      <section number="58-60-103.1" numlevel="1" lineno="40" slineno="1-2" type="amend">
        <secline lineno="39">Section 1, Section  
          <bold>58-60-103.1</bold> is amended to read:
        </secline>
        <catline lineno="40">
          <bold>58-60-103.1. Criminal background check.</bold>
        </catline>
        <subsection ssid="1-1" numlevel="1" lineno="41" slineno="1-3" dnum="1-o" placement="noreturn">
          <display>(1)</display>An applicant for licensure under this chapter who requires a criminal background check  
          <ln numlevel="1" lineno="42" slineno="1-4"/>shall:
          <subsection ssid="1-2" numlevel="1" lineno="43" slineno="1-5" dnum="a-o">
            <display>(a)</display>submit fingerprint cards in a form acceptable to the division at the time the license  
            <ln numlevel="1" lineno="44" slineno="1-6"/>application is filed; and
          </subsection>
          <subsection ssid="1-3" numlevel="1" lineno="45" slineno="1-7" dnum="b-o">
            <display>(b)</display>consent to a fingerprint background check conducted by the Bureau of Criminal  
            <ln numlevel="1" lineno="46" slineno="1-8"/>Identification and the Federal Bureau of Investigation regarding the application.
          </subsection>
        </subsection>
        <subsection ssid="1-4" numlevel="1" lineno="47" slineno="1-9" dnum="2-o">
          <display>(2)</display>The division shall:
          <subsection ssid="1-5" numlevel="1" lineno="48" slineno="1-10" dnum="a-o">
            <display>(a)</display>in addition to other fees authorized by this chapter, collect from each applicant  
            <ln numlevel="1" lineno="49" slineno="1-11"/>submitting fingerprints in accordance with this section the fee that the Bureau of  
            <ln numlevel="1" lineno="50" slineno="1-12"/>Criminal Identification is authorized to collect for the services provided under  
            <ln numlevel="1" lineno="51" slineno="1-13"/>Section  
            <xref depth="3" refnumber="53-10-108">53-10-108</xref> and the fee charged by the Federal Bureau of Investigation for  
            <ln numlevel="1" lineno="52" slineno="1-14"/>fingerprint processing for the purpose of obtaining federal criminal history record  
            <ln numlevel="1" lineno="53" slineno="1-15"/>information;
          </subsection>
          <subsection ssid="1-6" numlevel="1" lineno="54" slineno="1-16" dnum="b-o">
            <display>(b)</display>submit from each applicant the fingerprint card and the fees described in Subsection  
            <ln numlevel="1" lineno="55" slineno="1-17"/>(2)(a) to the Bureau of Criminal Identification; and
          </subsection>
          <subsection ssid="1-7" numlevel="1" lineno="56" slineno="1-18" dnum="c-o">
            <display>(c)</display>obtain and retain in division records a signed waiver approved by the Bureau of  
            <ln numlevel="1" lineno="57" slineno="1-19"/>Criminal Identification in accordance with Section  
            <xref depth="3" refnumber="53-10-108">53-10-108</xref> for each applicant.
          </subsection>
        </subsection>
        <subsection ssid="1-8" numlevel="1" lineno="58" slineno="1-20" dnum="3-o">
          <display>(3)</display>The Bureau of Criminal Identification shall, in accordance with the requirements of  
          <ln numlevel="1" lineno="59" slineno="1-21"/>Section  
          <xref depth="3" refnumber="53-10-108">53-10-108</xref>:
          <subsection ssid="1-9" numlevel="1" lineno="60" slineno="1-22" dnum="a-o">
            <display>(a)</display>check the fingerprints submitted under Subsection (2)(b) against the applicable state  
            <ln numlevel="1" lineno="61" slineno="1-23"/>and regional criminal records databases;
          </subsection>
          <subsection ssid="1-10" numlevel="1" lineno="62" slineno="1-24" dnum="b-o">
            <display>(b)</display>forward the fingerprints to the Federal Bureau of Investigation for a national criminal  
            <ln numlevel="1" lineno="63" slineno="1-25"/>history background check; and
          </subsection>
          <subsection ssid="1-11" numlevel="1" lineno="64" slineno="1-26" dnum="c-o">
            <display>(c)</display>provide the results from the state, regional, and nationwide criminal history  
            <ln numlevel="1" lineno="65" slineno="1-27"/>background checks to the division.
          </subsection>
        </subsection>
        <subsection ssid="1-12" numlevel="1" lineno="66" slineno="1-28" dnum="4-o">
          <display>(4)</display>For purposes of conducting a criminal background check required under this section, the  
          <ln numlevel="1" lineno="67" slineno="1-29"/>division shall have direct access to criminal background information maintained under  
          <ln numlevel="1" lineno="68" slineno="1-30"/>Title 53, Chapter 10, Part 2, Bureau of Criminal Identification.
        </subsection>
        <subsection ssid="1-13" numlevel="1" lineno="69" slineno="1-31" dnum="5-o">
          <display>(5)</display>The division may not:
          <subsection ssid="1-14" numlevel="1" lineno="70" slineno="1-32" dnum="a-o">
            <display>(a)</display>disseminate outside of the division any criminal history record information that the  
            <ln numlevel="1" lineno="71" slineno="1-33"/>division obtains from the Bureau of Criminal Identification or the Federal Bureau of  
            <ln numlevel="1" lineno="72" slineno="1-34"/>Investigation under the criminal background check requirements of this section; or
          </subsection>
          <subsection ssid="1-15" numlevel="1" lineno="73" slineno="1-35" dnum="b-o">
            <display>(b)</display>issue a letter of qualification to participate in the Counseling Compact under Chapter  
            <ln numlevel="1" lineno="74" slineno="1-36"/>60a, Counseling Compact, until the criminal background check described in this  
            <ln numlevel="1" lineno="75" slineno="1-37"/>section is completed
            <amendoutstart style="5"/>
            <amend anum="0" ea="erase" pairid="1" style="2" owner="ahouston" level="1" deltag="both">.</amend>
            <amendoutend style="5"/>

          </subsection>
          <subsection ssid="1-16" ea="amend" anum="0" owner="ahouston" style="1" numlevel="1" lineno="76" slineno="1-38" dnum="_-e:c-e">
            <display>
              <amend anum="0" ea="amend" pairid="19" style="1" owner="e" level="1" amendtag="start">(c)</amend>
            </display>
            <amend anum="0" ea="amend" pairid="4" style="1" owner="ahouston" level="1" amendtag="end">issue a letter of qualification to participate in the Social Work Licensure Compact  
              <ln numlevel="1" lineno="77" slineno="1-39"/>under Chapter 60b, Social Work Licensure Compact, until the criminal background  
              <ln numlevel="1" lineno="78" slineno="1-40"/>check described in this section is completed.
            </amend>
          </subsection>
        </subsection>

      <section number="58-60-205" numlevel="1" lineno="80" slineno="2-2" type="amend">
        <secline lineno="79">Section 2, Section  
          <bold>58-60-205</bold> is amended to read:
        </secline>
        <catline lineno="80">
          <bold>58-60-205. Qualifications for licensure or certification as a clinical social worker,  
            <ln numlevel="1" lineno="81" slineno="2-3"/>certified social worker, and social service worker.
          </bold>
        </catline>
        <subsection ssid="2-1" numlevel="1" lineno="82" slineno="2-4" dnum="1-o" placement="noreturn">
          <display>(1)</display>An applicant for licensure as a clinical social worker shall:
          <subsection ssid="2-2" numlevel="1" lineno="83" slineno="2-5" dnum="a-o">
            <display>(a)</display>submit an application on a form provided by the division;
          </subsection>
          <subsection ssid="2-3" numlevel="1" lineno="84" slineno="2-6" dnum="b-o">
            <display>(b)</display>pay a fee determined by the department under Section  
            <xref depth="3" refnumber="63J-1-504">63J-1-504</xref>;
          </subsection>
          <subsection ssid="2-4" numlevel="1" lineno="85" slineno="2-7" dnum="c-o">
            <display>(c)</display>produce certified transcripts from an accredited institution of higher education  
            <ln numlevel="1" lineno="86" slineno="2-8"/>recognized by the division in collaboration with the board verifying satisfactory  
            <ln numlevel="1" lineno="87" slineno="2-9"/>completion of an education and an earned degree as follows:
            <subsection ssid="2-5" numlevel="1" lineno="88" slineno="2-10" dnum="i-o">
              <display>(i)</display>a master's degree in a social work program accredited by the Council on Social  
              <ln numlevel="1" lineno="89" slineno="2-11"/>Work Education or by the Canadian Association of Schools of Social Work; or
            </subsection>
            <subsection ssid="2-6" numlevel="1" lineno="90" slineno="2-12" dnum="ii-o">
              <display>(ii)</display>a doctoral degree that contains a clinical social work concentration and practicum  
              <ln numlevel="1" lineno="91" slineno="2-13"/>approved by the division, by rule, in accordance with Title 63G, Chapter 3, Utah  
              <ln numlevel="1" lineno="92" slineno="2-14"/>Administrative Rulemaking Act, that is consistent with Section  
              <xref depth="3" refnumber="58-1-203">58-1-203</xref>;
            </subsection>
          </subsection>
          <subsection ssid="2-7" numlevel="1" lineno="93" slineno="2-15" dnum="d-o">
            <display>(d)</display>have completed a minimum of 3,000 hours of clinical social work training as defined  
            <ln numlevel="1" lineno="94" slineno="2-16"/>by division rule under Section  
            <xref depth="3" refnumber="58-1-203">58-1-203</xref>:
            <subsection ssid="2-8" numlevel="1" lineno="95" slineno="2-17" dnum="i-o">
              <display>(i)</display>under the supervision of a supervisor approved by the division in collaboration  
              <ln numlevel="1" lineno="96" slineno="2-18"/>with the board who is a:
              <subsection ssid="2-9" numlevel="1" lineno="97" slineno="2-19" dnum="A-o">
                <display>(A)</display>clinical mental health counselor;
              </subsection>
              <subsection ssid="2-10" numlevel="1" lineno="98" slineno="2-20" dnum="B-o">
                <display>(B)</display>psychiatrist;
              </subsection>
              <subsection ssid="2-11" numlevel="1" lineno="99" slineno="2-21" dnum="C-o">
                <display>(C)</display>psychologist;
              </subsection>
              <subsection ssid="2-12" numlevel="1" lineno="100" slineno="2-22" dnum="D-o">
                <display>(D)</display>registered psychiatric mental health nurse practitioner;
              </subsection>
              <subsection ssid="2-13" numlevel="1" lineno="101" slineno="2-23" dnum="E-o">
                <display>(E)</display>marriage and family therapist; or
              </subsection>
              <subsection ssid="2-14" numlevel="1" lineno="102" slineno="2-24" dnum="F-o">
                <display>(F)</display>clinical social worker; and
              </subsection>
            </subsection>
            <subsection ssid="2-15" numlevel="1" lineno="103" slineno="2-25" dnum="ii-o">
              <display>(ii)</display>including a minimum of two hours of training in suicide prevention via a course  
              <ln numlevel="1" lineno="104" slineno="2-26"/>that the division designates as approved;
            </subsection>
          </subsection>
          <subsection ssid="2-16" numlevel="1" lineno="105" slineno="2-27" dnum="e-o">
            <display>(e)</display>document successful completion of not less than 1,000 hours of supervised training  
            <ln numlevel="1" lineno="106" slineno="2-28"/>in mental health therapy obtained after completion of the education requirement in  
            <ln numlevel="1" lineno="107" slineno="2-29"/>Subsection (1)(c), which training may be included as part of the 3,000 hours of  
            <ln numlevel="1" lineno="108" slineno="2-30"/>training in Subsection (1)(d), and of which documented evidence demonstrates not  
            <ln numlevel="1" lineno="109" slineno="2-31"/>less than 75 of the hours were obtained under the direct supervision, as defined by  
            <ln numlevel="1" lineno="110" slineno="2-32"/>rule, of a supervisor described in Subsection (1)(d)(i);
          </subsection>
          <subsection ssid="2-17" numlevel="1" lineno="111" slineno="2-33" dnum="f-o">
            <display>(f)</display>have completed a case work, group work, or family treatment course sequence with a  
            <ln numlevel="1" lineno="112" slineno="2-34"/>clinical practicum in content as defined by rule under Section  
            <xref depth="3" refnumber="58-1-203">58-1-203</xref>;
          </subsection>
          <subsection ssid="2-18" numlevel="1" lineno="113" slineno="2-35" dnum="g-o">

            <amend anum="0" ea="amend" pairid="2" style="1" owner="ahouston" level="1" amendtag="both" space="true">Social Work Licensure Compact under Chapter 60b, 
              <ln numlevel="1" lineno="116" slineno="2-38"/>Social Work Licensure Compact,
            </amend> consent to a criminal background check in  
            <ln numlevel="1" lineno="117" slineno="2-39"/>accordance with Section  
            <xref depth="3" refnumber="58-60-103.1">58-60-103.1</xref> and any requirements established by division  
            <ln numlevel="1" lineno="118" slineno="2-40"/>rule made in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking  
            <ln numlevel="1" lineno="119" slineno="2-41"/>Act.
          </subsection>
        </subsection>
        <subsection ssid="2-20" numlevel="1" lineno="120" slineno="2-42" dnum="2-o">
          <display>(2)</display>An applicant for licensure as a certified social worker shall:
          <subsection ssid="2-21" numlevel="1" lineno="121" slineno="2-43" dnum="a-o">
            <display>(a)</display>submit an application on a form provided by the division;
          </subsection>
          <subsection ssid="2-22" numlevel="1" lineno="122" slineno="2-44" dnum="b-o">
            <display>(b)</display>pay a fee determined by the department under Section  
            <xref depth="3" refnumber="63J-1-504">63J-1-504</xref>; and
          </subsection>
          <subsection ssid="2-23" numlevel="1" lineno="123" slineno="2-45" dnum="c-o">
            <display>(c)</display>produce certified transcripts from an accredited institution of higher education  
            <ln numlevel="1" lineno="124" slineno="2-46"/>recognized by the division in collaboration with the board verifying satisfactory  
            <ln numlevel="1" lineno="125" slineno="2-47"/>completion of an education and an earned degree as follows:
            <subsection ssid="2-24" numlevel="1" lineno="126" slineno="2-48" dnum="i-o">
              <display>(i)</display>a master's degree in a social work program accredited by the Council on Social  
              <ln numlevel="1" lineno="127" slineno="2-49"/>Work Education or by the Canadian Association of Schools of Social Work; or
            </subsection>
            <subsection ssid="2-25" numlevel="1" lineno="128" slineno="2-50" dnum="ii-o">
              <display>(ii)</display>a doctoral degree that contains a clinical social work concentration and practicum  
              <ln numlevel="1" lineno="129" slineno="2-51"/>approved by the division, by rule, in accordance with Title 63G, Chapter 3, Utah  
              <ln numlevel="1" lineno="130" slineno="2-52"/>Administrative Rulemaking Act, that is consistent with Section  
              <xref depth="3" refnumber="58-1-203">58-1-203</xref>.
            </subsection>
          </subsection>
        </subsection>
        <subsection ssid="2-26" numlevel="1" lineno="131" slineno="2-53" dnum="3-o">
          <display>(3)</display>An applicant for licensure as a social service worker shall:
          <subsection ssid="2-27" numlevel="1" lineno="132" slineno="2-54" dnum="a-o">
            <display>(a)</display>submit an application on a form provided by the division;
          </subsection>
          <subsection ssid="2-28" numlevel="1" lineno="133" slineno="2-55" dnum="b-o">
            <display>(b)</display>pay a fee determined by the department under Section  
            <xref depth="3" refnumber="63J-1-504">63J-1-504</xref>; and
          </subsection>
          <subsection ssid="2-29" numlevel="1" lineno="134" slineno="2-56" dnum="c-o">
            <display>(c)</display>produce certified transcripts from an accredited institution of higher education  
            <ln numlevel="1" lineno="135" slineno="2-57"/>recognized by the division in collaboration with the board verifying satisfactory  
            <ln numlevel="1" lineno="136" slineno="2-58"/>completion of an education and an earned degree as follows:
            <subsection ssid="2-30" numlevel="1" lineno="137" slineno="2-59" dnum="i-o">
              <display>(i)</display>a bachelor's degree in a social work program accredited by the Council on Social  
              <ln numlevel="1" lineno="138" slineno="2-60"/>Work Education or by the Canadian Association of Schools of Social Work;
            </subsection>
            <subsection ssid="2-31" numlevel="1" lineno="139" slineno="2-61" dnum="ii-o">
              <display>(ii)</display>a master's degree in a field approved by the division in collaboration with the  
              <ln numlevel="1" lineno="140" slineno="2-62"/>board;
            </subsection>
            <subsection ssid="2-32" numlevel="1" lineno="141" slineno="2-63" dnum="iii-o">
              <display>(iii)</display>a bachelor's degree in any field if the applicant:
              <subsection ssid="2-33" numlevel="1" lineno="142" slineno="2-64" dnum="A-o">
                <display>(A)</display>has completed at least three semester hours, or the equivalent, in each of the  
                <ln numlevel="1" lineno="143" slineno="2-65"/>following areas:
                <subsection ssid="2-34" numlevel="1" lineno="144" slineno="2-66" dnum="I-o">
                  <display>(I)</display>social welfare policy;
                </subsection>
                <subsection ssid="2-35" numlevel="1" lineno="145" slineno="2-67" dnum="II-o">
                  <display>(II)</display>human growth and development; and
                </subsection>
                <subsection ssid="2-36" numlevel="1" lineno="146" slineno="2-68" dnum="III-o">
                  <display>(III)</display>social work practice methods, as defined by rule; and
                </subsection>
              </subsection>
              <subsection ssid="2-37" numlevel="1" lineno="147" slineno="2-69" dnum="B-o">
                <display>(B)</display>provides documentation that the applicant has completed at least 2,000 hours  
                <ln numlevel="1" lineno="148" slineno="2-70"/>of qualifying experience under the supervision of a mental health therapist,  
                <ln numlevel="1" lineno="149" slineno="2-71"/>which experience is approved by the division in collaboration with the board,  
                <ln numlevel="1" lineno="150" slineno="2-72"/>and which is performed after completion of the requirements to obtain the  
                <ln numlevel="1" lineno="151" slineno="2-73"/>bachelor's degree required under this Subsection

            </subsection>
            <subsection ssid="2-38" numlevel="1" lineno="152" slineno="2-74" dnum="iv-o">
              <display>(iv)</display>successful completion of the first academic year of a Council on Social Work  
              <ln numlevel="1" lineno="153" slineno="2-75"/>Education approved master's of social work curriculum and practicum.
            </subsection>
          </subsection>
        </subsection>
        <subsection ssid="2-39" numlevel="1" lineno="154" slineno="2-76" dnum="4-o">
          <display>(4)</display>The division shall ensure that the rules for an examination described under Subsection  
          <ln numlevel="1" lineno="155" slineno="2-77"/>(1)(g) allow additional time to complete the examination if requested by an applicant  
          <ln numlevel="1" lineno="156" slineno="2-78"/>who is:
          <subsection ssid="2-40" numlevel="1" lineno="157" slineno="2-79" dnum="a-o">
            <display>(a)</display>a foreign born legal resident of the United States for whom English is a second  
            <ln numlevel="1" lineno="158" slineno="2-80"/>language; or
          </subsection>
          <subsection ssid="2-41" numlevel="1" lineno="159" slineno="2-81" dnum="b-o">
            <display>(b)</display>an enrolled member of a federally recognized Native American tribe.
          </subsection>

            <ln numlevel="1" lineno="166" slineno="3-7"/>Compact preserves the regulatory authority of States to protect public health and  
            <ln numlevel="1" lineno="167" slineno="3-8"/>safety through the current system of State licensure.
          </amend>

          <amend anum="0" ea="amend" pairid="2" style="1" owner="ahouston" level="1">This Compact is designed to achieve the following objectives:</amend>

          <bold>58-60b-102. Section 2 -- Definitions.</bold>
        </catline>

          <amend anum="0" ea="amend" pairid="1" style="1" owner="ahouston" level="1" amendtag="start">As used in this Compact, and except as otherwise provided, the following definitions  
            <ln numlevel="1" lineno="189" slineno="4-4"/>shall apply:
          </amend>
          <eol numlevel="1" lineno="190" slineno="4-5"/>
          <para/>
          <amend anum="0" ea="amend" pairid="2" style="1" owner="ahouston" level="1">A. "Active Military Member" means any individual with full-time duty status in  
            <ln numlevel="1" lineno="191" slineno="4-6"/>the active armed forces of the United States including members of the National  
            <ln numlevel="1" lineno="192" slineno="4-7"/>Guard and Reserve.
          </amend>
          <eol numlevel="1" lineno="193" slineno="4-8"/>
          <para/>
          <amend anum="0" ea="amend" pairid="3" style="1" owner="ahouston" level="1">B. "Adverse Action" means any administrative, civil, equitable or criminal action  
            <ln numlevel="1" lineno="194" slineno="4-9"/>permitted by a State's laws which is imposed by a Licensing Authority or other  
            <ln numlevel="1" lineno="195" slineno="4-10"/>authority against a Regulated Social Worker, including actions against an individual's  
            <ln numlevel="1" lineno="196" slineno="4-11"/>license or Multistate Authorization to Practice such as revocation, suspension,  
            <ln numlevel="1" lineno="197" slineno="4-12"/>probation, monitoring of the Licensee, limitation on the Licensee's practice, or any  
            <ln numlevel="1" lineno="198" slineno="4-13"/>other Encumbrance on licensure affecting a Regulated Social Worker's authorization  
            <ln numlevel="1" lineno="199" slineno="4-14"/>to practice, including issuance of a cease and desist action.
          </amend>
          <eol numlevel="1" lineno="200" slineno="4-15"/>
          <para/>
          <amend anum="0" ea="amend" pairid="4" style="1" owner="ahouston" level="1">C. "Alternative Program" means a non-disciplinary monitoring or practice  
            <ln numlevel="1" lineno="201" slineno="4-16"/>remediation process approved by a Licensing Authority to address practitioners with  
            <ln numlevel="1" lineno="202" slineno="4-17"/>an Impairment.
          </amend>
          <eol numlevel="1" lineno="203" slineno="4-18"/>
          <para/>
          <amend anum="0" ea="amend" pairid="5" style="1" owner="ahouston" level="1">D. "Charter Member States" means Member States who have enacted legislation  
            <ln numlevel="1" lineno="204" slineno="4-19"/>to adopt this Compact where such legislation predates the effective date of this  
            <ln numlevel="1" lineno="205" slineno="4-20"/>Compact as described in Section 14.
          </amend>
          <eol numlevel="1" lineno="206" slineno="4-21"/>
          <para/>
          <amend anum="0" ea="amend" pairid="6" style="1" owner="ahouston" level="1">E. "Compact Commission" or "Commission" means the government agency  
            <ln numlevel="1" lineno="207" slineno="4-22"/>whose membership consists of all States that have enacted this Compact, which is  
            <ln numlevel="1" lineno="208" slineno="4-23"/>known as the Social Work Licensure Compact Commission, as described in Section  
            <ln numlevel="1" lineno="209" slineno="4-24"/>10, and which shall operate as an instrumentality of the Member States.
          </amend>
          <eol numlevel="1" lineno="210" slineno="4-25"/>
          <para/>
          <amend anum="0" ea="amend" pairid="7" style="1" owner="ahouston" level="1">F. "Current Significant Investigative Information" means:</amend>
          <eol numlevel="1" lineno="211" slineno="4-26"/>
          <para/>
          <amend anum="0" ea="amend" pairid="8" style="1" owner="ahouston" level="1">1. Investigative information that a Licensing Authority, after a preliminary inquiry  
            <ln numlevel="1" lineno="212" slineno="4-27"/>that includes notification and an opportunity for the Regulated Social Worker to  
            <ln numlevel="1" lineno="213" slineno="4-28"/>respond has reason to believe is not groundless and, if proved true, would indicate  
            <ln numlevel="1" lineno="214" slineno="4-29"/>more than a minor infraction as may be defined by the Commission; or
          </amend>
          <eol numlevel="1" lineno="215" slineno="4-30"/>
          <para/>
          <amend anum="0" ea="amend" pairid="9" style="1" owner="ahouston" level="1">2. Investigative information that indicates that the Regulated Social Worker  
            <ln numlevel="1" lineno="216" slineno="4-31"/>represents an immediate threat to public health and safety, as may be defined by the  
            <ln numlevel="1" lineno="217" slineno="4-32"/>Commission, regardless of whether the Regulated Social Worker has been notified  
            <ln numlevel="1" lineno="218" slineno="4-33"/>and has had an opportunity to respond.
          </amend>
          <eol numlevel="1" lineno="219" slineno="4-34"/>
          <para/>
          <amend anum="0" ea="amend" pairid="10" style="1" owner="ahouston" level="1">G. "Data System" means a repository of information about Licensees, including,  
            <ln numlevel="1" lineno="220" slineno="4-35"/>continuing education, examination, licensure, Current Significant Investigative  
            <ln numlevel="1" lineno="221" slineno="4-36"/>Information, Disqualifying Event, Multistate License(s) and Adverse Action  
            <ln numlevel="1" lineno="222" slineno="4-37"/>information or other information as required by the Commission.
          </amend>
          <eol numlevel="1" lineno="223" slineno="4-38"/>
          <para/>
          <amend anum="0" ea="amend" pairid="11" style="1" owner="ahouston" level="1">H. "Domicile" means the jurisdiction in which the Licensee resides and intends to  
            <ln numlevel="1" lineno="224" slineno="4-39"/>remain indefinitely.
          </amend>
          <eol numlevel="1" lineno="225" slineno="4-40"/>
          <para/>
          <amend anum="0" ea="amend" pairid="12" style="1" owner="ahouston" level="1">I. "Disqualifying Event" means any Adverse Action or incident which results in an  
            <ln numlevel="1" lineno="226" slineno="4-41"/>Encumbrance that disqualifies or makes the Licensee ineligible to either obtain,  
            <ln numlevel="1" lineno="227" slineno="4-42"/>retain or renew a Multistate License.
          </amend>
          <eol numlevel="1" lineno="228" slineno="4-43"/>
          <para/>
          <amend anum="0" ea="amend" pairid="13" style="1" owner="ahouston" level="1">J. "Encumbrance" means a revocation or suspension of, or any limitation on, the  
            <ln numlevel="1" lineno="229" slineno="4-44"/>full and unrestricted practice of Social Work licensed and regulated by a Licensing  
            <ln numlevel="1" lineno="230" slineno="4-45"/>Authority.
          </amend>
          <eol numlevel="1" lineno="231" slineno="4-46"/>
          <para/>
          <amend anum="0" ea="amend" pairid="14" style="1" owner="ahouston" level="1">K. "Executive Committee" means a group of delegates elected or appointed to act  
            <ln numlevel="1" lineno="232" slineno="4-47"/>on behalf of, and within the powers granted to them by, the compact and Commission.
          </amend>
          <eol numlevel="1" lineno="233" slineno="4-48"/>
          <para/>
          <amend anum="0" ea="amend" pairid="15" style="1" owner="ahouston" level="1">L. "Home State" means the Member State that is the Licensee's primary Domicile.</amend>
          <eol numlevel="1" lineno="234" slineno="4-49"/>
          <para/>
          <amend anum="0" ea="amend" pairid="16" style="1" owner="ahouston" level="1">M. "Impairment" means a condition(s) that may impair a practitioner's ability to  
            <ln numlevel="1" lineno="235" slineno="4-50"/>engage in full and unrestricted practice as a Regulated Social Worker without some  
            <ln numlevel="1" lineno="236" slineno="4-51"/>type of intervention and may include alcohol and drug dependence, mental health  
            <ln numlevel="1" lineno="237" slineno="4-52"/>impairment, and neurological or physical impairments.
          </amend>
          <eol numlevel="1" lineno="238" slineno="4-53"/>
          <para/>
          <amend anum="0" ea="amend" pairid="17" style="1" owner="ahouston" level="1">N. "Licensee(s)" means an individual who currently holds a license from a State to  
            <ln numlevel="1" lineno="239" slineno="4-54"/>practice as a Regulated Social Worker.
          </amend>
          <eol numlevel="1" lineno="240" slineno="4-55"/>
          <para/>
          <amend anum="0" ea="amend" pairid="18" style="1" owner="ahouston" level="1">O. "Licensing Authority" means the board or agency of a Member State, or  
            <ln numlevel="1" lineno="241" slineno="4-56"/>equivalent, that is responsible for the licensing and regulation of Regulated Social  
            <ln numlevel="1" lineno="242" slineno="4-57"/>Workers.
          </amend>
          <eol numlevel="1" lineno="243" slineno="4-58"/>
          <para/>
          <amend anum="0" ea="amend" pairid="19" style="1" owner="ahouston" level="1">P.  Member State" means a state, commonwealth, district, or territory of the  
            <ln numlevel="1" lineno="244" slineno="4-59"/>United States of America that has enacted this Compact.
          </amend>
          <eol numlevel="1" lineno="245" slineno="4-60"/>
          <para/>
          <amend anum="0" ea="amend" pairid="20" style="1" owner="ahouston" level="1">Q. "Multistate Authorization to Practice" means a legally authorized privilege to  
            <ln numlevel="1" lineno="246" slineno="4-61"/>practice, which is equivalent to a license, associated with a Multistate License  
            <ln numlevel="1" lineno="247" slineno="4-62"/>permitting the practice of Social Work in a Remote State.
          </amend>
          <eol numlevel="1" lineno="248" slineno="4-63"/>
          <para/>
          <amend anum="0" ea="amend" pairid="21" style="1" owner="ahouston" level="1">R. "Multistate License" means a license to practice as a Regulated Social Worker  
            <ln numlevel="1" lineno="249" slineno="4-64"/>issued by a Home State Licensing Authority that authorizes the Regulated Social  
            <ln numlevel="1" lineno="250" slineno="4-65"/>Worker to practice in all Member States under Multistate Authorization to Practice.
          </amend>
          <eol numlevel="1" lineno="251" slineno="4-66"/>
          <para/>
          <amend anum="0" ea="amend" pairid="22" style="1" owner="ahouston" level="1">S. "Qualifying National Exam" means a national licensing examination approved  
            <ln numlevel="1" lineno="252" slineno="4-67"/>by the Commission.
          </amend>
          <eol numlevel="1" lineno="253" slineno="4-68"/>
          <para/>
          <amend anum="0" ea="amend" pairid="23" style="1" owner="ahouston" level="1">T. "Regulated Social Worker" means any clinical, master's or bachelor's Social  
            <ln numlevel="1" lineno="254" slineno="4-69"/>Worker licensed by a Member State regardless of the title used by that Member State.
          </amend>
          <eol numlevel="1" lineno="255" slineno="4-70"/>
          <para/>
          <amend anum="0" ea="amend" pairid="24" style="1" owner="ahouston" level="1">U. "Remote State" means a Member State other than the Licensee's Home State.</amend>
          <eol numlevel="1" lineno="256" slineno="4-71"/>
          <para/>
          <amend anum="0" ea="amend" pairid="25" style="1" owner="ahouston" level="1">V. "Rule(s)" or "Rule(s) of the Commission" means a regulation or regulations  
            <ln numlevel="1" lineno="257" slineno="4-72"/>duly promulgated by the Commission, as authorized by the Compact, that has the

            <ln numlevel="1" lineno="261" slineno="4-76"/>Authorization to Practice in any Member State.
          </amend>

          <para/>
          <amend anum="0" ea="amend" pairid="27" style="1" owner="ahouston" level="1">X. "Social Work" or "Social Work Services" means the application of social work  
            <ln numlevel="1" lineno="263" slineno="4-78"/>theory, knowledge, methods, ethics, and the professional use of self to restore or  
            <ln numlevel="1" lineno="264" slineno="4-79"/>enhance social, psychosocial, or biopsychosocial functioning of individuals, couples,  
            <ln numlevel="1" lineno="265" slineno="4-80"/>families, groups, organizations, and communities through the care and services  
            <ln numlevel="1" lineno="266" slineno="4-81"/>provided by a Regulated Social Worker as set forth in the Member State's statutes  
            <ln numlevel="1" lineno="267" slineno="4-82"/>and regulations in the State where the services are being provided.
          </amend>
          <eol numlevel="1" lineno="268" slineno="4-83"/>
          <para/>
          <amend anum="0" ea="amend" pairid="28" style="1" owner="ahouston" level="1">Y. "State" means any state, commonwealth, district, or territory of the United  
            <ln numlevel="1" lineno="269" slineno="4-84"/>States of America that regulates the practice of Social Work.
          </amend>
          <eol numlevel="1" lineno="270" slineno="4-85"/>
          <para/>
          <amend anum="0" ea="amend" pairid="29" style="1" owner="ahouston" level="1" amendtag="end">Z. "Unencumbered License" means a license that authorizes a Regulated Social  
            <ln numlevel="1" lineno="271" slineno="4-86"/>Worker to engage in the full and unrestricted practice of Social Work.

          <bold>58-60b-103. Section 3 -- State participation in the Compact.</bold>

          <amend anum="0" ea="amend" pairid="1" style="1" owner="ahouston" level="1" amendtag="start">A. To be eligible to participate in the compact, a potential Member State must  
            <ln numlevel="1" lineno="275" slineno="5-4"/>currently meet all of the following criteria:
          </amend>
          <eol numlevel="1" lineno="276" slineno="5-5"/>
          <para/>
          <amend anum="0" ea="amend" pairid="2" style="1" owner="ahouston" level="1">1. License and regulate the practice of Social Work at either the clinical, master's,  
            <ln numlevel="1" lineno="277" slineno="5-6"/>or bachelor's category.
          </amend>
          <eol numlevel="1" lineno="278" slineno="5-7"/>
          <para/>
          <amend anum="0" ea="amend" pairid="3" style="1" owner="ahouston" level="1">2. Require applicants for licensure to graduate from a program that is:</amend>
          <eol numlevel="1" lineno="279" slineno="5-8"/>
          <para/>
          <amend anum="0" ea="amend" pairid="4" style="1" owner="ahouston" level="1">a. Operated by a college or university recognized by the Licensing Authority;</amend>
          <eol numlevel="1" lineno="280" slineno="5-9"/>
          <para/>
          <amend anum="0" ea="amend" pairid="5" style="1" owner="ahouston" level="1">b. Accredited, or in candidacy by an institution that subsequently becomes  
            <ln numlevel="1" lineno="281" slineno="5-10"/>accredited, by an accrediting agency recognized by either:
          </amend>
          <eol numlevel="1" lineno="282" slineno="5-11"/>
          <para/>
          <amend anum="0" ea="amend" pairid="6" style="1" owner="ahouston" level="1">i. the Council for Higher Education Accreditation, or its successor; or</amend>
          <eol numlevel="1" lineno="283" slineno="5-12"/>
          <para/>
          <amend anum="0" ea="amend" pairid="7" style="1" owner="ahouston" level="1">ii. the United States Department of Education; and</amend>
          <eol numlevel="1" lineno="284" slineno="5-13"/>
          <para/>
          <amend anum="0" ea="amend" pairid="8" style="1" owner="ahouston" level="1">c. Corresponds to the licensure as outlined in Section 4.</amend>
          <eol numlevel="1" lineno="285" slineno="5-14"/>
          <para/>
          <amend anum="0" ea="amend" pairid="9" style="1" owner="ahouston" level="1">3. Require applicants for clinical licensure to complete a period of supervised  
            <ln numlevel="1" lineno="286" slineno="5-15"/>practice.
          </amend>
          <eol numlevel="1" lineno="287" slineno="5-16"/>
          <para/>
          <amend anum="0" ea="amend" pairid="10" style="1" owner="ahouston" level="1">4. Have a mechanism in place for receiving, investigating, and adjudicating  
            <ln numlevel="1" lineno="288" slineno="5-17"/>complaints about Licensees.
          </amend>
          <eol numlevel="1" lineno="289" slineno="5-18"/>
          <para/>
          <amend anum="0" ea="amend" pairid="11" style="1" owner="ahouston" level="1">B. To maintain membership in the Compact a Member State shall:</amend>
          <eol numlevel="1" lineno="290" slineno="5-19"/>
          <para/>
          <amend anum="0" ea="amend" pairid="12" style="1" owner="ahouston" level="1">1. Require that applicants for a Multistate License pass a Qualifying National  
            <ln numlevel="1" lineno="291" slineno="5-20"/>Exam for the corresponding category of Multistate License sought as outlined in  
            <ln numlevel="1" lineno="292" slineno="5-21"/>Section 4;
          </amend>
          <eol numlevel="1" lineno="293" slineno="5-22"/>
          <para/>
          <amend anum="0" ea="amend" pairid="13" style="1" owner="ahouston" level="1">2. Participate fully in the Commission's Data System, including using the  
            <ln numlevel="1" lineno="294" slineno="5-23"/>Commission's unique identifier as defined in Rules;
          </amend>
          <eol numlevel="1" lineno="295" slineno="5-24"/>
          <para/>
          <amend anum="0" ea="amend" pairid="14" style="1" owner="ahouston" level="1">3. Notify the Commission, in compliance with the terms of the Compact and  
            <ln numlevel="1" lineno="296" slineno="5-25"/>Rules, of any Adverse Action or the availability of Current Significant Investigative  
            <ln numlevel="1" lineno="297" slineno="5-26"/>Information regarding a Licensee;
          </amend>
          <eol numlevel="1" lineno="298" slineno="5-27"/>
          <para/>
          <amend anum="0" ea="amend" pairid="15" style="1" owner="ahouston" level="1">4. Implement procedures for considering the criminal history records of applicants  
            <ln numlevel="1" lineno="299" slineno="5-28"/>for a Multistate License. Such procedures shall include the submission of fingerprints  
            <ln numlevel="1" lineno="300" slineno="5-29"/>or other biometric-based information by applicants for the purpose of obtaining an  
            <ln numlevel="1" lineno="301" slineno="5-30"/>applicant's criminal history record information from the Federal Bureau of  
            <ln numlevel="1" lineno="302" slineno="5-31"/>Investigation and the agency responsible for retaining that State's criminal records;
          </amend>
          <eol numlevel="1" lineno="303" slineno="5-32"/>
          <para/>
          <amend anum="0" ea="amend" pairid="16" style="1" owner="ahouston" level="1">5. Comply with the Rules of the Commission;</amend>
          <eol numlevel="1" lineno="304" slineno="5-33"/>
          <para/>
          <amend anum="0" ea="amend" pairid="17" style="1" owner="ahouston" level="1">6. Require an applicant to obtain or retain a license in the Home State and meet  
            <ln numlevel="1" lineno="305" slineno="5-34"/>the Home State's qualifications for licensure or renewal of licensure, as well as all  
            <ln numlevel="1" lineno="306" slineno="5-35"/>other applicable Home State laws;
          </amend>
          <eol numlevel="1" lineno="307" slineno="5-36"/>
          <para/>
          <amend anum="0" ea="amend" pairid="18" style="1" owner="ahouston" level="1">7. Authorize a Licensee holding a Multistate License in any Member State to  
            <ln numlevel="1" lineno="308" slineno="5-37"/>practice in accordance with the terms of the Compact and Rules of the Commission;  
            <ln numlevel="1" lineno="309" slineno="5-38"/>and
          </amend>
          <eol numlevel="1" lineno="310" slineno="5-39"/>
          <para/>
          <amend anum="0" ea="amend" pairid="19" style="1" owner="ahouston" level="1">8. Designate a delegate to participate in the Commission meetings.</amend>
          <eol numlevel="1" lineno="311" slineno="5-40"/>
          <para/>
          <amend anum="0" ea="amend" pairid="20" style="1" owner="ahouston" level="1">C. A Member State meeting the requirements of Section 3.A and 3.B of this  
            <ln numlevel="1" lineno="312" slineno="5-41"/>Compact shall designate the categories of Social Work licensure that are eligible for  
            <ln numlevel="1" lineno="313" slineno="5-42"/>issuance of a Multistate License for applicants in such Member State. To the extent  
            <ln numlevel="1" lineno="314" slineno="5-43"/>that any Member State does not meet the requirements for participation in the  
            <ln numlevel="1" lineno="315" slineno="5-44"/>Compact at any particular category of Social Work licensure, such Member State  
            <ln numlevel="1" lineno="316" slineno="5-45"/>may choose, but is not obligated to, issue a Multistate License to applicants that  
            <ln numlevel="1" lineno="317" slineno="5-46"/>otherwise meet the requirements of Section 4 for issuance of a Multistate License in  
            <ln numlevel="1" lineno="318" slineno="5-47"/>such category or categories of licensure.
          </amend>
          <eol numlevel="1" lineno="319" slineno="5-48"/>
          <para/>
          <amend anum="0" ea="amend" pairid="21" style="1" owner="ahouston" level="1" amendtag="end">D. The Home State may charge a fee for granting the Multistate License.</amend>

          <bold>58-60b-104. Section 4 -- Social Worker participation in the Compact.</bold>

          <amend anum="0" ea="amend" pairid="1" style="1" owner="ahouston" level="1" amendtag="start">A. To be eligible for a Multistate License under the terms and provisions of the  
            <ln numlevel="1" lineno="323" slineno="6-4"/>Compact, an applicant, regardless of category must:
          </amend>
          <eol numlevel="1" lineno="324" slineno="6-5"/>
          <para/>
          <amend anum="0" ea="amend" pairid="2" style="1" owner="ahouston" level="1">1. Hold or be eligible for an active, Unencumbered License in the Home State;</amend>
          <eol numlevel="1" lineno="325" slineno="6-6"/>
          <para/>
          <amend anum="0" ea="amend" pairid="3" style="1" owner="ahouston" level="1">2. Pay any applicable fees, including any State fee, for the Multistate License;</amend>
          <eol numlevel="1" lineno="326" slineno="6-7"/>
          <para/>
          <amend anum="0" ea="amend" pairid="4" style="1" owner="ahouston" level="1">3. Submit, in connection with an application for a Multistate License, fingerprints  
            <ln numlevel="1" lineno="327" slineno="6-8"/>or other biometric data for the purpose of obtaining criminal history record  
            <ln numlevel="1" lineno="328" slineno="6-9"/>information from the Federal Bureau of Investigation and the agency responsible for

          </amend>
          <eol numlevel="1" lineno="330" slineno="6-11"/>

          <amend anum="0" ea="amend" pairid="5" style="1" owner="ahouston" level="1">4. Notify the Home State of any Adverse Action, Encumbrance, or restriction on  
            <ln numlevel="1" lineno="331" slineno="6-12"/>any professional license taken by any Member State or non-Member State within 30  
            <ln numlevel="1" lineno="332" slineno="6-13"/>days from the date the action is taken;
          </amend>
          <eol numlevel="1" lineno="333" slineno="6-14"/>
          <para/>
          <amend anum="0" ea="amend" pairid="6" style="1" owner="ahouston" level="1">5. Meet any continuing competence requirements established by the Home State;  
            <ln numlevel="1" lineno="334" slineno="6-15"/>and
          </amend>
          <eol numlevel="1" lineno="335" slineno="6-16"/>
          <para/>
          <amend anum="0" ea="amend" pairid="7" style="1" owner="ahouston" level="1">6. Abide by the laws, regulations, and applicable standards in the Member State  
            <ln numlevel="1" lineno="336" slineno="6-17"/>where the client is located at the time care is rendered.
          </amend>
          <eol numlevel="1" lineno="337" slineno="6-18"/>
          <para/>
          <amend anum="0" ea="amend" pairid="8" style="1" owner="ahouston" level="1">B. An applicant for a clinical-category Multistate License must meet all of the  
            <ln numlevel="1" lineno="338" slineno="6-19"/>following requirements:
          </amend>
          <eol numlevel="1" lineno="339" slineno="6-20"/>
          <para/>
          <amend anum="0" ea="amend" pairid="9" style="1" owner="ahouston" level="1">1. Fulfill a competency requirement, which shall be satisfied by either:</amend>
          <eol numlevel="1" lineno="340" slineno="6-21"/>
          <para/>
          <amend anum="0" ea="amend" pairid="10" style="1" owner="ahouston" level="1">a. Passage of a clinical-category Qualifying National Exam; or</amend>
          <eol numlevel="1" lineno="341" slineno="6-22"/>
          <para/>
          <amend anum="0" ea="amend" pairid="11" style="1" owner="ahouston" level="1">b. Licensure of the applicant in their Home State at the clinical category,  
            <ln numlevel="1" lineno="342" slineno="6-23"/>beginning prior to such time as a Qualifying National Exam was required by the  
            <ln numlevel="1" lineno="343" slineno="6-24"/>Home State and accompanied by a period of continuous Social Work licensure  
            <ln numlevel="1" lineno="344" slineno="6-25"/>thereafter, all of which may be further governed by the Rules of the Commission; or
          </amend>
          <eol numlevel="1" lineno="345" slineno="6-26"/>
          <para/>
          <amend anum="0" ea="amend" pairid="12" style="1" owner="ahouston" level="1">c. The substantial equivalency of the foregoing competency requirements which  
            <ln numlevel="1" lineno="346" slineno="6-27"/>the Commission may determine by Rule.
          </amend>
          <eol numlevel="1" lineno="347" slineno="6-28"/>
          <para/>
          <amend anum="0" ea="amend" pairid="13" style="1" owner="ahouston" level="1">2. Attain at least a master's degree in Social Work from a program that is:</amend>
          <eol numlevel="1" lineno="348" slineno="6-29"/>
          <para/>
          <amend anum="0" ea="amend" pairid="14" style="1" owner="ahouston" level="1">a. Operated by a college or university recognized by the Licensing Authority; and</amend>
          <eol numlevel="1" lineno="349" slineno="6-30"/>
          <para/>
          <amend anum="0" ea="amend" pairid="15" style="1" owner="ahouston" level="1">b. Accredited, or in candidacy that subsequently becomes accredited, by an  
            <ln numlevel="1" lineno="350" slineno="6-31"/>accrediting agency recognized by either:
          </amend>
          <eol numlevel="1" lineno="351" slineno="6-32"/>
          <para/>
          <amend anum="0" ea="amend" pairid="16" style="1" owner="ahouston" level="1">i. the Council for Higher Education Accreditation or its successor; or</amend>
          <eol numlevel="1" lineno="352" slineno="6-33"/>
          <para/>
          <amend anum="0" ea="amend" pairid="17" style="1" owner="ahouston" level="1">ii. the United States Department of Education.</amend>
          <eol numlevel="1" lineno="353" slineno="6-34"/>
          <para/>
          <amend anum="0" ea="amend" pairid="18" style="1" owner="ahouston" level="1">3. Fulfill a practice requirement, which shall be satisfied by demonstrating  
            <ln numlevel="1" lineno="354" slineno="6-35"/>completion of either:
          </amend>
          <eol numlevel="1" lineno="355" slineno="6-36"/>
          <para/>
          <amend anum="0" ea="amend" pairid="19" style="1" owner="ahouston" level="1">a. A period of postgraduate supervised clinical practice equal to a minimum of  
            <ln numlevel="1" lineno="356" slineno="6-37"/>three thousand hours; or
          </amend>
          <eol numlevel="1" lineno="357" slineno="6-38"/>
          <para/>
          <amend anum="0" ea="amend" pairid="20" style="1" owner="ahouston" level="1">b. A minimum of two years of full-time postgraduate supervised clinical practice;  
            <ln numlevel="1" lineno="358" slineno="6-39"/>or
          </amend>
          <eol numlevel="1" lineno="359" slineno="6-40"/>
          <para/>
          <amend anum="0" ea="amend" pairid="21" style="1" owner="ahouston" level="1">c. The substantial equivalency of the foregoing practice requirements which the  
            <ln numlevel="1" lineno="360" slineno="6-41"/>Commission may determine by Rule.
          </amend>
          <eol numlevel="1" lineno="361" slineno="6-42"/>
          <para/>
          <amend anum="0" ea="amend" pairid="22" style="1" owner="ahouston" level="1">C. An applicant for a master's-category Multistate License must meet all of the  
            <ln numlevel="1" lineno="362" slineno="6-43"/>following requirements:
          </amend>
          <eol numlevel="1" lineno="363" slineno="6-44"/>
          <para/>
          <amend anum="0" ea="amend" pairid="23" style="1" owner="ahouston" level="1">1. Fulfill a competency requirement, which shall be satisfied by either:</amend>
          <eol numlevel="1" lineno="364" slineno="6-45"/>
          <para/>
          <amend anum="0" ea="amend" pairid="24" style="1" owner="ahouston" level="1">a. Passage of a master's-category Qualifying National Exam;</amend>
          <eol numlevel="1" lineno="365" slineno="6-46"/>
          <para/>
          <amend anum="0" ea="amend" pairid="25" style="1" owner="ahouston" level="1">b. Licensure of the applicant in their Home State at the master's category,  
            <ln numlevel="1" lineno="366" slineno="6-47"/>beginning prior to such time as a Qualifying National Exam was required by the  
            <ln numlevel="1" lineno="367" slineno="6-48"/>Home State at the master's category and accompanied by a continuous period of  
            <ln numlevel="1" lineno="368" slineno="6-49"/>Social Work licensure thereafter, all of which may be further governed by the Rules  
            <ln numlevel="1" lineno="369" slineno="6-50"/>of the Commission; or
          </amend>
          <eol numlevel="1" lineno="370" slineno="6-51"/>
          <para/>
          <amend anum="0" ea="amend" pairid="26" style="1" owner="ahouston" level="1">c. The substantial equivalency of the foregoing competency requirements which  
            <ln numlevel="1" lineno="371" slineno="6-52"/>the Commission may determine by Rule.
          </amend>
          <eol numlevel="1" lineno="372" slineno="6-53"/>
          <para/>
          <amend anum="0" ea="amend" pairid="27" style="1" owner="ahouston" level="1">2. Attain at least a master's degree in Social Work from a program that is:</amend>
          <eol numlevel="1" lineno="373" slineno="6-54"/>
          <para/>
          <amend anum="0" ea="amend" pairid="28" style="1" owner="ahouston" level="1">a. Operated by a college or university recognized by the Licensing Authority; and</amend>
          <eol numlevel="1" lineno="374" slineno="6-55"/>
          <para/>
          <amend anum="0" ea="amend" pairid="29" style="1" owner="ahouston" level="1">b. Accredited, or in candidacy that subsequently becomes accredited, by an  
            <ln numlevel="1" lineno="375" slineno="6-56"/>accrediting agency recognized by either:
          </amend>
          <eol numlevel="1" lineno="376" slineno="6-57"/>
          <para/>
          <amend anum="0" ea="amend" pairid="30" style="1" owner="ahouston" level="1">i. the Council for Higher Education Accreditation or its successor; or</amend>

          <amend anum="0" ea="amend" pairid="33" style="1" owner="ahouston" level="1">1. Fulfill a competency requirement, which shall be satisfied by either:</amend>
          <eol numlevel="1" lineno="381" slineno="6-62"/>
          <para/>
          <amend anum="0" ea="amend" pairid="34" style="1" owner="ahouston" level="1">a. Passage of a bachelor's-category Qualifying National Exam;</amend>
          <eol numlevel="1" lineno="382" slineno="6-63"/>
          <para/>
          <amend anum="0" ea="amend" pairid="35" style="1" owner="ahouston" level="1">b. Licensure of the applicant in their Home State at the bachelor's category,  
            <ln numlevel="1" lineno="383" slineno="6-64"/>beginning prior to such time as a Qualifying National Exam was required by the  
            <ln numlevel="1" lineno="384" slineno="6-65"/>Home State and accompanied by a period of continuous Social Work licensure  
            <ln numlevel="1" lineno="385" slineno="6-66"/>thereafter, all of which may be further governed by the Rules of the Commission; or
          </amend>
          <eol numlevel="1" lineno="386" slineno="6-67"/>
          <para/>
          <amend anum="0" ea="amend" pairid="36" style="1" owner="ahouston" level="1">c. The substantial equivalency of the foregoing competency requirements which  
            <ln numlevel="1" lineno="387" slineno="6-68"/>the Commission may determine by Rule.
          </amend>
          <eol numlevel="1" lineno="388" slineno="6-69"/>
          <para/>
          <amend anum="0" ea="amend" pairid="37" style="1" owner="ahouston" level="1">2. Attain at least a bachelor's degree in Social Work from a program that is:</amend>
          <eol numlevel="1" lineno="389" slineno="6-70"/>
          <para/>
          <amend anum="0" ea="amend" pairid="38" style="1" owner="ahouston" level="1">a. Operated by a college or university recognized by the Licensing Authority; and</amend>
          <eol numlevel="1" lineno="390" slineno="6-71"/>
          <para/>
          <amend anum="0" ea="amend" pairid="39" style="1" owner="ahouston" level="1">b. Accredited, or in candidacy that subsequently becomes accredited, by an  
            <ln numlevel="1" lineno="391" slineno="6-72"/>accrediting agency recognized by either:
          </amend>
          <eol numlevel="1" lineno="392" slineno="6-73"/>
          <para/>
          <amend anum="0" ea="amend" pairid="40" style="1" owner="ahouston" level="1">i. the Council for Higher Education Accreditation or its successor; or</amend>
          <eol numlevel="1" lineno="393" slineno="6-74"/>
          <para/>
          <amend anum="0" ea="amend" pairid="41" style="1" owner="ahouston" level="1">ii. the United States Department of Education.</amend>
          <eol numlevel="1" lineno="394" slineno="6-75"/>

          <amend anum="0" ea="amend" pairid="42" style="1" owner="ahouston" level="1">E. The Multistate License for a Regulated Social Worker is subject to the renewal  
            <ln numlevel="1" lineno="395" slineno="6-76"/>requirements of the Home State. The Regulated Social Worker must maintain  
            <ln numlevel="1" lineno="396" slineno="6-77"/>compliance with the requirements of Section 4(A) to be eligible to renew a Multistate  
            <ln numlevel="1" lineno="397" slineno="6-78"/>License.
          </amend>
          <eol numlevel="1" lineno="398" slineno="6-79"/>
          <para/>
          <amend anum="0" ea="amend" pairid="43" style="1" owner="ahouston" level="1">F. The Regulated Social Worker's services in a Remote State are subject to that  
            <ln numlevel="1" lineno="399" slineno="6-80"/>Member State's regulatory authority. A Remote State may, in accordance with due  
            <ln numlevel="1" lineno="400" slineno="6-81"/>process and that Member State's laws, remove a Regulated Social Worker's  
            <ln numlevel="1" lineno="401" slineno="6-82"/>Multistate Authorization to Practice in the Remote State for a specific period of time,  
            <ln numlevel="1" lineno="402" slineno="6-83"/>impose fines, and take any other necessary actions to protect the health and safety of  
            <ln numlevel="1" lineno="403" slineno="6-84"/>its citizens.
          </amend>

          <amend anum="0" ea="amend" pairid="44" style="1" owner="ahouston" level="1">G. If a Multistate License is encumbered, the Regulated Social Worker's

            <ln numlevel="1" lineno="406" slineno="6-87"/>Multistate License is no longer encumbered.

          <amend anum="0" ea="amend" pairid="2" style="1" owner="ahouston" level="1">B. If a Licensee changes their Home State by moving between two Member States:</amend>
          <eol numlevel="1" lineno="450" slineno="9-7"/>
          <para/>
          <amend anum="0" ea="amend" pairid="3" style="1" owner="ahouston" level="1">1. The Licensee shall immediately apply for the reissuance of their Multistate  
            <ln numlevel="1" lineno="451" slineno="9-8"/>License in their new Home State. The Licensee shall pay all applicable fees and  
            <ln numlevel="1" lineno="452" slineno="9-9"/>notify the prior Home State in accordance with the Rules of the Commission.
          </amend>
          <eol numlevel="1" lineno="453" slineno="9-10"/>
          <para/>
          <amend anum="0" ea="amend" pairid="4" style="1" owner="ahouston" level="1">2. Upon receipt of an application to reissue a Multistate License, the new Home  
            <ln numlevel="1" lineno="454" slineno="9-11"/>State shall verify that the Multistate License is active, unencumbered and eligible for  
            <ln numlevel="1" lineno="455" slineno="9-12"/>reissuance under the terms of the Compact and the Rules of the Commission. The  
            <ln numlevel="1" lineno="456" slineno="9-13"/>Multistate License issued by the prior Home State will be deactivated and all  
            <ln numlevel="1" lineno="457" slineno="9-14"/>Member States notified in accordance with the applicable Rules adopted by the  
            <ln numlevel="1" lineno="458" slineno="9-15"/>Commission.
          </amend>
          <eol numlevel="1" lineno="459" slineno="9-16"/>
          <para/>
          <amend anum="0" ea="amend" pairid="5" style="1" owner="ahouston" level="1">3. Prior to the reissuance of the Multistate License, the new Home State shall  
            <ln numlevel="1" lineno="460" slineno="9-17"/>conduct procedures for considering the criminal history records of the Licensee. Such  
            <ln numlevel="1" lineno="461" slineno="9-18"/>procedures shall include the submission of fingerprints or other biometric-based  
            <ln numlevel="1" lineno="462" slineno="9-19"/>information by applicants for the purpose of obtaining an applicant's criminal history  
            <ln numlevel="1" lineno="463" slineno="9-20"/>record information from the Federal Bureau of Investigation and the agency  
            <ln numlevel="1" lineno="464" slineno="9-21"/>responsible for retaining that State's criminal records.
          </amend>
          <eol numlevel="1" lineno="465" slineno="9-22"/>
          <para/>
          <amend anum="0" ea="amend" pairid="6" style="1" owner="ahouston" level="1">4. If required for initial licensure, the new Home State may require completion of  
            <ln numlevel="1" lineno="466" slineno="9-23"/>jurisprudence requirements in the new Home State.
          </amend>
          <eol numlevel="1" lineno="467" slineno="9-24"/>
          <para/>
          <amend anum="0" ea="amend" pairid="7" style="1" owner="ahouston" level="1">5. Notwithstanding any other provision of this Compact, if a Licensee does not  
            <ln numlevel="1" lineno="468" slineno="9-25"/>meet the requirements set forth in this Compact for the reissuance of a Multistate  
            <ln numlevel="1" lineno="469" slineno="9-26"/>License by the new Home State, then the Licensee shall be subject to the new Home  
            <ln numlevel="1" lineno="470" slineno="9-27"/>State requirements for the issuance of a Single State License in that State.
          </amend>
          <eol numlevel="1" lineno="471" slineno="9-28"/>
          <para/>
          <amend anum="0" ea="amend" pairid="8" style="1" owner="ahouston" level="1">C. If a Licensee changes their primary State of residence by moving from a  
            <ln numlevel="1" lineno="472" slineno="9-29"/>Member State to a non-Member State, or from a non-Member State to a Member  
            <ln numlevel="1" lineno="473" slineno="9-30"/>State, then the Licensee shall be subject to the State requirements for the issuance of  
            <ln numlevel="1" lineno="474" slineno="9-31"/>a Single State License in the new Home State.
          </amend>
          <eol numlevel="1" lineno="475" slineno="9-32"/>
          <para/>
          <amend anum="0" ea="amend" pairid="9" style="1" owner="ahouston" level="1">D. Nothing in this Compact shall interfere with a Licensee's ability to hold a  
            <ln numlevel="1" lineno="476" slineno="9-33"/>Single State License in multiple States; however, for the purposes of this Compact, a  
            <ln numlevel="1" lineno="477" slineno="9-34"/>Licensee shall have only one Home State, and only one Multistate License.
          </amend>

          <para/>
          <amend anum="0" ea="amend" pairid="10" style="1" owner="ahouston" level="1" amendtag="end">E. Nothing in this Compact shall interfere with the requirements established by a

          <bold>58-60b-109. Section 9 -- Adverse Actions.</bold>
        </catline>

          <amend anum="0" ea="amend" pairid="1" style="1" owner="ahouston" level="1" amendtag="start">A. In addition to the other powers conferred by State law, a Remote State shall have  
            <ln numlevel="1" lineno="488" slineno="11-4"/>the authority, in accordance with existing State due process law, to:
          </amend>
          <eol numlevel="1" lineno="489" slineno="11-5"/>
          <para/>
          <amend anum="0" ea="amend" pairid="2" style="1" owner="ahouston" level="1">1. Take Adverse Action against a Regulated Social Worker's Multistate  
            <ln numlevel="1" lineno="490" slineno="11-6"/>Authorization to Practice only within that Member State, and issue subpoenas for  
            <ln numlevel="1" lineno="491" slineno="11-7"/>both hearings and investigations that require the attendance and testimony of  
            <ln numlevel="1" lineno="492" slineno="11-8"/>witnesses as well as the production of evidence. Subpoenas issued by a Licensing  
            <ln numlevel="1" lineno="493" slineno="11-9"/>Authority in a Member State for the attendance and testimony of witnesses or the  
            <ln numlevel="1" lineno="494" slineno="11-10"/>production of evidence from another Member State shall be enforced in the latter  
            <ln numlevel="1" lineno="495" slineno="11-11"/>State by any court of competent jurisdiction, according to the practice and procedure  
            <ln numlevel="1" lineno="496" slineno="11-12"/>of that court applicable to subpoenas issued in proceedings pending before it. The  
            <ln numlevel="1" lineno="497" slineno="11-13"/>issuing Licensing Authority shall pay any witness fees, travel expenses, mileage, and  
            <ln numlevel="1" lineno="498" slineno="11-14"/>other fees required by the service statutes of the State in which the witnesses or  
            <ln numlevel="1" lineno="499" slineno="11-15"/>evidence are located.
          </amend>
          <eol numlevel="1" lineno="500" slineno="11-16"/>
          <para/>
          <amend anum="0" ea="amend" pairid="3" style="1" owner="ahouston" level="1">2. Only the Home State shall have the power to take Adverse Action against a  
            <ln numlevel="1" lineno="501" slineno="11-17"/>Regulated Social Worker's Multistate License.
          </amend>
          <eol numlevel="1" lineno="502" slineno="11-18"/>
          <para/>
          <amend anum="0" ea="amend" pairid="4" style="1" owner="ahouston" level="1">B. For purposes of taking Adverse Action, the Home State shall give the same  
            <ln numlevel="1" lineno="503" slineno="11-19"/>priority and effect to reported conduct received from a Member State as it would if  
            <ln numlevel="1" lineno="504" slineno="11-20"/>the conduct had occurred within the Home State. In so doing, the Home State shall  
            <ln numlevel="1" lineno="505" slineno="11-21"/>apply its own State laws to determine appropriate action.
          </amend>
          <eol numlevel="1" lineno="506" slineno="11-22"/>
          <para/>
          <amend anum="0" ea="amend" pairid="5" style="1" owner="ahouston" level="1">C. The Home State shall complete any pending investigations of a Regulated  
            <ln numlevel="1" lineno="507" slineno="11-23"/>Social Worker who changes their Home State during the course of the investigations.  
            <ln numlevel="1" lineno="508" slineno="11-24"/>The Home State shall also have the authority to take appropriate action(s) and shall  
            <ln numlevel="1" lineno="509" slineno="11-25"/>promptly report the conclusions of the investigations to the administrator of the Data  
            <ln numlevel="1" lineno="510" slineno="11-26"/>System. The administrator of the Data System shall promptly notify the new Home  
            <ln numlevel="1" lineno="511" slineno="11-27"/>State of any Adverse Actions.
          </amend>
          <eol numlevel="1" lineno="512" slineno="11-28"/>
          <para/>
          <amend anum="0" ea="amend" pairid="6" style="1" owner="ahouston" level="1">D. A Member State, if otherwise permitted by State law, may recover from the  
            <ln numlevel="1" lineno="513" slineno="11-29"/>affected Regulated Social Worker the costs of investigations and dispositions of cases  
            <ln numlevel="1" lineno="514" slineno="11-30"/>resulting from any Adverse Action taken against that Regulated Social Worker.
          </amend>
          <eol numlevel="1" lineno="515" slineno="11-31"/>
          <para/>
          <amend anum="0" ea="amend" pairid="7" style="1" owner="ahouston" level="1">E. A Member State may take Adverse Action based on the factual findings of  
            <ln numlevel="1" lineno="516" slineno="11-32"/>another Member State, provided that the Member State follows its own procedures  
            <ln numlevel="1" lineno="517" slineno="11-33"/>for taking the Adverse Action.
          </amend>
          <eol numlevel="1" lineno="518" slineno="11-34"/>
          <para/>
          <amend anum="0" ea="amend" pairid="8" style="1" owner="ahouston" level="1">F. Joint Investigations:</amend>
          <eol numlevel="1" lineno="519" slineno="11-35"/>
          <para/>
          <amend anum="0" ea="amend" pairid="9" style="1" owner="ahouston" level="1">1. In addition to the authority granted to a Member State by its respective Social  
            <ln numlevel="1" lineno="520" slineno="11-36"/>Work practice act or other applicable State law, any Member State may participate  
            <ln numlevel="1" lineno="521" slineno="11-37"/>with other Member States in joint investigations of Licensees.
          </amend>
          <eol numlevel="1" lineno="522" slineno="11-38"/>
          <para/>
          <amend anum="0" ea="amend" pairid="10" style="1" owner="ahouston" level="1">2. Member States shall share any investigative, litigation, or compliance materials  
            <ln numlevel="1" lineno="523" slineno="11-39"/>in furtherance of any joint or individual investigation initiated under the Compact.
          </amend>
          <eol numlevel="1" lineno="524" slineno="11-40"/>
          <para/>
          <amend anum="0" ea="amend" pairid="11" style="1" owner="ahouston" level="1">G. If Adverse Action is taken by the Home State against the Multistate License of  
            <ln numlevel="1" lineno="525" slineno="11-41"/>a Regulated Social Worker, the Regulated Social Worker's Multistate Authorization  
            <ln numlevel="1" lineno="526" slineno="11-42"/>to Practice in all other Member States shall be deactivated until all Encumbrances  
            <ln numlevel="1" lineno="527" slineno="11-43"/>have been removed from the Multistate License. All Home State disciplinary orders  
            <ln numlevel="1" lineno="528" slineno="11-44"/>that impose Adverse Action against the license of a Regulated Social Worker shall  
            <ln numlevel="1" lineno="529" slineno="11-45"/>include a statement that the Regulated Social Worker's Multistate Authorization to  
            <ln numlevel="1" lineno="530" slineno="11-46"/>Practice is deactivated in all Member States until all conditions of the decision, order  
            <ln numlevel="1" lineno="531" slineno="11-47"/>or agreement are satisfied.
          </amend>
          <eol numlevel="1" lineno="532" slineno="11-48"/>
          <para/>
          <amend anum="0" ea="amend" pairid="12" style="1" owner="ahouston" level="1">H. If a Member State takes Adverse Action, it shall promptly notify the  
            <ln numlevel="1" lineno="533" slineno="11-49"/>administrator of the Data System. The administrator of the Data System shall  
            <ln numlevel="1" lineno="534" slineno="11-50"/>promptly notify the Home State and all other Member States of any Adverse Actions  
            <ln numlevel="1" lineno="535" slineno="11-51"/>by Remote States.
          </amend>
          <eol numlevel="1" lineno="536" slineno="11-52"/>
          <para/>
          <amend anum="0" ea="amend" pairid="13" style="1" owner="ahouston" level="1">I. Nothing in this Compact shall override a Member State's decision that  
            <ln numlevel="1" lineno="537" slineno="11-53"/>participation in an Alternative Program may be used in lieu of Adverse Action.
          </amend>
          <eol numlevel="1" lineno="538" slineno="11-54"/>
          <para/>
          <amend anum="0" ea="amend" pairid="14" style="1" owner="ahouston" level="1">J. Nothing in this Compact shall authorize a Member State to demand the issuance  
            <ln numlevel="1" lineno="539" slineno="11-55"/>of subpoenas for attendance and testimony of witnesses or the production of evidence  
            <ln numlevel="1" lineno="540" slineno="11-56"/>from another Member State for lawful actions within that Member State.
          </amend>
          <eol numlevel="1" lineno="541" slineno="11-57"/>
          <para/>
          <amend anum="0" ea="amend" pairid="15" style="1" owner="ahouston" level="1" amendtag="end">K. Nothing in this Compact shall authorize a Member State to impose discipline  
            <ln numlevel="1" lineno="542" slineno="11-58"/>against a Regulated Social Worker who holds a Multistate Authorization to Practice  
            <ln numlevel="1" lineno="543" slineno="11-59"/>for lawful actions within another Member State.
          </amend>

          <bold>58-60b-110. Section 10 -- Establishment of Social Work Licensure Compact  
            <ln numlevel="1" lineno="546" slineno="12-3"/>Commission.
          </bold>

          <amend anum="0" ea="amend" pairid="1" style="1" owner="ahouston" level="1" amendtag="start">A. The Compact Member States hereby create and establish a joint government  
            <ln numlevel="1" lineno="548" slineno="12-5"/>agency whose membership consists of all member states that have enacted the  
            <ln numlevel="1" lineno="549" slineno="12-6"/>compact known as the Social Work Licensure Compact Commission. The  
            <ln numlevel="1" lineno="550" slineno="12-7"/>Commission is an instrumentality of the Compact States acting jointly and not an  
            <ln numlevel="1" lineno="551" slineno="12-8"/>instrumentality of any one state. The Commission shall come into existence on or  
            <ln numlevel="1" lineno="552" slineno="12-9"/>after the effective date of the Compact as set forth in Section 14.
          </amend>
          <eol numlevel="1" lineno="553" slineno="12-10"/>
          <para/>
          <amend anum="0" ea="amend" pairid="2" style="1" owner="ahouston" level="1">B. Membership, Voting, and Meetings</amend>
          <eol numlevel="1" lineno="554" slineno="12-11"/>
          <para/>
          <amend anum="0" ea="amend" pairid="3" style="1" owner="ahouston" level="1">1. Each Member State shall have and be limited to one (1) delegate selected by  
            <ln numlevel="1" lineno="555" slineno="12-12"/>that Member State's Licensing Authority.
          </amend>
          <eol numlevel="1" lineno="556" slineno="12-13"/>
          <para/>
          <amend anum="0" ea="amend" pairid="4" style="1" owner="ahouston" level="1">2. The delegate shall be either:</amend>
          <eol numlevel="1" lineno="557" slineno="12-14"/>
          <para/>
          <amend anum="0" ea="amend" pairid="5" style="1" owner="ahouston" level="1">a. A current member of the State Licensing Authority at the time of appointment,  
            <ln numlevel="1" lineno="558" slineno="12-15"/>who is a Regulated Social Worker or public member of the Licensing Authority; or
          </amend>
          <eol numlevel="1" lineno="559" slineno="12-16"/>
          <para/>
          <amend anum="0" ea="amend" pairid="6" style="1" owner="ahouston" level="1">b. An administrator of the Licensing Authority or their designee.</amend>
          <eol numlevel="1" lineno="560" slineno="12-17"/>
          <para/>
          <amend anum="0" ea="amend" pairid="7" style="1" owner="ahouston" level="1">3. The Commission shall by Rule or bylaw establish a term of office for delegates  
            <ln numlevel="1" lineno="561" slineno="12-18"/>and may by Rule or bylaw establish term limits.
          </amend>
          <eol numlevel="1" lineno="562" slineno="12-19"/>
          <para/>
          <amend anum="0" ea="amend" pairid="8" style="1" owner="ahouston" level="1">4. The Commission may recommend removal or suspension of any delegate from  
            <ln numlevel="1" lineno="563" slineno="12-20"/>office.
          </amend>
          <eol numlevel="1" lineno="564" slineno="12-21"/>
          <para/>
          <amend anum="0" ea="amend" pairid="9" style="1" owner="ahouston" level="1">5. A Member State's Licensing Authority shall fill any vacancy of its delegate  
            <ln numlevel="1" lineno="565" slineno="12-22"/>occurring on the Commission within 60 days of the vacancy.
          </amend>
          <eol numlevel="1" lineno="566" slineno="12-23"/>
          <para/>
          <amend anum="0" ea="amend" pairid="10" style="1" owner="ahouston" level="1">6. Each delegate shall be entitled to one vote on all matters before the  
            <ln numlevel="1" lineno="567" slineno="12-24"/>Commission requiring a vote by Commission delegates.
          </amend>
          <eol numlevel="1" lineno="568" slineno="12-25"/>
          <para/>
          <amend anum="0" ea="amend" pairid="11" style="1" owner="ahouston" level="1">7. A delegate shall vote in person or by such other means as provided in the  
            <ln numlevel="1" lineno="569" slineno="12-26"/>bylaws. The bylaws may provide for delegates to meet by telecommunication, video  
            <ln numlevel="1" lineno="570" slineno="12-27"/>conference or other means of communication.
          </amend>
          <eol numlevel="1" lineno="571" slineno="12-28"/>
          <para/>
          <amend anum="0" ea="amend" pairid="12" style="1" owner="ahouston" level="1">8. The Commission shall meet at least once during each calendar year. Additional  
            <ln numlevel="1" lineno="572" slineno="12-29"/>meetings may be held as set forth in the bylaws. The Commission may meet by  
            <ln numlevel="1" lineno="573" slineno="12-30"/>telecommunication, video conference or other similar electronic means.
          </amend>
          <eol numlevel="1" lineno="574" slineno="12-31"/>
          <para/>
          <amend anum="0" ea="amend" pairid="13" style="1" owner="ahouston" level="1">C. The Commission shall have the following powers:</amend>
          <eol numlevel="1" lineno="575" slineno="12-32"/>
          <para/>
          <amend anum="0" ea="amend" pairid="14" style="1" owner="ahouston" level="1">1. Establish the fiscal year of the Commission;</amend>
          <eol numlevel="1" lineno="576" slineno="12-33"/>
          <para/>
          <amend anum="0" ea="amend" pairid="15" style="1" owner="ahouston" level="1">2. Establish code of conduct and conflict of interest policies;</amend>
          <eol numlevel="1" lineno="577" slineno="12-34"/>
          <para/>
          <amend anum="0" ea="amend" pairid="16" style="1" owner="ahouston" level="1">3. Establish and amend Rules and bylaws;</amend>
          <eol numlevel="1" lineno="578" slineno="12-35"/>
          <para/>
          <amend anum="0" ea="amend" pairid="17" style="1" owner="ahouston" level="1">4. Maintain its financial records in accordance with the bylaws;</amend>
          <eol numlevel="1" lineno="579" slineno="12-36"/>
          <para/>
          <amend anum="0" ea="amend" pairid="18" style="1" owner="ahouston" level="1">5. Meet and take such actions as are consistent with the provisions of this  
            <ln numlevel="1" lineno="580" slineno="12-37"/>Compact, the Commission's Rules and the bylaws;
          </amend>
          <eol numlevel="1" lineno="581" slineno="12-38"/>
          <para/>
          <amend anum="0" ea="amend" pairid="19" style="1" owner="ahouston" level="1">6. Initiate and conclude legal proceedings or actions in the name of the  
            <ln numlevel="1" lineno="582" slineno="12-39"/>Commission, provided that the standing of any Licensing Authority to sue or be sued  
            <ln numlevel="1" lineno="583" slineno="12-40"/>under applicable law shall not be affected;
          </amend>
          <eol numlevel="1" lineno="584" slineno="12-41"/>
          <para/>
          <amend anum="0" ea="amend" pairid="20" style="1" owner="ahouston" level="1">7. Maintain and certify records and information provided to a Member State as the  
            <ln numlevel="1" lineno="585" slineno="12-42"/>authenticated business records of the Commission and designate an agent to do so on  
            <ln numlevel="1" lineno="586" slineno="12-43"/>the Commission's behalf;
          </amend>
          <eol numlevel="1" lineno="587" slineno="12-44"/>
          <para/>
          <amend anum="0" ea="amend" pairid="21" style="1" owner="ahouston" level="1">8. Purchase and maintain insurance and bonds;</amend>
          <eol numlevel="1" lineno="588" slineno="12-45"/>
          <para/>
          <amend anum="0" ea="amend" pairid="22" style="1" owner="ahouston" level="1">9. Borrow, accept, or contract for services of personnel, including, but not limited  
            <ln numlevel="1" lineno="589" slineno="12-46"/>to, employees of a Member State;
          </amend>
          <eol numlevel="1" lineno="590" slineno="12-47"/>
          <para/>
          <amend anum="0" ea="amend" pairid="23" style="1" owner="ahouston" level="1">10. Conduct an annual financial review;</amend>
          <eol numlevel="1" lineno="591" slineno="12-48"/>
          <para/>
          <amend anum="0" ea="amend" pairid="24" style="1" owner="ahouston" level="1">11. Hire employees, elect or appoint officers, fix compensation, define duties,  
            <ln numlevel="1" lineno="592" slineno="12-49"/>grant such individuals appropriate authority to carry out the purposes of the Compact,  
            <ln numlevel="1" lineno="593" slineno="12-50"/>and establish the Commission's personnel policies and programs relating to conflicts  
            <ln numlevel="1" lineno="594" slineno="12-51"/>of interest, qualifications of personnel, and other related personnel matters;
          </amend>
          <eol numlevel="1" lineno="595" slineno="12-52"/>
          <para/>
          <amend anum="0" ea="amend" pairid="25" style="1" owner="ahouston" level="1">12. Assess and collect fees;</amend>
          <eol numlevel="1" lineno="596" slineno="12-53"/>
          <para/>
          <amend anum="0" ea="amend" pairid="26" style="1" owner="ahouston" level="1">13. Accept any and all appropriate gifts, donations, grants of money, other sources  
            <ln numlevel="1" lineno="597" slineno="12-54"/>of revenue, equipment, supplies, materials, and services, and receive, utilize, and  
            <ln numlevel="1" lineno="598" slineno="12-55"/>dispose of the same; provided that at all times the Commission shall avoid any  
            <ln numlevel="1" lineno="599" slineno="12-56"/>appearance of impropriety or conflict of interest;
          </amend>
          <eol numlevel="1" lineno="600" slineno="12-57"/>
          <para/>
          <amend anum="0" ea="amend" pairid="27" style="1" owner="ahouston" level="1">14. Lease, purchase, retain, own, hold, improve, or use any property, real,  
            <ln numlevel="1" lineno="601" slineno="12-58"/>personal, or mixed, or any undivided interest therein;
          </amend>
          <eol numlevel="1" lineno="602" slineno="12-59"/>
          <para/>
          <amend anum="0" ea="amend" pairid="28" style="1" owner="ahouston" level="1">15. Sell, convey, mortgage, pledge, lease, exchange, abandon, or otherwise  
            <ln numlevel="1" lineno="603" slineno="12-60"/>dispose of any property real, personal, or mixed;
          </amend>
          <eol numlevel="1" lineno="604" slineno="12-61"/>
          <para/>
          <amend anum="0" ea="amend" pairid="29" style="1" owner="ahouston" level="1">16. Establish a budget and make expenditures;</amend>
          <eol numlevel="1" lineno="605" slineno="12-62"/>
          <para/>
          <amend anum="0" ea="amend" pairid="30" style="1" owner="ahouston" level="1">17. Borrow money;</amend>
          <eol numlevel="1" lineno="606" slineno="12-63"/>
          <para/>
          <amend anum="0" ea="amend" pairid="31" style="1" owner="ahouston" level="1">18. Appoint committees, including standing committees, composed of members,  
            <ln numlevel="1" lineno="607" slineno="12-64"/>State regulators, State legislators or their representatives, and consumer  
            <ln numlevel="1" lineno="608" slineno="12-65"/>representatives, and such other interested persons as may be designated in this  
            <ln numlevel="1" lineno="609" slineno="12-66"/>Compact and the bylaws;
          </amend>
          <eol numlevel="1" lineno="610" slineno="12-67"/>
          <para/>
          <amend anum="0" ea="amend" pairid="32" style="1" owner="ahouston" level="1">19. Provide and receive information from, and cooperate with, law enforcement  
            <ln numlevel="1" lineno="611" slineno="12-68"/>agencies;
          </amend>
          <eol numlevel="1" lineno="612" slineno="12-69"/>
          <para/>
          <amend anum="0" ea="amend" pairid="33" style="1" owner="ahouston" level="1">20. Establish and elect an Executive Committee, including a chair and a vice chair;</amend>
          <eol numlevel="1" lineno="613" slineno="12-70"/>
          <para/>
          <amend anum="0" ea="amend" pairid="34" style="1" owner="ahouston" level="1">21. Determine whether a State's adopted language is materially different from the  
            <ln numlevel="1" lineno="614" slineno="12-71"/>model compact language such that the State would not qualify for participation in the  
            <ln numlevel="1" lineno="615" slineno="12-72"/>Compact; and
          </amend>
          <eol numlevel="1" lineno="616" slineno="12-73"/>
          <para/>
          <amend anum="0" ea="amend" pairid="35" style="1" owner="ahouston" level="1">22. Perform such other functions as may be necessary or appropriate to achieve  
            <ln numlevel="1" lineno="617" slineno="12-74"/>the purposes of this Compact.
          </amend>
          <eol numlevel="1" lineno="618" slineno="12-75"/>
          <para/>
          <amend anum="0" ea="amend" pairid="36" style="1" owner="ahouston" level="1">D. The Executive Committee</amend>
          <eol numlevel="1" lineno="619" slineno="12-76"/>
          <para/>
          <amend anum="0" ea="amend" pairid="37" style="1" owner="ahouston" level="1">1. The Executive Committee shall have the power to act on behalf of the  
            <ln numlevel="1" lineno="620" slineno="12-77"/>Commission according to the terms of this Compact. The powers, duties, and  
            <ln numlevel="1" lineno="621" slineno="12-78"/>responsibilities of the Executive Committee shall include:
          </amend>
          <eol numlevel="1" lineno="622" slineno="12-79"/>
          <para/>
          <amend anum="0" ea="amend" pairid="38" style="1" owner="ahouston" level="1">a. Oversee the day-to-day activities of the administration of the compact including  
            <ln numlevel="1" lineno="623" slineno="12-80"/>enforcement and compliance with the provisions of the compact, its Rules and  
            <ln numlevel="1" lineno="624" slineno="12-81"/>bylaws, and other such duties as deemed necessary;
          </amend>
          <eol numlevel="1" lineno="625" slineno="12-82"/>
          <para/>
          <amend anum="0" ea="amend" pairid="39" style="1" owner="ahouston" level="1">b. Recommend to the Commission changes to the Rules or bylaws, changes to this  
            <ln numlevel="1" lineno="626" slineno="12-83"/>Compact legislation, fees charged to Compact Member States, fees charged to  
            <ln numlevel="1" lineno="627" slineno="12-84"/>Licensees, and other fees;
          </amend>
          <eol numlevel="1" lineno="628" slineno="12-85"/>
          <para/>
          <amend anum="0" ea="amend" pairid="40" style="1" owner="ahouston" level="1">c. Ensure Compact administration services are appropriately provided, including  
            <ln numlevel="1" lineno="629" slineno="12-86"/>by contract;
          </amend>
          <eol numlevel="1" lineno="630" slineno="12-87"/>
          <para/>
          <amend anum="0" ea="amend" pairid="41" style="1" owner="ahouston" level="1">d. Prepare and recommend the budget;</amend>
          <eol numlevel="1" lineno="631" slineno="12-88"/>
          <para/>
          <amend anum="0" ea="amend" pairid="42" style="1" owner="ahouston" level="1">e. Maintain financial records on behalf of the Commission;</amend>
          <eol numlevel="1" lineno="632" slineno="12-89"/>
          <para/>
          <amend anum="0" ea="amend" pairid="43" style="1" owner="ahouston" level="1">f. Monitor Compact compliance of Member States and provide compliance reports  
            <ln numlevel="1" lineno="633" slineno="12-90"/>to the Commission;
          </amend>
          <eol numlevel="1" lineno="634" slineno="12-91"/>
          <para/>
          <amend anum="0" ea="amend" pairid="44" style="1" owner="ahouston" level="1">g. Establish additional committees as necessary;</amend>
          <eol numlevel="1" lineno="635" slineno="12-92"/>
          <para/>
          <amend anum="0" ea="amend" pairid="45" style="1" owner="ahouston" level="1">h. Exercise the powers and duties of the Commission during the interim between  
            <ln numlevel="1" lineno="636" slineno="12-93"/>Commission meetings, except for adopting or amending Rules, adopting or amending  
            <ln numlevel="1" lineno="637" slineno="12-94"/>bylaws, and exercising any other powers and duties expressly reserved to the  
            <ln numlevel="1" lineno="638" slineno="12-95"/>Commission by Rule or bylaw; and
          </amend>
          <eol numlevel="1" lineno="639" slineno="12-96"/>
          <para/>
          <amend anum="0" ea="amend" pairid="46" style="1" owner="ahouston" level="1">i. Other duties as provided in the Rules or bylaws of the Commission.</amend>
          <eol numlevel="1" lineno="640" slineno="12-97"/>
          <para/>
          <amend anum="0" ea="amend" pairid="47" style="1" owner="ahouston" level="1">2. The Executive Committee shall be composed of up to eleven (11) members:</amend>
          <eol numlevel="1" lineno="641" slineno="12-98"/>
          <para/>
          <amend anum="0" ea="amend" pairid="48" style="1" owner="ahouston" level="1">a. The chair and vice chair of the Commission shall be voting members of the  
            <ln numlevel="1" lineno="642" slineno="12-99"/>Executive Committee;
          </amend>
          <eol numlevel="1" lineno="643" slineno="12-100"/>
          <para/>
          <amend anum="0" ea="amend" pairid="49" style="1" owner="ahouston" level="1">b. The Commission shall elect five voting members from the current membership  
            <ln numlevel="1" lineno="644" slineno="12-101"/>of the Commission;
          </amend>
          <eol numlevel="1" lineno="645" slineno="12-102"/>
          <para/>
          <amend anum="0" ea="amend" pairid="50" style="1" owner="ahouston" level="1">c. Up to four (4) ex-officio, nonvoting members from four (4) recognized national  
            <ln numlevel="1" lineno="646" slineno="12-103"/>Social Work organizations; and
          </amend>
          <eol numlevel="1" lineno="647" slineno="12-104"/>
          <para/>
          <amend anum="0" ea="amend" pairid="51" style="1" owner="ahouston" level="1">d. The ex-officio members will be selected by their respective organizations.</amend>
          <eol numlevel="1" lineno="648" slineno="12-105"/>
          <para/>
          <amend anum="0" ea="amend" pairid="52" style="1" owner="ahouston" level="1">3. The Commission may remove any member of the Executive Committee as  
            <ln numlevel="1" lineno="649" slineno="12-106"/>provided in the Commission's bylaws.
          </amend>
          <eol numlevel="1" lineno="650" slineno="12-107"/>
          <para/>
          <amend anum="0" ea="amend" pairid="53" style="1" owner="ahouston" level="1">4. The Executive Committee shall meet at least annually.</amend>
          <eol numlevel="1" lineno="651" slineno="12-108"/>
          <para/>
          <amend anum="0" ea="amend" pairid="54" style="1" owner="ahouston" level="1">a. Executive Committee meetings shall be open to the public, except that the  
            <ln numlevel="1" lineno="652" slineno="12-109"/>Executive Committee may meet in a closed, non-public meeting as provided in  
            <ln numlevel="1" lineno="653" slineno="12-110"/>subsection F.2 below.
          </amend>
          <eol numlevel="1" lineno="654" slineno="12-111"/>
          <para/>
          <amend anum="0" ea="amend" pairid="55" style="1" owner="ahouston" level="1">b. The Executive Committee shall give seven (7) days' notice of its meetings,  
            <ln numlevel="1" lineno="655" slineno="12-112"/>posted on its website and as determined to provide notice to persons with an interest  
            <ln numlevel="1" lineno="656" slineno="12-113"/>in the business of the Commission.
          </amend>
          <eol numlevel="1" lineno="657" slineno="12-114"/>
          <para/>
          <amend anum="0" ea="amend" pairid="56" style="1" owner="ahouston" level="1">c. The Executive Committee may hold a special meeting in accordance with  
            <ln numlevel="1" lineno="658" slineno="12-115"/>subsection F.1.b below.
          </amend>
          <eol numlevel="1" lineno="659" slineno="12-116"/>
          <para/>
          <amend anum="0" ea="amend" pairid="57" style="1" owner="ahouston" level="1">E. The Commission shall adopt and provide to the Member States an annual report.</amend>
          <eol numlevel="1" lineno="660" slineno="12-117"/>
          <para/>
          <amend anum="0" ea="amend" pairid="58" style="1" owner="ahouston" level="1">F. Meetings of the Commission</amend>
          <eol numlevel="1" lineno="661" slineno="12-118"/>
          <para/>
          <amend anum="0" ea="amend" pairid="59" style="1" owner="ahouston" level="1">1. All meetings shall be open to the public, except that the Commission may meet  
            <ln numlevel="1" lineno="662" slineno="12-119"/>in a closed, non-public meeting as provided in subsection F.2 below.
          </amend>
          <eol numlevel="1" lineno="663" slineno="12-120"/>
          <para/>
          <amend anum="0" ea="amend" pairid="60" style="1" owner="ahouston" level="1">a. Public notice for all meetings of the full Commission of meetings shall be given  
            <ln numlevel="1" lineno="664" slineno="12-121"/>in the same manner as required under the Rulemaking provisions in Section 12,  
            <ln numlevel="1" lineno="665" slineno="12-122"/>except that the Commission may hold a special meeting as provided in subsection  
            <ln numlevel="1" lineno="666" slineno="12-123"/>F.1.b below.
          </amend>
          <eol numlevel="1" lineno="667" slineno="12-124"/>
          <para/>
          <amend anum="0" ea="amend" pairid="61" style="1" owner="ahouston" level="1">b. The Commission may hold a special meeting when it must meet to conduct  
            <ln numlevel="1" lineno="668" slineno="12-125"/>emergency business by giving 48 hours' notice to all commissioners, on the  
            <ln numlevel="1" lineno="669" slineno="12-126"/>Commission's website, and other means as provided in the Commission's rules. The  
            <ln numlevel="1" lineno="670" slineno="12-127"/>Commission's legal counsel shall certify that the Commission's need to meet qualifies  
            <ln numlevel="1" lineno="671" slineno="12-128"/>as an emergency.
          </amend>
          <eol numlevel="1" lineno="672" slineno="12-129"/>
          <para/>
          <amend anum="0" ea="amend" pairid="62" style="1" owner="ahouston" level="1">2. The Commission or the Executive Committee or other committees of the  
            <ln numlevel="1" lineno="673" slineno="12-130"/>Commission may convene in a closed, non-public meeting for the Commission or  
            <ln numlevel="1" lineno="674" slineno="12-131"/>Executive Committee or other committees of the Commission to receive legal advice  
            <ln numlevel="1" lineno="675" slineno="12-132"/>or to discuss:
          </amend>
          <eol numlevel="1" lineno="676" slineno="12-133"/>
          <para/>
          <amend anum="0" ea="amend" pairid="63" style="1" owner="ahouston" level="1">a. Non-compliance of a Member State with its obligations under the Compact;</amend>
          <eol numlevel="1" lineno="677" slineno="12-134"/>
          <para/>
          <amend anum="0" ea="amend" pairid="64" style="1" owner="ahouston" level="1">b. The employment, compensation, discipline or other matters, practices or  
            <ln numlevel="1" lineno="678" slineno="12-135"/>procedures related to specific employees;
          </amend>
          <eol numlevel="1" lineno="679" slineno="12-136"/>
          <para/>
          <amend anum="0" ea="amend" pairid="65" style="1" owner="ahouston" level="1">c. Current or threatened discipline of a Licensee by the Commission or by a  
            <ln numlevel="1" lineno="680" slineno="12-137"/>Member State's Licensing Authority;
          </amend>
          <eol numlevel="1" lineno="681" slineno="12-138"/>
          <para/>
          <amend anum="0" ea="amend" pairid="66" style="1" owner="ahouston" level="1">d. Current, threatened, or reasonably anticipated litigation;</amend>
          <eol numlevel="1" lineno="682" slineno="12-139"/>
          <para/>
          <amend anum="0" ea="amend" pairid="67" style="1" owner="ahouston" level="1">e. Negotiation of contracts for the purchase, lease, or sale of goods, services, or  
            <ln numlevel="1" lineno="683" slineno="12-140"/>real estate;
          </amend>
          <eol numlevel="1" lineno="684" slineno="12-141"/>
          <para/>
          <amend anum="0" ea="amend" pairid="68" style="1" owner="ahouston" level="1">f. Accusing any person of a crime or formally censuring any person;</amend>
          <eol numlevel="1" lineno="685" slineno="12-142"/>
          <para/>

          <amend anum="0" ea="amend" pairid="74" style="1" owner="ahouston" level="1">l. Other matters as promulgated by the Commission by Rule.</amend>
          <eol numlevel="1" lineno="696" slineno="12-153"/>
          <para/>
          <amend anum="0" ea="amend" pairid="75" style="1" owner="ahouston" level="1">3. If a meeting, or portion of a meeting, is closed, the presiding officer shall state  
            <ln numlevel="1" lineno="697" slineno="12-154"/>that the meeting will be closed and reference each relevant exempting provision, and  
            <ln numlevel="1" lineno="698" slineno="12-155"/>such reference shall be recorded in the minutes.
          </amend>
          <eol numlevel="1" lineno="699" slineno="12-156"/>
          <para/>
          <amend anum="0" ea="amend" pairid="76" style="1" owner="ahouston" level="1">4. The Commission shall keep minutes that fully and clearly describe all matters  
            <ln numlevel="1" lineno="700" slineno="12-157"/>discussed in a meeting and shall provide a full and accurate summary of actions  
            <ln numlevel="1" lineno="701" slineno="12-158"/>taken, and the reasons therefore, including a description of the views expressed. All  
            <ln numlevel="1" lineno="702" slineno="12-159"/>documents considered in connection with an action shall be identified in such  
            <ln numlevel="1" lineno="703" slineno="12-160"/>minutes. All minutes and documents of a closed meeting shall remain under seal,  
            <ln numlevel="1" lineno="704" slineno="12-161"/>subject to release only by a majority vote of the Commission or order of a court of  
            <ln numlevel="1" lineno="705" slineno="12-162"/>competent jurisdiction.
          </amend>
          <eol numlevel="1" lineno="706" slineno="12-163"/>
          <para/>
          <amend anum="0" ea="amend" pairid="77" style="1" owner="ahouston" level="1">G. Financing of the Commission</amend>
          <eol numlevel="1" lineno="707" slineno="12-164"/>
          <para/>
          <amend anum="0" ea="amend" pairid="78" style="1" owner="ahouston" level="1">1. The Commission shall pay, or provide for the payment of, the reasonable  
            <ln numlevel="1" lineno="708" slineno="12-165"/>expenses of its establishment, organization, and ongoing activities.
          </amend>
          <eol numlevel="1" lineno="709" slineno="12-166"/>
          <para/>
          <amend anum="0" ea="amend" pairid="79" style="1" owner="ahouston" level="1">2. The Commission may accept any and all appropriate revenue sources, as  
            <ln numlevel="1" lineno="710" slineno="12-167"/>provided in C(13).
          </amend>
          <eol numlevel="1" lineno="711" slineno="12-168"/>
          <para/>
          <amend anum="0" ea="amend" pairid="80" style="1" owner="ahouston" level="1">3. The Commission may levy on and collect an annual assessment from each  
            <ln numlevel="1" lineno="712" slineno="12-169"/>Member State and impose fees on licensees of Member States to whom it grants a  
            <ln numlevel="1" lineno="713" slineno="12-170"/>Multistate License to cover the cost of the operations and activities of the  
            <ln numlevel="1" lineno="714" slineno="12-171"/>Commission and its staff, which must be in a total amount sufficient to cover its  
            <ln numlevel="1" lineno="715" slineno="12-172"/>annual budget as approved each year for which revenue is not provided by other  
            <ln numlevel="1" lineno="716" slineno="12-173"/>sources. The aggregate annual assessment amount for Member States shall be  
            <ln numlevel="1" lineno="717" slineno="12-174"/>allocated based upon a formula that the Commission shall promulgate by Rule.
          </amend>
          <eol numlevel="1" lineno="718" slineno="12-175"/>
          <para/>
          <amend anum="0" ea="amend" pairid="81" style="1" owner="ahouston" level="1">4. The Commission shall not incur obligations of any kind prior to securing the  
            <ln numlevel="1" lineno="719" slineno="12-176"/>funds adequate to meet the same; nor shall the Commission pledge the credit of any  
            <ln numlevel="1" lineno="720" slineno="12-177"/>of the Member States, except by and with the authority of the Member State.
          </amend>
          <eol numlevel="1" lineno="721" slineno="12-178"/>
          <para/>
          <amend anum="0" ea="amend" pairid="82" style="1" owner="ahouston" level="1">5. The Commission shall keep accurate accounts of all receipts and disbursements.  
            <ln numlevel="1" lineno="722" slineno="12-179"/>The receipts and disbursements of the Commission shall be subject to the financial  
            <ln numlevel="1" lineno="723" slineno="12-180"/>review and accounting procedures established under its bylaws. However, all receipts  
            <ln numlevel="1" lineno="724" slineno="12-181"/>and disbursements of funds handled by the Commission shall be subject to an annual  
            <ln numlevel="1" lineno="725" slineno="12-182"/>financial review by a certified or licensed public accountant, and the report of the  
            <ln numlevel="1" lineno="726" slineno="12-183"/>financial review shall be included in and become part of the annual report of the  
            <ln numlevel="1" lineno="727" slineno="12-184"/>Commission.
          </amend>
          <eol numlevel="1" lineno="728" slineno="12-185"/>
          <para/>
          <amend anum="0" ea="amend" pairid="83" style="1" owner="ahouston" level="1">H. Qualified Immunity, Defense, and Indemnification</amend>
          <eol numlevel="1" lineno="729" slineno="12-186"/>
          <para/>
          <amend anum="0" ea="amend" pairid="84" style="1" owner="ahouston" level="1">1. The members, officers, executive director, employees and representatives of the  
            <ln numlevel="1" lineno="730" slineno="12-187"/>Commission shall be immune from suit and liability, both personally and in their  
            <ln numlevel="1" lineno="731" slineno="12-188"/>official capacity, for any claim for damage to or loss of property or personal injury or  
            <ln numlevel="1" lineno="732" slineno="12-189"/>other civil liability caused by or arising out of any actual or alleged act, error or  
            <ln numlevel="1" lineno="733" slineno="12-190"/>omission that occurred, or that the person against whom the claim is made had a  
            <ln numlevel="1" lineno="734" slineno="12-191"/>reasonable basis for believing occurred within the scope of Commission employment,  
            <ln numlevel="1" lineno="735" slineno="12-192"/>duties or responsibilities; provided that nothing in this paragraph shall be construed  
            <ln numlevel="1" lineno="736" slineno="12-193"/>to protect any such person from suit or liability for any damage, loss, injury, or  
            <ln numlevel="1" lineno="737" slineno="12-194"/>liability caused by the intentional or willful or wanton misconduct of that person. The  
            <ln numlevel="1" lineno="738" slineno="12-195"/>procurement of insurance of any type by the Commission shall not in any way  
            <ln numlevel="1" lineno="739" slineno="12-196"/>compromise or limit the immunity granted hereunder.
          </amend>
          <eol numlevel="1" lineno="740" slineno="12-197"/>
          <para/>
          <amend anum="0" ea="amend" pairid="85" style="1" owner="ahouston" level="1">2. The Commission shall defend any member, officer, executive director,  
            <ln numlevel="1" lineno="741" slineno="12-198"/>employee and representative of the Commission in any civil action seeking to impose  
            <ln numlevel="1" lineno="742" slineno="12-199"/>liability arising out of any actual or alleged act, error, or omission that occurred  
            <ln numlevel="1" lineno="743" slineno="12-200"/>within the scope of Commission employment, duties, or responsibilities, or as  
            <ln numlevel="1" lineno="744" slineno="12-201"/>determined by the Commission that the person against whom the claim is made had a  
            <ln numlevel="1" lineno="745" slineno="12-202"/>reasonable basis for believing occurred within the scope of Commission employment,  
            <ln numlevel="1" lineno="746" slineno="12-203"/>duties, or responsibilities; provided that nothing herein shall be construed to prohibit  
            <ln numlevel="1" lineno="747" slineno="12-204"/>that person from retaining their own counsel at their own expense; and provided  
            <ln numlevel="1" lineno="748" slineno="12-205"/>further, that the actual or alleged act, error, or omission did not result from that  
            <ln numlevel="1" lineno="749" slineno="12-206"/>person's intentional or willful or wanton misconduct.
          </amend>
          <eol numlevel="1" lineno="750" slineno="12-207"/>
          <para/>
          <amend anum="0" ea="amend" pairid="86" style="1" owner="ahouston" level="1">3. The Commission shall indemnify and hold harmless any member, officer,  
            <ln numlevel="1" lineno="751" slineno="12-208"/>executive director, employee, and representative of the Commission for the amount  
            <ln numlevel="1" lineno="752" slineno="12-209"/>of any settlement or judgment obtained against that person arising out of any actual  
            <ln numlevel="1" lineno="753" slineno="12-210"/>or alleged act, error, or omission that occurred within the scope of Commission  
            <ln numlevel="1" lineno="754" slineno="12-211"/>employment, duties, or responsibilities, or that such person had a reasonable basis for  
            <ln numlevel="1" lineno="755" slineno="12-212"/>believing occurred within the scope of Commission employment, duties, or  
            <ln numlevel="1" lineno="756" slineno="12-213"/>responsibilities, provided that the actual or alleged act, error, or omission did not  
            <ln numlevel="1" lineno="757" slineno="12-214"/>result from the intentional or willful or wanton misconduct of that person.
          </amend>
          <eol numlevel="1" lineno="758" slineno="12-215"/>
          <para/>
          <amend anum="0" ea="amend" pairid="87" style="1" owner="ahouston" level="1">4. Nothing herein shall be construed as a limitation on the liability of any licensee  
            <ln numlevel="1" lineno="759" slineno="12-216"/>for professional malpractice or misconduct, which shall be governed solely by any  
            <ln numlevel="1" lineno="760" slineno="12-217"/>other applicable State laws.
          </amend>
          <eol numlevel="1" lineno="761" slineno="12-218"/>
          <para/>
          <amend anum="0" ea="amend" pairid="88" style="1" owner="ahouston" level="1">5. Nothing in this Compact shall be interpreted to waive or otherwise abrogate a  
            <ln numlevel="1" lineno="762" slineno="12-219"/>Member State's state action immunity or state action affirmative defense with respect  
            <ln numlevel="1" lineno="763" slineno="12-220"/>to antitrust claims under the Sherman Act, Clayton Act, or any other State or federal  
            <ln numlevel="1" lineno="764" slineno="12-221"/>antitrust or anticompetitive law or regulation.
          </amend>
          <eol numlevel="1" lineno="765" slineno="12-222"/>
          <para/>
          <amend anum="0" ea="amend" pairid="89" style="1" owner="ahouston" level="1" amendtag="end">6. Nothing in this Compact shall be construed to be a waiver of sovereign  
            <ln numlevel="1" lineno="766" slineno="12-223"/>immunity by the Member States or by the Commission.
          </amend>

          </amend>
          <eol numlevel="1" lineno="771" slineno="13-5"/>
          <para/>
          <amend anum="0" ea="amend" pairid="2" style="1" owner="ahouston" level="1">B. The Commission shall assign each applicant for a Multistate License a unique  
            <ln numlevel="1" lineno="772" slineno="13-6"/>identifier, as determined by the Rules of the Commission.
          </amend>
          <eol numlevel="1" lineno="773" slineno="13-7"/>
          <para/>
          <amend anum="0" ea="amend" pairid="3" style="1" owner="ahouston" level="1">C. Notwithstanding any other provision of State law to the contrary, a Member  
            <ln numlevel="1" lineno="774" slineno="13-8"/>State shall submit a uniform data set to the Data System on all individuals to whom  
            <ln numlevel="1" lineno="775" slineno="13-9"/>this Compact is applicable as required by the Rules of the Commission, including:
          </amend>
          <eol numlevel="1" lineno="776" slineno="13-10"/>
          <para/>
          <amend anum="0" ea="amend" pairid="4" style="1" owner="ahouston" level="1">1. Identifying information;</amend>
          <eol numlevel="1" lineno="777" slineno="13-11"/>
          <para/>
          <amend anum="0" ea="amend" pairid="5" style="1" owner="ahouston" level="1">2. Licensure data;</amend>
          <eol numlevel="1" lineno="778" slineno="13-12"/>
          <para/>
          <amend anum="0" ea="amend" pairid="6" style="1" owner="ahouston" level="1">3. Adverse Actions against a license and information related thereto;</amend>
          <eol numlevel="1" lineno="779" slineno="13-13"/>
          <para/>
          <amend anum="0" ea="amend" pairid="7" style="1" owner="ahouston" level="1">4. Non-confidential information related to Alternative Program participation, the  
            <ln numlevel="1" lineno="780" slineno="13-14"/>beginning and ending dates of such participation, and other information related to  
            <ln numlevel="1" lineno="781" slineno="13-15"/>such participation not made confidential under Member State law;
          </amend>
          <eol numlevel="1" lineno="782" slineno="13-16"/>
          <para/>
          <amend anum="0" ea="amend" pairid="8" style="1" owner="ahouston" level="1">5. Any denial of application for licensure, and the reason(s) for such denial;</amend>
          <eol numlevel="1" lineno="783" slineno="13-17"/>
          <para/>
          <amend anum="0" ea="amend" pairid="9" style="1" owner="ahouston" level="1">6. The presence of Current Significant Investigative Information; and</amend>
          <eol numlevel="1" lineno="784" slineno="13-18"/>
          <para/>
          <amend anum="0" ea="amend" pairid="10" style="1" owner="ahouston" level="1">7. Other information that may facilitate the administration of this Compact or the  
            <ln numlevel="1" lineno="785" slineno="13-19"/>protection of the public, as determined by the Rules of the Commission.
          </amend>
          <eol numlevel="1" lineno="786" slineno="13-20"/>
          <para/>
          <amend anum="0" ea="amend" pairid="11" style="1" owner="ahouston" level="1">D. The records and information provided to a Member State pursuant to this  
            <ln numlevel="1" lineno="787" slineno="13-21"/>Compact or through the Data System, when certified by the Commission or an agent  
            <ln numlevel="1" lineno="788" slineno="13-22"/>thereof, shall constitute the authenticated business records of the Commission, and  
            <ln numlevel="1" lineno="789" slineno="13-23"/>shall be entitled to any associated hearsay exception in any relevant judicial,  
            <ln numlevel="1" lineno="790" slineno="13-24"/>quasi-judicial or administrative proceedings in a Member State.
          </amend>
          <eol numlevel="1" lineno="791" slineno="13-25"/>
          <para/>
          <amend anum="0" ea="amend" pairid="12" style="1" owner="ahouston" level="1">E. Current Significant Investigative Information pertaining to a Licensee in any  
            <ln numlevel="1" lineno="792" slineno="13-26"/>Member State will only be available to other Member States.
          </amend>
          <eol numlevel="1" lineno="793" slineno="13-27"/>
          <para/>
          <amend anum="0" ea="amend" pairid="13" style="1" owner="ahouston" level="1">1. It is the responsibility of the Member States to report any Adverse Action  
            <ln numlevel="1" lineno="794" slineno="13-28"/>against a Licensee and to monitor the database to determine whether Adverse Action  
            <ln numlevel="1" lineno="795" slineno="13-29"/>has been taken against a Licensee. Adverse Action information pertaining to a  
            <ln numlevel="1" lineno="796" slineno="13-30"/>Licensee in any Member State will be available to any other Member State.
          </amend>
          <eol numlevel="1" lineno="797" slineno="13-31"/>
          <para/>
          <amend anum="0" ea="amend" pairid="14" style="1" owner="ahouston" level="1">F. Member States contributing information to the Data System may designate  
            <ln numlevel="1" lineno="798" slineno="13-32"/>information that may not be shared with the public without the express permission of  
            <ln numlevel="1" lineno="799" slineno="13-33"/>the contributing State.
          </amend>
          <eol numlevel="1" lineno="800" slineno="13-34"/>
          <para/>
          <amend anum="0" ea="amend" pairid="15" style="1" owner="ahouston" level="1" amendtag="end">G. Any information submitted to the Data System that is subsequently expunged  
            <ln numlevel="1" lineno="801" slineno="13-35"/>pursuant to federal law or the laws of the Member State contributing the information  
            <ln numlevel="1" lineno="802" slineno="13-36"/>shall be removed from the Data System.
          </amend>

          <amend anum="0" ea="amend" pairid="1" style="1" owner="ahouston" level="1" amendtag="start">A. The Commission shall promulgate reasonable Rules in order to effectively and  
            <ln numlevel="1" lineno="806" slineno="14-4"/>efficiently implement and administer the purposes and provisions of the Compact. A  
            <ln numlevel="1" lineno="807" slineno="14-5"/>Rule shall be invalid and have no force or effect only if a court of competent  
            <ln numlevel="1" lineno="808" slineno="14-6"/>jurisdiction holds that the Rule is invalid because the Commission exercised its  
            <ln numlevel="1" lineno="809" slineno="14-7"/>rulemaking authority in a manner that is beyond the scope and purposes of the  
            <ln numlevel="1" lineno="810" slineno="14-8"/>Compact, or the powers granted hereunder, or based upon another applicable  
            <ln numlevel="1" lineno="811" slineno="14-9"/>standard of review.
          </amend>
          <eol numlevel="1" lineno="812" slineno="14-10"/>
          <para/>
          <amend anum="0" ea="amend" pairid="2" style="1" owner="ahouston" level="1">B. The Rules of the Commission shall have the force of law in each Member  
            <ln numlevel="1" lineno="813" slineno="14-11"/>State, provided however that where the Rules of the Commission conflict with the  
            <ln numlevel="1" lineno="814" slineno="14-12"/>laws of the Member State that establish the Member State's laws, regulations, and  
            <ln numlevel="1" lineno="815" slineno="14-13"/>applicable standards that govern the practice of Social Work as held by a court of  
            <ln numlevel="1" lineno="816" slineno="14-14"/>competent jurisdiction, the Rules of the Commission shall be ineffective in that State  
            <ln numlevel="1" lineno="817" slineno="14-15"/>to the extent of the conflict.
          </amend>
          <eol numlevel="1" lineno="818" slineno="14-16"/>
          <para/>
          <amend anum="0" ea="amend" pairid="3" style="1" owner="ahouston" level="1">C. The Commission shall exercise its Rulemaking powers pursuant to the criteria  
            <ln numlevel="1" lineno="819" slineno="14-17"/>set forth in this Section and the Rules adopted thereunder. Rules shall become  
            <ln numlevel="1" lineno="820" slineno="14-18"/>binding on the day following adoption or the date specified in the Rule or  
            <ln numlevel="1" lineno="821" slineno="14-19"/>amendment, whichever is later.
          </amend>
          <eol numlevel="1" lineno="822" slineno="14-20"/>
          <para/>
          <amend anum="0" ea="amend" pairid="4" style="1" owner="ahouston" level="1">D. If a majority of the legislatures of the Member States rejects a Rule or portion  
            <ln numlevel="1" lineno="823" slineno="14-21"/>of a Rule, by enactment of a statute or resolution in the same manner used to adopt  
            <ln numlevel="1" lineno="824" slineno="14-22"/>the Compact within four (4) years of the date of adoption of the Rule, then such Rule  
            <ln numlevel="1" lineno="825" slineno="14-23"/>shall have no further force and effect in any Member State.
          </amend>
          <eol numlevel="1" lineno="826" slineno="14-24"/>
          <para/>
          <amend anum="0" ea="amend" pairid="5" style="1" owner="ahouston" level="1">E. Rules shall be adopted at a regular or special meeting of the Commission.</amend>
          <eol numlevel="1" lineno="827" slineno="14-25"/>
          <para/>
          <amend anum="0" ea="amend" pairid="6" style="1" owner="ahouston" level="1">F. Prior to adoption of a proposed Rule, the Commission shall hold a public  
            <ln numlevel="1" lineno="828" slineno="14-26"/>hearing and allow persons to provide oral and written comments, data, facts,  
            <ln numlevel="1" lineno="829" slineno="14-27"/>opinions, and arguments.
          </amend>
          <eol numlevel="1" lineno="830" slineno="14-28"/>
          <para/>
          <amend anum="0" ea="amend" pairid="7" style="1" owner="ahouston" level="1">G. Prior to adoption of a proposed Rule by the Commission, and at least thirty  
            <ln numlevel="1" lineno="831" slineno="14-29"/>(30) days in advance of the meeting at which the Commission will hold a public  
            <ln numlevel="1" lineno="832" slineno="14-30"/>hearing on the proposed Rule, the Commission shall provide a Notice of Proposed  
            <ln numlevel="1" lineno="833" slineno="14-31"/>Rulemaking:
          </amend>
          <eol numlevel="1" lineno="834" slineno="14-32"/>
          <para/>
          <amend anum="0" ea="amend" pairid="8" style="1" owner="ahouston" level="1">1. On the website of the Commission or other publicly accessible platform;</amend>

          <amend anum="0" ea="amend" pairid="12" style="1" owner="ahouston" level="1">1. The time, date, and location of the public hearing at which the Commission will  
            <ln numlevel="1" lineno="840" slineno="14-38"/>hear public comments on the proposed Rule and, if different, the time, date, and  
            <ln numlevel="1" lineno="841" slineno="14-39"/>location of the meeting where the Commission will consider and vote on the  
            <ln numlevel="1" lineno="842" slineno="14-40"/>proposed rule;
          </amend>
          <eol numlevel="1" lineno="843" slineno="14-41"/>
          <para/>
          <amend anum="0" ea="amend" pairid="13" style="1" owner="ahouston" level="1">2. If the hearing is held via telecommunication, video conference, or other  
            <ln numlevel="1" lineno="844" slineno="14-42"/>electronic means, the Commission shall include the mechanism for access to the  
            <ln numlevel="1" lineno="845" slineno="14-43"/>hearing in the Notice of Proposed Rulemaking;
          </amend>
          <eol numlevel="1" lineno="846" slineno="14-44"/>
          <para/>
          <amend anum="0" ea="amend" pairid="14" style="1" owner="ahouston" level="1">3. The text of the proposed Rule and the reason therefor;</amend>
          <eol numlevel="1" lineno="847" slineno="14-45"/>
          <para/>
          <amend anum="0" ea="amend" pairid="15" style="1" owner="ahouston" level="1">4. A request for comments on the proposed Rule from any interested person; and</amend>
          <eol numlevel="1" lineno="848" slineno="14-46"/>
          <para/>
          <amend anum="0" ea="amend" pairid="16" style="1" owner="ahouston" level="1">5. The manner in which interested persons may submit written comments.</amend>
          <eol numlevel="1" lineno="849" slineno="14-47"/>
          <para/>
          <amend anum="0" ea="amend" pairid="17" style="1" owner="ahouston" level="1">I. All hearings will be recorded. A copy of the recording and all written comments  
            <ln numlevel="1" lineno="850" slineno="14-48"/>and documents received by the Commission in response to the proposed Rule shall be  
            <ln numlevel="1" lineno="851" slineno="14-49"/>available to the public.
          </amend>
          <eol numlevel="1" lineno="852" slineno="14-50"/>
          <para/>
          <amend anum="0" ea="amend" pairid="18" style="1" owner="ahouston" level="1">J. Nothing in this section shall be construed as requiring a separate hearing on  
            <ln numlevel="1" lineno="853" slineno="14-51"/>each Rule. Rules may be grouped for the convenience of the Commission at hearings  
            <ln numlevel="1" lineno="854" slineno="14-52"/>required by this section.
          </amend>
          <eol numlevel="1" lineno="855" slineno="14-53"/>
          <para/>
          <amend anum="0" ea="amend" pairid="19" style="1" owner="ahouston" level="1">K. The Commission shall, by majority vote of all members, take final action on  
            <ln numlevel="1" lineno="856" slineno="14-54"/>the proposed Rule based on the Rulemaking record and the full text of the Rule.
          </amend>
          <eol numlevel="1" lineno="857" slineno="14-55"/>
          <para/>
          <amend anum="0" ea="amend" pairid="20" style="1" owner="ahouston" level="1">1. The Commission may adopt changes to the proposed Rule provided the changes  
            <ln numlevel="1" lineno="858" slineno="14-56"/>do not enlarge the original purpose of the proposed Rule.
          </amend>
          <eol numlevel="1" lineno="859" slineno="14-57"/>
          <para/>
          <amend anum="0" ea="amend" pairid="21" style="1" owner="ahouston" level="1">2. The Commission shall provide an explanation of the reasons for substantive  
            <ln numlevel="1" lineno="860" slineno="14-58"/>changes made to the proposed Rule as well as reasons for substantive changes not  
            <ln numlevel="1" lineno="861" slineno="14-59"/>made that were recommended by commenters.
          </amend>
          <eol numlevel="1" lineno="862" slineno="14-60"/>
          <para/>
          <amend anum="0" ea="amend" pairid="22" style="1" owner="ahouston" level="1">3. The Commission shall determine a reasonable effective date for the Rule.  
            <ln numlevel="1" lineno="863" slineno="14-61"/>Except for an emergency as provided in Section 12.L, the effective date of the Rule  
            <ln numlevel="1" lineno="864" slineno="14-62"/>shall be no sooner than 30 days after issuing the notice that it adopted or amended the  
            <ln numlevel="1" lineno="865" slineno="14-63"/>Rule.
          </amend>
          <eol numlevel="1" lineno="866" slineno="14-64"/>
          <para/>
          <amend anum="0" ea="amend" pairid="23" style="1" owner="ahouston" level="1">L. Upon determination that an emergency exists, the Commission may consider  
            <ln numlevel="1" lineno="867" slineno="14-65"/>and adopt an emergency Rule with 48 hours' notice, with opportunity to comment,  
            <ln numlevel="1" lineno="868" slineno="14-66"/>provided that the usual Rulemaking procedures provided in the Compact and in this  
            <ln numlevel="1" lineno="869" slineno="14-67"/>section shall be retroactively applied to the Rule as soon as reasonably possible, in no  
            <ln numlevel="1" lineno="870" slineno="14-68"/>event later than ninety (90) days after the effective date of the Rule. For the purposes  
            <ln numlevel="1" lineno="871" slineno="14-69"/>of this provision, an emergency Rule is one that must be adopted immediately in  
            <ln numlevel="1" lineno="872" slineno="14-70"/>order to:
          </amend>
          <eol numlevel="1" lineno="873" slineno="14-71"/>
          <para/>
          <amend anum="0" ea="amend" pairid="24" style="1" owner="ahouston" level="1">1. Meet an imminent threat to public health, safety, or welfare;</amend>
          <eol numlevel="1" lineno="874" slineno="14-72"/>
          <para/>
          <amend anum="0" ea="amend" pairid="25" style="1" owner="ahouston" level="1">2. Prevent a loss of Commission or Member State funds;</amend>
          <eol numlevel="1" lineno="875" slineno="14-73"/>
          <para/>
          <amend anum="0" ea="amend" pairid="26" style="1" owner="ahouston" level="1">3. Meet a deadline for the promulgation of a Rule that is established by federal  
            <ln numlevel="1" lineno="876" slineno="14-74"/>law or rule; or
          </amend>
          <eol numlevel="1" lineno="877" slineno="14-75"/>
          <para/>
          <amend anum="0" ea="amend" pairid="27" style="1" owner="ahouston" level="1">4. Protect public health and safety.</amend>
          <eol numlevel="1" lineno="878" slineno="14-76"/>
          <para/>
          <amend anum="0" ea="amend" pairid="28" style="1" owner="ahouston" level="1">M. The Commission or an authorized committee of the Commission may direct  
            <ln numlevel="1" lineno="879" slineno="14-77"/>revisions to a previously adopted Rule for purposes of correcting typographical  
            <ln numlevel="1" lineno="880" slineno="14-78"/>errors, errors in format, errors in consistency, or grammatical errors. Public notice of  
            <ln numlevel="1" lineno="881" slineno="14-79"/>any revisions shall be posted on the website of the Commission. The revision shall be  
            <ln numlevel="1" lineno="882" slineno="14-80"/>subject to challenge by any person for a period of thirty (30) days after posting. The  
            <ln numlevel="1" lineno="883" slineno="14-81"/>revision may be challenged only on grounds that the revision results in a material  
            <ln numlevel="1" lineno="884" slineno="14-82"/>change to a Rule. A challenge shall be made in writing and delivered to the  
            <ln numlevel="1" lineno="885" slineno="14-83"/>Commission prior to the end of the notice period. If no challenge is made, the  
            <ln numlevel="1" lineno="886" slineno="14-84"/>revision will take effect without further action. If the revision is challenged, the  
            <ln numlevel="1" lineno="887" slineno="14-85"/>revision may not take effect without the approval of the Commission.
          </amend>
          <eol numlevel="1" lineno="888" slineno="14-86"/>
          <para/>
          <amend anum="0" ea="amend" pairid="29" style="1" owner="ahouston" level="1" amendtag="end">N. No Member State's rulemaking requirements shall apply under this compact.</amend>

          <amend anum="0" ea="amend" pairid="1" style="1" owner="ahouston" level="1" amendtag="start">A. Oversight</amend>
          <eol numlevel="1" lineno="892" slineno="15-4"/>
          <para/>
          <amend anum="0" ea="amend" pairid="2" style="1" owner="ahouston" level="1">1. The executive and judicial branches of State government in each Member State  
            <ln numlevel="1" lineno="893" slineno="15-5"/>shall enforce this Compact and take all actions necessary and appropriate to  
            <ln numlevel="1" lineno="894" slineno="15-6"/>implement the Compact.
          </amend>
          <eol numlevel="1" lineno="895" slineno="15-7"/>
          <para/>
          <amend anum="0" ea="amend" pairid="3" style="1" owner="ahouston" level="1">2. Except as otherwise provided in this Compact, venue is proper and judicial  
            <ln numlevel="1" lineno="896" slineno="15-8"/>proceedings by or against the Commission shall be brought solely and exclusively in  
            <ln numlevel="1" lineno="897" slineno="15-9"/>a court of competent jurisdiction where the principal office of the Commission is  
            <ln numlevel="1" lineno="898" slineno="15-10"/>located. The Commission may waive venue and jurisdictional defenses to the extent  
            <ln numlevel="1" lineno="899" slineno="15-11"/>it adopts or consents to participate in alternative dispute resolution proceedings.  
            <ln numlevel="1" lineno="900" slineno="15-12"/>Nothing herein shall affect or limit the selection or propriety of venue in any action  
            <ln numlevel="1" lineno="901" slineno="15-13"/>against a Licensee for professional malpractice, misconduct or any such similar  
            <ln numlevel="1" lineno="902" slineno="15-14"/>matter.
          </amend>
          <eol numlevel="1" lineno="903" slineno="15-15"/>
          <para/>
          <amend anum="0" ea="amend" pairid="4" style="1" owner="ahouston" level="1">3. The Commission shall be entitled to receive service of process in any  
            <ln numlevel="1" lineno="904" slineno="15-16"/>proceeding regarding the enforcement or interpretation of the Compact and shall have  
            <ln numlevel="1" lineno="905" slineno="15-17"/>standing to intervene in such a proceeding for all purposes. Failure to provide the  
            <ln numlevel="1" lineno="906" slineno="15-18"/>Commission service of process shall render a judgment or order void as to the  
            <ln numlevel="1" lineno="907" slineno="15-19"/>Commission, this Compact, or promulgated Rules.
          </amend>
          <eol numlevel="1" lineno="908" slineno="15-20"/>
          <para/>
          <amend anum="0" ea="amend" pairid="5" style="1" owner="ahouston" level="1">B. Default, Technical Assistance, and Termination</amend>
          <eol numlevel="1" lineno="909" slineno="15-21"/>
          <para/>
          <amend anum="0" ea="amend" pairid="6" style="1" owner="ahouston" level="1">1. If the Commission determines that a Member State has defaulted in the  
            <ln numlevel="1" lineno="910" slineno="15-22"/>performance of its obligations or responsibilities under this Compact or the  
            <ln numlevel="1" lineno="911" slineno="15-23"/>promulgated Rules, the Commission shall provide written notice to the defaulting  
            <ln numlevel="1" lineno="912" slineno="15-24"/>State. The notice of default shall describe the default, the proposed means of curing  
            <ln numlevel="1" lineno="913" slineno="15-25"/>the default, and any other action that the Commission may take, and shall offer  
            <ln numlevel="1" lineno="914" slineno="15-26"/>training and specific technical assistance regarding the default.
          </amend>
          <eol numlevel="1" lineno="915" slineno="15-27"/>
          <para/>
          <amend anum="0" ea="amend" pairid="7" style="1" owner="ahouston" level="1">2. The Commission shall provide a copy of the notice of default to the other  
            <ln numlevel="1" lineno="916" slineno="15-28"/>Member States.
          </amend>
          <eol numlevel="1" lineno="917" slineno="15-29"/>
          <para/>
          <amend anum="0" ea="amend" pairid="8" style="1" owner="ahouston" level="1">C. If a State in default fails to cure the default, the defaulting State may be  
            <ln numlevel="1" lineno="918" slineno="15-30"/>terminated from the Compact upon an affirmative vote of a majority of the delegates  
            <ln numlevel="1" lineno="919" slineno="15-31"/>of the Member States, and all rights, privileges and benefits conferred on that State  
            <ln numlevel="1" lineno="920" slineno="15-32"/>by this Compact may be terminated on the effective date of termination. A cure of the  
            <ln numlevel="1" lineno="921" slineno="15-33"/>default does not relieve the offending State of obligations or liabilities incurred  
            <ln numlevel="1" lineno="922" slineno="15-34"/>during the period of default.
          </amend>
          <eol numlevel="1" lineno="923" slineno="15-35"/>
          <para/>
          <amend anum="0" ea="amend" pairid="9" style="1" owner="ahouston" level="1">D. Termination of membership in the Compact shall be imposed only after all  
            <ln numlevel="1" lineno="924" slineno="15-36"/>other means of securing compliance have been exhausted. Notice of intent to suspend  
            <ln numlevel="1" lineno="925" slineno="15-37"/>or terminate shall be given by the Commission to the governor, the majority and  
            <ln numlevel="1" lineno="926" slineno="15-38"/>minority leaders of the defaulting State's legislature, the defaulting State's State  
            <ln numlevel="1" lineno="927" slineno="15-39"/>Licensing Authority and each of the Member States' Licensing Authority.
          </amend>
          <eol numlevel="1" lineno="928" slineno="15-40"/>
          <para/>
          <amend anum="0" ea="amend" pairid="10" style="1" owner="ahouston" level="1">E. A State that has been terminated is responsible for all assessments, obligations,  
            <ln numlevel="1" lineno="929" slineno="15-41"/>and liabilities incurred through the effective date of termination, including  
            <ln numlevel="1" lineno="930" slineno="15-42"/>obligations that extend beyond the effective date of termination.
          </amend>
          <eol numlevel="1" lineno="931" slineno="15-43"/>
          <para/>
          <amend anum="0" ea="amend" pairid="11" style="1" owner="ahouston" level="1">F. Upon the termination of a State's membership from this Compact, that State  
            <ln numlevel="1" lineno="932" slineno="15-44"/>shall immediately provide notice to all Licensees within that State of such  
            <ln numlevel="1" lineno="933" slineno="15-45"/>termination. The terminated State shall continue to recognize all licenses granted  
            <ln numlevel="1" lineno="934" slineno="15-46"/>pursuant to this Compact for a minimum of six (6) months after the date of said  
            <ln numlevel="1" lineno="935" slineno="15-47"/>notice of termination.
          </amend>
          <eol numlevel="1" lineno="936" slineno="15-48"/>
          <para/>
          <amend anum="0" ea="amend" pairid="12" style="1" owner="ahouston" level="1">G. The Commission shall not bear any costs related to a State that is found to be in  
            <ln numlevel="1" lineno="937" slineno="15-49"/>default or that has been terminated from the Compact, unless agreed upon in writing  
            <ln numlevel="1" lineno="938" slineno="15-50"/>between the Commission and the defaulting State.
          </amend>
          <eol numlevel="1" lineno="939" slineno="15-51"/>
          <para/>
          <amend anum="0" ea="amend" pairid="13" style="1" owner="ahouston" level="1">H. The defaulting State may appeal the action of the Commission by petitioning  
            <ln numlevel="1" lineno="940" slineno="15-52"/>the U.S. District Court for the District of Columbia or the federal district where the  
            <ln numlevel="1" lineno="941" slineno="15-53"/>Commission has its principal offices. The prevailing party shall be awarded all costs  
            <ln numlevel="1" lineno="942" slineno="15-54"/>of such litigation, including reasonable attorney's fees.
          </amend>
          <eol numlevel="1" lineno="943" slineno="15-55"/>
          <para/>
          <amend anum="0" ea="amend" pairid="14" style="1" owner="ahouston" level="1">I. Dispute Resolution</amend>
          <eol numlevel="1" lineno="944" slineno="15-56"/>
          <para/>
          <amend anum="0" ea="amend" pairid="15" style="1" owner="ahouston" level="1">1. Upon request by a Member State, the Commission shall attempt to resolve  
            <ln numlevel="1" lineno="945" slineno="15-57"/>disputes related to the Compact that arise among Member States and between  
            <ln numlevel="1" lineno="946" slineno="15-58"/>Member and non-Member States.
          </amend>
          <eol numlevel="1" lineno="947" slineno="15-59"/>
          <para/>
          <amend anum="0" ea="amend" pairid="16" style="1" owner="ahouston" level="1">2. The Commission shall promulgate a Rule providing for both mediation and  
            <ln numlevel="1" lineno="948" slineno="15-60"/>binding dispute resolution for disputes as appropriate.
          </amend>
          <eol numlevel="1" lineno="949" slineno="15-61"/>
          <para/>
          <amend anum="0" ea="amend" pairid="17" style="1" owner="ahouston" level="1">J. Enforcement</amend>
          <eol numlevel="1" lineno="950" slineno="15-62"/>
          <para/>
          <amend anum="0" ea="amend" pairid="18" style="1" owner="ahouston" level="1">1. By majority vote as provided by Rule, the Commission may initiate legal action  
            <ln numlevel="1" lineno="951" slineno="15-63"/>against a Member State in default in the United States District Court for the District  
            <ln numlevel="1" lineno="952" slineno="15-64"/>of Columbia or the federal district where the Commission has its principal offices to  
            <ln numlevel="1" lineno="953" slineno="15-65"/>enforce compliance with the provisions of the Compact and its promulgated Rules.  
            <ln numlevel="1" lineno="954" slineno="15-66"/>The relief sought may include both injunctive relief and damages. In the event  
            <ln numlevel="1" lineno="955" slineno="15-67"/>judicial enforcement is necessary, the prevailing party shall be awarded all costs of  
            <ln numlevel="1" lineno="956" slineno="15-68"/>such litigation, including reasonable attorney's fees. The remedies herein shall not be  
            <ln numlevel="1" lineno="957" slineno="15-69"/>the exclusive remedies of the Commission. The Commission may pursue any other  
            <ln numlevel="1" lineno="958" slineno="15-70"/>remedies available under federal or the defaulting Member State's law.
          </amend>
          <eol numlevel="1" lineno="959" slineno="15-71"/>
          <para/>
          <amend anum="0" ea="amend" pairid="19" style="1" owner="ahouston" level="1">2. A Member State may initiate legal action against the Commission in the U.S.  
            <ln numlevel="1" lineno="960" slineno="15-72"/>District Court for the District of Columbia or the federal district where the  
            <ln numlevel="1" lineno="961" slineno="15-73"/>Commission has its principal offices to enforce compliance with the provisions of the  
            <ln numlevel="1" lineno="962" slineno="15-74"/>Compact and its promulgated Rules. The relief sought may include both injunctive  
            <ln numlevel="1" lineno="963" slineno="15-75"/>relief and damages. In the event judicial enforcement is necessary, the prevailing  
            <ln numlevel="1" lineno="964" slineno="15-76"/>party shall be awarded all costs of such litigation, including reasonable attorney's fees.
          </amend>
          <eol numlevel="1" lineno="965" slineno="15-77"/>
          <para/>
          <amend anum="0" ea="amend" pairid="20" style="1" owner="ahouston" level="1" amendtag="end">3. No person other than a Member State shall enforce this compact against the  
            <ln numlevel="1" lineno="966" slineno="15-78"/>Commission.
          </amend>

          <amend anum="0" ea="amend" pairid="1" style="1" owner="ahouston" level="1" amendtag="start">A. The Compact shall come into effect on the date on which the Compact statute is  
            <ln numlevel="1" lineno="970" slineno="16-4"/>enacted into law in the seventh Member State.
          </amend>
          <eol numlevel="1" lineno="971" slineno="16-5"/>
          <para/>
          <amend anum="0" ea="amend" pairid="2" style="1" owner="ahouston" level="1">1. On or after the effective date of the Compact, the Commission shall convene  
            <ln numlevel="1" lineno="972" slineno="16-6"/>and review the enactment of each of the first seven Member States ("Charter Member  
            <ln numlevel="1" lineno="973" slineno="16-7"/>States") to determine if the statute enacted by each such Charter Member State is  
            <ln numlevel="1" lineno="974" slineno="16-8"/>materially different than the model Compact statute.
          </amend>
          <eol numlevel="1" lineno="975" slineno="16-9"/>
          <para/>
          <amend anum="0" ea="amend" pairid="3" style="1" owner="ahouston" level="1">a. A Charter Member State whose enactment is found to be materially different  
            <ln numlevel="1" lineno="976" slineno="16-10"/>from the model Compact statute shall be entitled to the default process set forth in  
            <ln numlevel="1" lineno="977" slineno="16-11"/>Section 13.
          </amend>
          <eol numlevel="1" lineno="978" slineno="16-12"/>
          <para/>
          <amend anum="0" ea="amend" pairid="4" style="1" owner="ahouston" level="1">b. If any Member State is later found to be in default, or is terminated or  
            <ln numlevel="1" lineno="979" slineno="16-13"/>withdraws from the Compact, the Commission shall remain in existence and the  
            <ln numlevel="1" lineno="980" slineno="16-14"/>Compact shall remain in effect even if the number of Member States should be less  
            <ln numlevel="1" lineno="981" slineno="16-15"/>than seven.
          </amend>
          <eol numlevel="1" lineno="982" slineno="16-16"/>
          <para/>
          <amend anum="0" ea="amend" pairid="5" style="1" owner="ahouston" level="1">2. Member States enacting the Compact subsequent to the seven initial Charter  
            <ln numlevel="1" lineno="983" slineno="16-17"/>Member States shall be subject to the process set forth in Section 10(C)(21) to  
            <ln numlevel="1" lineno="984" slineno="16-18"/>determine if their enactments are materially different from the model Compact statute  
            <ln numlevel="1" lineno="985" slineno="16-19"/>and whether they qualify for participation in the Compact.
          </amend>
          <eol numlevel="1" lineno="986" slineno="16-20"/>
          <para/>
          <amend anum="0" ea="amend" pairid="6" style="1" owner="ahouston" level="1">3. All actions taken for the benefit of the Commission or in furtherance of the  
            <ln numlevel="1" lineno="987" slineno="16-21"/>purposes of the administration of the Compact prior to the effective date of the  
            <ln numlevel="1" lineno="988" slineno="16-22"/>Compact or the Commission coming into existence shall be considered to be actions  
            <ln numlevel="1" lineno="989" slineno="16-23"/>of the Commission unless specifically repudiated by the Commission.
          </amend>
          <eol numlevel="1" lineno="990" slineno="16-24"/>
          <para/>
          <amend anum="0" ea="amend" pairid="7" style="1" owner="ahouston" level="1">4. Any State that joins the Compact subsequent to the Commission's initial  
            <ln numlevel="1" lineno="991" slineno="16-25"/>adoption of the Rules and bylaws shall be subject to the Rules and bylaws as they  
            <ln numlevel="1" lineno="992" slineno="16-26"/>exist on the date on which the Compact becomes law in that State. Any Rule that has  
            <ln numlevel="1" lineno="993" slineno="16-27"/>been previously adopted by the Commission shall have the full force and effect of  
            <ln numlevel="1" lineno="994" slineno="16-28"/>law on the day the Compact becomes law in that State.
          </amend>
          <eol numlevel="1" lineno="995" slineno="16-29"/>
          <para/>
          <amend anum="0" ea="amend" pairid="8" style="1" owner="ahouston" level="1">B. Any Member State may withdraw from this Compact by enacting a statute  
            <ln numlevel="1" lineno="996" slineno="16-30"/>repealing the same.
          </amend>
          <eol numlevel="1" lineno="997" slineno="16-31"/>
          <para/>
          <amend anum="0" ea="amend" pairid="9" style="1" owner="ahouston" level="1">1. A Member State's withdrawal shall not take effect until 180 days after  
            <ln numlevel="1" lineno="998" slineno="16-32"/>enactment of the repealing statute.
          </amend>
          <eol numlevel="1" lineno="999" slineno="16-33"/>
          <para/>
          <amend anum="0" ea="amend" pairid="10" style="1" owner="ahouston" level="1">2. Withdrawal shall not affect the continuing requirement of the withdrawing  
            <ln numlevel="1" lineno="1000" slineno="16-34"/>State's Licensing Authority to comply with the investigative and Adverse Action  
            <ln numlevel="1" lineno="1001" slineno="16-35"/>reporting requirements of this Compact prior to the effective date of withdrawal.
          </amend>
          <eol numlevel="1" lineno="1002" slineno="16-36"/>
          <para/>
          <amend anum="0" ea="amend" pairid="11" style="1" owner="ahouston" level="1">3. Upon the enactment of a statute withdrawing from this compact, a State shall  
            <ln numlevel="1" lineno="1003" slineno="16-37"/>immediately provide notice of such withdrawal to all Licensees within that State.  
            <ln numlevel="1" lineno="1004" slineno="16-38"/>Notwithstanding any subsequent statutory enactment to the contrary, such  
            <ln numlevel="1" lineno="1005" slineno="16-39"/>withdrawing State shall continue to recognize all licenses granted pursuant to this  
            <ln numlevel="1" lineno="1006" slineno="16-40"/>compact for a minimum of 180 days after the date of such notice of withdrawal.
          </amend>
          <eol numlevel="1" lineno="1007" slineno="16-41"/>
          <para/>
          <amend anum="0" ea="amend" pairid="12" style="1" owner="ahouston" level="1">C. Nothing contained in this Compact shall be construed to invalidate or prevent  
            <ln numlevel="1" lineno="1008" slineno="16-42"/>any licensure agreement or other cooperative arrangement between a Member State  
            <ln numlevel="1" lineno="1009" slineno="16-43"/>and a non-Member State that does not conflict with the provisions of this Compact.
          </amend>
          <eol numlevel="1" lineno="1010" slineno="16-44"/>
          <para/>
          <amend anum="0" ea="amend" pairid="13" style="1" owner="ahouston" level="1" amendtag="end">D. This Compact may be amended by the Member States. No amendment to this  
            <ln numlevel="1" lineno="1011" slineno="16-45"/>Compact shall become effective and binding upon any Member State until it is  
            <ln numlevel="1" lineno="1012" slineno="16-46"/>enacted into the laws of all Member States.
          </amend>

          <amend anum="0" ea="amend" pairid="1" style="1" owner="ahouston" level="1" amendtag="start">A. This Compact and the Commission's rulemaking authority shall be liberally  
            <ln numlevel="1" lineno="1016" slineno="17-4"/>construed so as to effectuate the purposes, and the implementation and administration  
            <ln numlevel="1" lineno="1017" slineno="17-5"/>of the Compact. Provisions of the Compact expressly authorizing or requiring the  
            <ln numlevel="1" lineno="1018" slineno="17-6"/>promulgation of Rules shall not be construed to limit the Commission's rulemaking  
            <ln numlevel="1" lineno="1019" slineno="17-7"/>authority solely for those purposes.
          </amend>
          <eol numlevel="1" lineno="1020" slineno="17-8"/>
          <para/>
          <amend anum="0" ea="amend" pairid="2" style="1" owner="ahouston" level="1">B. The provisions of this Compact shall be severable and if any phrase, clause,  
            <ln numlevel="1" lineno="1021" slineno="17-9"/>sentence or provision of this Compact is held by a court of competent jurisdiction to  
            <ln numlevel="1" lineno="1022" slineno="17-10"/>be contrary to the constitution of any Member State, a State seeking participation in  
            <ln numlevel="1" lineno="1023" slineno="17-11"/>the Compact, or of the United States, or the applicability thereof to any government,  
            <ln numlevel="1" lineno="1024" slineno="17-12"/>agency, person or circumstance is held to be unconstitutional by a court of competent  
            <ln numlevel="1" lineno="1025" slineno="17-13"/>jurisdiction, the validity of the remainder of this Compact and the applicability  
            <ln numlevel="1" lineno="1026" slineno="17-14"/>thereof to any other government, agency, person or circumstance shall not be affected  
            <ln numlevel="1" lineno="1027" slineno="17-15"/>thereby.
          </amend>
          <eol numlevel="1" lineno="1028" slineno="17-16"/>
          <para/>
          <amend anum="0" ea="amend" pairid="3" style="1" owner="ahouston" level="1" amendtag="end">C. Notwithstanding subsection B of this section, the Commission may deny a  
            <ln numlevel="1" lineno="1029" slineno="17-17"/>State's participation in the Compact or, in accordance with the requirements of  
            <ln numlevel="1" lineno="1030" slineno="17-18"/>Section 13.B, terminate a Member State's participation in the Compact, if it  
            <ln numlevel="1" lineno="1031" slineno="17-19"/>determines that a constitutional requirement of a Member State is a material  
            <ln numlevel="1" lineno="1032" slineno="17-20"/>departure from the Compact. Otherwise, if this Compact shall be held to be contrary  
            <ln numlevel="1" lineno="1033" slineno="17-21"/>to the constitution of any Member State, the Compact shall remain in full force and  
            <ln numlevel="1" lineno="1034" slineno="17-22"/>effect as to the remaining Member States and in full force and effect as to the  
            <ln numlevel="1" lineno="1035" slineno="17-23"/>Member State affected as to all severable matters.
          </amend>
