    <gdhead lineno="4">General Description:</gdhead>
    <gd numlevel="1" lineno="5" slineno="0-5">This bill modifies provisions of the Utah State Personnel Management Act.</gd>
    <hphead lineno="6">Highlighted Provisions:</hphead>
    <hp numlevel="1" lineno="7" slineno="0-7">This bill:
      <hl numlevel="1" lineno="8" slineno="0-8" level="1">provides that the director of the Division of Human Resource Management (DHRM) is  
        <ln numlevel="1" lineno="9" slineno="0-9"/>the chief human resources officer for the state executive branch;
      </hl>
      <hl numlevel="1" lineno="10" slineno="0-10" level="1">eliminates the requirement that the director of DHRM provide charter schools and  
        <ln numlevel="1" lineno="11" slineno="0-11"/>political subdivisions with training and advice on human resource management;
      </hl>
      <hl numlevel="1" lineno="12" slineno="0-12" level="1">for purposes of the state's pay for performance policy, provides that an employee does  
        <ln numlevel="1" lineno="13" slineno="0-13"/>not include an individual who is ineligible to receive a state retirement benefit or who is in a  
        <ln numlevel="1" lineno="14" slineno="0-14"/>time-limited position lasting less than 12 months;
      </hl>
      <hl numlevel="1" lineno="15" slineno="0-15" level="1">clarifies the purpose of the state's pay for performance policy;</hl>
      <hl numlevel="1" lineno="16" slineno="0-16" level="1">permits an agency to file a request with DHRM:
        <hl numlevel="1" lineno="17" slineno="0-17" level="2">to keep a competitive career service position scheduled as a competitive career  
          <ln numlevel="1" lineno="18" slineno="0-18"/>service position; or
        </hl>
        <hl numlevel="1" lineno="19" slineno="0-19" level="2">to reschedule a non-competitive career service position as a competitive career  
          <ln numlevel="1" lineno="20" slineno="0-20"/>service position;
        </hl>
      </hl>
      <hl numlevel="1" lineno="21" slineno="0-21" level="1">clarifies the process for an agency's demotion or dismissal of a career service employee;</hl>
      <hl numlevel="1" lineno="22" slineno="0-22" level="1">clarifies language regarding compensation for overtime and an employee's regular  
        <ln numlevel="1" lineno="23" slineno="0-23"/>hourly wage; and
      </hl>
      <hl numlevel="1" lineno="24" slineno="0-24" level="1">makes technical and conforming changes.  </hl>

        <subsection ssid="1-1" numlevel="1" lineno="44" slineno="1-4" dnum="1-o">
          <display>(1)</display>"Agency" means any department or unit of Utah state government with authority to  
          <ln numlevel="1" lineno="45" slineno="1-5"/>employ personnel.
        </subsection>
        <subsection ssid="1-2" numlevel="1" lineno="46" slineno="1-6" dnum="2-o">
          <display>(2)</display>"Career service" means positions under schedule B as defined in Section  
          <xref depth="3" refnumber="63A-17-301">63A-17-301</xref>.
        </subsection>
        <subsection ssid="1-3" numlevel="1" lineno="47" slineno="1-7" dnum="3-o">
          <display>(3)</display>"Career service employee" means an employee who has successfully completed a  
          <ln numlevel="1" lineno="48" slineno="1-8"/>probationary period of service in a position covered by the career service.
        </subsection>
        <subsection ssid="1-4" numlevel="1" lineno="49" slineno="1-9" dnum="4-o">
          <display>(4)</display>"Career service status" means status granted to employees who successfully complete  
          <ln numlevel="1" lineno="50" slineno="1-10"/>probationary periods for competitive career service positions.
        </subsection>
        <subsection ssid="1-5" numlevel="1" lineno="51" slineno="1-11" dnum="5-o">
          <display>(5)</display>"Classified service" means those positions subject to the classification and  
          <ln numlevel="1" lineno="52" slineno="1-12"/>compensation provisions of Section  
          <xref depth="3" refnumber="63A-17-307">63A-17-307</xref>.
        </subsection>
        <subsection ssid="1-6" numlevel="1" lineno="53" slineno="1-13" dnum="6-o">
          <display>(6)</display>"Controlled substance" means controlled substance as defined in Section  
          <xref depth="3" refnumber="58-37-2">58-37-2</xref>.
        </subsection>
        <subsection ssid="1-7" numlevel="1" lineno="54" slineno="1-14" dnum="7-o" space="false">
          <display>(7)</display>
          <subsection ssid="1-8" dnum="a-o" placement="sameline">
            <display>(a)</display>"Demotion" means a disciplinary action resulting in a reduction of an employee's 
            <ln numlevel="1" lineno="55" slineno="1-15"/>current actual wage.
          </subsection>
          <subsection ssid="1-9" numlevel="1" lineno="56" slineno="1-16" dnum="b-o">
            <display>(b)</display>"Demotion" does not mean:
            <subsection ssid="1-10" numlevel="1" lineno="57" slineno="1-17" dnum="i-o">
              <display>(i)</display>a nondisciplinary movement of an employee to another position without a 
              <ln numlevel="1" lineno="58" slineno="1-18"/>reduction in the current actual wage; or
            </subsection>
            <subsection ssid="1-11" numlevel="1" lineno="59" slineno="1-19" dnum="ii-o">
              <display>(ii)</display>a reclassification of an employee's position under the provisions of Subsection 
              <xref depth="3" refnumber="63A-17-307">
                <ln numlevel="1" lineno="60" slineno="1-20"/>63A-17-307
              </xref>(3) and rules made by the department.
            </subsection>
          </subsection>
        </subsection>
        <subsection ssid="1-12" numlevel="1" lineno="61" slineno="1-21" dnum="8-o">
          <display>(8)</display>"Director" means the director of the division.
        </subsection>
        <subsection ssid="1-13" numlevel="1" lineno="62" slineno="1-22" dnum="9-o">
          <display>(9)</display>"Disability" means a physical or mental disability as defined and protected under the  
          <ln numlevel="1" lineno="63" slineno="1-23"/>Americans with Disabilities Act, 42 U.S.C. Section 12101 et seq.
        </subsection>
        <subsection ssid="1-14" numlevel="1" lineno="64" slineno="1-24" dnum="10-o">
          <display>(10)</display>"Division" means the Division of Human Resource Management, created in Section  
          <xref depth="3" refnumber="63A-17-105">
            <ln numlevel="1" lineno="65" slineno="1-25"/>63A-17-105
          </xref>.
        </subsection>
        <subsection ssid="1-15" numlevel="1" lineno="66" slineno="1-26" dnum="11-o">
          <display>(11)</display>"Employee" means any individual in a paid status covered by the career service or  
          <ln numlevel="1" lineno="67" slineno="1-27"/>classified service provisions of this chapter.
        </subsection>
        <subsection ssid="1-16" numlevel="1" lineno="68" slineno="1-28" dnum="12-o">
          <display>(12)</display>"Examining instruments" means written or other types of proficiency tests.
        </subsection>
        <subsection ssid="1-17" numlevel="1" lineno="69" slineno="1-29" dnum="13-o">
          <display>(13)</display>"Human resource function" means those duties and responsibilities specified:
          <subsection ssid="1-18" numlevel="1" lineno="70" slineno="1-30" dnum="a-o">
            <display>(a)</display>under Section  
            <xref depth="3" refnumber="63A-17-106">63A-17-106</xref>;
          </subsection>
          <subsection ssid="1-19" numlevel="1" lineno="71" slineno="1-31" dnum="b-o">
            <display>(b)</display>under rules of the division; and
          </subsection>
          <subsection ssid="1-20" numlevel="1" lineno="72" slineno="1-32" dnum="c-o">
            <display>(c)</display>under other state or federal statute.
          </subsection>
        </subsection>
        <subsection ssid="1-21" numlevel="1" lineno="73" slineno="1-33" dnum="14-o">
          <display>(14)</display>"Market comparability adjustment" means a salary range adjustment determined  
          <ln numlevel="1" lineno="74" slineno="1-34"/>necessary through a market survey of salary data and other relevant information.
        </subsection>
        <subsection ssid="1-22" numlevel="1" lineno="75" slineno="1-35" dnum="15-o">
          <display>(15)</display>"Probationary employee" means an employee serving a probationary period in a career  
          <ln numlevel="1" lineno="76" slineno="1-36"/>service position but who does not have career service status.
        </subsection>
        <subsection ssid="1-23" numlevel="1" lineno="77" slineno="1-37" dnum="16-o">
          <display>(16)</display>"Probationary period" means that period of time determined by the division that an  
          <ln numlevel="1" lineno="78" slineno="1-38"/>employee serves in a career service position as part of the hiring process before career  
          <ln numlevel="1" lineno="79" slineno="1-39"/>service status is granted to the employee.
        </subsection>
        <subsection ssid="1-24" numlevel="1" lineno="80" slineno="1-40" dnum="17-o">
          <display>(17)</display>"Probationary status" means the status of an employee between the employee's hiring  
          <ln numlevel="1" lineno="81" slineno="1-41"/>and the granting of career service status.
        </subsection>
        <subsection ssid="1-25" numlevel="1" lineno="82" slineno="1-42" dnum="18-o">
          <display>(18)</display>"Structure adjustment" means a division modification of salary ranges.
        </subsection>
        <subsection ssid="1-26" numlevel="1" lineno="83" slineno="1-43" dnum="19-o">
          <display>(19)</display>"Temporary employee" means

          <display>(20)</display>"Total compensation" means salaries and wages, bonuses, paid leave, group insurance  
          <ln numlevel="1" lineno="86" slineno="1-46"/>plans, retirement, and all other benefits offered to state employees as inducements to  
          <ln numlevel="1" lineno="87" slineno="1-47"/>work for the state.
        </subsection>

          <bold>63A-17-106</bold> is amended to read:
        </secline>

          <bold>63A-17-106. Responsibilities of the director.</bold>
        </catline>
        <subsection ssid="3-1" numlevel="1" lineno="101" slineno="3-3" dnum="1-o" placement="noreturn">
          <display>(1)</display>As used in this section, "miscarriage" means the spontaneous or accidental loss of a  
          <ln numlevel="1" lineno="102" slineno="3-4"/>fetus, regardless of gestational age or the duration of the pregnancy.
        </subsection>
        <subsection ssid="3-2" numlevel="1" lineno="103" slineno="3-5" dnum="2-o">
          <display>(2)</display>The director shall have full responsibility and accountability for the administration of  
          <ln numlevel="1" lineno="104" slineno="3-6"/>the statewide human resource management system.
        </subsection>
        <subsection ssid="3-3" numlevel="1" lineno="105" slineno="3-7" dnum="3-o">
          <display>(3)</display>Except as provided in Section  
          <xref depth="3" refnumber="63A-17-201">63A-17-201</xref>, an agency may not perform human resource  
          <ln numlevel="1" lineno="106" slineno="3-8"/>functions without the consent of the director.
        </subsection>
        <subsection ssid="3-4" numlevel="1" lineno="107" slineno="3-9" dnum="4-o">
          <display>(4)</display>Statewide human resource management rules made by the division in accordance with  
          <ln numlevel="1" lineno="108" slineno="3-10"/>Title 63G, Chapter 3, Utah Administrative Rulemaking Act, shall take precedence if  
          <ln numlevel="1" lineno="109" slineno="3-11"/>there is a conflict with agency rules, policies, or practices.
        </subsection>

          <display>(5)</display>The division may operate as an internal service fund agency in accordance with Section  
          <xref depth="3" refnumber="63J-1-410">
            <ln numlevel="1" lineno="111" slineno="3-13"/>63J-1-410
          </xref> for the human resource functions the division provides.
        </subsection>
        <subsection ssid="3-6" numlevel="1" lineno="112" slineno="3-14" dnum="6-o">
          <display>(6)</display>The director shall:
          <subsection ssid="3-7" numlevel="1" lineno="113" slineno="3-15" dnum="a-o">
            <display>(a)</display>develop, implement, and administer a statewide program of human resource  
            <ln numlevel="1" lineno="114" slineno="3-16"/>management that will:
            <subsection ssid="3-8" numlevel="1" lineno="115" slineno="3-17" dnum="i-o">
              <display>(i)</display>aid in the efficient execution of public policy;
            </subsection>
            <subsection ssid="3-9" numlevel="1" lineno="116" slineno="3-18" dnum="ii-o">
              <display>(ii)</display>foster careers in public service for qualified employees; and
            </subsection>
            <subsection ssid="3-10" numlevel="1" lineno="117" slineno="3-19" dnum="iii-o">
              <display>(iii)</display>render assistance to state agencies in performing their missions;
            </subsection>
          </subsection>
          <subsection ssid="3-11" numlevel="1" lineno="118" slineno="3-20" dnum="b-o">
            <display>(b)</display>design and administer the state pay plan;
          </subsection>
          <subsection ssid="3-12" numlevel="1" lineno="119" slineno="3-21" dnum="c-o">
            <display>(c)</display>design and administer the state classification system and procedures for determining  
            <ln numlevel="1" lineno="120" slineno="3-22"/>schedule assignments;
          </subsection>
          <subsection ssid="3-13" numlevel="1" lineno="121" slineno="3-23" dnum="d-o">
            <display>(d)</display>design and administer the state recruitment and selection system;
          </subsection>
          <subsection ssid="3-14" numlevel="1" lineno="122" slineno="3-24" dnum="e-o">
            <display>(e)</display>administer agency human resource practices and ensure compliance with federal law,  
            <ln numlevel="1" lineno="123" slineno="3-25"/>state law, and state human resource rules, including equal employment opportunity;
          </subsection>
          <subsection ssid="3-15" numlevel="1" lineno="124" slineno="3-26" dnum="f-o">
            <display>(f)</display>consult with agencies on decisions concerning employee corrective action and  
            <ln numlevel="1" lineno="125" slineno="3-27"/>discipline;
          </subsection>
          <subsection ssid="3-16" numlevel="1" lineno="126" slineno="3-28" dnum="g-o">
            <display>(g)</display>maintain central personnel records;
          </subsection>
          <subsection ssid="3-17" numlevel="1" lineno="127" slineno="3-29" dnum="h-o">
            <display>(h)</display>perform those functions necessary to implement this chapter unless otherwise  
            <ln numlevel="1" lineno="128" slineno="3-30"/>assigned or prohibited;
          </subsection>
          <subsection ssid="3-18" numlevel="1" lineno="129" slineno="3-31" dnum="i-o">
            <display>(i)</display>perform duties assigned by the governor, executive director, or statute;
          </subsection>
          <subsection ssid="3-19" numlevel="1" lineno="130" slineno="3-32" dnum="j-o">
            <display>(j)</display>make rules for human resource management, in accordance with Title 63G, Chapter  
            <ln numlevel="1" lineno="131" slineno="3-33"/>3, Utah Administrative Rulemaking Act;
          </subsection>
          <subsection ssid="3-20" numlevel="1" lineno="132" slineno="3-34" dnum="k-o">
            <display>(k)</display>establish and maintain a management information system that will furnish the  
            <ln numlevel="1" lineno="133" slineno="3-35"/>governor, the Legislature, and agencies with current information on authorized  
            <ln numlevel="1" lineno="134" slineno="3-36"/>positions, payroll, and related matters concerning state human resources;
          </subsection>
          <subsection ssid="3-21" numlevel="1" lineno="135" slineno="3-37" dnum="l-o">
            <display>(l)</display>conduct research and planning activities to:
            <subsection ssid="3-22" numlevel="1" lineno="136" slineno="3-38" dnum="i-o">
              <display>(i)</display>determine and prepare for future state human resource needs;
            </subsection>
            <subsection ssid="3-23" numlevel="1" lineno="137" slineno="3-39" dnum="ii-o">
              <display>(ii)</display>develop methods for improving public human resource management; and
            </subsection>
            <subsection ssid="3-24" numlevel="1" lineno="138" slineno="3-40" dnum="iii-o">
              <display>(iii)</display>propose needed policy changes to the governor;
            </subsection>
          </subsection>
          <subsection ssid="3-25" numlevel="1" lineno="139" slineno="3-41" dnum="m-o">
            <display>(m)</display>study the character, causes, and extent of discrimination in state employment and  
            <ln numlevel="1" lineno="140" slineno="3-42"/>develop plans for its elimination through programs consistent with federal and state  
            <ln numlevel="1" lineno="141" slineno="3-43"/>laws governing equal employment opportunity in employment;
          </subsection>
          <subsection ssid="3-26" ea="erase" anum="0" owner="mcipriano" style="2" numlevel="1" lineno="142" slineno="3-44" dnum="n-o:_-e">
            <display>

              <ln numlevel="1" lineno="144" slineno="3-46"/>advice on human resource management at a charge determined by the director;

            </display>submit an annual report to the executive director, the governor, and the

          </subsection>

            <display>

            </display>assist with the development of a vacant position report required under  
            <ln numlevel="1" lineno="151" slineno="3-53"/>Subsection  
            <xref depth="3" refnumber="63J-1-201">63J-1-201</xref>(2)(b)(vi).
          </subsection>
        </subsection>
        <subsection ssid="3-31" numlevel="1" lineno="152" slineno="3-54" dnum="7-o" space="false">
          <display>(7)</display>
          <subsection ssid="3-32" dnum="a-o" placement="sameline">
            <display>(a)</display>After consultation with the executive director, the governor, and the heads of 
            <ln numlevel="1" lineno="153" slineno="3-55"/>other agencies, the director shall establish and coordinate statewide training 
            <ln numlevel="1" lineno="154" slineno="3-56"/>programs, including training described in Subsection (7)(e).
          </subsection>
          <subsection ssid="3-33" numlevel="1" lineno="155" slineno="3-57" dnum="b-o">
            <display>(b)</display>The programs developed under this Subsection (7) shall have application to more 
            <ln numlevel="1" lineno="156" slineno="3-58"/>than one agency.
          </subsection>
          <subsection ssid="3-34" numlevel="1" lineno="157" slineno="3-59" dnum="c-o">
            <display>(c)</display>The division may not establish training programs that train employees to perform 
            <ln numlevel="1" lineno="158" slineno="3-60"/>highly specialized or technical jobs and tasks.
          </subsection>
          <subsection ssid="3-35" numlevel="1" lineno="159" slineno="3-61" dnum="d-o">
            <display>(d)</display>The division shall ensure that any training program described in this Subsection (7) 
            <ln numlevel="1" lineno="160" slineno="3-62"/>complies with Title 63G, Chapter 22, State Training and Certification Requirements.
          </subsection>
          <subsection ssid="3-36" numlevel="1" lineno="161" slineno="3-63" dnum="e-o" space="false">
            <display>(e)</display>
            <subsection ssid="3-37" dnum="i-o" placement="sameline">
              <display>(i)</display>As used in this Subsection (7)(e):
              <subsection ssid="3-38" numlevel="1" lineno="162" slineno="3-64" dnum="A-o" tab="1">
                <display>(A)</display>"Employee" means the same as that term is defined in Section 
                <xref depth="3" refnumber="63A-17-112">63A-17-112</xref>.
              </subsection>
              <subsection ssid="3-39" numlevel="1" lineno="163" slineno="3-65" dnum="B-o" tab="1">
                <display>(B)</display>"Supervisor" means an individual in a position at an agency, as defined in 
                <ln numlevel="1" lineno="164" slineno="3-66"/>Section 
                <xref depth="3" refnumber="63A-17-112">63A-17-112</xref>, that requires the regular supervision and performance 
                <ln numlevel="1" lineno="165" slineno="3-67"/>evaluation of an employee.
              </subsection>
            </subsection>
            <subsection ssid="3-40" numlevel="1" lineno="166" slineno="3-68" dnum="ii-o">
              <display>(ii)</display>A supervisor shall attend the training:
              <subsection ssid="3-41" numlevel="1" lineno="167" slineno="3-69" dnum="A-o">
                <display>(A)</display>within six months of being promoted or hired to the position of supervisor; and
              </subsection>
              <subsection ssid="3-42" numlevel="1" lineno="168" slineno="3-70" dnum="B-o">
                <display>(B)</display>at least annually.
              </subsection>
            </subsection>
            <subsection ssid="3-43" numlevel="1" lineno="169" slineno="3-71" dnum="iii-o">
              <display>(iii)</display>
              <amendoutstart style="5"/>
              <amend anum="0" ea="erase" pairid="4" style="2" owner="mcipriano" level="1" deltag="both">Training attendance and the</amend>
              <amendoutend style="5"/>
              <amend anum="0" ea="amend" pairid="5" style="1" owner="mcipriano" level="1" amendtag="both" space="true">A supervisor's completion of training and</amend> effective 
              <ln numlevel="1" lineno="170" slineno="3-72"/>use of training information and principles shall be considered in an evaluation of 
              <amendoutstart style="5"/>
              <amend anum="0" ea="erase" pairid="6" style="2" owner="mcipriano" level="1" deltag="both">a</amend>
              <amendoutend style="5"/>
              <amend anum="0" ea="amend" pairid="7" style="1" owner="mcipriano" level="1" amendtag="both" space="true">
                <ln numlevel="1" lineno="171" slineno="3-73"/>the
              </amend> supervisor's job performance.
            </subsection>
            <subsection ssid="3-44" numlevel="1" lineno="172" slineno="3-74" dnum="iv-o">
              <display>(iv)</display>The training shall include:
              <subsection ssid="3-45" numlevel="1" lineno="173" slineno="3-75" dnum="A-o">
                <display>(A)</display>effective employee management and evaluation methods based on the pay for 
                <ln numlevel="1" lineno="174" slineno="3-76"/>performance management system described in Section 
                <xref depth="3" refnumber="63A-17-112">63A-17-112</xref>;
              </subsection>
              <subsection ssid="3-46" numlevel="1" lineno="175" slineno="3-77" dnum="B-o">
                <display>(B)</display>instruction to improve supervisor and employee communications;
              </subsection>
              <subsection ssid="3-47" numlevel="1" lineno="176" slineno="3-78" dnum="C-o">
                <display>(C)</display>best practices for recognizing and retaining high-performing employees;
              </subsection>
              <subsection ssid="3-48" numlevel="1" lineno="177" slineno="3-79" dnum="D-o">
                <display>(D)</display>best practices for addressing poor-performing employees; and
              </subsection>
              <subsection ssid="3-49" numlevel="1" lineno="178" slineno="3-80" dnum="E-o">
                <display>(E)</display>any other information and principles identified by the division to improve 
                <ln numlevel="1" lineno="179" slineno="3-81"/>management or organizational effectiveness.
              </subsection>
            </subsection>
          </subsection>
        </subsection>
        <subsection ssid="3-50" numlevel="1" lineno="180" slineno="3-82" dnum="8-o" space="false">
          <display>(8)</display>
          <subsection ssid="3-51" dnum="a-o" placement="sameline" space="false">
            <display>(a)</display>
            <subsection ssid="3-52" dnum="i-o" tab="1" placement="sameline">
              <display>(i)</display>The division may collect fees for training as authorized by this Subsection 
              <ln numlevel="1" lineno="181" slineno="3-83"/>(8).
            </subsection>
            <subsection ssid="3-53" numlevel="1" lineno="182" slineno="3-84" dnum="ii-o" tab="1">
              <display>(ii)</display>Training funded from General Fund appropriations shall be treated as a separate 
              <ln numlevel="1" lineno="183" slineno="3-85"/>program within the department budget.
            </subsection>
            <subsection ssid="3-54" numlevel="1" lineno="184" slineno="3-86" dnum="iii-o" tab="1">
              <display>(iii)</display>All money received from fees under this section will be accounted for by the 
              <ln numlevel="1" lineno="185" slineno="3-87"/>department as a separate user driven training program.
            </subsection>
            <subsection ssid="3-55" numlevel="1" lineno="186" slineno="3-88" dnum="iv-o" tab="1">
              <display>(iv)</display>The user training program includes the costs of developing, procuring, and 
              <ln numlevel="1" lineno="187" slineno="3-89"/>presenting training and development programs, and other associated costs for 
              <ln numlevel="1" lineno="188" slineno="3-90"/>these programs.
            </subsection>
          </subsection>
          <subsection ssid="3-56" numlevel="1" lineno="189" slineno="3-91" dnum="b-o" space="false">
            <display>(b)</display>
            <subsection ssid="3-57" dnum="i-o" placement="sameline">
              <display>(i)</display>Funds remaining at the end of the fiscal year in the user training program are 
              <ln numlevel="1" lineno="190" slineno="3-92"/>nonlapsing.
            </subsection>
            <subsection ssid="3-58" numlevel="1" lineno="191" slineno="3-93" dnum="ii-o">
              <display>(ii)</display>Each year, as part of the appropriations process, the Legislature shall review the 
              <ln numlevel="1" lineno="192" slineno="3-94"/>amount of nonlapsing funds remaining at the end of the fiscal year and may, by 
              <ln numlevel="1" lineno="193" slineno="3-95"/>statute, require the department to lapse a portion of the funds.
            </subsection>
          </subsection>
        </subsection>
        <subsection ssid="3-59" numlevel="1" lineno="194" slineno="3-96" dnum="9-o">
          <display>(9)</display>Rules described in Subsection (6)(j) shall provide for at least three work days of paid  
          <ln numlevel="1" lineno="195" slineno="3-97"/>bereavement leave for an employee:
          <subsection ssid="3-60" numlevel="1" lineno="196" slineno="3-98" dnum="a-o">
            <display>(a)</display>following the end of the employee's pregnancy by way of miscarriage or stillbirth; or
          </subsection>
          <subsection ssid="3-61" numlevel="1" lineno="197" slineno="3-99" dnum="b-o">
            <display>(b)</display>following the end of another individual's pregnancy by way of a miscarriage or  
            <ln numlevel="1" lineno="198" slineno="3-100"/>stillbirth, if:
            <subsection ssid="3-62" numlevel="1" lineno="199" slineno="3-101" dnum="i-o">
              <display>(i)</display>the employee is the individual's spouse or partner;
            </subsection>
            <subsection ssid="3-63" numlevel="1" lineno="200" slineno="3-102" dnum="ii-o" space="false">
              <display>(ii)</display>
              <subsection ssid="3-64" dnum="A-o" placement="sameline">
                <display>(A)</display>the employee is the individual's former spouse or partner; and
              </subsection>
              <subsection ssid="3-65" numlevel="1" lineno="201" slineno="3-103" dnum="B-o">
                <display>(B)</display>the employee would have been a biological parent of a child born as a result of 
                <ln numlevel="1" lineno="202" slineno="3-104"/>the pregnancy;
              </subsection>
            </subsection>

              <display>(iii)</display>the employee provides documentation to show that the individual intended for  
              <ln numlevel="1" lineno="204" slineno="3-106"/>the employee to be an adoptive parent, as that term is defined in Section  
              <xref depth="3" refnumber="78B-6-103">
                <ln numlevel="1" lineno="205" slineno="3-107"/>78B-6-103
              </xref>, of a child born as a result of the pregnancy; or
            </subsection>
            <subsection ssid="3-67" numlevel="1" lineno="206" slineno="3-108" dnum="iv-o">
              <display>(iv)</display>under a valid gestational agreement in accordance with Title 78B, Chapter 15,  
              <ln numlevel="1" lineno="207" slineno="3-109"/>Part 8, Gestational Agreement, the employee would have been a parent of a child  
              <ln numlevel="1" lineno="208" slineno="3-110"/>born as a result of the pregnancy.
            </subsection>
          </subsection>

            <amend anum="0" ea="amend" pairid="18" style="1" owner="mcipriano" level="1" amendtag="both"> and</amend> measurement procedures are in place
            <amendoutstart style="5"/>
            <amend anum="0" ea="erase" pairid="16" style="2" owner="mcipriano" level="1" deltag="both">
              <ln numlevel="1" lineno="231" slineno="4-23"/>, and specific incentives are provided when goals and targets are met
            </amend>
            <amendoutend style="5"/>.
          </subsection>
          <subsection ssid="4-12" dnum="d-o" numlevel="1" lineno="232" slineno="4-24">
            <display>(d)</display>"Pay for performance management system" means the system described in  
            <ln numlevel="1" lineno="233" slineno="4-25"/>Subsection (2).
          </subsection>
        </subsection>
        <subsection ssid="4-13" dnum="2-o" numlevel="1" lineno="234" slineno="4-26">
          <display>(2)</display>The division shall establish and, in accordance with Title 63G, Chapter 3, Utah  
          <ln numlevel="1" lineno="235" slineno="4-27"/>Administrative Rulemaking Act, make rules for the administration of a pay for  
          <ln numlevel="1" lineno="236" slineno="4-28"/>performance management system.
        </subsection>
        <subsection ssid="4-14" dnum="3-o" numlevel="1" lineno="237" slineno="4-29">
          <display>(3)</display>The pay for performance management system shall include:
          <subsection ssid="4-15" dnum="a-o" numlevel="1" lineno="238" slineno="4-30">
            <display>(a)</display>guidelines and criteria for an agency to adopt pay for performance policies and  
            <ln numlevel="1" lineno="239" slineno="4-31"/>administer pay based on an employee's performance in furtherance of the agency's  
            <ln numlevel="1" lineno="240" slineno="4-32"/>mission;
          </subsection>
          <subsection ssid="4-16" dnum="b-o" numlevel="1" lineno="241" slineno="4-33">
            <display>(b)</display>employee performance ratings;
          </subsection>
          <subsection ssid="4-17" dnum="c-o" numlevel="1" lineno="242" slineno="4-34">
            <display>(c)</display>requirements for written employee performance standards and expectations;
          </subsection>
          <subsection ssid="4-18" dnum="d-o" numlevel="1" lineno="243" slineno="4-35">
            <display>(d)</display>supervisor verbal and written feedback based on the standards of performance and  
            <ln numlevel="1" lineno="244" slineno="4-36"/>behavior outlined in an employee's performance plan; and
          </subsection>
          <subsection ssid="4-19" dnum="e-o" numlevel="1" lineno="245" slineno="4-37">
            <display>(e)</display>quarterly written evaluation of an employee's performance.
          </subsection>
        </subsection>
        <subsection ssid="4-20" dnum="4-o" numlevel="1" lineno="246" slineno="4-38">
          <display>(4)</display>In consultation with the division, no later than July 1, 2023, each agency shall:
          <subsection ssid="4-21" dnum="a-o" numlevel="1" lineno="247" slineno="4-39">
            <display>(a)</display>adopt pay for performance policies based on the performance management system;  
            <ln numlevel="1" lineno="248" slineno="4-40"/>and
          </subsection>
          <subsection ssid="4-22" dnum="b-o" numlevel="1" lineno="249" slineno="4-41">
            <display>(b)</display>subject to available funds and as necessary, adjust an employee's wage to reflect:
            <subsection ssid="4-23" dnum="i-o" numlevel="1" lineno="250" slineno="4-42">
              <display>(i)</display>subject to Subsection (5), for a classified service employee, the salary range of the  
              <ln numlevel="1" lineno="251" slineno="4-43"/>position classified plan for the employee's position; and
            </subsection>
            <subsection ssid="4-24" dnum="ii-o" numlevel="1" lineno="252" slineno="4-44">
              <display>(ii)</display>an increase, decrease, or no change in the employee's wage:
              <subsection ssid="4-25" dnum="A-o" numlevel="1" lineno="253" slineno="4-45">
                <display>(A)</display>commensurate to an employee's performance as reflected by the employee's  
                <ln numlevel="1" lineno="254" slineno="4-46"/>evaluation conducted in accordance with the pay for performance management  
                <ln numlevel="1" lineno="255" slineno="4-47"/>system; and
              </subsection>
              <subsection ssid="4-26" dnum="B-o" numlevel="1" lineno="256" slineno="4-48">
                <display>(B)</display>in an amount that is in accordance with the guidelines and criteria established  
                <ln numlevel="1" lineno="257" slineno="4-49"/>for a wage change in the pay for performance management system.
              </subsection>
            </subsection>
          </subsection>
        </subsection>
        <subsection ssid="4-27" dnum="5-o" numlevel="1" lineno="258" slineno="4-50">
          <display>(5)</display>In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the  
          <ln numlevel="1" lineno="259" slineno="4-51"/>division shall make rules authorizing a classified service employee to receive a wage  
          <ln numlevel="1" lineno="260" slineno="4-52"/>that exceeds the salary range of the classified service employee's position classified plan  
          <ln numlevel="1" lineno="261" slineno="4-53"/>if warranted based on the classified employee's performance rating.
        </subsection>

            <ln numlevel="1" lineno="282" slineno="5-21"/>Board of Education designates as exempt from the career service provisions of this  
            <ln numlevel="1" lineno="283" slineno="5-22"/>chapter;
          </subsection>
          <subsection ssid="5-13" dnum="f-o" numlevel="1" lineno="284" slineno="5-23">
            <display>(f)</display>schedule AG includes employees in the Office of the Attorney General who are under  
            <ln numlevel="1" lineno="285" slineno="5-24"/>their own career service pay plan under Sections  
            <xref depth="3" refnumber="67-5-7">67-5-7</xref> through  
            <xref depth="3" refnumber="67-5-13">67-5-13</xref>;
          </subsection>
          <subsection ssid="5-14" dnum="g-o" numlevel="1" lineno="286" slineno="5-25">
            <display>(g)</display>schedule AH includes:
            <subsection ssid="5-15" dnum="i-o" numlevel="1" lineno="287" slineno="5-26">
              <display>(i)</display>teaching staff of all state institutions; and
            </subsection>

            </subsection>
            <subsection ssid="5-24" dnum="ii-o" numlevel="1" lineno="297" slineno="5-36">
              <display>(ii)</display>a water commissioner appointed under Section  
              <xref depth="3" refnumber="73-5-1">73-5-1</xref>;
            </subsection>
            <subsection ssid="5-25" dnum="iii-o" numlevel="1" lineno="298" slineno="5-37">
              <display>(iii)</display>other local officials serving in an ex officio capacity; and
            </subsection>
            <subsection ssid="5-26" dnum="iv-o" numlevel="1" lineno="299" slineno="5-38">
              <display>(iv)</display>officers, faculty, and other employees of state universities and other state  
              <ln numlevel="1" lineno="300" slineno="5-39"/>institutions of higher education;
            </subsection>
          </subsection>
          <subsection ssid="5-27" dnum="l-o" numlevel="1" lineno="301" slineno="5-40">
            <display>(l)</display>schedule AR includes employees in positions that involve responsibility:
            <subsection ssid="5-28" dnum="i-o" numlevel="1" lineno="302" slineno="5-41">
              <display>(i)</display>for determining policy;
            </subsection>
            <subsection ssid="5-29" dnum="ii-o" numlevel="1" lineno="303" slineno="5-42">
              <display>(ii)</display>for determining the way in which a policy is carried out; or
            </subsection>
            <subsection ssid="5-30" dnum="iii-o" numlevel="1" lineno="304" slineno="5-43">
              <display>(iii)</display>of a type not appropriate for career service, as determined by the agency head  
              <ln numlevel="1" lineno="305" slineno="5-44"/>with the concurrence of the director;
            </subsection>
          </subsection>
          <subsection ssid="5-31" dnum="m-o" numlevel="1" lineno="306" slineno="5-45">
            <display>(m)</display>schedule AS includes any other employee:
            <subsection ssid="5-32" dnum="i-o" numlevel="1" lineno="307" slineno="5-46">
              <display>(i)</display>whose appointment is required by statute to be career service exempt;
            </subsection>
            <subsection ssid="5-33" dnum="ii-o" numlevel="1" lineno="308" slineno="5-47">
              <display>(ii)</display>whose agency is not subject to this chapter; or
            </subsection>
            <subsection ssid="5-34" dnum="iii-o" numlevel="1" lineno="309" slineno="5-48">
              <display>(iii)</display>whose agency has authority to make rules regarding the performance,  
              <ln numlevel="1" lineno="310" slineno="5-49"/>compensation, and bonuses for its employees;
            </subsection>
          </subsection>
          <subsection ssid="5-35" dnum="n-o" numlevel="1" lineno="311" slineno="5-50">
            <display>(n)</display>schedule AT includes employees of the Division of Technology Services, designated  
            <ln numlevel="1" lineno="312" slineno="5-51"/>as executive/professional positions by the director of the Division of Technology  
            <ln numlevel="1" lineno="313" slineno="5-52"/>Services with the concurrence of the director of the division;
          </subsection>
          <subsection ssid="5-36" dnum="o-o" numlevel="1" lineno="314" slineno="5-53">
            <display>(o)</display>schedule AU includes patients and inmates employed in state institutions;
          </subsection>
          <subsection ssid="5-37" dnum="p-o" numlevel="1" lineno="315" slineno="5-54">
            <display>(p)</display>employees of the Department of Workforce Services, designated as schedule AW:
            <subsection ssid="5-38" dnum="i-o" numlevel="1" lineno="316" slineno="5-55">
              <display>(i)</display>who are temporary employees that are federally funded and are required to work  
              <ln numlevel="1" lineno="317" slineno="5-56"/>under federally qualified merit principles as certified by the director; or
            </subsection>
            <subsection ssid="5-39" dnum="ii-o" numlevel="1" lineno="318" slineno="5-57">
              <display>(ii)</display>for whom substantially all of their work is repetitive, measurable, or transaction  
              <ln numlevel="1" lineno="319" slineno="5-58"/>based, and who voluntarily apply for and are accepted by the Department of  
              <ln numlevel="1" lineno="320" slineno="5-59"/>Workforce Services to work in a pay for performance program designed by the  
              <ln numlevel="1" lineno="321" slineno="5-60"/>Department of Workforce Services with the concurrence of the director of the  
              <ln numlevel="1" lineno="322" slineno="5-61"/>division;
            </subsection>
          </subsection>
          <subsection ssid="5-40" dnum="q-o" numlevel="1" lineno="323" slineno="5-62">
            <display>(q)</display>subject to Subsection (6), schedule AX includes employees in positions that:
            <subsection ssid="5-41" dnum="i-o" numlevel="1" lineno="324" slineno="5-63">
              <display>(i)</display>require the regular supervision and performance evaluation of one or more other  
              <ln numlevel="1" lineno="325" slineno="5-64"/>employees; and
            </subsection>
            <subsection ssid="5-42" dnum="ii-o" numlevel="1" lineno="326" slineno="5-65">
              <display>(ii)</display>are not designated exempt from career service under any other schedule described  
              <ln numlevel="1" lineno="327" slineno="5-66"/>in this Subsection (1); and
            </subsection>
          </subsection>
          <subsection ssid="5-43" dnum="r-o" numlevel="1" lineno="328" slineno="5-67">
            <display>(r)</display>for employees in positions that are temporary, seasonal, time limited, funding limited,  
            <ln numlevel="1" lineno="329" slineno="5-68"/>or variable hour in nature, under schedule codes and parameters established by the  
            <ln numlevel="1" lineno="330" slineno="5-69"/>division by administrative rule.
          </subsection>
        </subsection>
        <subsection ssid="5-44" dnum="2-o" numlevel="1" lineno="331" slineno="5-70">
          <display>(2)</display>The civil service shall consist of two schedules as follows:
          <subsection ssid="5-45" dnum="a-o" numlevel="1" lineno="332" slineno="5-71" space="false">
            <display>(a)</display>
            <subsection ssid="5-46" dnum="i-o" placement="sameline">
              <display>(i)</display>Schedule A is the schedule consisting of positions under Subsection (1).
            </subsection>
            <subsection ssid="5-47" dnum="ii-o" numlevel="1" lineno="333" slineno="5-72">
              <display>(ii)</display>Removal from any appointive position under schedule A, unless otherwise 
              <ln numlevel="1" lineno="334" slineno="5-73"/>regulated by statute, is at the pleasure of the appointing officers without regard to 
              <ln numlevel="1" lineno="335" slineno="5-74"/>tenure.
            </subsection>
          </subsection>
          <subsection ssid="5-48" dnum="b-o" numlevel="1" lineno="336" slineno="5-75">
            <display>(b)</display>Schedule B is the competitive career service schedule, consisting of:
            <subsection ssid="5-49" dnum="i-o" numlevel="1" lineno="337" slineno="5-76">
              <display>(i)</display>all positions filled through competitive selection procedures as defined by the  
              <ln numlevel="1" lineno="338" slineno="5-77"/>director; or
            </subsection>
            <subsection ssid="5-50" dnum="ii-o" numlevel="1" lineno="339" slineno="5-78">
              <display>(ii)</display>positions filled through a division approved on-the-job examination intended to  
              <ln numlevel="1" lineno="340" slineno="5-79"/>appoint a qualified person with a disability, or a veteran in accordance with Title  
              <ln numlevel="1" lineno="341" slineno="5-80"/>71A, Chapter 2, Veterans Preference.
            </subsection>
          </subsection>
        </subsection>
        <subsection ssid="5-51" dnum="3-o" numlevel="1" lineno="342" slineno="5-81" space="false">
          <display>(3)</display>
          <subsection ssid="5-52" dnum="a-o" placement="sameline">
            <display>(a)</display>The director, after consultation with the heads of concerned executive branch 
            <ln numlevel="1" lineno="343" slineno="5-82"/>departments and agencies and with the approval of the governor, shall allocate 
            <ln numlevel="1" lineno="344" slineno="5-83"/>positions to the appropriate schedules under this section.
          </subsection>
          <subsection ssid="5-53" dnum="b-o" numlevel="1" lineno="345" slineno="5-84">
            <display>(b)</display>Agency heads shall make requests and obtain approval from the director before 
            <ln numlevel="1" lineno="346" slineno="5-85"/>changing the schedule assignment and tenure rights of any position.
          </subsection>
          <subsection ssid="5-54" dnum="c-o" numlevel="1" lineno="347" slineno="5-86">
            <display>(c)</display>Unless the director's decision is reversed by the governor, when the director denies 
            <ln numlevel="1" lineno="348" slineno="5-87"/>an agency's request, the director's decision is final.
          </subsection>
          <subsection ssid="5-55" dnum="d-o" numlevel="1" lineno="349" slineno="5-88" space="false">
            <display>(d)</display>
            <subsection ssid="5-56" dnum="i-o" placement="sameline">
              <display>(i)</display>An agency may file 
              <amendoutstart style="5"/>
              <amend anum="0" ea="erase" pairid="1" style="2" owner="mcipriano" level="1" deltag="both">with the division a request</amend>
              <amendoutend style="5"/>

                <amend anum="0" ea="amend" pairid="8" style="1" owner="mcipriano" level="1" amendtag="both" space="true">is</amend> scheduled as a schedule A 
                <ln numlevel="1" lineno="353" slineno="5-92"/>position
                <amend anum="0" ea="amend" pairid="9" style="1" owner="mcipriano" level="1" amendtag="both">as a schedule B position</amend>.
              </subsection>
            </subsection>
            <subsection ssid="5-59" dnum="ii-o" numlevel="1" lineno="354" slineno="5-93">
              <display>(ii)</display>The division shall review a request filed under Subsection (3)(d)(i) and approve 
              <ln numlevel="1" lineno="355" slineno="5-94"/>the request only if the exception is necessary to conform to a requirement imposed 
              <ln numlevel="1" lineno="356" slineno="5-95"/>as a condition precedent to receipt of federal funds or grant of a tax benefit under 
              <ln numlevel="1" lineno="357" slineno="5-96"/>federal law.
            </subsection>
          </subsection>
        </subsection>
        <subsection ssid="5-60" dnum="4-o" numlevel="1" lineno="358" slineno="5-97" space="false">
          <display>(4)</display>
          <subsection ssid="5-61" dnum="a-o" placement="sameline">
            <display>(a)</display>Compensation for employees of the Legislature shall be established by the 
            <ln numlevel="1" lineno="359" slineno="5-98"/>directors of the legislative offices in accordance with Section 
            <xref depth="3" refnumber="36-12-7">36-12-7</xref>.
          </subsection>
          <subsection ssid="5-62" dnum="b-o" numlevel="1" lineno="360" slineno="5-99">
            <display>(b)</display>Compensation for employees of the judiciary shall be established by the state court 
            <ln numlevel="1" lineno="361" slineno="5-100"/>administrator in accordance with Section 
            <xref depth="3" refnumber="78A-2-107">78A-2-107</xref>.
          </subsection>
          <subsection ssid="5-63" dnum="c-o" numlevel="1" lineno="362" slineno="5-101">
            <display>(c)</display>Compensation for officers, faculty, and other employees of state universities and 
            <ln numlevel="1" lineno="363" slineno="5-102"/>institutions of higher education shall be established as provided in Title 53B, Chapter 
            <ln numlevel="1" lineno="364" slineno="5-103"/>1, Governance, Powers, Rights, and Responsibilities, and Title 53B, Chapter 2, 
            <ln numlevel="1" lineno="365" slineno="5-104"/>Institutions of Higher Education.
          </subsection>
          <subsection ssid="5-64" dnum="d-o" numlevel="1" lineno="366" slineno="5-105">
            <display>(d)</display>Unless otherwise provided by law, compensation for all other schedule A employees 
            <ln numlevel="1" lineno="367" slineno="5-106"/>shall be established by their appointing authorities, within ranges approved by, and 
            <ln numlevel="1" lineno="368" slineno="5-107"/>after consultation with the director.
          </subsection>
        </subsection>
        <subsection ssid="5-65" dnum="5-o" numlevel="1" lineno="369" slineno="5-108">
          <display>(5)</display>An employee who is in a position designated schedule AC and who holds career service  
          <ln numlevel="1" lineno="370" slineno="5-109"/>status on June 30, 2010, shall retain the career service status if the employee:

            <display>(a)</display>remains in the position that the employee is in on June 30, 2010; and
          </subsection>

            <display>(b)</display>does not elect to convert to career service exempt status in accordance with a rule  
            <ln numlevel="1" lineno="373" slineno="5-112"/>made by the division.
          </subsection>
        </subsection>
        <subsection ssid="5-68" dnum="6-o" numlevel="1" lineno="374" slineno="5-113" space="false">
          <display>(6)</display>
          <subsection ssid="5-69" dnum="a-o" placement="sameline">
            <display>(a)</display>An employee who is hired for a schedule AX position on or after July 1, 2022, is 
            <ln numlevel="1" lineno="375" slineno="5-114"/>exempt from career service status.
          </subsection>
          <subsection ssid="5-70" dnum="b-o" numlevel="1" lineno="376" slineno="5-115">
            <display>(b)</display>An employee who before July 1, 2022, is a career service employee employed in a 
            <ln numlevel="1" lineno="377" slineno="5-116"/>schedule B position that is rescheduled to a schedule AX position on July 1, 2022, 
            <ln numlevel="1" lineno="378" slineno="5-117"/>shall maintain the employee's career service status for the duration of the employee's 
            <ln numlevel="1" lineno="379" slineno="5-118"/>employment in the same position unless the employee voluntarily converts to career 
            <ln numlevel="1" lineno="380" slineno="5-119"/>service exempt status before July 1, 2023.
          </subsection>
          <subsection ssid="5-71" dnum="c-o" numlevel="1" lineno="381" slineno="5-120" space="false">
            <display>(c)</display>
            <subsection ssid="5-72" dnum="i-o" placement="sameline">
              <display>(i)</display>Subject to Subsection (6)(c)(ii), an employee is exempt from career service 
              <ln numlevel="1" lineno="382" slineno="5-121"/>status if:
              <subsection ssid="5-73" dnum="A-o" numlevel="1" lineno="383" slineno="5-122" tab="1">
                <display>(A)</display>before July 1, 2022, the employee was a probationary employee in a schedule 
                <ln numlevel="1" lineno="384" slineno="5-123"/>B position and had not completed the probationary period; and
              </subsection>
              <subsection ssid="5-74" dnum="B-o" numlevel="1" lineno="385" slineno="5-124" tab="1">
                <display>(B)</display>on July 1, 2022, the schedule B position in which the probationary employee 
                <ln numlevel="1" lineno="386" slineno="5-125"/>is employed is rescheduled as a scheduled AX position.
              </subsection>
            </subsection>
            <subsection ssid="5-75" dnum="ii-o" numlevel="1" lineno="387" slineno="5-126">
              <display>(ii)</display>An employee described in Subsection (6)(c)(i):
              <subsection ssid="5-76" dnum="A-o" numlevel="1" lineno="388" slineno="5-127">
                <display>(A)</display>is not a probationary employee on or after July 1, 2022; and
              </subsection>
              <subsection ssid="5-77" dnum="B-o" numlevel="1" lineno="389" slineno="5-128">
                <display>(B)</display>is exempt from career service status on and after July 1, 2022, unless the 
                <ln numlevel="1" lineno="390" slineno="5-129"/>employee changes employment to a schedule B position.
              </subsection>
            </subsection>
          </subsection>
          <subsection ssid="5-78" dnum="d-o" numlevel="1" lineno="391" slineno="5-130">
            <display>(d)</display>The division shall disseminate to each employee described in Subsection (6)(b) 
            <ln numlevel="1" lineno="392" slineno="5-131"/>information on financial and other incentives for voluntary conversion to 
            <ln numlevel="1" lineno="393" slineno="5-132"/>career-service exempt status.
          </subsection>
          <subsection ssid="5-79" dnum="e-o" numlevel="1" lineno="394" slineno="5-133">
            <display>(e)</display>An agency, as defined in Section 
            <xref depth="3" refnumber="63A-17-112">63A-17-112</xref>, may adopt a policy, created in 
            <ln numlevel="1" lineno="395" slineno="5-134"/>consultation with the division, for agency review of recommendations that schedule 
            <ln numlevel="1" lineno="396" slineno="5-135"/>AX employees be suspended, demoted, or dismissed from employment.
          </subsection>
        </subsection>

            <display>(b)</display>An agency may not set an employee's salary:
            <subsection ssid="6-4" numlevel="1" lineno="403" slineno="6-7" dnum="i-o">
              <display>(i)</display>higher than the maximum in the new salary range; or
            </subsection>
            <subsection ssid="6-5" numlevel="1" lineno="404" slineno="6-8" dnum="ii-o">
              <display>(ii)</display>lower than the minimum in the new salary range of the position.
            </subsection>
          </subsection>
        </subsection>
        <subsection ssid="6-6" numlevel="1" lineno="405" slineno="6-9" dnum="2-o">
          <display>(2)</display>An agency shall adjust the salary range for an employee whose salary range is approved  
          <ln numlevel="1" lineno="406" slineno="6-10"/>by the Legislature for a market comparability adjustment consistent with Subsection

          <display>(6)</display>
          <subsection ssid="7-14" dnum="a-o" placement="sameline">
            <display>(a)</display>Reductions in force required by inadequate funds, change of workload, or lack of 
            <ln numlevel="1" lineno="450" slineno="7-36"/>work are governed by retention points established by the director.
          </subsection>
          <subsection ssid="7-15" numlevel="1" lineno="451" slineno="7-37" dnum="b-o">
            <display>(b)</display>Under those circumstances:
            <subsection ssid="7-16" numlevel="1" lineno="452" slineno="7-38" dnum="i-o">
              <display>(i)</display>The agency head shall designate the category of work to be eliminated, subject to 
              <ln numlevel="1" lineno="453" slineno="7-39"/>review by the director.
            </subsection>
            <subsection ssid="7-17" numlevel="1" lineno="454" slineno="7-40" dnum="ii-o">
              <display>(ii)</display>Temporary and probationary employees shall be separated before any career 
              <ln numlevel="1" lineno="455" slineno="7-41"/>service employee.
            </subsection>
            <subsection ssid="7-18" numlevel="1" lineno="456" slineno="7-42" dnum="iii-o" space="false">
              <display>(iii)</display>
              <subsection ssid="7-19" dnum="A-o" placement="sameline">
                <display>(A)</display>When more than one career service employee is affected, the employees 
                <ln numlevel="1" lineno="457" slineno="7-43"/>shall be separated in the order of their retention points, the employee with the 
                <ln numlevel="1" lineno="458" slineno="7-44"/>lowest points to be discharged first.
              </subsection>
              <subsection ssid="7-20" numlevel="1" lineno="459" slineno="7-45" dnum="B-o">
                <display>(B)</display>Retention points for each career service employee shall be computed 
                <ln numlevel="1" lineno="460" slineno="7-46"/>according to rules established by the director, allowing appropriate 
                <ln numlevel="1" lineno="461" slineno="7-47"/>consideration for proficiency and seniority in state government, including any 
                <ln numlevel="1" lineno="462" slineno="7-48"/>active duty military service fulfilled subsequent to original state appointment.
              </subsection>
            </subsection>
          </subsection>
          <subsection ssid="7-21" numlevel="1" lineno="463" slineno="7-49" dnum="c-o" space="false">
            <display>(c)</display>
            <subsection ssid="7-22" dnum="i-o" placement="sameline">
              <display>(i)</display>A career service employee who is separated in a reduction in force under this 
              <ln numlevel="1" lineno="464" slineno="7-50"/>section shall be given preferential consideration when applying for a career 
              <ln numlevel="1" lineno="465" slineno="7-51"/>service position.
            </subsection>
            <subsection ssid="7-23" numlevel="1" lineno="466" slineno="7-52" dnum="ii-o">
              <display>(ii)</display>Preferential consideration under Subsection (6)(c)(i) applies only until the former 
              <ln numlevel="1" lineno="467" slineno="7-53"/>career service employee accepts a career service position.
            </subsection>
            <subsection ssid="7-24" numlevel="1" lineno="468" slineno="7-54" dnum="iii-o">
              <display>(iii)</display>The director shall make rules in accordance with Title 63G, Chapter 3, Utah 
              <ln numlevel="1" lineno="469" slineno="7-55"/>Administrative Rulemaking Act, concerning the manner of granting preferential 
              <ln numlevel="1" lineno="470" slineno="7-56"/>consideration under Subsection (6)(c)(i).
            </subsection>
          </subsection>
          <subsection ssid="7-25" numlevel="1" lineno="471" slineno="7-57" dnum="d-o" space="false">
            <display>(d)</display>
            <subsection ssid="7-26" dnum="i-o" placement="sameline">
              <display>(i)</display>An employee separated due to a reduction in force may appeal to the 
              <ln numlevel="1" lineno="472" slineno="7-58"/>department head for an administrative review.
            </subsection>
            <subsection ssid="7-27" numlevel="1" lineno="473" slineno="7-59" dnum="ii-o">
              <display>(ii)</display>The notice of appeal must be submitted within 20 working days after the

            </subsection>

              <display>(iii)</display>The employee may appeal the decision of the department head according to the 
              <ln numlevel="1" lineno="476" slineno="7-62"/>grievance and appeals procedure of this chapter and Title 67, Chapter 19a,

        </catline>
        <subsection ssid="8-1" numlevel="1" lineno="480" slineno="8-3" dnum="1-o" placement="noreturn">
          <display>(1)</display>As used in this section:
          <subsection ssid="8-2" numlevel="1" lineno="481" slineno="8-4" dnum="a-o">
            <display>(a)</display>"Accrued overtime hours" means:
            <subsection ssid="8-3" numlevel="1" lineno="482" slineno="8-5" dnum="i-o">
              <display>(i)</display>for nonexempt employees, overtime hours earned during a fiscal year that, at the  
              <ln numlevel="1" lineno="483" slineno="8-6"/>end of the fiscal year, have not been paid and have not been taken as time off by  
              <ln numlevel="1" lineno="484" slineno="8-7"/>the nonexempt state employee who accrued them; and
            </subsection>
            <subsection ssid="8-4" numlevel="1" lineno="485" slineno="8-8" dnum="ii-o">
              <display>(ii)</display>for exempt employees, overtime hours earned during an overtime year.
            </subsection>
          </subsection>
          <subsection ssid="8-5" numlevel="1" lineno="486" slineno="8-9" dnum="b-o">
            <display>(b)</display>"Appointed official" means:
            <subsection ssid="8-6" numlevel="1" lineno="487" slineno="8-10" dnum="i-o">
              <display>(i)</display>each department executive director and deputy director, each division director, and  
              <ln numlevel="1" lineno="488" slineno="8-11"/>each member of a board or commission; and
            </subsection>
            <subsection ssid="8-7" numlevel="1" lineno="489" slineno="8-12" dnum="ii-o">
              <display>(ii)</display>any other person employed by a department who is appointed by, or whose  
              <ln numlevel="1" lineno="490" slineno="8-13"/>appointment is required by law to be approved by, the governor and who:
              <subsection ssid="8-8" numlevel="1" lineno="491" slineno="8-14" dnum="A-o">
                <display>(A)</display>is paid a salary by the state; and
              </subsection>
              <subsection ssid="8-9" numlevel="1" lineno="492" slineno="8-15" dnum="B-o">
                <display>(B)</display>who exercises managerial, policy-making, or advisory responsibility.
              </subsection>
            </subsection>
          </subsection>
          <subsection ssid="8-10" numlevel="1" lineno="493" slineno="8-16" dnum="c-o">
            <display>(c)</display>"Department" means the Department of Government Operations, the Department of  
            <ln numlevel="1" lineno="494" slineno="8-17"/>Corrections, the Department of Financial Institutions, the Department of Alcoholic  
            <ln numlevel="1" lineno="495" slineno="8-18"/>Beverage Services, the Insurance Department, the Public Service Commission, the  
            <ln numlevel="1" lineno="496" slineno="8-19"/>Labor Commission, the Department of Agriculture and Food, the Department of  
            <ln numlevel="1" lineno="497" slineno="8-20"/>Human Services, the Department of Natural Resources, the Department of  
            <ln numlevel="1" lineno="498" slineno="8-21"/>Transportation, the Department of Commerce, the Department of Workforce  
            <ln numlevel="1" lineno="499" slineno="8-22"/>Services, the State Tax Commission, the Department of Cultural and Community  
            <ln numlevel="1" lineno="500" slineno="8-23"/>Engagement, the Department of Health, the National Guard, the Department of  
            <ln numlevel="1" lineno="501" slineno="8-24"/>Environmental Quality, the Department of Public Safety, the Commission on  
            <ln numlevel="1" lineno="502" slineno="8-25"/>Criminal and Juvenile Justice, all merit employees except attorneys in the Office of  
            <ln numlevel="1" lineno="503" slineno="8-26"/>the Attorney General, merit employees in the Office of the State Treasurer, merit  
            <ln numlevel="1" lineno="504" slineno="8-27"/>employees in the Office of the State Auditor, Department of Veterans and Military  
            <ln numlevel="1" lineno="505" slineno="8-28"/>Affairs, and the Board of Pardons and Parole.
          </subsection>
          <subsection ssid="8-11" numlevel="1" lineno="506" slineno="8-29" dnum="d-o">
            <display>(d)</display>"Elected official" means any person who is an employee of the state because the  
            <ln numlevel="1" lineno="507" slineno="8-30"/>person was elected by the registered voters of Utah to a position in state government.
          </subsection>
          <subsection ssid="8-12" numlevel="1" lineno="508" slineno="8-31" dnum="e-o">
            <display>(e)</display>"Exempt employee" means a state employee who is exempt as defined by the Fair  
            <ln numlevel="1" lineno="509" slineno="8-32"/>Labor Standards Act of 1978, 29 U.S.C. Sec. 201 et seq.
          </subsection>
          <subsection ssid="8-13" numlevel="1" lineno="510" slineno="8-33" dnum="f-o">
            <display>(f)</display>"FLSA" means the Fair Labor Standards Act of 1978, 29 U.S.C. Sec. 201 et seq.
          </subsection>
          <subsection ssid="8-14" numlevel="1" lineno="511" slineno="8-34" dnum="g-o">
            <display>(g)</display>"FLSA agreement" means the agreement authorized by the Fair Labor Standards Act  
            <ln numlevel="1" lineno="512" slineno="8-35"/>of 1978, 29 U.S.C. Sec. 201 et seq., by which a nonexempt employee elects the form  
            <ln numlevel="1" lineno="513" slineno="8-36"/>of compensation the nonexempt employee will receive for overtime.
          </subsection>
          <subsection ssid="8-15" numlevel="1" lineno="514" slineno="8-37" dnum="h-o">
            <display>(h)</display>"Nonexempt employee" means a state employee who is nonexempt as defined by the  
            <ln numlevel="1" lineno="515" slineno="8-38"/>division applying FLSA requirements.
          </subsection>
          <subsection ssid="8-16" numlevel="1" lineno="516" slineno="8-39" dnum="i-o">
            <display>(i)</display>"Overtime" means actual time worked in excess of the employee's defined work  
            <ln numlevel="1" lineno="517" slineno="8-40"/>period.
          </subsection>
          <subsection ssid="8-17" numlevel="1" lineno="518" slineno="8-41" dnum="j-o">
            <display>(j)</display>"Overtime year" means the year determined by a department under Subsection (4)(b)  
            <ln numlevel="1" lineno="519" slineno="8-42"/>at the end of which an exempt employee's accrued overtime lapses.
          </subsection>
          <subsection ssid="8-18" numlevel="1" lineno="520" slineno="8-43" dnum="k-o">
            <display>(k)</display>"State employee" means every person employed by a department who is not:
            <subsection ssid="8-19" numlevel="1" lineno="521" slineno="8-44" dnum="i-o">
              <display>(i)</display>an appointed official;
            </subsection>
            <subsection ssid="8-20" numlevel="1" lineno="522" slineno="8-45" dnum="ii-o">
              <display>(ii)</display>an elected official; or
            </subsection>
            <subsection ssid="8-21" numlevel="1" lineno="523" slineno="8-46" dnum="iii-o">
              <display>(iii)</display>a member of a board or commission who is paid only for per diem or travel  
              <ln numlevel="1" lineno="524" slineno="8-47"/>expenses.
            </subsection>
          </subsection>
          <subsection ssid="8-22" numlevel="1" lineno="525" slineno="8-48" dnum="l-o">
            <display>(l)</display>"Uniform annual date" means the date when an exempt employee's accrued overtime  
            <ln numlevel="1" lineno="526" slineno="8-49"/>lapses.
          </subsection>
          <subsection ssid="8-23" numlevel="1" lineno="527" slineno="8-50" dnum="m-o">
            <display>(m)</display>"Work period" means:
            <subsection ssid="8-24" numlevel="1" lineno="528" slineno="8-51" dnum="i-o">
              <display>(i)</display>for all nonexempt employees, except law enforcement and hospital employees, a  
              <ln numlevel="1" lineno="529" slineno="8-52"/>consecutive seven day 24 hour work period of 40 hours;
            </subsection>
            <subsection ssid="8-25" numlevel="1" lineno="530" slineno="8-53" dnum="ii-o">
              <display>(ii)</display>for all exempt employees, a 14 day, 80 hour payroll cycle; and
            </subsection>
            <subsection ssid="8-26" numlevel="1" lineno="531" slineno="8-54" dnum="iii-o">
              <display>(iii)</display>for nonexempt law enforcement and hospital employees, the period established  
              <ln numlevel="1" lineno="532" slineno="8-55"/>by each department by rule for those employees according to the requirements of  
              <ln numlevel="1" lineno="533" slineno="8-56"/>the Fair Labor Standards Act of 1978, 29 U.S.C. Sec. 201 et seq.
            </subsection>
          </subsection>
        </subsection>
        <subsection ssid="8-27" numlevel="1" lineno="534" slineno="8-57" dnum="2-o">
          <display>(2)</display>Each department shall compensate each state employee who works overtime by  
          <ln numlevel="1" lineno="535" slineno="8-58"/>complying with the requirements of this section.
        </subsection>
        <subsection ssid="8-28" numlevel="1" lineno="536" slineno="8-59" dnum="3-o" space="false">
          <display>(3)</display>
          <subsection ssid="8-29" dnum="a-o" placement="sameline">
            <display>(a)</display>Each department shall negotiate and obtain a signed FLSA agreement from each 
            <ln numlevel="1" lineno="537" slineno="8-60"/>nonexempt employee.
          </subsection>
          <subsection ssid="8-30" numlevel="1" lineno="538" slineno="8-61" dnum="b-o">
            <display>(b)</display>In the FLSA agreement, the nonexempt employee shall elect either to be 
            <ln numlevel="1" lineno="539" slineno="8-62"/>compensated for overtime by:
            <subsection ssid="8-31" numlevel="1" lineno="540" slineno="8-63" dnum="i-o">
              <display>(i)</display>taking time off work at the rate of one and one-half hour off for each overtime 
              <ln numlevel="1" lineno="541" slineno="8-64"/>hour worked; or
            </subsection>
            <subsection ssid="8-32" numlevel="1" lineno="542" slineno="8-65" dnum="ii-o">
              <display>(ii)</display>being paid for the overtime worked at the rate of one and one-half times 
              <amendoutstart style="5"/>
              <amend anum="0" ea="erase" pairid="1" style="2" owner="mcipriano" level="1" deltag="both">the rate 
                <ln numlevel="1" lineno="543" slineno="8-66"/>per hour that the state employee receives for nonovertime work
              </amend>
              <amendoutend style="5"/>
              <amend anum="0" ea="amend" pairid="2" style="1" owner="mcipriano" level="1" amendtag="both" space="true">the employee's 
                <ln numlevel="1" lineno="544" slineno="8-67"/>regular hourly wage
              </amend>.
            </subsection>
          </subsection>
          <subsection ssid="8-33" numlevel="1" lineno="545" slineno="8-68" dnum="c-o">
            <display>(c)</display>Any nonexempt employee who elects to take time off under this Subsection (3) shall 
            <ln numlevel="1" lineno="546" slineno="8-69"/>be paid for any overtime worked in excess of the cap established by the division.
          </subsection>
          <subsection ssid="8-34" numlevel="1" lineno="547" slineno="8-70" dnum="d-o">
            <display>(d)</display>Before working any overtime, each nonexempt employee shall obtain authorization 
            <ln numlevel="1" lineno="548" slineno="8-71"/>to work overtime from the employee's immediate supervisor.
          </subsection>
          <subsection ssid="8-35" numlevel="1" lineno="549" slineno="8-72" dnum="e-o">
            <display>(e)</display>Each department shall:
            <subsection ssid="8-36" numlevel="1" lineno="550" slineno="8-73" dnum="i-o">
              <display>(i)</display>for employees who elect to be compensated with time off for overtime, allow 
              <ln numlevel="1" lineno="551" slineno="8-74"/>overtime earned during a fiscal year to be accumulated; and
            </subsection>
            <subsection ssid="8-37" numlevel="1" lineno="552" slineno="8-75" dnum="ii-o">
              <display>(ii)</display>for employees who elect to be paid for overtime worked, pay them for overtime 
              <ln numlevel="1" lineno="553" slineno="8-76"/>worked in the paycheck for the pay period in which the employee worked the 
              <ln numlevel="1" lineno="554" slineno="8-77"/>overtime.
            </subsection>
          </subsection>
          <subsection ssid="8-38" numlevel="1" lineno="555" slineno="8-78" dnum="f-o">
            <display>(f)</display>If a department pays a nonexempt employee for overtime, that department shall 
            <ln numlevel="1" lineno="556" slineno="8-79"/>charge that payment to that department's budget.
          </subsection>
          <subsection ssid="8-39" numlevel="1" lineno="557" slineno="8-80" dnum="g-o">
            <display>(g)</display>At the end of each fiscal year, the Division of Finance shall total all the accrued 
            <ln numlevel="1" lineno="558" slineno="8-81"/>overtime hours for nonexempt employees and charge that total against the 
            <ln numlevel="1" lineno="559" slineno="8-82"/>appropriate fund or subfund.
          </subsection>
        </subsection>
        <subsection ssid="8-40" numlevel="1" lineno="560" slineno="8-83" dnum="4-o" space="false">
          <display>(4)</display>
          <subsection ssid="8-41" dnum="a-o" placement="sameline" space="false">
            <display>(a)</display>
            <subsection ssid="8-42" dnum="i-o" tab="1" placement="sameline">
              <display>(i)</display>Except as provided in Subsection (4)(a)(ii), each department shall 
              <ln numlevel="1" lineno="561" slineno="8-84"/>compensate exempt employees who work overtime by granting them time off at 
              <ln numlevel="1" lineno="562" slineno="8-85"/>the rate of one hour off for each hour of overtime worked.
            </subsection>
            <subsection ssid="8-43" numlevel="1" lineno="563" slineno="8-86" dnum="ii-o" tab="1">
              <display>(ii)</display>The director of the division may grant limited exceptions to 
              <amendoutstart style="5"/>
              <amend anum="0" ea="erase" pairid="3" style="2" owner="mcipriano" level="1" deltag="both">this requirement</amend>
              <amendoutend style="5"/>
              <amend anum="0" ea="amend" pairid="4" style="1" owner="mcipriano" level="1" amendtag="both" space="true">the 
                <ln numlevel="1" lineno="564" slineno="8-87"/>compensation requirement described in Subsection (4)(a)(i)
              </amend>, where work 
              <ln numlevel="1" lineno="565" slineno="8-88"/>circumstances dictate, by authorizing a department to pay 
              <amendoutstart style="5"/>
              <amend anum="0" ea="erase" pairid="5" style="2" owner="mcipriano" level="1" deltag="both">employees</amend>
              <amendoutend style="5"/>
              <amend anum="0" ea="amend" pairid="6" style="1" owner="mcipriano" level="1" amendtag="both" space="true">an exempt 
                <ln numlevel="1" lineno="566" slineno="8-89"/>employee
              </amend> for overtime worked at the 
              <amendoutstart style="5"/>
              <amend anum="0" ea="erase" pairid="7" style="2" owner="mcipriano" level="1" deltag="both">rate per hour that the employee receives for 
                <ln numlevel="1" lineno="567" slineno="8-90"/>nonovertime work,
              </amend>
              <amendoutend style="5"/>
              <amend anum="0" ea="amend" pairid="8" style="1" owner="mcipriano" level="1" amendtag="both" space="true">employee's regular hourly wage</amend> if that department has funds 
              <ln numlevel="1" lineno="568" slineno="8-91"/>available.
            </subsection>
          </subsection>
          <subsection ssid="8-44" numlevel="1" lineno="569" slineno="8-92" dnum="b-o" space="false">
            <display>(b)</display>
            <subsection ssid="8-45" dnum="i-o" placement="sameline">
              <display>(i)</display>Each department shall:
              <subsection ssid="8-46" numlevel="1" lineno="570" slineno="8-93" dnum="A-o" tab="1">
                <display>(A)</display>establish in its written human resource policies a uniform annual date for each 
                <ln numlevel="1" lineno="571" slineno="8-94"/>division that is at the end of any pay period; and
              </subsection>
              <subsection ssid="8-47" numlevel="1" lineno="572" slineno="8-95" dnum="B-o" tab="1">
                <display>(B)</display>communicate the uniform annual date to its employees.
              </subsection>
            </subsection>
            <subsection ssid="8-48" numlevel="1" lineno="573" slineno="8-96" dnum="ii-o">
              <display>(ii)</display>If any department fails to establish a uniform annual date as required by this 
              <ln numlevel="1" lineno="574" slineno="8-97"/>Subsection (4), the director of the division, in conjunction with the director of the 
              <ln numlevel="1" lineno="575" slineno="8-98"/>Division of Finance, shall establish the date for that department.
            </subsection>
          </subsection>
          <subsection ssid="8-49" numlevel="1" lineno="576" slineno="8-99" dnum="c-o" space="false">
            <display>(c)</display>
            <subsection ssid="8-50" dnum="i-o" placement="sameline">
              <display>(i)</display>Any overtime earned under this Subsection (4) is not an entitlement, is not a 
              <ln numlevel="1" lineno="577" slineno="8-100"/>benefit, and is not a vested right.
            </subsection>
            <subsection ssid="8-51" numlevel="1" lineno="578" slineno="8-101" dnum="ii-o">
              <display>(ii)</display>A court may not construe the overtime for exempt employees authorized by this 
              <ln numlevel="1" lineno="579" slineno="8-102"/>Subsection (4) as an entitlement, a benefit, or as a vested right.
            </subsection>
          </subsection>
          <subsection ssid="8-52" numlevel="1" lineno="580" slineno="8-103" dnum="d-o">
            <display>(d)</display>At the end of the overtime year, upon transfer to another department at any time, and 
            <ln numlevel="1" lineno="581" slineno="8-104"/>upon termination, retirement, or other situations where the employee will not return 
            <ln numlevel="1" lineno="582" slineno="8-105"/>to work before the end of the overtime year:
            <subsection ssid="8-53" numlevel="1" lineno="583" slineno="8-106" dnum="i-o">
              <display>(i)</display>any of an exempt employee's overtime that is more than the maximum established 
              <ln numlevel="1" lineno="584" slineno="8-107"/>by division rule lapses; and
            </subsection>
            <subsection ssid="8-54" numlevel="1" lineno="585" slineno="8-108" dnum="ii-o">
              <display>(ii)</display>unless authorized by the director of the division under Subsection (4)(a)(ii), a 
              <ln numlevel="1" lineno="586" slineno="8-109"/>department may not compensate the exempt employee for that lapsed overtime by 
              <ln numlevel="1" lineno="587" slineno="8-110"/>paying the employee for the overtime or by granting the employee time off for the 
              <ln numlevel="1" lineno="588" slineno="8-111"/>lapsed overtime.
            </subsection>
          </subsection>
          <subsection ssid="8-55" numlevel="1" lineno="589" slineno="8-112" dnum="e-o">
            <display>(e)</display>Before working any overtime, each exempt employee shall obtain authorization to 
            <ln numlevel="1" lineno="590" slineno="8-113"/>work overtime from the exempt employee's immediate supervisor.
          </subsection>
          <subsection ssid="8-56" numlevel="1" lineno="591" slineno="8-114" dnum="f-o">
            <display>(f)</display>If a department pays an exempt employee for overtime under authorization from the 
            <ln numlevel="1" lineno="592" slineno="8-115"/>director of the division, that department shall charge that payment to that 
            <ln numlevel="1" lineno="593" slineno="8-116"/>department's budget in the pay period earned.
          </subsection>
        </subsection>
        <subsection ssid="8-57" numlevel="1" lineno="594" slineno="8-117" dnum="5-o">
          <display>(5)</display>The division shall:
          <subsection ssid="8-58" numlevel="1" lineno="595" slineno="8-118" dnum="a-o">
            <display>(a)</display>ensure that the provisions of the FLSA and this section are implemented throughout  
            <ln numlevel="1" lineno="596" slineno="8-119"/>state government;
          </subsection>
          <subsection ssid="8-59" numlevel="1" lineno="597" slineno="8-120" dnum="b-o">
            <display>(b)</display>determine, for each state employee, whether that employee is exempt, nonexempt,  
            <ln numlevel="1" lineno="598" slineno="8-121"/>law enforcement, or has some other status under the FLSA;
          </subsection>
          <subsection ssid="8-60" numlevel="1" lineno="599" slineno="8-122" dnum="c-o">
            <display>(c)</display>in coordination with modifications to the systems operated by the Division of  
            <ln numlevel="1" lineno="600" slineno="8-123"/>Finance, make rules:
            <subsection ssid="8-61" numlevel="1" lineno="601" slineno="8-124" dnum="i-o">
              <display>(i)</display>establishing procedures for recording overtime worked that comply with FLSA  
              <ln numlevel="1" lineno="602" slineno="8-125"/>requirements;
            </subsection>
            <subsection ssid="8-62" numlevel="1" lineno="603" slineno="8-126" dnum="ii-o">
              <display>(ii)</display>establishing requirements governing overtime worked while traveling and  
              <ln numlevel="1" lineno="604" slineno="8-127"/>procedures for recording that overtime that comply with FLSA requirements;
            </subsection>
            <subsection ssid="8-63" numlevel="1" lineno="605" slineno="8-128" dnum="iii-o">
              <display>(iii)</display>establishing requirements governing overtime worked if the employee is "on  
              <ln numlevel="1" lineno="606" slineno="8-129"/>call" and procedures for recording that overtime that comply with FLSA  
              <ln numlevel="1" lineno="607" slineno="8-130"/>requirements;
            </subsection>
            <subsection ssid="8-64" numlevel="1" lineno="608" slineno="8-131" dnum="iv-o">
              <display>(iv)</display>establishing requirements governing overtime worked while an employee is  
              <ln numlevel="1" lineno="609" slineno="8-132"/>being trained and procedures for recording that overtime that comply with FLSA  
              <ln numlevel="1" lineno="610" slineno="8-133"/>requirements;
            </subsection>
            <subsection ssid="8-65" numlevel="1" lineno="611" slineno="8-134" dnum="v-o">
              <display>(v)</display>subject to the FLSA, establishing the maximum number of hours that a  
              <ln numlevel="1" lineno="612" slineno="8-135"/>nonexempt employee may accrue before a department is required to pay the  
              <ln numlevel="1" lineno="613" slineno="8-136"/>employee for the overtime worked;
            </subsection>
            <subsection ssid="8-66" numlevel="1" lineno="614" slineno="8-137" dnum="vi-o">
              <display>(vi)</display>subject to the FLSA, establishing the maximum number of overtime hours for an  
              <ln numlevel="1" lineno="615" slineno="8-138"/>exempt employee that do not lapse; and
            </subsection>
            <subsection ssid="8-67" numlevel="1" lineno="616" slineno="8-139" dnum="vii-o">
              <display>(vii)</display>establishing procedures for adjudicating appeals of any FLSA determinations  
              <ln numlevel="1" lineno="617" slineno="8-140"/>made by the division as required by this section;
            </subsection>
          </subsection>
          <subsection ssid="8-68" numlevel="1" lineno="618" slineno="8-141" dnum="d-o">
            <display>(d)</display>monitor departments for compliance with the FLSA; and
          </subsection>
          <subsection ssid="8-69" numlevel="1" lineno="619" slineno="8-142" dnum="e-o">
            <display>(e)</display>recommend to the Legislature and the governor any statutory changes necessary  
            <ln numlevel="1" lineno="620" slineno="8-143"/>because of federal government action.
          </subsection>
        </subsection>
        <subsection ssid="8-70" numlevel="1" lineno="621" slineno="8-144" dnum="6-o" space="false">
          <display>(6)</display>
          <subsection ssid="8-71" dnum="a-o" placement="sameline">
            <display>(a)</display>In coordination with the procedures for recording overtime worked established in 
            <ln numlevel="1" lineno="622" slineno="8-145"/>rule by the division, the Division of Finance shall modify its payroll and human 
            <ln numlevel="1" lineno="623" slineno="8-146"/>resource systems to accommodate those procedures.
          </subsection>
          <subsection ssid="8-72" numlevel="1" lineno="624" slineno="8-147" dnum="b-o">
            <display>(b)</display>Notwithstanding the procedures and requirements of Title 63G, Chapter 4, 
            <ln numlevel="1" lineno="625" slineno="8-148"/>Administrative Procedures Act, Section 
            <xref depth="3" refnumber="63A-17-602">63A-17-602</xref>, and Section 
            <xref depth="3" refnumber="67-19a-301">67-19a-301</xref>, any 
            <ln numlevel="1" lineno="626" slineno="8-149"/>employee who is aggrieved by the FLSA designation made by the division as 
            <ln numlevel="1" lineno="627" slineno="8-150"/>required by this section may appeal that determination to the director of the division 
            <ln numlevel="1" lineno="628" slineno="8-151"/>by following the procedures and requirements established in division rule.
          </subsection>
          <subsection ssid="8-73" numlevel="1" lineno="629" slineno="8-152" dnum="c-o">
            <display>(c)</display>Upon receipt of an appeal under this section, the director shall notify the executive 
            <ln numlevel="1" lineno="630" slineno="8-153"/>director of the employee's department that the appeal has been filed.
          </subsection>
          <subsection ssid="8-74" numlevel="1" lineno="631" slineno="8-154" dnum="d-o">
            <display>(d)</display>If the employee is aggrieved by the decision of the director, the employee shall 
            <ln numlevel="1" lineno="632" slineno="8-155"/>appeal that determination to the Department of Labor, Wage and Hour Division, 
            <ln numlevel="1" lineno="633" slineno="8-156"/>according to the procedures and requirements of federal law.
          </subsection>
        </subsection>
