    <gdhead lineno="4">General Description:</gdhead>
    <gd numlevel="1" lineno="5" slineno="0-5">This bill establishes the Workforce Initiatives Fund within the Department of Workforce  
      <ln numlevel="1" lineno="6" slineno="0-6"/>Services (department).
    </gd>
    <hphead lineno="7">Highlighted Provisions:</hphead>
    <hp numlevel="1" lineno="8" slineno="0-8">This bill:
      <hl numlevel="1" lineno="9" slineno="0-9" level="1">defines terms;</hl>
      <hl numlevel="1" lineno="10" slineno="0-10" level="1">replaces the department's Special Administrative Expense Account with a special  
        <ln numlevel="1" lineno="11" slineno="0-11"/>revenue fund known as the Workforce Initiatives Fund, consisting of interest and penalties  
        <ln numlevel="1" lineno="12" slineno="0-12"/>collected by the department under the Employment Support Act;
      </hl>
      <hl numlevel="1" lineno="13" slineno="0-13" level="1">authorizes the department to use Workforce Initiatives Fund revenues for the  
        <ln numlevel="1" lineno="14" slineno="0-14"/>administration of the Utah Workforce Services Code and to cover the costs of the department's  
        <ln numlevel="1" lineno="15" slineno="0-15"/>workforce development programs; and

        <secline lineno="53">Section 1, Section  
          <bold>31A-38-104</bold> is amended to read:
        </secline>
        <catline lineno="54">
          <bold>31A-38-104. Authorization -- Money transferred for reserves.</bold>
        </catline>
        <subsection ssid="1-1" numlevel="1" lineno="55" slineno="1-3" dnum="1-o" placement="noreturn">
          <display>(1)</display>The Department of Workforce Services may:
          <subsection ssid="1-2" numlevel="1" lineno="56" slineno="1-4" dnum="a-o">
            <display>(a)</display>convert the bridge program to the state program through any of the following, or  
            <ln numlevel="1" lineno="57" slineno="1-5"/>combination of the following, that the Department of Workforce Services considers  
            <ln numlevel="1" lineno="58" slineno="1-6"/>best serves the needs of qualified participants:
            <subsection ssid="1-3" numlevel="1" lineno="59" slineno="1-7" dnum="i-o">
              <display>(i)</display>a contract with a licensed insurance company authorized to do business in the state;
            </subsection>
            <subsection ssid="1-4" numlevel="1" lineno="60" slineno="1-8" dnum="ii-o">
              <display>(ii)</display>through any other arrangement acceptable under the Trade Reform Act; or
            </subsection>
            <subsection ssid="1-5" numlevel="1" lineno="61" slineno="1-9" dnum="iii-o">
              <display>(iii)</display>a self-insurance program through a third party administrator as provided in  
              <ln numlevel="1" lineno="62" slineno="1-10"/>Subsection  
              <xref depth="3" refnumber="31A-38-103">31A-38-103</xref>(3)(b)(ii); and
            </subsection>
          </subsection>
          <subsection ssid="1-6" numlevel="1" lineno="63" slineno="1-11" dnum="b-o">
            <display>(b)</display>obligate up to $2,000,000 of the  
            <amendoutstart style="5"/>
            <amend anum="0" ea="erase" pairid="1" style="2" owner="bwalters" level="1" deltag="both">Special Administrative Expense Account</amend>
            <amendoutend style="5"/>

        </subsection>
        <subsection ssid="1-7" numlevel="1" lineno="66" slineno="1-14" dnum="2-o">
          <display>(2)</display>The money in Subsection (1)(b) may be used until the reserves in the state program  
          <ln numlevel="1" lineno="67" slineno="1-15"/>become adequate.
        </subsection>
      </section>

        <secline lineno="68">Section 2, Section  
          <bold>35A-4-305</bold> is amended to read:
        </secline>
        <catline lineno="69">
          <bold>35A-4-305. Collection of contributions -- Unpaid contributions to bear interest --  
            <ln numlevel="1" lineno="70" slineno="2-3"/>Offer to compromise.
          </bold>
        </catline>
        <subsection ssid="2-1" numlevel="1" lineno="71" slineno="2-4" dnum="1-o" placement="noreturn" space="false">
          <display>(1)</display>
          <subsection ssid="2-2" dnum="a-o" placement="sameline">
            <display>(a)</display>Contributions unpaid on the date on which they are due and payable, as 
            <ln numlevel="1" lineno="72" slineno="2-5"/>prescribed by the division, shall bear interest at the rate of 1% per month from and 
            <ln numlevel="1" lineno="73" slineno="2-6"/>after that date until payment plus accrued interest is received by the division.
          </subsection>
          <subsection ssid="2-3" numlevel="1" lineno="74" slineno="2-7" dnum="b-o" space="false">
            <display>(b)</display>
            <subsection ssid="2-4" dnum="i-o" placement="sameline">
              <display>(i)</display>Contribution reports not made and filed by the date on which they are due as 
              <ln numlevel="1" lineno="75" slineno="2-8"/>prescribed by the division are subject to a penalty to be assessed and collected in 
              <ln numlevel="1" lineno="76" slineno="2-9"/>the same manner as contributions due under this section equal to 5% of the 
              <ln numlevel="1" lineno="77" slineno="2-10"/>contribution due if the failure to file on time was not more than 15 days, with an 
              <ln numlevel="1" lineno="78" slineno="2-11"/>additional 5% for each additional 15 days or fraction thereof during which the 
              <ln numlevel="1" lineno="79" slineno="2-12"/>failure continued, but not to exceed 25% in the aggregate and not less than $25 
              <ln numlevel="1" lineno="80" slineno="2-13"/>with respect to each reporting period.
            </subsection>
            <subsection ssid="2-5" numlevel="1" lineno="81" slineno="2-14" dnum="ii-o">
              <display>(ii)</display>If a report is filed after the required time and it is shown to the satisfaction of the 
              <ln numlevel="1" lineno="82" slineno="2-15"/>division or its authorized representative that the failure to file was due to a 
              <ln numlevel="1" lineno="83" slineno="2-16"/>reasonable cause and not to willful neglect, no addition shall be made to the 
              <ln numlevel="1" lineno="84" slineno="2-17"/>contribution.
            </subsection>
          </subsection>
          <subsection ssid="2-6" numlevel="1" lineno="85" slineno="2-18" dnum="c-o" space="false">
            <display>(c)</display>
            <subsection ssid="2-7" dnum="i-o" placement="sameline">
              <display>(i)</display>If contributions are unpaid after 10 days from the date of the mailing or 
              <ln numlevel="1" lineno="86" slineno="2-19"/>personal delivery by the division or its authorized representative, of a written 
              <ln numlevel="1" lineno="87" slineno="2-20"/>demand for payment, there shall attach to the contribution, to be assessed and 
              <ln numlevel="1" lineno="88" slineno="2-21"/>collected in the same manner as contributions due under this section, a penalty 
              <ln numlevel="1" lineno="89" slineno="2-22"/>equal to 5% of the contribution due.
            </subsection>
            <subsection ssid="2-8" numlevel="1" lineno="90" slineno="2-23" dnum="ii-o">
              <display>(ii)</display>A penalty may not attach if within 10 days after the mailing or personal delivery, 
              <ln numlevel="1" lineno="91" slineno="2-24"/>arrangements for payment have been made with the division, or its authorized 
              <ln numlevel="1" lineno="92" slineno="2-25"/>representative, and payment is made in accordance with those arrangements.
            </subsection>
          </subsection>
          <subsection ssid="2-9" numlevel="1" lineno="93" slineno="2-26" dnum="d-o">
            <display>(d)</display>The division shall assess as a penalty a service charge, in addition to any other 
            <ln numlevel="1" lineno="94" slineno="2-27"/>penalties that may apply, in an amount not to exceed the service charge imposed by 
            <ln numlevel="1" lineno="95" slineno="2-28"/>Section 
            <xref depth="3" refnumber="7-15-1">7-15-1</xref> for dishonored instruments if:
            <subsection ssid="2-10" numlevel="1" lineno="96" slineno="2-29" dnum="i-o">
              <display>(i)</display>any amount due the division for contributions, interest, other penalties or benefit 
              <ln numlevel="1" lineno="97" slineno="2-30"/>overpayments is paid by check, draft, order, or other instrument; and
            </subsection>
            <subsection ssid="2-11" numlevel="1" lineno="98" slineno="2-31" dnum="ii-o">
              <display>(ii)</display>the instrument is dishonored or not paid by the institution against which it is 
              <ln numlevel="1" lineno="99" slineno="2-32"/>drawn.
            </subsection>
          </subsection>
          <subsection ssid="2-12" numlevel="1" lineno="100" slineno="2-33" dnum="e-o">
            <display>(e)</display>Except for benefit overpayments under Subsection 
            <xref depth="3" refnumber="35A-4-405">35A-4-405</xref>(5), benefit 
            <ln numlevel="1" lineno="101" slineno="2-34"/>overpayments, contributions, interest, penalties, and assessed costs, uncollected three 
            <ln numlevel="1" lineno="102" slineno="2-35"/>years after they become due, may be charged as uncollectible and removed from the 
            <ln numlevel="1" lineno="103" slineno="2-36"/>records of the division if:
            <subsection ssid="2-13" numlevel="1" lineno="104" slineno="2-37" dnum="i-o">
              <display>(i)</display>no assets belonging to the liable person and subject to attachment can be found; 
              <ln numlevel="1" lineno="105" slineno="2-38"/>and
            </subsection>
            <subsection ssid="2-14" numlevel="1" lineno="106" slineno="2-39" dnum="ii-o">
              <display>(ii)</display>in the opinion of the division there is no likelihood of collection at a future date.
            </subsection>
          </subsection>
          <subsection ssid="2-15" numlevel="1" lineno="107" slineno="2-40" dnum="f-o">
            <display>(f)</display>Interest and penalties collected in accordance with this section shall be 
            <amendoutstart style="5"/>
            <amend anum="0" ea="erase" pairid="1" style="2" owner="bwalters" level="1" deltag="both">paid</amend>
            <amendoutend style="5"/>
            <amend anum="0" ea="amend" pairid="2" style="1" owner="bwalters" level="1" amendtag="both" space="true">
              <ln numlevel="1" lineno="108" slineno="2-41"/>deposited
            </amend> into the 
            <amendoutstart style="5"/>
            <amend anum="0" ea="erase" pairid="3" style="2" owner="bwalters" level="1" deltag="both">Special Administrative Expense Account created by</amend>
            <amendoutend style="5"/>
            <amend anum="0" ea="amend" pairid="4" style="1" owner="bwalters" level="1" amendtag="both" space="true">Workforce 
              <ln numlevel="1" lineno="109" slineno="2-42"/>Initiatives Fund created in
            </amend> Section 
            <xref depth="3" refnumber="35A-4-506">35A-4-506</xref>.
          </subsection>
          <subsection ssid="2-16" numlevel="1" lineno="110" slineno="2-43" dnum="g-o">
            <display>(g)</display>Action required for the collection of sums due under this chapter is subject to the 
            <ln numlevel="1" lineno="111" slineno="2-44"/>applicable limitations of actions under Title 78B, Chapter 2, Statutes of Limitations.
          </subsection>
        </subsection>
        <subsection ssid="2-17" numlevel="1" lineno="112" slineno="2-45" dnum="2-o" space="false">
          <display>(2)</display>
          <subsection ssid="2-18" dnum="a-o" placement="sameline">
            <display>(a)</display>If an employer fails to file a report when prescribed by the division for the 
            <ln numlevel="1" lineno="113" slineno="2-46"/>purpose of determining the amount of the employer's contribution due under this 
            <ln numlevel="1" lineno="114" slineno="2-47"/>chapter, or if the report when filed is incorrect or insufficient or is not satisfactory to 
            <ln numlevel="1" lineno="115" slineno="2-48"/>the division, the division may determine the amount of wages paid for employment 
            <ln numlevel="1" lineno="116" slineno="2-49"/>during the period or periods with respect to which the reports were or should have 
            <ln numlevel="1" lineno="117" slineno="2-50"/>been made and the amount of contribution due from the employer on the basis of any 
            <ln numlevel="1" lineno="118" slineno="2-51"/>information it may be able to obtain.
          </subsection>
          <subsection ssid="2-19" numlevel="1" lineno="119" slineno="2-52" dnum="b-o">
            <display>(b)</display>The division shall give written notice of the determination to the employer.
          </subsection>
          <subsection ssid="2-20" numlevel="1" lineno="120" slineno="2-53" dnum="c-o">
            <display>(c)</display>The determination is considered correct unless:
            <subsection ssid="2-21" numlevel="1" lineno="121" slineno="2-54" dnum="i-o">
              <display>(i)</display>the employer, within 10 days after mailing or personal delivery of notice of the 
              <ln numlevel="1" lineno="122" slineno="2-55"/>determination, applies to the division for a review of the determination as 
              <ln numlevel="1" lineno="123" slineno="2-56"/>provided in Section 
              <xref depth="3" refnumber="35A-4-508">35A-4-508</xref>; or
            </subsection>
            <subsection ssid="2-22" numlevel="1" lineno="124" slineno="2-57" dnum="ii-o">
              <display>(ii)</display>unless the division or its authorized representative of its own motion reviews the 
              <ln numlevel="1" lineno="125" slineno="2-58"/>determination.
            </subsection>
          </subsection>
          <subsection ssid="2-23" numlevel="1" lineno="126" slineno="2-59" dnum="d-o">
            <display>(d)</display>The amount of contribution determined under Subsection (2)(a) is subject to 
            <ln numlevel="1" lineno="127" slineno="2-60"/>penalties and interest as provided in Subsection (1).
          </subsection>
        </subsection>
        <subsection ssid="2-24" numlevel="1" lineno="128" slineno="2-61" dnum="3-o" space="false">
          <display>(3)</display>
          <subsection ssid="2-25" dnum="a-o" placement="sameline">
            <display>(a)</display>If, after due notice, an employer defaults in the payment of contributions, interest, 
            <ln numlevel="1" lineno="129" slineno="2-62"/>or penalties on the contributions, or a claimant defaults in a repayment of benefit 
            <ln numlevel="1" lineno="130" slineno="2-63"/>overpayments and penalties on the overpayments, the amount due shall be collectible 
            <ln numlevel="1" lineno="131" slineno="2-64"/>by civil action in the name of the division, and the employer adjudged in default shall 
            <ln numlevel="1" lineno="132" slineno="2-65"/>pay the costs of the action.
          </subsection>
          <subsection ssid="2-26" numlevel="1" lineno="133" slineno="2-66" dnum="b-o">
            <display>(b)</display>Civil actions brought under this section to collect contributions, interest, or penalties 
            <ln numlevel="1" lineno="134" slineno="2-67"/>from an employer, or benefit overpayments and penalties from a claimant shall be:
            <subsection ssid="2-27" numlevel="1" lineno="135" slineno="2-68" dnum="i-o">
              <display>(i)</display>heard by the court at the earliest possible date; and
            </subsection>
            <subsection ssid="2-28" numlevel="1" lineno="136" slineno="2-69" dnum="ii-o">
              <display>(ii)</display>entitled to preference upon the calendar of the court over all other civil actions 
              <ln numlevel="1" lineno="137" slineno="2-70"/>except:
              <subsection ssid="2-29" numlevel="1" lineno="138" slineno="2-71" dnum="A-o">
                <display>(A)</display>petitions for judicial review under this chapter; and
              </subsection>
              <subsection ssid="2-30" numlevel="1" lineno="139" slineno="2-72" dnum="B-o">
                <display>(B)</display>cases arising under the workers' compensation law of this state.
              </subsection>
            </subsection>
          </subsection>
          <subsection ssid="2-31" numlevel="1" lineno="140" slineno="2-73" dnum="c-o" space="false">
            <display>(c)</display>
            <subsection ssid="2-32" dnum="i-o" placement="sameline" space="false">
              <display>(i)</display>
              <subsection ssid="2-33" dnum="A-o" tab="1" placement="sameline">
                <display>(A)</display>To collect contributions, interest, or penalties, or benefit overpayments 
                <ln numlevel="1" lineno="141" slineno="2-74"/>and penalties due from employers or claimants located outside Utah, the 
                <ln numlevel="1" lineno="142" slineno="2-75"/>division may employ private collectors providing debt collection services 
                <ln numlevel="1" lineno="143" slineno="2-76"/>outside Utah.
              </subsection>
              <subsection ssid="2-34" numlevel="1" lineno="144" slineno="2-77" dnum="B-o" tab="1">
                <display>(B)</display>Accounts may be placed with private collectors only after the employer or 
                <ln numlevel="1" lineno="145" slineno="2-78"/>claimant has been given a final notice that the division intends to place the 
                <ln numlevel="1" lineno="146" slineno="2-79"/>account with a private collector for further collection action.
              </subsection>
              <subsection ssid="2-35" numlevel="1" lineno="147" slineno="2-80" dnum="C-o" tab="1">
                <display>(C)</display>The notice shall advise the employer or claimant of the employer's or 
                <ln numlevel="1" lineno="148" slineno="2-81"/>claimant's rights under this chapter and the applicable rules of the department.
              </subsection>
            </subsection>
            <subsection ssid="2-36" numlevel="1" lineno="149" slineno="2-82" dnum="ii-o" space="false">
              <display>(ii)</display>
              <subsection ssid="2-37" dnum="A-o" placement="sameline">
                <display>(A)</display>A private collector may receive as compensation up to 25% of the lesser 
                <ln numlevel="1" lineno="150" slineno="2-83"/>of the amount collected or the amount due, plus the costs and fees of any civil 
                <ln numlevel="1" lineno="151" slineno="2-84"/>action or postjudgment remedy instituted by the private collector with the 
                <ln numlevel="1" lineno="152" slineno="2-85"/>approval of the division.
              </subsection>
              <subsection ssid="2-38" numlevel="1" lineno="153" slineno="2-86" dnum="B-o">
                <display>(B)</display>The employer or claimant shall be liable to pay the compensation of the 
                <ln numlevel="1" lineno="154" slineno="2-87"/>collector, costs, and fees in addition to the original amount due.
              </subsection>
            </subsection>
            <subsection ssid="2-39" numlevel="1" lineno="155" slineno="2-88" dnum="iii-o">
              <display>(iii)</display>A private collector is subject to the federal Fair Debt Collection Practices Act, 15 
              <ln numlevel="1" lineno="156" slineno="2-89"/>U.S.C. Sec. 1692 et seq.
            </subsection>
            <subsection ssid="2-40" numlevel="1" lineno="157" slineno="2-90" dnum="iv-o" space="false">
              <display>(iv)</display>
              <subsection ssid="2-41" dnum="A-o" placement="sameline">
                <display>(A)</display>A civil action may not be maintained by a private collector without 
                <ln numlevel="1" lineno="158" slineno="2-91"/>specific prior written approval of the division.
              </subsection>
              <subsection ssid="2-42" numlevel="1" lineno="159" slineno="2-92" dnum="B-o">
                <display>(B)</display>When division approval is given for civil action against an employer or 
                <ln numlevel="1" lineno="160" slineno="2-93"/>claimant, the division may cooperate with the private collector to the extent 
                <ln numlevel="1" lineno="161" slineno="2-94"/>necessary to effect the civil action.
              </subsection>
            </subsection>
          </subsection>
          <subsection ssid="2-43" numlevel="1" lineno="162" slineno="2-95" dnum="d-o" space="false">
            <display>(d)</display>
            <subsection ssid="2-44" dnum="i-o" placement="sameline">
              <display>(i)</display>Notwithstanding Section 
              <xref depth="3" refnumber="35A-4-312">35A-4-312</xref>, the division may disclose the 
              <ln numlevel="1" lineno="163" slineno="2-96"/>contribution, interest, penalties or benefit overpayments and penalties, costs due, 
              <ln numlevel="1" lineno="164" slineno="2-97"/>the name of the employer or claimant, and the employer's or claimant's address 
              <ln numlevel="1" lineno="165" slineno="2-98"/>and telephone number when any collection matter is referred to a private collector 
              <ln numlevel="1" lineno="166" slineno="2-99"/>under Subsection (3)(c).
            </subsection>
            <subsection ssid="2-45" numlevel="1" lineno="167" slineno="2-100" dnum="ii-o">
              <display>(ii)</display>A private collector is subject to the confidentiality requirements and penalty 
              <ln numlevel="1" lineno="168" slineno="2-101"/>provisions provided in Section 
              <xref depth="3" refnumber="35A-4-312">35A-4-312</xref> and Subsection 
              <xref depth="3" refnumber="76-8-1301">76-8-1301</xref>(4), except to 
              <ln numlevel="1" lineno="169" slineno="2-102"/>the extent disclosure is necessary in a civil action to enforce collection of the 
              <ln numlevel="1" lineno="170" slineno="2-103"/>amounts due.
            </subsection>
          </subsection>
          <subsection ssid="2-46" numlevel="1" lineno="171" slineno="2-104" dnum="e-o">
            <display>(e)</display>An action taken by the division under this section may not be construed to be an 
            <ln numlevel="1" lineno="172" slineno="2-105"/>election to forego other collection procedures by the division.
          </subsection>
        </subsection>
        <subsection ssid="2-47" numlevel="1" lineno="173" slineno="2-106" dnum="4-o" space="false">
          <display>(4)</display>
          <subsection ssid="2-48" dnum="a-o" placement="sameline">
            <display>(a)</display>In the event of a distribution of an employer's assets under an order of a court 
            <ln numlevel="1" lineno="174" slineno="2-107"/>under the laws of Utah, including a receivership, assignment for benefits of creditors, 
            <ln numlevel="1" lineno="175" slineno="2-108"/>adjudicated insolvency, composition, or similar proceedings, contributions then or 
            <ln numlevel="1" lineno="176" slineno="2-109"/>thereafter due shall be paid in full prior to all other claims except taxes and claims for 
            <ln numlevel="1" lineno="177" slineno="2-110"/>wages of not more than $400 to each claimant, earned within five months of the 
            <ln numlevel="1" lineno="178" slineno="2-111"/>commencement of the proceeding.
          </subsection>
          <subsection ssid="2-49" numlevel="1" lineno="179" slineno="2-112" dnum="b-o">
            <display>(b)</display>If an employer commences a proceeding in the Federal Bankruptcy Court under a 
            <ln numlevel="1" lineno="180" slineno="2-113"/>chapter of 11 U.S.C. 101 et seq., as amended by the Bankruptcy Abuse Prevention 
            <ln numlevel="1" lineno="181" slineno="2-114"/>and Consumer Protection Act of 2005, contributions, interest, and penalties then or 
            <ln numlevel="1" lineno="182" slineno="2-115"/>thereafter due shall be entitled to the priority provided for taxes, interest, and 
            <ln numlevel="1" lineno="183" slineno="2-116"/>penalties in the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005.
          </subsection>
        </subsection>
        <subsection ssid="2-50" numlevel="1" lineno="184" slineno="2-117" dnum="5-o" space="false">
          <display>(5)</display>
          <subsection ssid="2-51" dnum="a-o" placement="sameline">
            <display>(a)</display>In addition and as an alternative to any other remedy provided by this chapter and 
            <ln numlevel="1" lineno="185" slineno="2-118"/>provided that no appeal or other proceeding for review provided by this chapter is 
            <ln numlevel="1" lineno="186" slineno="2-119"/>then pending and the time for taking it has expired, the division may issue a warrant 
            <ln numlevel="1" lineno="187" slineno="2-120"/>in duplicate, under its official seal, directed to the sheriff of any county of the state, 
            <ln numlevel="1" lineno="188" slineno="2-121"/>commanding the sheriff to levy upon and sell the real and personal property of a 
            <ln numlevel="1" lineno="189" slineno="2-122"/>delinquent employer or claimant found within the sheriff's county for the payment of 
            <ln numlevel="1" lineno="190" slineno="2-123"/>the contributions due, with the added penalties, interest, or benefit overpayment and 
            <ln numlevel="1" lineno="191" slineno="2-124"/>penalties, and costs, and to return the warrant to the division and pay into the fund the 
            <ln numlevel="1" lineno="192" slineno="2-125"/>money collected by virtue of the warrant by a time to be specified in the warrant, not 
            <ln numlevel="1" lineno="193" slineno="2-126"/>more than 60 days from the date of the warrant.
          </subsection>
          <subsection ssid="2-52" numlevel="1" lineno="194" slineno="2-127" dnum="b-o" space="false">
            <display>(b)</display>
            <subsection ssid="2-53" dnum="i-o" placement="sameline">
              <display>(i)</display>Immediately upon receipt of the warrant in duplicate, the sheriff shall file the 
              <ln numlevel="1" lineno="195" slineno="2-128"/>duplicate with the clerk of the district court in the sheriff's county.
            </subsection>
            <subsection ssid="2-54" numlevel="1" lineno="196" slineno="2-129" dnum="ii-o">
              <display>(ii)</display>The clerk shall enter in the judgment docket, in the column for judgment debtors, 
              <ln numlevel="1" lineno="197" slineno="2-130"/>the name of the delinquent employer or claimant mentioned in the warrant, and in 
              <ln numlevel="1" lineno="198" slineno="2-131"/>appropriate columns the amount of the contribution, penalties, interest, or benefit 
              <ln numlevel="1" lineno="199" slineno="2-132"/>overpayment and penalties, and costs, for which the warrant is issued and the date 
              <ln numlevel="1" lineno="200" slineno="2-133"/>when the duplicate is filed.
            </subsection>
          </subsection>
          <subsection ssid="2-55" numlevel="1" lineno="201" slineno="2-134" dnum="c-o">
            <display>(c)</display>The amount of the docketed warrant shall:
            <subsection ssid="2-56" numlevel="1" lineno="202" slineno="2-135" dnum="i-o">
              <display>(i)</display>have the force and effect of an execution against all personal property of the 
              <ln numlevel="1" lineno="203" slineno="2-136"/>delinquent employer; and
            </subsection>
            <subsection ssid="2-57" numlevel="1" lineno="204" slineno="2-137" dnum="ii-o">
              <display>(ii)</display>become a lien upon the real property of the delinquent employer or claimant in 
              <ln numlevel="1" lineno="205" slineno="2-138"/>the same manner and to the same extent as a judgment duly rendered by a district 
              <ln numlevel="1" lineno="206" slineno="2-139"/>court and docketed in the office of the clerk.
            </subsection>
          </subsection>
          <subsection ssid="2-58" numlevel="1" lineno="207" slineno="2-140" dnum="d-o">
            <display>(d)</display>After docketing, the sheriff shall:
            <subsection ssid="2-59" numlevel="1" lineno="208" slineno="2-141" dnum="i-o">
              <display>(i)</display>proceed in the same manner as is prescribed by law with respect to execution 
              <ln numlevel="1" lineno="209" slineno="2-142"/>issued against property upon judgments of a court of record; and
            </subsection>
            <subsection ssid="2-60" numlevel="1" lineno="210" slineno="2-143" dnum="ii-o">
              <display>(ii)</display>be entitled to the same fees for the sheriff's services in executing the warrant, to 
              <ln numlevel="1" lineno="211" slineno="2-144"/>be collected in the same manner.
            </subsection>
          </subsection>
        </subsection>
        <subsection ssid="2-61" numlevel="1" lineno="212" slineno="2-145" dnum="6-o" space="false">
          <display>(6)</display>
          <subsection ssid="2-62" dnum="a-o" placement="sameline">
            <display>(a)</display>Contributions imposed by this chapter are a lien upon the property of an 
            <ln numlevel="1" lineno="213" slineno="2-146"/>employer liable for the contribution required to be collected under this section who 
            <ln numlevel="1" lineno="214" slineno="2-147"/>shall sell out the employer's business or stock of goods or shall quit business, if the 
            <ln numlevel="1" lineno="215" slineno="2-148"/>employer fails to make a final report and payment on the date subsequent to the date 
            <ln numlevel="1" lineno="216" slineno="2-149"/>of selling or quitting business on which they are due and payable as prescribed by 
            <ln numlevel="1" lineno="217" slineno="2-150"/>rule.
          </subsection>
          <subsection ssid="2-63" numlevel="1" lineno="218" slineno="2-151" dnum="b-o" space="false">
            <display>(b)</display>
            <subsection ssid="2-64" dnum="i-o" placement="sameline">
              <display>(i)</display>An employer's successor, successors, or assigns, if any, are required to 
              <ln numlevel="1" lineno="219" slineno="2-152"/>withhold sufficient of the purchase money to cover the amount of the 
              <ln numlevel="1" lineno="220" slineno="2-153"/>contributions and interest or penalties due and payable until the former owner 
              <ln numlevel="1" lineno="221" slineno="2-154"/>produces a receipt from the division showing that they have been paid or a 
              <ln numlevel="1" lineno="222" slineno="2-155"/>certificate stating that no amount is due.
            </subsection>
            <subsection ssid="2-65" numlevel="1" lineno="223" slineno="2-156" dnum="ii-o">
              <display>(ii)</display>If the purchaser of a business or stock of goods fails to withhold sufficient 
              <ln numlevel="1" lineno="224" slineno="2-157"/>purchase money, the purchaser is personally liable for the payment of the amount 
              <ln numlevel="1" lineno="225" slineno="2-158"/>of the contributions required to be paid by the former owner, interest and penalties 
              <ln numlevel="1" lineno="226" slineno="2-159"/>accrued and unpaid by the former owner, owners, or assignors.
            </subsection>
          </subsection>
        </subsection>
        <subsection ssid="2-66" numlevel="1" lineno="227" slineno="2-160" dnum="7-o" space="false">
          <display>(7)</display>
          <subsection ssid="2-67" dnum="a-o" placement="sameline">
            <display>(a)</display>If an employer is delinquent in the payment of a contribution, the division may 
            <ln numlevel="1" lineno="228" slineno="2-161"/>give notice of the amount of the delinquency by registered mail to all persons having 
            <ln numlevel="1" lineno="229" slineno="2-162"/>in their possession or under their control, any credits or other personal property 
            <ln numlevel="1" lineno="230" slineno="2-163"/>belonging to the employer, or owing any debts to the employer at the time of the 
            <ln numlevel="1" lineno="231" slineno="2-164"/>receipt by them of the notice.
          </subsection>
          <subsection ssid="2-68" numlevel="1" lineno="232" slineno="2-165" dnum="b-o">
            <display>(b)</display>A person notified under Subsection (7)(a) shall neither transfer nor make any other 
            <ln numlevel="1" lineno="233" slineno="2-166"/>disposition of the credits, other personal property, or debts until:
            <subsection ssid="2-69" numlevel="1" lineno="234" slineno="2-167" dnum="i-o">
              <display>(i)</display>the division has consented to a transfer or disposition; or
            </subsection>
            <subsection ssid="2-70" numlevel="1" lineno="235" slineno="2-168" dnum="ii-o">
              <display>(ii)</display>20 days after the receipt of the notice.
            </subsection>
          </subsection>
          <subsection ssid="2-71" numlevel="1" lineno="236" slineno="2-169" dnum="c-o">
            <display>(c)</display>All persons notified under Subsection (7)(a) shall, within five days after receipt of 
            <ln numlevel="1" lineno="237" slineno="2-170"/>the notice, advise the division of credits, other personal property, or other debts in 
            <ln numlevel="1" lineno="238" slineno="2-171"/>their possession, under their control or owing by them, as the case may be.
          </subsection>
        </subsection>
        <subsection ssid="2-72" numlevel="1" lineno="239" slineno="2-172" dnum="8-o" space="false">
          <display>(8)</display>
          <subsection ssid="2-73" dnum="a-o" placement="sameline" space="false">
            <display>(a)</display>
            <subsection ssid="2-74" dnum="i-o" tab="1" placement="sameline">
              <display>(i)</display>Each employer shall furnish the division necessary information for the 
              <ln numlevel="1" lineno="240" slineno="2-173"/>proper administration of this chapter and shall include wage information for each 
              <ln numlevel="1" lineno="241" slineno="2-174"/>employee, for each calendar quarter.
            </subsection>
            <subsection ssid="2-75" numlevel="1" lineno="242" slineno="2-175" dnum="ii-o" tab="1">
              <display>(ii)</display>The information shall be furnished at a time, in the form, and to those individuals 
              <ln numlevel="1" lineno="243" slineno="2-176"/>as the department may by rule require.
            </subsection>
          </subsection>
          <subsection ssid="2-76" numlevel="1" lineno="244" slineno="2-177" dnum="b-o" space="false">
            <display>(b)</display>
            <subsection ssid="2-77" dnum="i-o" placement="sameline">
              <display>(i)</display>Each employer shall furnish each individual worker who is separated that 
              <ln numlevel="1" lineno="245" slineno="2-178"/>information as the department may by rule require, and shall furnish within 48 
              <ln numlevel="1" lineno="246" slineno="2-179"/>hours of the receipt of a request from the division a report of the earnings of any 
              <ln numlevel="1" lineno="247" slineno="2-180"/>individual during the individual's base-period.
            </subsection>
            <subsection ssid="2-78" numlevel="1" lineno="248" slineno="2-181" dnum="ii-o">
              <display>(ii)</display>The report shall be on a form prescribed by the division and contain all 
              <ln numlevel="1" lineno="249" slineno="2-182"/>information prescribed by the division.
            </subsection>
          </subsection>
          <subsection ssid="2-79" numlevel="1" lineno="250" slineno="2-183" dnum="c-o" space="false">
            <display>(c)</display>
            <subsection ssid="2-80" dnum="i-o" placement="sameline">
              <display>(i)</display>For each failure by an employer to conform to this Subsection (8) the division 
              <ln numlevel="1" lineno="251" slineno="2-184"/>shall, unless good cause is shown, assess a $50 penalty if the filing was not more 
              <ln numlevel="1" lineno="252" slineno="2-185"/>than 15 days late.
            </subsection>
            <subsection ssid="2-81" numlevel="1" lineno="253" slineno="2-186" dnum="ii-o">
              <display>(ii)</display>If the filing is more than 15 days late, the division shall assess an additional 
              <ln numlevel="1" lineno="254" slineno="2-187"/>penalty of $50 for each 15 days, or a fraction of the 15 days that the filing is late, 
              <ln numlevel="1" lineno="255" slineno="2-188"/>not to exceed $250 per filing.
            </subsection>
            <subsection ssid="2-82" numlevel="1" lineno="256" slineno="2-189" dnum="iii-o">
              <display>(iii)</display>The penalty is to be collected in the same manner as contributions due under this 
              <ln numlevel="1" lineno="257" slineno="2-190"/>chapter.
            </subsection>
          </subsection>
          <subsection ssid="2-83" numlevel="1" lineno="258" slineno="2-191" dnum="d-o" space="false">
            <display>(d)</display>
            <subsection ssid="2-84" dnum="i-o" placement="sameline">
              <display>(i)</display>The division shall prescribe rules providing standards for determining which 
              <ln numlevel="1" lineno="259" slineno="2-192"/>contribution reports shall be filed on magnetic or electronic media or in other 
              <ln numlevel="1" lineno="260" slineno="2-193"/>machine-readable form.
            </subsection>
            <subsection ssid="2-85" numlevel="1" lineno="261" slineno="2-194" dnum="ii-o">
              <display>(ii)</display>In prescribing these rules, the division:
              <subsection ssid="2-86" numlevel="1" lineno="262" slineno="2-195" dnum="A-o">
                <display>(A)</display>may not require an employer to file contribution reports on magnetic or 
                <ln numlevel="1" lineno="263" slineno="2-196"/>electronic media unless the employer is required to file wage data on at least 
                <ln numlevel="1" lineno="264" slineno="2-197"/>250 employees during any calendar quarter or is an authorized employer 
                <ln numlevel="1" lineno="265" slineno="2-198"/>representative who files quarterly tax reports on behalf of 100 or more 
                <ln numlevel="1" lineno="266" slineno="2-199"/>employers during any calendar quarter;
              </subsection>
              <subsection ssid="2-87" numlevel="1" lineno="267" slineno="2-200" dnum="B-o">
                <display>(B)</display>shall take into account, among other relevant factors, the ability of the 
                <ln numlevel="1" lineno="268" slineno="2-201"/>employer to comply at reasonable cost with the requirements of the rules; and
              </subsection>
              <subsection ssid="2-88" numlevel="1" lineno="269" slineno="2-202" dnum="C-o">
                <display>(C)</display>may require an employer to post a bond for failure to comply with the rules 
                <ln numlevel="1" lineno="270" slineno="2-203"/>required by this Subsection (8)(d).
              </subsection>
            </subsection>
          </subsection>
        </subsection>
        <subsection ssid="2-89" numlevel="1" lineno="271" slineno="2-204" dnum="9-o" space="false">
          <display>(9)</display>
          <subsection ssid="2-90" dnum="a-o" placement="sameline" space="false">
            <display>(a)</display>
            <subsection ssid="2-91" dnum="i-o" tab="1" placement="sameline">
              <display>(i)</display>An employer liable for payments in lieu of contributions shall file 
              <ln numlevel="1" lineno="272" slineno="2-205"/>Reimbursable Employment and Wage Reports.
            </subsection>
            <subsection ssid="2-92" numlevel="1" lineno="273" slineno="2-206" dnum="ii-o" tab="1">
              <display>(ii)</display>The reports are due on the last day of the month that follows the end of each 
              <ln numlevel="1" lineno="274" slineno="2-207"/>calendar quarter unless the division, after giving notice, changes the due date.
            </subsection>
            <subsection ssid="2-93" numlevel="1" lineno="275" slineno="2-208" dnum="iii-o" tab="1">
              <display>(iii)</display>A report postmarked on or before the due date is considered timely.
            </subsection>
          </subsection>
          <subsection ssid="2-94" numlevel="1" lineno="276" slineno="2-209" dnum="b-o" space="false">
            <display>(b)</display>
            <subsection ssid="2-95" dnum="i-o" placement="sameline">
              <display>(i)</display>Unless the employer can show good cause, the division shall assess a $50 
              <ln numlevel="1" lineno="277" slineno="2-210"/>penalty against an employer who does not file Reimbursable Employment and 
              <ln numlevel="1" lineno="278" slineno="2-211"/>Wage Reports within the time limits set out in Subsection (9)(a) if the filing was 
              <ln numlevel="1" lineno="279" slineno="2-212"/>not more than 15 days late.
            </subsection>
            <subsection ssid="2-96" numlevel="1" lineno="280" slineno="2-213" dnum="ii-o">
              <display>(ii)</display>If the filing is more than 15 days late, the division shall assess an additional 
              <ln numlevel="1" lineno="281" slineno="2-214"/>penalty of $50 for each 15 days, or a fraction of the 15 days that the filing is late, 
              <ln numlevel="1" lineno="282" slineno="2-215"/>not to exceed $250 per filing.
            </subsection>
            <subsection ssid="2-97" numlevel="1" lineno="283" slineno="2-216" dnum="iii-o">
              <display>(iii)</display>The division shall assess and collect the penalties referred to in this Subsection 
              <ln numlevel="1" lineno="284" slineno="2-217"/>(9)(b) in the same manner as prescribed in Sections 
              <xref depth="3" refnumber="35A-4-309">35A-4-309</xref> and 
              <xref depth="3" refnumber="35A-4-311">35A-4-311</xref>.
            </subsection>
          </subsection>
        </subsection>
        <subsection ssid="2-98" numlevel="1" lineno="285" slineno="2-218" dnum="10-o">
          <display>(10)</display>If a person liable to pay a contribution or benefit overpayment imposed by this chapter  
          <ln numlevel="1" lineno="286" slineno="2-219"/>neglects or refuses to pay it after demand, the amount, including any interest, additional  
          <ln numlevel="1" lineno="287" slineno="2-220"/>amount, addition to contributions, or assessable penalty, together with any additional  
          <ln numlevel="1" lineno="288" slineno="2-221"/>accruable costs, shall be a lien in favor of the division upon all property and rights to  
          <ln numlevel="1" lineno="289" slineno="2-222"/>property, whether real or personal belonging to the person.
        </subsection>
        <subsection ssid="2-99" numlevel="1" lineno="290" slineno="2-223" dnum="11-o" space="false">
          <display>(11)</display>
          <subsection ssid="2-100" dnum="a-o" placement="sameline">
            <display>(a)</display>The lien imposed by Subsection (10) arises at the time the assessment, as 
            <ln numlevel="1" lineno="291" slineno="2-224"/>defined in the department rules, is made and continues until the liability for the 
            <ln numlevel="1" lineno="292" slineno="2-225"/>amount assessed, or a judgment against the taxpayer arising out of the liability, is 
            <ln numlevel="1" lineno="293" slineno="2-226"/>satisfied.
          </subsection>
          <subsection ssid="2-101" numlevel="1" lineno="294" slineno="2-227" dnum="b-o" space="false">
            <display>(b)</display>
            <subsection ssid="2-102" dnum="i-o" placement="sameline">
              <display>(i)</display>The lien imposed by Subsection (10) is not valid as against a purchaser, holder 
              <ln numlevel="1" lineno="295" slineno="2-228"/>of a security interest, mechanics' lien holder, or judgment lien creditor until the 
              <ln numlevel="1" lineno="296" slineno="2-229"/>division files a warrant with the clerk of the district court.
            </subsection>
            <subsection ssid="2-103" numlevel="1" lineno="297" slineno="2-230" dnum="ii-o">
              <display>(ii)</display>For the purposes of this Subsection (11)(b):
              <subsection ssid="2-104" numlevel="1" lineno="298" slineno="2-231" dnum="A-o">
                <display>(A)</display>"Judgment lien creditor" means a person who obtains a valid judgment of a 
                <ln numlevel="1" lineno="299" slineno="2-232"/>court of record for recovery of specific property or a sum certain of money, and 
                <ln numlevel="1" lineno="300" slineno="2-233"/>who in the case of a recovery of money, has a perfected lien under the 
                <ln numlevel="1" lineno="301" slineno="2-234"/>judgment on the property involved. A judgment lien does not include inchoate 
                <ln numlevel="1" lineno="302" slineno="2-235"/>liens such as attachment or garnishment liens until they ripen into a judgment. 
                <ln numlevel="1" lineno="303" slineno="2-236"/>A judgment lien does not include the determination or assessment of a 
                <ln numlevel="1" lineno="304" slineno="2-237"/>quasi-judicial authority, such as a state or federal taxing authority.
              </subsection>
              <subsection ssid="2-105" numlevel="1" lineno="305" slineno="2-238" dnum="B-o">
                <display>(B)</display>"Mechanics' lien holder" means any person who has a lien on real property, or 
                <ln numlevel="1" lineno="306" slineno="2-239"/>on the proceeds of a contract relating to real property, for services, labor, or 
                <ln numlevel="1" lineno="307" slineno="2-240"/>materials furnished in connection with the construction or improvement of the 
                <ln numlevel="1" lineno="308" slineno="2-241"/>property. A person has a lien on the earliest date the lien becomes valid 
                <ln numlevel="1" lineno="309" slineno="2-242"/>against subsequent purchasers without actual notice, but not before the person 
                <ln numlevel="1" lineno="310" slineno="2-243"/>begins to furnish the services, labor, or materials.
              </subsection>
              <subsection ssid="2-106" numlevel="1" lineno="311" slineno="2-244" dnum="C-o">
                <display>(C)</display>"Person" means:
                <subsection ssid="2-107" numlevel="1" lineno="312" slineno="2-245" dnum="I-o">
                  <display>(I)</display>an individual;
                </subsection>
                <subsection ssid="2-108" numlevel="1" lineno="313" slineno="2-246" dnum="II-o">
                  <display>(II)</display>a trust;
                </subsection>
                <subsection ssid="2-109" numlevel="1" lineno="314" slineno="2-247" dnum="III-o">
                  <display>(III)</display>an estate;
                </subsection>
                <subsection ssid="2-110" numlevel="1" lineno="315" slineno="2-248" dnum="IV-o">
                  <display>(IV)</display>a partnership;
                </subsection>
                <subsection ssid="2-111" numlevel="1" lineno="316" slineno="2-249" dnum="V-o">
                  <display>(V)</display>an association;
                </subsection>
                <subsection ssid="2-112" numlevel="1" lineno="317" slineno="2-250" dnum="VI-o">
                  <display>(VI)</display>a company;
                </subsection>
                <subsection ssid="2-113" numlevel="1" lineno="318" slineno="2-251" dnum="VII-o">
                  <display>(VII)</display>a limited liability company;
                </subsection>
                <subsection ssid="2-114" numlevel="1" lineno="319" slineno="2-252" dnum="VIII-o">
                  <display>(VIII)</display>a limited liability partnership; or
                </subsection>
                <subsection ssid="2-115" numlevel="1" lineno="320" slineno="2-253" dnum="IX-o">
                  <display>(IX)</display>a corporation.
                </subsection>
              </subsection>
              <subsection ssid="2-116" numlevel="1" lineno="321" slineno="2-254" dnum="D-o">
                <display>(D)</display>"Purchaser" means a person who, for adequate and full consideration in 
                <ln numlevel="1" lineno="322" slineno="2-255"/>money or money's worth, acquires an interest, other than a lien or security 
                <ln numlevel="1" lineno="323" slineno="2-256"/>interest, in property which is valid under state law against subsequent 
                <ln numlevel="1" lineno="324" slineno="2-257"/>purchasers without actual notice.
              </subsection>
              <subsection ssid="2-117" numlevel="1" lineno="325" slineno="2-258" dnum="E-o">
                <display>(E)</display>"Security interest" means any interest in property acquired by contract for the 
                <ln numlevel="1" lineno="326" slineno="2-259"/>purpose of securing payment or performance of an obligation or indemnifying 
                <ln numlevel="1" lineno="327" slineno="2-260"/>against loss or liability. A security interest exists at any time:
                <subsection ssid="2-118" numlevel="1" lineno="328" slineno="2-261" dnum="I-o">
                  <display>(I)</display>the property is in existence and the interest has become protected under the 
                  <ln numlevel="1" lineno="329" slineno="2-262"/>law against a subsequent judgment lien arising out of an unsecured 
                  <ln numlevel="1" lineno="330" slineno="2-263"/>obligation; and
                </subsection>
                <subsection ssid="2-119" numlevel="1" lineno="331" slineno="2-264" dnum="II-o">
                  <display>(II)</display>to the extent that, at that time, the holder has parted with money or money's 
                  <ln numlevel="1" lineno="332" slineno="2-265"/>worth.
                </subsection>
              </subsection>
            </subsection>
          </subsection>
        </subsection>
        <subsection ssid="2-120" numlevel="1" lineno="333" slineno="2-266" dnum="12-o" space="false">
          <display>(12)</display>
          <subsection ssid="2-121" dnum="a-o" placement="sameline">
            <display>(a)</display>Except in cases involving a violation of unemployment compensation provisions 
            <ln numlevel="1" lineno="334" slineno="2-267"/>under Section 
            <xref depth="3" refnumber="76-8-1301">76-8-1301</xref>, Subsection 
            <xref depth="3" refnumber="35A-4-304">35A-4-304</xref>(5), or Subsection 
            <xref depth="3" refnumber="35A-4-405">35A-4-405</xref>(5), and 
            <ln numlevel="1" lineno="335" slineno="2-268"/>at the discretion of the division, the division may accept an offer in compromise from 
            <ln numlevel="1" lineno="336" slineno="2-269"/>an employer or claimant to reduce past due debt arising from contributions or benefit 
            <ln numlevel="1" lineno="337" slineno="2-270"/>overpayments imposed under this chapter.
          </subsection>
          <subsection ssid="2-122" numlevel="1" lineno="338" slineno="2-271" dnum="b-o">
            <display>(b)</display>In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the 
            <ln numlevel="1" lineno="339" slineno="2-272"/>division shall make rules for allowing an offer in compromise provided under 
            <ln numlevel="1" lineno="340" slineno="2-273"/>Subsection (12)(a).
          </subsection>
        </subsection>
      </section>

          <bold>35A-4-314</bold> is amended to read:

          <bold>35A-4-314. Disclosure of information for debt collection -- Court order --  
            <ln numlevel="1" lineno="343" slineno="3-3"/>Procedures -- Use of information restrictions -- Penalties.
          </bold>
        </catline>
        <subsection ssid="3-1" numlevel="1" lineno="344" slineno="3-4" dnum="1-o" placement="noreturn">
          <display>(1)</display>The division shall disclose to a creditor who has obtained judgment against a debtor the  
          <ln numlevel="1" lineno="345" slineno="3-5"/>name and address of the last known employer of the debtor if:
          <subsection ssid="3-2" numlevel="1" lineno="346" slineno="3-6" dnum="a-o">
            <display>(a)</display>the judgment creditor obtains a court order requiring disclosure of the information as  
            <ln numlevel="1" lineno="347" slineno="3-7"/>described in Subsection (2); and
          </subsection>
          <subsection ssid="3-3" numlevel="1" lineno="348" slineno="3-8" dnum="b-o">
            <display>(b)</display>the judgment creditor completes the requirements described in Subsection (3),  
            <ln numlevel="1" lineno="349" slineno="3-9"/>including entering into a written agreement with the division.
          </subsection>
        </subsection>
        <subsection ssid="3-4" numlevel="1" lineno="350" slineno="3-10" dnum="2-o" space="false">
          <display>(2)</display>
          <subsection ssid="3-5" dnum="a-o" placement="sameline">
            <display>(a)</display>A court shall grant an order to disclose the information described in Subsection 
            <ln numlevel="1" lineno="351" slineno="3-11"/>(1) if, under the applicable Utah Rules of Civil Procedure:
            <subsection ssid="3-6" numlevel="1" lineno="352" slineno="3-12" dnum="i-o" tab="1">
              <display>(i)</display>the judgment creditor files a motion with the court, which includes a copy of the 
              <ln numlevel="1" lineno="353" slineno="3-13"/>judgment, and serves a copy of the motion to the judgment debtor and the division;
            </subsection>
            <subsection ssid="3-7" numlevel="1" lineno="354" slineno="3-14" dnum="ii-o" tab="1">
              <display>(ii)</display>the judgment debtor and the division have the opportunity to respond to the 
              <ln numlevel="1" lineno="355" slineno="3-15"/>motion; and
            </subsection>
            <subsection ssid="3-8" numlevel="1" lineno="356" slineno="3-16" dnum="iii-o" tab="1">
              <display>(iii)</display>the court denies or overrules any objection to disclosure in the judgment debtor's 
              <ln numlevel="1" lineno="357" slineno="3-17"/>and the division's response.
            </subsection>
          </subsection>
          <subsection ssid="3-9" numlevel="1" lineno="358" slineno="3-18" dnum="b-o">
            <display>(b)</display>A court may not grant an order to disclose the information described in Subsection 
            <ln numlevel="1" lineno="359" slineno="3-19"/>(1), if the court finds that the division has established that disclosure will have a 
            <ln numlevel="1" lineno="360" slineno="3-20"/>negative effect on:
            <subsection ssid="3-10" numlevel="1" lineno="361" slineno="3-21" dnum="i-o">
              <display>(i)</display>the willingness of employers to report wage and employment information; or
            </subsection>
            <subsection ssid="3-11" numlevel="1" lineno="362" slineno="3-22" dnum="ii-o">
              <display>(ii)</display>the willingness of individuals to file claims for unemployment benefits.
            </subsection>
          </subsection>
          <subsection ssid="3-12" numlevel="1" lineno="363" slineno="3-23" dnum="c-o">
            <display>(c)</display>The requirements of Subsection 
            <xref depth="3" refnumber="63G-2-202">63G-2-202</xref>(7) and Section 
            <xref depth="3" refnumber="63G-2-207">63G-2-207</xref> do not apply 
            <ln numlevel="1" lineno="364" slineno="3-24"/>to information sought through a court order as described in this section.
          </subsection>
        </subsection>
        <subsection ssid="3-13" numlevel="1" lineno="365" slineno="3-25" dnum="3-o">
          <display>(3)</display>If a court order is granted in accordance with this section, a judgment creditor shall:
          <subsection ssid="3-14" numlevel="1" lineno="366" slineno="3-26" dnum="a-o">
            <display>(a)</display>provide to the division a copy of the order requiring the disclosure;
          </subsection>
          <subsection ssid="3-15" numlevel="1" lineno="367" slineno="3-27" dnum="b-o">
            <display>(b)</display>enter into a written agreement with the division, in a form approved by the division;
          </subsection>
          <subsection ssid="3-16" numlevel="1" lineno="368" slineno="3-28" dnum="c-o">
            <display>(c)</display>pay the division a reasonable fee that reflects the cost for processing the request as  
            <ln numlevel="1" lineno="369" slineno="3-29"/>established by department rule; and
          </subsection>
          <subsection ssid="3-17" numlevel="1" lineno="370" slineno="3-30" dnum="d-o">
            <display>(d)</display>comply with the data safeguard and security measures described in 20 C.F.R. Sec.  
            <ln numlevel="1" lineno="371" slineno="3-31"/>603.9 with respect to information received from the division under this section.
          </subsection>
        </subsection>
        <subsection ssid="3-18" numlevel="1" lineno="372" slineno="3-32" dnum="4-o">
          <display>(4)</display>If a judgment creditor complies with Subsection (3), the division shall provide the  
          <ln numlevel="1" lineno="373" slineno="3-33"/>information to the judgment creditor within 14 business days after the day on which the  
          <ln numlevel="1" lineno="374" slineno="3-34"/>creditor complies with Subsection (3).
        </subsection>
        <subsection ssid="3-19" numlevel="1" lineno="375" slineno="3-35" dnum="5-o">
          <display>(5)</display>A judgment creditor may not:
          <subsection ssid="3-20" numlevel="1" lineno="376" slineno="3-36" dnum="a-o">
            <display>(a)</display>use the information obtained under this section for a purpose other than satisfying the  
            <ln numlevel="1" lineno="377" slineno="3-37"/>judgment between the creditor and debtor; or
          </subsection>
          <subsection ssid="3-21" numlevel="1" lineno="378" slineno="3-38" dnum="b-o">
            <display>(b)</display>disclose or share the information with any other person.
          </subsection>
        </subsection>
        <subsection ssid="3-22" numlevel="1" lineno="379" slineno="3-39" dnum="6-o">
          <display>(6)</display>The division may audit a judgment creditor or other party receiving information under  
          <ln numlevel="1" lineno="380" slineno="3-40"/>this section for compliance with the data safeguard and security measures described in  
          <ln numlevel="1" lineno="381" slineno="3-41"/>20 C.F.R. Sec. 603.9.
        </subsection>
        <subsection ssid="3-23" numlevel="1" lineno="382" slineno="3-42" dnum="7-o">
          <display>(7)</display>If a judgment creditor or other party fails to comply with the data safeguard and security  
          <ln numlevel="1" lineno="383" slineno="3-43"/>measures under 20 C.F.R. Sec. 603.9, the judgment creditor or other party is subject to a  
          <ln numlevel="1" lineno="384" slineno="3-44"/>civil penalty of no more than $10,000 enforceable by the Utah Office of the Attorney  
          <ln numlevel="1" lineno="385" slineno="3-45"/>General as follows:
          <subsection ssid="3-24" numlevel="1" lineno="386" slineno="3-46" dnum="a-o">
            <display>(a)</display>the attorney general, on the attorney general's own behalf or on behalf of the  
            <ln numlevel="1" lineno="387" slineno="3-47"/>division, may bring an action in a court with jurisdiction under Title 78A, Judiciary  
            <ln numlevel="1" lineno="388" slineno="3-48"/>and Judicial Administration, to enforce the civil penalty; and
          </subsection>
          <subsection ssid="3-25" numlevel="1" lineno="389" slineno="3-49" dnum="b-o">
            <display>(b)</display>if the attorney general prevails in enforcing the civil penalty against the judgment  
            <ln numlevel="1" lineno="390" slineno="3-50"/>creditor or other party:
            <subsection ssid="3-26" numlevel="1" lineno="391" slineno="3-51" dnum="i-o">
              <display>(i)</display>the attorney general is entitled to an award for reasonable attorney fees, court  
              <ln numlevel="1" lineno="392" slineno="3-52"/>costs, and investigative expenses; and
            </subsection>
            <subsection ssid="3-27" numlevel="1" lineno="393" slineno="3-53" dnum="ii-o">
              <display>(ii)</display>the civil penalty shall be deposited into the

              <ln numlevel="1" lineno="429" slineno="4-34"/>Subsection 303(a)(8) of the Social Security Act, 42 U.S.C. Sec. 503(a)(8), as
