9     General Description:
10          This joint rules resolution addresses Ŝ→ [

24     Be it resolved by the Legislature of the state of Utah:
25          Section 1. JR3-2-702 is amended to read:
26          JR3-2-702. Review and referral of requests for appropriation.
27          (1) As used in this rule, "capital development project" means the same as that term is

28     defined in Utah Code Section 63A-5b-401.
29          (2) (a) The legislative fiscal analyst shall review each request for appropriation.
30          (b) If the request for appropriation requires that a statute be enacted, amended, or
31     repealed, the legislative fiscal analyst shall immediately transfer the request to the Office of
32     Legislative Research and General Counsel as a request for legislation.
33          (c) If the request for appropriation contains each item described in JR3-2-701(4) and
34     does not require that a statute be enacted, amended, or repealed, the legislative fiscal analyst
35     shall number, title, and refer the request for appropriation to:
36          (i) the House chair of the Executive Appropriations Committee, if the sponsor is a
37     House member; or
38          (ii) the Senate chair of the Executive Appropriations Committee, if the sponsor is a
39     Senate member.

42     appropriations subcommittee with oversight responsibility or to the Executive Appropriations

(b) If a request for appropriation is for a capital development project, the House or
45     Senate chair of the Executive Appropriations Committee shall refer the request to the
46     Infrastructure and General Government Appropriations Subcommittee.

47          [(3)] (4) Each joint appropriations subcommittee that receives a request for
48     appropriation shall:
49          (a) allow the sponsor to present and discuss the request for appropriation with the
50     subcommittee;
51          (b) discuss the request for appropriation; and
52          (c) do one of the following:
53          (i) include all or part of the request for appropriation in the budget recommendation
54     made by the subcommittee or the Executive Appropriations Committee;
55          (ii) reject the request for appropriation; or
56          (iii) recommend to the Executive Appropriations Committee that all or part of the
57     requested appropriation be placed on a funding prioritization list.
57a     Ŝ→ (5) The Infrastructure and General Government Appropriations Subcommittee shall, in
57b     accordance with Subsection (4), consider any request for appropriation for a capital
57c     development project. ←Ŝ
58          Section 2. Effective date.
59          This resolution takes effect upon a successful vote for final passage.
