7     LONG TITLE
8     General Description:
9          This bill addresses the regulation of public cold baths.
10     Highlighted Provisions:
11          This bill:
12          ▸     defines a public cold bath; and
13          ▸     prohibits the Department of Health and Human Services from regulating public cold
14     baths.

23     Be it enacted by the Legislature of the state of Utah:
24          Section 1. Section 26B-7-122 is enacted to read:
25          26B-7-122. Rules for public cold baths.

26          (1) As used in this section, "public cold bath" means a tub or tank that:
27          (a) is used by:
28          (i) the general public, regardless of whether there is a charge or payment for use; and
29          (ii) one bather at a time; Ŝ→ [

30          (b) contains chilled water that is:
31          (i) maintained at a temperature lower than 60 degrees Fahrenheit;
32          (ii) no more than 180 gallons in volume; and
33          (iii) at a depth that allows the bather to maintain the bather's head above the water

34a          (c) continuously filters and santizes the chilled water. ←Ŝ
35          (2) The department may not adopt a rule that restricts, limits, or imposes requirements
36     on the operation of a public cold bath.
37          Section 2. Effective date.
38          This bill takes effect on May 1, 2024.
