7     LONG TITLE
8     General Description:
9          This bill addresses grant funding for law enforcement canines.
10     Highlighted Provisions:
11          This bill:
12          ▸     defines terms;
13          ▸     creates the Law Enforcement Canine Grant Program (program) to provide grant
14     funding for a law enforcement agency to purchase, train, handle, and insure law
15     enforcement canines;
16          ▸     requires the Department of Public Safety (department) to administer the program;
17          ▸     requires the department to give funding priority to small law enforcement agencies;
18          ▸     provides the department with rulemaking authority to implement the program; and
19          ▸     adds a sunset provision.
20     Money Appropriated in this Bill:
21          This bill appropriates in fiscal year 2025:

38     Be it enacted by the Legislature of the state of Utah:
39          Section 1. Section 53-1-122 is enacted to read:
40          53-1-122. Law Enforcement Canine Grant Program -- Rulemaking.
41          (1) As used in this section:
42          (a) "Grant" means a grant awarded under this section.
43          (b) "Program" means the Law Enforcement Canine Grant Program created in this
44     section.
45          (2) (a) There is created within the department the Law Enforcement Canine Grant
46     Program.
47          (b) The purpose of the program is to provide grant funding for a law enforcement
48     agency to purchase, train, handle, and insure law enforcement canines.
49          (3) A law enforcement agency that submits a proposal for a grant to the department
50     shall include in the proposal:
51          (a) a statement describing the reasons why the law enforcement agency wishes to
52     obtain a grant under the program;
53          (b) a plan for utilizing the law enforcement canines, including whether the law
54     enforcement agency has or will need access to one or more law enforcement canine handlers as
55     described in Chapter 6, Part 4, Law Enforcement Canine Team Certification Act;
56          (c) any funding sources in addition to the grant for the law enforcement canines and the

57     training, handling, and insuring of the law enforcement canines;
58          (d) any existing or planned partnerships for the use of the law enforcement canines
59     with another entity; and
60          (e) the viability and sustainability of the proposal.
61          (4) The department shall prioritize grant funding based on the number of full-time and
62     part-time employees of the law enforcement agency, with the law enforcement agencies with
63     the fewest number of employees having first priority for grants under the program.
64          (5) Subject to Subsections (3) and (4), the department may, in accordance with Title
65     63G, Chapter 3, Utah Administrative Rulemaking Act, make rules to establish:
66          (a) eligibility criteria for a grant, including the types of expenses relating to law
67     enforcement canines that are eligible for a grant;
68          (b) the form and process for submitting a proposal for a grant to the department;
69          (c) the method and formula for determining a grant amount; and
70          (d) reporting requirements for a grant recipient.
71          Section 2. Section 63I-1-253 (Superseded 07/01/24) is amended to read:
72          63I-1-253 (Superseded 07/01/24). Repeal dates: Titles 53 through 53G.
73          (1) Section 53-1-122, which creates the Law Enforcement Canine Grant Program, is
74     repealed July 1, 2027.
75          (2) Section 53-2a-105, which creates the Emergency Management Administration
76     Council, is repealed July 1, 2027.

78     Advisory Board, are repealed July 1, 2027.

240          Section 5. FY 2025 Appropriation.
241          The following sums of money are appropriated for the fiscal year beginning July 1,
242     2024, and ending June 30, 2025. These are additions to amounts previously appropriated for

243     fiscal year 2025.
244          Subsection 5(a). Operating and Capital Budgets.
245          Under the terms and conditions of Title 63J, Chapter 1, Budgetary Procedures Act, the
246     Legislature appropriates the following sums of money from the funds or accounts indicated for
247     the use and support of the government of the state of Utah.

252     The Legislature intends that:
253          (1) the appropriation under this item be used for the grant program described in Section
254     53-1-122 of this bill; and

256     lapse at the close of fiscal year 2025 and the use of any nonlapsing funds is limited to the
257     purpose described in Subsection (1) of this item.
258          Section 6. Effective date.
259          (1) Except as provided in Subsection (2), this bill takes effect on May 1, 2024.
260          (2) (a) The actions affecting Section 63I-1-253 (Eff 07/01/24) (Cont Sup 01/01/25)
261     take effect on July 1, 2024.
262          (b) The actions affecting Section 63I-1-253 (Contingently Effective 01/01/25)
263     contingently take effect on January 1, 2025.
