    <gdhead lineno="4">General Description:</gdhead>
    <gd numlevel="1" lineno="5" slineno="0-5">This bill modifies provisions related to victim reparations and the Utah Office for Victims  
      <ln numlevel="1" lineno="6" slineno="0-6"/>of Crimes.
    </gd>
    <hphead lineno="7">Highlighted Provisions:</hphead>
    <hp numlevel="1" lineno="8" slineno="0-8">This bill:
      <hl numlevel="1" lineno="9" slineno="0-9" level="1">requires law enforcement agencies to provide copies of investigative reports to the Utah  
        <ln numlevel="1" lineno="10" slineno="0-10"/>Office for Victims of Crimes to assist the office in performing its official duties;
      </hl>
      <hl numlevel="1" lineno="11" slineno="0-11" level="1">establishes timelines, procedures, and sharing restrictions in relation to the request and  
        <ln numlevel="1" lineno="12" slineno="0-12"/>provision of documents;
      </hl>
      <hl numlevel="1" lineno="13" slineno="0-13" level="1">establishes a criminal penalty for unauthorized use or distribution of an investigative

          <display>(1)</display>"Accomplice" means an individual who has engaged in criminal conduct as described in  
          <ln numlevel="1" lineno="32" slineno="1-5"/>Section  
          <xref depth="3" refnumber="76-2-202">76-2-202</xref>.
        </subsection>
        <subsection ssid="1-2" numlevel="1" lineno="33" slineno="1-6" dnum="2-o">
          <display>(2)</display>"Advocacy services provider" means the same as that term is defined in Section  
          <xref depth="3" refnumber="77-38-403">
            <ln numlevel="1" lineno="34" slineno="1-7"/>77-38-403
          </xref>.
        </subsection>
        <subsection ssid="1-3" numlevel="1" lineno="35" slineno="1-8" dnum="3-o">
          <display>(3)</display>"Board" means the Crime Victim Reparations and Assistance Board created under  
          <ln numlevel="1" lineno="36" slineno="1-9"/>Section  
          <xref depth="3" refnumber="63M-7-504">63M-7-504</xref>.
        </subsection>
        <subsection ssid="1-4" numlevel="1" lineno="37" slineno="1-10" dnum="4-o">
          <display>(4)</display>"Bodily injury" means physical pain, illness, or any impairment of physical condition.
        </subsection>
        <subsection ssid="1-5" numlevel="1" lineno="38" slineno="1-11" dnum="5-o">
          <display>(5)</display>"Claimant" means any of the following claiming reparations under this part:
          <subsection ssid="1-6" numlevel="1" lineno="39" slineno="1-12" dnum="a-o">
            <display>(a)</display>a victim;
          </subsection>
          <subsection ssid="1-7" numlevel="1" lineno="40" slineno="1-13" dnum="b-o">
            <display>(b)</display>a dependent of a deceased victim; or
          </subsection>
          <subsection ssid="1-8" numlevel="1" lineno="41" slineno="1-14" dnum="c-o">
            <display>(c)</display>an individual or representative who files a reparations claim on behalf of a victim.
          </subsection>
        </subsection>
        <subsection ssid="1-9" numlevel="1" lineno="42" slineno="1-15" dnum="6-o">
          <display>(6)</display>"Child" means an unemancipated individual who is under 18 years old.
        </subsection>
        <subsection ssid="1-10" numlevel="1" lineno="43" slineno="1-16" dnum="7-o">
          <display>(7)</display>"Collateral source" means any source of benefits or advantages for economic loss  
          <ln numlevel="1" lineno="44" slineno="1-17"/>otherwise reparable under this part that the victim or claimant has received, or that is  
          <ln numlevel="1" lineno="45" slineno="1-18"/>readily available to the victim from:
          <subsection ssid="1-11" numlevel="1" lineno="46" slineno="1-19" dnum="a-o">
            <display>(a)</display>the offender;
          </subsection>
          <subsection ssid="1-12" numlevel="1" lineno="47" slineno="1-20" dnum="b-o">
            <display>(b)</display>the insurance of the offender or the victim;
          </subsection>
          <subsection ssid="1-13" numlevel="1" lineno="48" slineno="1-21" dnum="c-o">
            <display>(c)</display>the United States government or any of its agencies, a state or any of its political  
            <ln numlevel="1" lineno="49" slineno="1-22"/>subdivisions, or an instrumentality of two or more states, except in the case on  
            <ln numlevel="1" lineno="50" slineno="1-23"/>nonobligatory state-funded programs;
          </subsection>
          <subsection ssid="1-14" numlevel="1" lineno="51" slineno="1-24" dnum="d-o">
            <display>(d)</display>social security, Medicare, and Medicaid;
          </subsection>
          <subsection ssid="1-15" numlevel="1" lineno="52" slineno="1-25" dnum="e-o">
            <display>(e)</display>state-required temporary nonoccupational income replacement insurance or disability  
            <ln numlevel="1" lineno="53" slineno="1-26"/>income insurance;
          </subsection>
          <subsection ssid="1-16" numlevel="1" lineno="54" slineno="1-27" dnum="f-o">
            <display>(f)</display>workers' compensation;
          </subsection>
          <subsection ssid="1-17" numlevel="1" lineno="55" slineno="1-28" dnum="g-o">
            <display>(g)</display>wage continuation programs of any employer;
          </subsection>
          <subsection ssid="1-18" numlevel="1" lineno="56" slineno="1-29" dnum="h-o">
            <display>(h)</display>proceeds of a contract of insurance payable to the victim for the loss the victim  
            <ln numlevel="1" lineno="57" slineno="1-30"/>sustained because of the criminally injurious conduct;
          </subsection>
          <subsection ssid="1-19" numlevel="1" lineno="58" slineno="1-31" dnum="i-o">
            <display>(i)</display>a contract providing prepaid hospital and other health care services or benefits for  
            <ln numlevel="1" lineno="59" slineno="1-32"/>disability; or
          </subsection>
          <subsection ssid="1-20" numlevel="1" lineno="60" slineno="1-33" dnum="j-o">
            <display>(j)</display>veteran's benefits, including veteran's hospitalization benefits.
          </subsection>
        </subsection>
        <subsection ssid="1-21" numlevel="1" lineno="61" slineno="1-34" dnum="8-o">
          <display>(8)</display>"Criminal justice system victim advocate" means the same as that term is defined in  
          <ln numlevel="1" lineno="62" slineno="1-35"/>Section  
          <xref depth="3" refnumber="77-38-403">77-38-403</xref>.
        </subsection>
        <subsection ssid="1-22" numlevel="1" lineno="63" slineno="1-36" dnum="9-o" space="false">
          <display>(9)</display>
          <subsection ssid="1-23" dnum="a-o" placement="sameline">
            <display>(a)</display>"Criminally injurious conduct" other than acts of war declared or not declared 
            <ln numlevel="1" lineno="64" slineno="1-37"/>means conduct that:
            <subsection ssid="1-24" numlevel="1" lineno="65" slineno="1-38" dnum="i-o" tab="1">
              <display>(i)</display>is or would be subject to prosecution in this state under Section 
              <xref depth="3" refnumber="76-1-201">76-1-201</xref>;
            </subsection>
            <subsection ssid="1-25" numlevel="1" lineno="66" slineno="1-39" dnum="ii-o" tab="1">
              <display>(ii)</display>occurs or is attempted;
            </subsection>
            <subsection ssid="1-26" numlevel="1" lineno="67" slineno="1-40" dnum="iii-o" tab="1">
              <display>(iii)</display>causes, or poses a substantial threat of causing, bodily injury or death;
            </subsection>
            <subsection ssid="1-27" numlevel="1" lineno="68" slineno="1-41" dnum="iv-o" tab="1">
              <display>(iv)</display>is punishable by fine, imprisonment, or death if the individual engaging in the 
              <ln numlevel="1" lineno="69" slineno="1-42"/>conduct possessed the capacity to commit the conduct; and
            </subsection>
            <subsection ssid="1-28" numlevel="1" lineno="70" slineno="1-43" dnum="v-o" tab="1">
              <display>(v)</display>does not arise out of the ownership, maintenance, or use of a motor vehicle, 
              <ln numlevel="1" lineno="71" slineno="1-44"/>aircraft, or water craft, unless the conduct is:
              <subsection ssid="1-29" numlevel="1" lineno="72" slineno="1-45" dnum="A-o">
                <display>(A)</display>intended to cause bodily injury or death;
              </subsection>
              <subsection ssid="1-30" numlevel="1" lineno="73" slineno="1-46" dnum="B-o">
                <display>(B)</display>punishable under Title 76, Chapter 5, Offenses Against the Individual; or
              </subsection>
              <subsection ssid="1-31" numlevel="1" lineno="74" slineno="1-47" dnum="C-o">
                <display>(C)</display>chargeable as an offense for driving under the influence of alcohol or drugs.
              </subsection>
            </subsection>
          </subsection>
          <subsection ssid="1-32" numlevel="1" lineno="75" slineno="1-48" dnum="b-o">
            <display>(b)</display>"Criminally injurious conduct" includes a felony violation of Section 
            <xref depth="3" refnumber="76-7-101">76-7-101</xref> and 
            <ln numlevel="1" lineno="76" slineno="1-49"/>other conduct leading to the psychological injury of an individual resulting from 
            <ln numlevel="1" lineno="77" slineno="1-50"/>living in a setting that involves a bigamous relationship.
          </subsection>
        </subsection>
        <subsection ssid="1-33" numlevel="1" lineno="78" slineno="1-51" dnum="10-o" space="false">
          <display>(10)</display>
          <subsection ssid="1-34" dnum="a-o" placement="sameline">
            <display>(a)</display>"Dependent" means a natural person to whom the victim is wholly or partially 
            <ln numlevel="1" lineno="79" slineno="1-52"/>legally responsible for care or support.
          </subsection>
          <subsection ssid="1-35" numlevel="1" lineno="80" slineno="1-53" dnum="b-o">
            <display>(b)</display>"Dependent" includes a child of the victim born after the victim's death.
          </subsection>
        </subsection>
        <subsection ssid="1-36" numlevel="1" lineno="81" slineno="1-54" dnum="11-o">
          <display>(11)</display>"Dependent's economic loss" means loss after the victim's death of contributions of  
          <ln numlevel="1" lineno="82" slineno="1-55"/>things of economic value to the victim's dependent, not including services the dependent  
          <ln numlevel="1" lineno="83" slineno="1-56"/>would have received from the victim if the victim had not suffered the fatal injury, less  
          <ln numlevel="1" lineno="84" slineno="1-57"/>expenses of the dependent avoided by reason of victim's death.
        </subsection>
        <subsection ssid="1-37" numlevel="1" lineno="85" slineno="1-58" dnum="12-o">
          <display>(12)</display>"Dependent's replacement services loss" means loss reasonably and necessarily  
          <ln numlevel="1" lineno="86" slineno="1-59"/>incurred by the dependent after the victim's death in obtaining services in lieu of those  
          <ln numlevel="1" lineno="87" slineno="1-60"/>the decedent would have performed for the victim's benefit if the victim had not suffered  
          <ln numlevel="1" lineno="88" slineno="1-61"/>the fatal injury, less expenses of the dependent avoided by reason of the victim's death  
          <ln numlevel="1" lineno="89" slineno="1-62"/>and not subtracted in calculating the dependent's economic loss.
        </subsection>
        <subsection ssid="1-38" numlevel="1" lineno="90" slineno="1-63" dnum="13-o">
          <display>(13)</display>"Director" means the director of the office.
        </subsection>
        <subsection ssid="1-39" numlevel="1" lineno="91" slineno="1-64" dnum="14-o">
          <display>(14)</display>"Disposition" means the sentencing or determination of penalty or punishment to be  
          <ln numlevel="1" lineno="92" slineno="1-65"/>imposed upon an individual:
          <subsection ssid="1-40" numlevel="1" lineno="93" slineno="1-66" dnum="a-o">
            <display>(a)</display>convicted of a crime;
          </subsection>
          <subsection ssid="1-41" numlevel="1" lineno="94" slineno="1-67" dnum="b-o">
            <display>(b)</display>found delinquent; or
          </subsection>
          <subsection ssid="1-42" numlevel="1" lineno="95" slineno="1-68" dnum="c-o">
            <display>(c)</display>against whom a finding of sufficient facts for conviction or finding of delinquency is  
            <ln numlevel="1" lineno="96" slineno="1-69"/>made.
          </subsection>
        </subsection>
        <subsection ssid="1-43" numlevel="1" lineno="97" slineno="1-70" dnum="15-o" space="false">
          <display>(15)</display>
          <subsection ssid="1-44" dnum="a-o" placement="sameline">
            <display>(a)</display>"Economic loss" means economic detriment consisting only of allowable 
            <ln numlevel="1" lineno="98" slineno="1-71"/>expense, work loss, replacement services loss, and if injury causes death, dependent's 
            <ln numlevel="1" lineno="99" slineno="1-72"/>economic loss and dependent's replacement service loss.
          </subsection>
          <subsection ssid="1-45" numlevel="1" lineno="100" slineno="1-73" dnum="b-o">
            <display>(b)</display>"Economic loss" includes economic detriment even if caused by pain and suffering 
            <ln numlevel="1" lineno="101" slineno="1-74"/>or physical impairment.
          </subsection>
          <subsection ssid="1-46" numlevel="1" lineno="102" slineno="1-75" dnum="c-o">
            <display>(c)</display>"Economic loss" does not include noneconomic detriment.
          </subsection>
        </subsection>
        <subsection ssid="1-47" numlevel="1" lineno="103" slineno="1-76" dnum="16-o">
          <display>(16)</display>"Elderly victim" means an individual who is 60 years old or older and who is a victim.
        </subsection>
        <subsection ssid="1-48" numlevel="1" lineno="104" slineno="1-77" dnum="17-o">
          <display>(17)</display>"Fraudulent claim" means a filed reparations based on material misrepresentation of  
          <ln numlevel="1" lineno="105" slineno="1-78"/>fact and intended to deceive the reparations staff for the purpose of obtaining reparation  
          <ln numlevel="1" lineno="106" slineno="1-79"/>funds for which the claimant is not eligible.
        </subsection>
        <subsection ssid="1-49" numlevel="1" lineno="107" slineno="1-80" dnum="18-o">
          <display>(18)</display>"Fund" means the Crime Victim Reparations Fund created in Section  
          <xref depth="3" refnumber="63M-7-526">63M-7-526</xref>.
        </subsection>
        <subsection ssid="1-50" numlevel="1" lineno="108" slineno="1-81" dnum="19-o" space="false">
          <display>(19)</display>
          <subsection ssid="1-51" dnum="a-o" placement="sameline">
            <display>(a)</display>"Interpersonal violence" means an act involving violence, physical harm, or a 
            <ln numlevel="1" lineno="109" slineno="1-82"/>threat of violence or physical harm, that is committed by an individual who is or has 
            <ln numlevel="1" lineno="110" slineno="1-83"/>been in a domestic, dating, sexual, or intimate relationship with the victim.
          </subsection>
          <subsection ssid="1-52" numlevel="1" lineno="111" slineno="1-84" dnum="b-o">
            <display>(b)</display>"Interpersonal violence" includes any attempt, conspiracy, or solicitation of an act 
            <ln numlevel="1" lineno="112" slineno="1-85"/>described in Subsection (19)(a).
          </subsection>
        </subsection>
        <subsection ssid="1-53" ea="amend" anum="0" owner="bwalters" style="1" numlevel="1" lineno="113" slineno="1-86" dnum="_-e:20-e">

            <ln numlevel="1" lineno="114" slineno="1-87"/>power and charged with making arrests in connection with enforcement of the criminal  
            <ln numlevel="1" lineno="115" slineno="1-88"/>statutes and ordinances of this state or any political subdivision.

        </subsection>

            <display>(b)</display>"Medical examination" does not include mental health evaluations for the

          </display>"Mental health counseling" means outpatient and inpatient counseling

          <ln numlevel="1" lineno="124" slineno="1-97"/>board in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act.
        </subsection>
        <subsection ssid="1-59" numlevel="1" lineno="125" slineno="1-98" dnum="23-o:24-e">

          </display>"Misconduct" means conduct by the victim that was attributable to the injury or

          <ln numlevel="1" lineno="127" slineno="1-100"/>63G, Chapter 3, Utah Administrative Rulemaking Act.
        </subsection>

          </display>"Noneconomic detriment" means pain, suffering, inconvenience, physical

        </subsection>

          <tab/>In addition to all rights afforded to victims and witnesses under this chapter, child  
          <ln numlevel="1" lineno="253" slineno="3-4"/>victims and witnesses shall be afforded these rights:
        </sectionText>
        <subsection ssid="3-1" numlevel="1" lineno="254" slineno="3-5" dnum="1-o">
          <display>(1)</display>Children have the right to protection from physical and emotional abuse during their  
          <ln numlevel="1" lineno="255" slineno="3-6"/>involvement with the criminal justice process.
        </subsection>
        <subsection ssid="3-2" numlevel="1" lineno="256" slineno="3-7" dnum="2-o">
          <display>(2)</display>Children are not responsible for inappropriate behavior adults commit against them and  
          <ln numlevel="1" lineno="257" slineno="3-8"/>have the right not to be questioned, in any manner, nor to have allegations made,  
          <ln numlevel="1" lineno="258" slineno="3-9"/>implying this responsibility.  Those who interview children have the responsibility to  
          <ln numlevel="1" lineno="259" slineno="3-10"/>consider the interests of the child in this regard.
        </subsection>
        <subsection ssid="3-3" numlevel="1" lineno="260" slineno="3-11" dnum="3-o">
          <display>(3)</display>Child victims and witnesses have the right to have interviews relating to a criminal  
          <ln numlevel="1" lineno="261" slineno="3-12"/>prosecution kept to a minimum.  All agencies shall coordinate interviews and ensure that  
          <ln numlevel="1" lineno="262" slineno="3-13"/>they are conducted by persons sensitive to the needs of children.
        </subsection>
        <subsection ssid="3-4" numlevel="1" lineno="263" slineno="3-14" dnum="4-o">
          <display>(4)</display>Child victims have the right to be informed of available community resources that might  
          <ln numlevel="1" lineno="264" slineno="3-15"/>assist them and how to gain access to those resources.  Law enforcement and  
          <ln numlevel="1" lineno="265" slineno="3-16"/>prosecutors have the duty to ensure that child victims are informed of community  
          <ln numlevel="1" lineno="266" slineno="3-17"/>resources, including counseling prior to the court proceeding, and have those services  
          <ln numlevel="1" lineno="267" slineno="3-18"/>available throughout the criminal justice process.
        </subsection>
        <subsection ssid="3-5" numlevel="1" lineno="268" slineno="3-19" dnum="5-o" space="false">
          <display>(5)</display>
          <subsection ssid="3-6" dnum="a-o" placement="sameline">
            <display>(a)</display>Child victims have the right, once an investigation has been initiated by law 
            <ln numlevel="1" lineno="269" slineno="3-20"/>enforcement or the Division of Child and Family Services, to keep confidential their 
            <ln numlevel="1" lineno="270" slineno="3-21"/>interviews that are conducted at a Children's Justice Center, including video and 
            <ln numlevel="1" lineno="271" slineno="3-22"/>audio recordings, and transcripts of those recordings. Except as provided in 
            <ln numlevel="1" lineno="272" slineno="3-23"/>Subsection (6), recordings and transcripts of interviews may not be distributed, 
            <ln numlevel="1" lineno="273" slineno="3-24"/>released, or displayed to anyone without a court order.
          </subsection>
          <subsection ssid="3-7" numlevel="1" lineno="274" slineno="3-25" dnum="b-o">
            <display>(b)</display>A court order described in Subsection (5)(a):
            <subsection ssid="3-8" numlevel="1" lineno="275" slineno="3-26" dnum="i-o">
              <display>(i)</display>shall describe with particularity to whom the recording or transcript of the 
              <ln numlevel="1" lineno="276" slineno="3-27"/>interview may be released and prohibit further distribution or viewing by anyone 
              <ln numlevel="1" lineno="277" slineno="3-28"/>not named in the order; and
            </subsection>
            <subsection ssid="3-9" numlevel="1" lineno="278" slineno="3-29" dnum="ii-o">
              <display>(ii)</display>may impose restrictions on access to the materials considered reasonable to 
              <ln numlevel="1" lineno="279" slineno="3-30"/>protect the privacy of the child victim.
            </subsection>
          </subsection>
          <subsection ssid="3-10" numlevel="1" lineno="280" slineno="3-31" dnum="c-o">
            <display>(c)</display>A parent or guardian of the child victim may petition a juvenile or district court for 
            <ln numlevel="1" lineno="281" slineno="3-32"/>an order allowing the parent or guardian to view a recording or transcript upon a 
            <ln numlevel="1" lineno="282" slineno="3-33"/>finding of good cause. The order shall designate the agency that is required to 
            <ln numlevel="1" lineno="283" slineno="3-34"/>display the recording or transcript to the parent or guardian and shall prohibit viewing 
            <ln numlevel="1" lineno="284" slineno="3-35"/>by anyone not named in the order.
          </subsection>
          <subsection ssid="3-11" numlevel="1" lineno="285" slineno="3-36" dnum="d-o">
            <display>(d)</display>Following the conclusion of any legal proceedings in which the recordings or 
            <ln numlevel="1" lineno="286" slineno="3-37"/>transcripts are used, the court shall order the recordings and transcripts in the court's 
            <ln numlevel="1" lineno="287" slineno="3-38"/>file sealed and preserved.
          </subsection>
        </subsection>
        <subsection ssid="3-12" numlevel="1" lineno="288" slineno="3-39" dnum="6-o" space="false">
          <display>(6)</display>
          <subsection ssid="3-13" dnum="a-o" placement="sameline">
            <display>(a)</display>The following offices and their designated employees may distribute and receive 
            <ln numlevel="1" lineno="289" slineno="3-40"/>a recording or transcript to and from one another without a court order:
            <subsection ssid="3-14" numlevel="1" lineno="290" slineno="3-41" dnum="i-o" tab="1">
              <display>(i)</display>the Division of Child and Family Services;
            </subsection>
            <subsection ssid="3-15" numlevel="1" lineno="291" slineno="3-42" dnum="ii-o" tab="1">
              <display>(ii)</display>administrative law judges employed by the Department of Human Services;
            </subsection>
            <subsection ssid="3-16" numlevel="1" lineno="292" slineno="3-43" dnum="iii-o" tab="1">
              <display>(iii)</display>Department of Human Services investigators investigating the Division of Child 
              <ln numlevel="1" lineno="293" slineno="3-44"/>and Family Services or investigators authorized to investigate under Section 
              <xref depth="3" refnumber="80-2-703">
                <ln numlevel="1" lineno="294" slineno="3-45"/>80-2-703
              </xref>;
            </subsection>
            <subsection ssid="3-17" numlevel="1" lineno="295" slineno="3-46" dnum="iv-o" tab="1">
              <display>(iv)</display>an office of the city attorney, county attorney, district attorney, or attorney 
              <ln numlevel="1" lineno="296" slineno="3-47"/>general;
            </subsection>
            <subsection ssid="3-18" numlevel="1" lineno="297" slineno="3-48" dnum="v-o" tab="1">
              <display>(v)</display>a law enforcement agency;
            </subsection>
            <subsection ssid="3-19" numlevel="1" lineno="298" slineno="3-49" dnum="vi-o" tab="1">
              <display>(vi)</display>a Children's Justice Center established under Section 
              <xref depth="3" refnumber="67-5b-102">67-5b-102</xref>; or
            </subsection>
            <subsection ssid="3-20" numlevel="1" lineno="299" slineno="3-50" dnum="vii-o" tab="1">
              <display>(vii)</display>the attorney for the child who is the subject of the interview.
            </subsection>
          </subsection>
          <subsection ssid="3-21" numlevel="1" lineno="300" slineno="3-51" dnum="b-o">
            <display>(b)</display>In a criminal case or in a juvenile court in which the state is a party:
            <subsection ssid="3-22" numlevel="1" lineno="301" slineno="3-52" dnum="i-o">
              <display>(i)</display>the parties may display and enter into evidence a recording or transcript in the 
              <ln numlevel="1" lineno="302" slineno="3-53"/>course of a prosecution;
            </subsection>
            <subsection ssid="3-23" numlevel="1" lineno="303" slineno="3-54" dnum="ii-o">
              <display>(ii)</display>the state's attorney may distribute a recording or transcript to the attorney for the 
              <ln numlevel="1" lineno="304" slineno="3-55"/>defendant, pro se defendant, respondent, or pro se respondent pursuant to a valid 
              <ln numlevel="1" lineno="305" slineno="3-56"/>request for discovery;
            </subsection>
            <subsection ssid="3-24" numlevel="1" lineno="306" slineno="3-57" dnum="iii-o">
              <display>(iii)</display>the attorney for the defendant or respondent may do one or both of the following:
              <subsection ssid="3-25" numlevel="1" lineno="307" slineno="3-58" dnum="A-o">
                <display>(A)</display>release the recording or transcript to an expert retained by the attorney for the 
                <ln numlevel="1" lineno="308" slineno="3-59"/>defendant or respondent if the expert agrees in writing that the expert will not 
                <ln numlevel="1" lineno="309" slineno="3-60"/>distribute, release, or display the recording or transcript to anyone without prior 
                <ln numlevel="1" lineno="310" slineno="3-61"/>authorization from the court; or
              </subsection>
              <subsection ssid="3-26" numlevel="1" lineno="311" slineno="3-62" dnum="B-o">
                <display>(B)</display>permit the defendant or respondent to view the recording or transcript, but 
                <ln numlevel="1" lineno="312" slineno="3-63"/>may not distribute or release the recording or transcript to the defendant or 
                <ln numlevel="1" lineno="313" slineno="3-64"/>respondent; and
              </subsection>
            </subsection>
            <subsection ssid="3-27" numlevel="1" lineno="314" slineno="3-65" dnum="iv-o">
              <display>(iv)</display>the court shall advise a pro se defendant or respondent that a recording or 
              <ln numlevel="1" lineno="315" slineno="3-66"/>transcript received as part of discovery is confidential and may not be distributed, 
              <ln numlevel="1" lineno="316" slineno="3-67"/>released, or displayed without prior authorization from the court.
            </subsection>
          </subsection>
          <subsection ssid="3-28" numlevel="1" lineno="317" slineno="3-68" dnum="c-o">
            <display>(c)</display>A court's failure to advise a pro se defendant or respondent that a recording or 
            <ln numlevel="1" lineno="318" slineno="3-69"/>transcript received as part of discovery is confidential and may not be used as a 
            <ln numlevel="1" lineno="319" slineno="3-70"/>defense to prosecution for a violation of the disclosure rule.
          </subsection>
          <subsection ssid="3-29" numlevel="1" lineno="320" slineno="3-71" dnum="d-o">
            <display>(d)</display>In an administrative case, pursuant to a written request, the Division of Child and 
            <ln numlevel="1" lineno="321" slineno="3-72"/>Family Services may display, but may not distribute or release, a recording or 
            <ln numlevel="1" lineno="322" slineno="3-73"/>transcript to the respondent or to the respondent's designated representative.
          </subsection>
          <subsection ssid="3-30" numlevel="1" lineno="323" slineno="3-74" dnum="e-o" space="false">
            <display>(e)</display>
            <subsection ssid="3-31" dnum="i-o" placement="sameline">
              <display>(i)</display>Within two business days of a request from a parent or guardian of a child 
              <ln numlevel="1" lineno="324" slineno="3-75"/>victim, an investigative agency shall allow the parent or guardian to view a 
              <ln numlevel="1" lineno="325" slineno="3-76"/>recording after the conclusion of an interview, unless:
              <subsection ssid="3-32" numlevel="1" lineno="326" slineno="3-77" dnum="A-o" tab="1">
                <display>(A)</display>the suspect is a parent or guardian of the child victim;
              </subsection>
              <subsection ssid="3-33" numlevel="1" lineno="327" slineno="3-78" dnum="B-o" tab="1">
                <display>(B)</display>the suspect resides in the home with the child victim; or
              </subsection>
              <subsection ssid="3-34" numlevel="1" lineno="328" slineno="3-79" dnum="C-o" tab="1">
                <display>(C)</display>the investigative agency determines that allowing the parent or guardian to 
                <ln numlevel="1" lineno="329" slineno="3-80"/>view the recording would likely compromise or impede the investigation.
              </subsection>
            </subsection>
            <subsection ssid="3-35" numlevel="1" lineno="330" slineno="3-81" dnum="ii-o">
              <display>(ii)</display>If the investigative agency determines that allowing the parent or guardian to 
              <ln numlevel="1" lineno="331" slineno="3-82"/>view the recording would likely compromise or impede the investigation, the 
              <ln numlevel="1" lineno="332" slineno="3-83"/>parent or guardian may petition a juvenile or district court for an expedited 
              <ln numlevel="1" lineno="333" slineno="3-84"/>hearing on whether there is good cause for the court to enter an order allowing the 
              <ln numlevel="1" lineno="334" slineno="3-85"/>parent or guardian to view the recording in accordance with Subsection (5)(c).
            </subsection>
            <subsection ssid="3-36" numlevel="1" lineno="335" slineno="3-86" dnum="iii-o">
              <display>(iii)</display>A Children's Justice Center shall coordinate the viewing of the recording 
              <ln numlevel="1" lineno="336" slineno="3-87"/>described in this Subsection (6)(e).
            </subsection>
          </subsection>
          <subsection ssid="3-37" numlevel="1" lineno="337" slineno="3-88" dnum="f-o">
            <display>(f)</display>A multidisciplinary team assembled by a Children's Justice Center or an 
            <ln numlevel="1" lineno="338" slineno="3-89"/>interdisciplinary team assembled by the Division of Child and Family Services may 
            <ln numlevel="1" lineno="339" slineno="3-90"/>view a recording or transcript, but may not receive a recording or transcript.
          </subsection>
          <subsection ssid="3-38" numlevel="1" lineno="340" slineno="3-91" dnum="g-o">
            <display>(g)</display>A Children's Justice Center:
            <subsection ssid="3-39" numlevel="1" lineno="341" slineno="3-92" dnum="i-o">
              <display>(i)</display>may distribute or display a recording or transcript to an authorized trainer or 
              <ln numlevel="1" lineno="342" slineno="3-93"/>evaluator for purposes of training or evaluation; and
            </subsection>
            <subsection ssid="3-40" numlevel="1" lineno="343" slineno="3-94" dnum="ii-o">
              <display>(ii)</display>may display, but may not distribute, a recording or transcript to an authorized 
              <ln numlevel="1" lineno="344" slineno="3-95"/>trainee.
            </subsection>
          </subsection>
          <subsection ssid="3-41" numlevel="1" lineno="345" slineno="3-96" dnum="h-o">
            <display>(h)</display>An authorized trainer or instructor may display a recording or transcript according to 
            <ln numlevel="1" lineno="346" slineno="3-97"/>the terms of the authorized trainer's or instructor's contract with the Children's Justice 
            <ln numlevel="1" lineno="347" slineno="3-98"/>Center or according to the authorized trainer's or instructor's scope of employment.
          </subsection>
          <subsection ssid="3-42" numlevel="1" lineno="348" slineno="3-99" dnum="i-o" space="false">
            <display>(i)</display>
            <subsection ssid="3-43" dnum="i-o" placement="sameline">
              <display>(i)</display>In an investigation under Section 
              <xref depth="3" refnumber="53E-6-506">53E-6-506</xref>, in which a child victim who is the 
              <ln numlevel="1" lineno="349" slineno="3-100"/>subject of the recording or transcript has alleged criminal conduct against an 
              <ln numlevel="1" lineno="350" slineno="3-101"/>educator, a law enforcement agency may distribute or release the recording or 
              <ln numlevel="1" lineno="351" slineno="3-102"/>transcript to an investigator operating under State Board of Education 
              <ln numlevel="1" lineno="352" slineno="3-103"/>authorization, upon the investigator's written request.
            </subsection>
            <subsection ssid="3-44" numlevel="1" lineno="353" slineno="3-104" dnum="ii-o">
              <display>(ii)</display>If the respondent in a case investigated under Section 
              <xref depth="3" refnumber="53E-6-506">53E-6-506</xref> requests a 
              <ln numlevel="1" lineno="354" slineno="3-105"/>hearing authorized under that section, the investigator operating under State Board 
              <ln numlevel="1" lineno="355" slineno="3-106"/>of Education authorization may display, release, or distribute the recording or 
              <ln numlevel="1" lineno="356" slineno="3-107"/>transcript to the prosecutor operating under State Board of Education 
              <ln numlevel="1" lineno="357" slineno="3-108"/>authorization or to an expert retained by an investigator.
            </subsection>
            <subsection ssid="3-45" numlevel="1" lineno="358" slineno="3-109" dnum="iii-o">
              <display>(iii)</display>Upon request for a hearing under Section 
              <xref depth="3" refnumber="53E-6-506">53E-6-506</xref>, a prosecutor operating 
              <ln numlevel="1" lineno="359" slineno="3-110"/>under State Board of Education authorization may display the recording or 
              <ln numlevel="1" lineno="360" slineno="3-111"/>transcript to a pro se respondent, to an attorney retained by the respondent, or to 
              <ln numlevel="1" lineno="361" slineno="3-112"/>an expert retained by the respondent.
            </subsection>
            <subsection ssid="3-46" numlevel="1" lineno="362" slineno="3-113" dnum="iv-o">
              <display>(iv)</display>The parties to a hearing authorized under Section 
              <xref depth="3" refnumber="53E-6-506">53E-6-506</xref> may display and 
              <ln numlevel="1" lineno="363" slineno="3-114"/>enter into evidence a recording or transcript in the course of a prosecution.
            </subsection>
          </subsection>
          <subsection ssid="3-47" ea="amend" anum="0" owner="bwalters" style="1" numlevel="1" lineno="364" slineno="3-115" dnum="_-e:j-e">
            <display>
              <amend anum="0" ea="amend" pairid="48" style="1" owner="e" level="1" amendtag="start">(j)</amend>
            </display>
            <amend anum="0" ea="amend" pairid="2" style="1" owner="bwalters" level="1" amendtag="end">Notwithstanding any other provision in this section, a law enforcement agency shall 
              <ln numlevel="1" lineno="365" slineno="3-116"/>provide an investigative report to the Utah Office for Victims of Crime as provided 
              <ln numlevel="1" lineno="366" slineno="3-117"/>under Section 
              <xref depth="3" refnumber="63M-7-527">63M-7-527</xref>.
            </amend>
          </subsection>
        </subsection>
        <subsection ssid="3-48" numlevel="1" lineno="367" slineno="3-118" dnum="7-o">
          <display>(7)</display>Except as otherwise provided in this section, it is a class B misdemeanor for any  
          <ln numlevel="1" lineno="368" slineno="3-119"/>individual to distribute, release, or display any recording or transcript of an interview of  
          <ln numlevel="1" lineno="369" slineno="3-120"/>a child victim conducted at a Children's Justice Center.
        </subsection>
