of felony and misdemeanor;
38          (b) standardizing the format of criminal statutes; and
39          (c) other modifications related to the criminal code and related statutes as directed by
40     the chairs of the Law Enforcement and Criminal Justice Interim Committee.
41          (3) The appointed chair of the subcommittee shall coordinate the subcommittee's
42     efforts with the following individuals to provide recommendations and advice to the
43     subcommittee:
44          (a) the executive director of the State Commission on Criminal and Juvenile Justice or
45     the executive director's designee;
46          (b) the director of the Utah Sentencing Commission or the director's designee;
47          (c) one member appointed by the presiding officer of the Utah Judicial Council;
48          (d) one member of the Utah Prosecution Council appointed by the chair of the Utah
49     Prosecution Council;
50          (e) the executive director of the Department of Corrections or the executive director's
51     designee;
52          (f) the commissioner of the Department of Public Safety or the commissioner's
53     designee;
54          (g) the director of the Utah Office for Victims of Crime or the director's designee;
55          (h) an individual who represents an association of criminal defense attorneys; and
56          (i) an individual who represents an association of victim advocates.
57          (4) The subcommittee terminates on July 1, 2028.
58          Section 2. Effective date.

59          This resolution takes effect upon a successful vote for final passage.
