        <secline lineno="22">Section 1, Section  
          <bold>80-4-104</bold> is amended to read:
        </secline>
        <catline lineno="23">
          <bold>80-4-104. Judicial process for termination -- Parent unfit or incompetent -- Best  
            <ln numlevel="1" lineno="24" slineno="1-3"/>interest of child.
          </bold>
        </catline>
        <subsection ssid="1-1" numlevel="1" lineno="25" slineno="1-4" dnum="1-o" placement="noreturn">
          <display>(1)</display>Under both the United States Constitution and the constitution of this state, a parent  
          <ln numlevel="1" lineno="26" slineno="1-5"/>possesses a fundamental liberty interest in the care, custody, and management of the  
          <ln numlevel="1" lineno="27" slineno="1-6"/>parent's child.  For this reason, the termination of family ties by the state may only be  
          <ln numlevel="1" lineno="28" slineno="1-7"/>done for compelling reasons.
        </subsection>
        <subsection ssid="1-2" numlevel="1" lineno="29" slineno="1-8" dnum="2-o">
          <display>(2)</display>The juvenile court shall provide a fundamentally fair process to a parent if a party  
          <ln numlevel="1" lineno="30" slineno="1-9"/>moves to terminate the parent's parental rights.
        </subsection>
        <subsection ssid="1-3" numlevel="1" lineno="31" slineno="1-10" dnum="3-o">
          <display>(3)</display>If the party moving to terminate parental rights is a governmental entity, the juvenile  
          <ln numlevel="1" lineno="32" slineno="1-11"/>court shall find that any actions or allegations made in opposition to the rights and  
          <ln numlevel="1" lineno="33" slineno="1-12"/>desires of a parent regarding the parent's child are supported by sufficient evidence to  
          <ln numlevel="1" lineno="34" slineno="1-13"/>satisfy a parent's constitutional entitlement to heightened protection against government  
          <ln numlevel="1" lineno="35" slineno="1-14"/>interference with the parent's fundamental rights and liberty interests.
        </subsection>
        <subsection ssid="1-4" numlevel="1" lineno="36" slineno="1-15" dnum="4-o" space="false">
          <display>(4)</display>
          <subsection ssid="1-5" dnum="a-o" placement="sameline">
            <display>(a)</display>The fundamental liberty interest of a parent concerning the care, custody, and 
            <ln numlevel="1" lineno="37" slineno="1-16"/>management of the parent's child is recognized, protected, and does not cease to exist 
            <ln numlevel="1" lineno="38" slineno="1-17"/>simply because:
            <subsection ssid="1-6" numlevel="1" lineno="39" slineno="1-18" dnum="i-o" tab="1">
              <display>(i)</display>a parent may fail to be a model parent; or
            </subsection>
            <subsection ssid="1-7" numlevel="1" lineno="40" slineno="1-19" dnum="ii-o" tab="1">
              <display>(ii)</display>the parent's child is placed in the temporary custody of the state.
            </subsection>
          </subsection>
          <subsection ssid="1-8" numlevel="1" lineno="41" slineno="1-20" dnum="b-o">
            <display>(b)</display>The juvenile court should give serious consideration to the fundamental right of a 
            <ln numlevel="1" lineno="42" slineno="1-21"/>parent to rear the parent's child, and concomitantly, of the right of the child to be 
            <ln numlevel="1" lineno="43" slineno="1-22"/>reared by the child's natural parent.
          </subsection>
        </subsection>
        <subsection ssid="1-9" numlevel="1" lineno="44" slineno="1-23" dnum="5-o">
          <display>(5)</display>At all times, a parent retains a vital interest in preventing the irretrievable destruction of  
          <ln numlevel="1" lineno="45" slineno="1-24"/>family life.
        </subsection>
        <subsection ssid="1-10" numlevel="1" lineno="46" slineno="1-25" dnum="6-o">
          <display>(6)</display>Before an adjudication of unfitness, government action in relation to a parent and a  
          <ln numlevel="1" lineno="47" slineno="1-26"/>parent's child may not exceed the least restrictive means or alternatives available to  
          <ln numlevel="1" lineno="48" slineno="1-27"/>accomplish a compelling state interest.
        </subsection>
        <subsection ssid="1-11" numlevel="1" lineno="49" slineno="1-28" dnum="7-o">
          <display>(7)</display>Until parental unfitness is established and the children suffer, or are substantially likely  
          <ln numlevel="1" lineno="50" slineno="1-29"/>to suffer, serious detriment as a result, the child and the child's parent share a vital  
          <ln numlevel="1" lineno="51" slineno="1-30"/>interest in preventing erroneous termination of their relationship and the juvenile court  
          <ln numlevel="1" lineno="52" slineno="1-31"/>may not presume that a child and the child's parents are adversaries.
        </subsection>
        <subsection ssid="1-12" numlevel="1" lineno="53" slineno="1-32" dnum="8-o">
          <display>(8)</display>It is in the best interest and welfare of a child to be raised under the care and supervision  
          <ln numlevel="1" lineno="54" slineno="1-33"/>of the child's natural parents. A child's need for a normal family life in a permanent  
          <ln numlevel="1" lineno="55" slineno="1-34"/>home, and for positive, nurturing family relationships is usually best met by the child's  
          <ln numlevel="1" lineno="56" slineno="1-35"/>natural parents. Additionally, the integrity of the family unit and the right of parents to  
          <ln numlevel="1" lineno="57" slineno="1-36"/>conceive and raise their children are constitutionally protected. For these reasons, the  
          <ln numlevel="1" lineno="58" slineno="1-37"/>juvenile court should only transfer custody of a child from the child's natural parent for  
          <ln numlevel="1" lineno="59" slineno="1-38"/>compelling reasons and when there is a jurisdictional basis to do so.
        </subsection>
        <subsection ssid="1-13" numlevel="1" lineno="60" slineno="1-39" dnum="9-o">
          <display>(9)</display>The right of a fit, competent parent to raise the parent's child without undue government  
          <ln numlevel="1" lineno="61" slineno="1-40"/>interference is a fundamental liberty interest that has long been protected by the laws  
          <ln numlevel="1" lineno="62" slineno="1-41"/>and Constitution of this state and of the United States, and is a fundamental public  
          <ln numlevel="1" lineno="63" slineno="1-42"/>policy of this state.
        </subsection>
        <subsection ssid="1-14" numlevel="1" lineno="64" slineno="1-43" dnum="10-o" space="false">
          <display>(10)</display>
          <subsection ssid="1-15" dnum="a-o" placement="sameline">
            <display>(a)</display>The state recognizes that:
            <subsection ssid="1-16" numlevel="1" lineno="65" slineno="1-44" dnum="i-o" tab="1">
              <display>(i)</display>a parent has the right, obligation, responsibility, and authority to raise, manage, 
              <ln numlevel="1" lineno="66" slineno="1-45"/>train, educate, provide for, and reasonably discipline the parent's child; and
            </subsection>
            <subsection ssid="1-17" numlevel="1" lineno="67" slineno="1-46" dnum="ii-o" tab="1">
              <display>(ii)</display>the state's role is secondary and supportive to the primary role of a parent.
            </subsection>
          </subsection>
          <subsection ssid="1-18" numlevel="1" lineno="68" slineno="1-47" dnum="b-o">
            <display>(b)</display>It is the public policy of this state that a parent retain the fundamental right and duty 
            <ln numlevel="1" lineno="69" slineno="1-48"/>to exercise primary control over the care, supervision, upbringing, and education of 
            <ln numlevel="1" lineno="70" slineno="1-49"/>the parent's child.
          </subsection>
          <subsection ssid="1-19" numlevel="1" lineno="71" slineno="1-50" dnum="c-o">
            <display>(c)</display>The interests of the state favor preservation and not severance of natural familial 
            <ln numlevel="1" lineno="72" slineno="1-51"/>bonds in situations where a positive, nurturing parent-child relationship can exist, 
            <ln numlevel="1" lineno="73" slineno="1-52"/>including extended family association and support.
          </subsection>
        </subsection>
        <subsection ssid="1-20" numlevel="1" lineno="74" slineno="1-53" dnum="11-o">
          <display>(11)</display>This chapter provides a judicial process for voluntary and involuntary severance of the  
          <ln numlevel="1" lineno="75" slineno="1-54"/>parent-child relationship, designed to safeguard the rights and interests of all parties  
          <ln numlevel="1" lineno="76" slineno="1-55"/>concerned and promote their welfare and that of the state.
        </subsection>
        <subsection ssid="1-21" numlevel="1" lineno="77" slineno="1-56" dnum="12-o" space="false">
          <display>(12)</display>
          <subsection ssid="1-22" dnum="a-o" placement="sameline">
            <display>(a)</display>Wherever possible, family life should be strengthened and preserved, but if a 
            <ln numlevel="1" lineno="78" slineno="1-57"/>parent is found, by reason of the parent's conduct or condition, to be unfit or 
            <ln numlevel="1" lineno="79" slineno="1-58"/>incompetent based upon any of the grounds for termination described in this part, the 
            <ln numlevel="1" lineno="80" slineno="1-59"/>juvenile court shall then consider the welfare and best interest of the child of 
            <ln numlevel="1" lineno="81" slineno="1-60"/>paramount importance in determining whether termination of parental rights shall be 
            <ln numlevel="1" lineno="82" slineno="1-61"/>ordered.
          </subsection>
          <subsection ssid="1-23" numlevel="1" lineno="83" slineno="1-62" dnum="b-o">
            <display>(b)</display>In determining whether termination is in the best interest of the child, and in finding
            <amend anum="0" ea="amend" pairid="1" style="1" owner="ahouston" level="1" amendtag="both">, 
              <ln numlevel="1" lineno="84" slineno="1-63"/>based on the totality of the circumstances,
            </amend> that termination of parental rights, from 
            <ln numlevel="1" lineno="85" slineno="1-64"/>the child's point of view, is strictly necessary
            <amend anum="0" ea="amend" pairid="2" style="1" owner="ahouston" level="1" amendtag="both">to promote the child's best interest</amend>, the 
            <ln numlevel="1" lineno="86" slineno="1-65"/>juvenile court shall consider, among other relevant factors, whether:
            <subsection ssid="1-24" numlevel="1" lineno="87" slineno="1-66" dnum="i-o">
              <display>(i)</display>sufficient efforts were dedicated to reunification in accordance with Section 
              <xref depth="3" refnumber="80-4-301">
                <ln numlevel="1" lineno="88" slineno="1-67"/>80-4-301
              </xref>; and
            </subsection>
            <subsection ssid="1-25" numlevel="1" lineno="89" slineno="1-68" dnum="ii-o">
              <display>(ii)</display>
              <amend anum="0" ea="amend" pairid="3" style="1" owner="ahouston" level="1" amendtag="both">pursuant to Section 
                <xref depth="3" refnumber="80-3-302">80-3-302</xref>,
              </amend>the efforts to place the child with 
              <amendoutstart style="5"/>
              <amend anum="0" ea="erase" pairid="4" style="2" owner="ahouston" level="1" deltag="both">kin who have, or 
                <ln numlevel="1" lineno="90" slineno="1-69"/>are
              </amend>
              <amendoutend style="5"/>
              <amend anum="0" ea="amend" pairid="5" style="1" owner="ahouston" level="1" amendtag="both" space="true">a relative who has, or is</amend> willing to come forward to care for the child, were 
              <ln numlevel="1" lineno="91" slineno="1-70"/>given due weight.
            </subsection>
          </subsection>
        </subsection>
      </section>
    </bsec>

      <section number="80-4-301" numlevel="1" lineno="93" slineno="2-2" type="amend">
        <secline lineno="92">Section 2, Section  
          <bold>80-4-301</bold> is amended to read:
        </secline>
        <catline lineno="93">
          <bold>80-4-301. Grounds for termination of parental rights -- Findings regarding  
            <ln numlevel="1" lineno="94" slineno="2-3"/>reasonable efforts by division.
          </bold>
        </catline>
        <subsection ssid="2-1" numlevel="1" lineno="95" slineno="2-4" dnum="1-o" placement="noreturn">
          <display>(1)</display>Subject to the protections and requirements of Section  
          <xref depth="3" refnumber="80-4-104">80-4-104</xref>, and if
          <amend anum="0" ea="amend" pairid="1" style="1" owner="ahouston" level="1" amendtag="both">, based on the  
            <ln numlevel="1" lineno="96" slineno="2-5"/>totality of the circumstances,
          </amend> the juvenile court finds termination of parental rights, from  
          <ln numlevel="1" lineno="97" slineno="2-6"/>the child's point of view, is strictly necessary
          <amend anum="0" ea="amend" pairid="2" style="1" owner="ahouston" level="1" amendtag="both"> to promote the child's best interest</amend>, the  
          <ln numlevel="1" lineno="98" slineno="2-7"/>juvenile court may terminate all parental rights with respect to the parent if the juvenile  
          <ln numlevel="1" lineno="99" slineno="2-8"/>court finds any one of the following:
          <subsection ssid="2-2" numlevel="1" lineno="100" slineno="2-9" dnum="a-o">
            <display>(a)</display>that the parent has abandoned the child;
          </subsection>
          <subsection ssid="2-3" numlevel="1" lineno="101" slineno="2-10" dnum="b-o">
            <display>(b)</display>that the parent has neglected or abused the child;
          </subsection>
          <subsection ssid="2-4" numlevel="1" lineno="102" slineno="2-11" dnum="c-o">
            <display>(c)</display>that the parent is unfit or incompetent;
          </subsection>
          <subsection ssid="2-5" numlevel="1" lineno="103" slineno="2-12" dnum="d-o" space="false">
            <display>(d)</display>
            <subsection ssid="2-6" dnum="i-o" placement="sameline">
              <display>(i)</display>that the child is being cared for in an out-of-home placement under the 
              <ln numlevel="1" lineno="104" slineno="2-13"/>supervision of the juvenile court or the division;
            </subsection>
            <subsection ssid="2-7" numlevel="1" lineno="105" slineno="2-14" dnum="ii-o">
              <display>(ii)</display>that the parent has substantially neglected, willfully refused, or has been unable or 
              <ln numlevel="1" lineno="106" slineno="2-15"/>unwilling to remedy the circumstances that cause the child to be in an 
              <ln numlevel="1" lineno="107" slineno="2-16"/>out-of-home placement; and
            </subsection>
            <subsection ssid="2-8" numlevel="1" lineno="108" slineno="2-17" dnum="iii-o">
              <display>(iii)</display>that there is a substantial likelihood that the parent will not be capable of 
              <ln numlevel="1" lineno="109" slineno="2-18"/>exercising proper and effective parental care in the near future;
            </subsection>
          </subsection>
          <subsection ssid="2-9" numlevel="1" lineno="110" slineno="2-19" dnum="e-o">
            <display>(e)</display>failure of parental adjustment, as defined in this chapter;
          </subsection>
          <subsection ssid="2-10" numlevel="1" lineno="111" slineno="2-20" dnum="f-o">
            <display>(f)</display>that only token efforts have been made by the parent:
            <subsection ssid="2-11" numlevel="1" lineno="112" slineno="2-21" dnum="i-o">
              <display>(i)</display>to support or communicate with the child;
            </subsection>
            <subsection ssid="2-12" numlevel="1" lineno="113" slineno="2-22" dnum="ii-o">
              <display>(ii)</display>to prevent neglect of the child;
            </subsection>
            <subsection ssid="2-13" numlevel="1" lineno="114" slineno="2-23" dnum="iii-o">
              <display>(iii)</display>to eliminate the risk of serious harm to the child; or
            </subsection>
            <subsection ssid="2-14" numlevel="1" lineno="115" slineno="2-24" dnum="iv-o">
              <display>(iv)</display>to avoid being an unfit parent;
            </subsection>
          </subsection>
          <subsection ssid="2-15" numlevel="1" lineno="116" slineno="2-25" dnum="g-o" space="false">
            <display>(g)</display>
            <subsection ssid="2-16" dnum="i-o" placement="sameline">
              <display>(i)</display>that the parent has voluntarily relinquished the parent's parental rights to the 
              <ln numlevel="1" lineno="117" slineno="2-26"/>child; and
            </subsection>
            <subsection ssid="2-17" numlevel="1" lineno="118" slineno="2-27" dnum="ii-o">
              <display>(ii)</display>that termination is in the child's best interest;
            </subsection>
          </subsection>
          <subsection ssid="2-18" numlevel="1" lineno="119" slineno="2-28" dnum="h-o">
            <display>(h)</display>that, after a period of trial during which the child was returned to live in the child's  
            <ln numlevel="1" lineno="120" slineno="2-29"/>own home, the parent substantially and continuously or repeatedly refused or failed  
            <ln numlevel="1" lineno="121" slineno="2-30"/>to give the child proper parental care and protection; or
          </subsection>
          <subsection ssid="2-19" numlevel="1" lineno="122" slineno="2-31" dnum="i-o">
            <display>(i)</display>the terms and conditions of safe relinquishment of a newborn child have been  
            <ln numlevel="1" lineno="123" slineno="2-32"/>complied with, in accordance with Part 5, Safe Relinquishment of a Newborn Child.
          </subsection>
        </subsection>
        <subsection ssid="2-20" numlevel="1" lineno="124" slineno="2-33" dnum="2-o">
          <display>(2)</display>
          <amend anum="0" ea="amend" pairid="3" style="1" owner="ahouston" level="1" amendtag="both">When determining whether termination of parental rights is strictly necessary to  
            <ln numlevel="1" lineno="125" slineno="2-34"/>promote the child's best interest, the court shall:
          </amend>
          <subsection ssid="2-21" ea="amend" anum="0" owner="ahouston" style="1" numlevel="1" lineno="126" slineno="2-35" dnum="_-e:a-e">
            <display>
              <amend anum="0" ea="amend" pairid="45" style="1" owner="e" level="1" amendtag="start">(a)</amend>
            </display>
            <amend anum="0" ea="amend" pairid="5" style="1" owner="ahouston" level="1" amendtag="end">undertake the analysis from the child's point of view;</amend>
          </subsection>
          <subsection ssid="2-22" ea="amend" anum="0" owner="ahouston" style="1" numlevel="1" lineno="127" slineno="2-36" dnum="_-e:b-e">
            <display>
              <amend anum="0" ea="amend" pairid="46" style="1" owner="e" level="1" amendtag="start">(b)</amend>
            </display>
            <amend anum="0" ea="amend" pairid="8" style="1" owner="ahouston" level="1" amendtag="end">focus on finding the outcome that best secures the child's well-being;</amend>
          </subsection>
          <subsection ssid="2-23" ea="amend" anum="0" owner="ahouston" style="1" numlevel="1" lineno="128" slineno="2-37" dnum="_-e:c-e">
            <display>
              <amend anum="0" ea="amend" pairid="47" style="1" owner="e" level="1" amendtag="start">(c)</amend>
            </display>
            <amend anum="0" ea="amend" pairid="11" style="1" owner="ahouston" level="1" amendtag="end">include, as applicable, the considerations described in Sections  
              <xref depth="3" refnumber="80-4-303">80-4-303</xref> and  
              <xref depth="3" refnumber="80-4-304">
                <ln numlevel="1" lineno="129" slineno="2-38"/>80-4-304
              </xref>; and
            </amend>
          </subsection>
          <subsection ssid="2-24" ea="amend" anum="0" owner="ahouston" style="1" numlevel="1" lineno="130" slineno="2-39" dnum="_-e:d-e">
            <display>
              <amend anum="0" ea="amend" pairid="48" style="1" owner="e" level="1" amendtag="start">(d)</amend>
            </display>
            <amend anum="0" ea="amend" pairid="14" style="1" owner="ahouston" level="1" amendtag="end">explore whether other feasible options exist that could address the specific problems  
              <ln numlevel="1" lineno="131" slineno="2-40"/>or issues facing the family, short of imposing the ultimate remedy of terminating the  
              <ln numlevel="1" lineno="132" slineno="2-41"/>parent's rights.
            </amend>
          </subsection>
        </subsection>
        <subsection ssid="2-25" ea="amend" anum="0" owner="ahouston" style="1" numlevel="1" lineno="133" slineno="2-42" dnum="_-e:3-e">
          <display>
            <amend anum="0" ea="amend" pairid="49" style="1" owner="e" level="1" amendtag="both">(3)</amend>
          </display>The juvenile court may not terminate the parental rights of a parent because the parent

            <ln numlevel="1" lineno="137" slineno="2-46"/>the juvenile court must find that the division made reasonable efforts to provide those 
            <ln numlevel="1" lineno="138" slineno="2-47"/>services before the juvenile court may terminate the parent's rights under Subsection 
            <ln numlevel="1" lineno="139" slineno="2-48"/>(1)(b), (c), (d), (e), (f), or (h).
          </subsection>
          <subsection ssid="2-28" numlevel="1" lineno="140" slineno="2-49" dnum="b-o">
            <display>(b)</display>Notwithstanding Subsection 
            <amendoutstart style="5"/>
            <amend anum="0" ea="erase" pairid="20" style="2" owner="ahouston" level="1" deltag="both">(3)(a)</amend>
            <amendoutend style="5"/>
            <amend anum="0" ea="amend" pairid="21" style="1" owner="ahouston" level="1" amendtag="both" space="true">(4)(a)</amend>, the juvenile court is not required to make 
            <ln numlevel="1" lineno="141" slineno="2-50"/>the finding under Subsection 
            <amendoutstart style="5"/>
            <amend anum="0" ea="erase" pairid="22" style="2" owner="ahouston" level="1" deltag="both">(3)(a)</amend>
            <amendoutend style="5"/>
            <amend anum="0" ea="amend" pairid="23" style="1" owner="ahouston" level="1" amendtag="both" space="true">(4)(a)</amend> before terminating a parent's rights:
            <subsection ssid="2-29" numlevel="1" lineno="142" slineno="2-51" dnum="i-o">
              <display>(i)</display>under Subsection (1)(b), if the juvenile court finds that the abuse or neglect 
              <ln numlevel="1" lineno="143" slineno="2-52"/>occurred subsequent to adjudication; or

              <display>(ii)</display>if reasonable efforts to provide the services described in Subsection

              <ln numlevel="1" lineno="145" slineno="2-54"/> are not required under federal law, and federal law is not inconsistent with Utah
