    <gdhead lineno="4">General Description:</gdhead>
    <gd numlevel="1" lineno="5" slineno="0-5">This bill amends provisions related to victims of sexual offenses.</gd>
    <hphead lineno="6">Highlighted Provisions:</hphead>
    <hp numlevel="1" lineno="7" slineno="0-7">This bill:
      <hl numlevel="1" lineno="8" slineno="0-8" level="1">defines terms;</hl>
      <hl numlevel="1" lineno="9" slineno="0-9" level="1">moves a statute regarding custody and parent-time for a child conceived as a result of a  
        <ln numlevel="1" lineno="10" slineno="0-10"/>sexual offense;
      </hl>
      <hl numlevel="1" lineno="11" slineno="0-11" level="1">amends the requirements for retaining or disposing of a sexual assault kit;</hl>
      <hl numlevel="1" lineno="12" slineno="0-12" level="1">requires  
        <amend anum="0" ea="amend" pairid="2" style="1" owner="jrenner" level="1" amendtag="both">an </amend>agency to provide a victim with notice of intent when the agency intends to  
        <ln numlevel="1" lineno="13" slineno="0-13"/>destroy or dispose of a sexual assault kit;
      </hl>
      <hl numlevel="1" lineno="14" slineno="0-14" level="1">addresses the rights for victims of sexual offenses, including rights related to sexual  
        <ln numlevel="1" lineno="15" slineno="0-15"/>assault kits;
      </hl>
      <hl numlevel="1" lineno="16" slineno="0-16" level="1">allows for the termination of parental rights of a parent who was convicted of a sexual  
        <ln numlevel="1" lineno="17" slineno="0-17"/>offense that resulted in conception of the child when termination is in the best interests of the  
        <ln numlevel="1" lineno="18" slineno="0-18"/>child; and
      </hl>
      <hl numlevel="1" lineno="19" slineno="0-19" level="1">makes technical and conforming changes.</hl>

      <section number="30-3-10" numlevel="1" lineno="47" slineno="1-2" type="amend">
        <secline lineno="46">Section 1, Section  
          <bold>30-3-10</bold> is amended to read:
        </secline>
        <catline lineno="47">
          <bold>30-3-10. Custody and parent-time of a child -- Custody factors -- Child  
            <ln numlevel="1" lineno="48" slineno="1-3"/>conceived as a result of a sexual offense.
          </bold>
        </catline>
        <subsection ssid="1-1" numlevel="1" lineno="49" slineno="1-4" dnum="1-o" placement="noreturn">
          <display>(1)</display>If a married couple having one or more minor children are separated, or the married  
          <ln numlevel="1" lineno="50" slineno="1-5"/>couple's marriage is declared void or dissolved, the court shall enter, and has continuing  
          <ln numlevel="1" lineno="51" slineno="1-6"/>jurisdiction to modify, an order of custody and parent-time.
        </subsection>
        <subsection ssid="1-2" numlevel="1" lineno="52" slineno="1-7" dnum="2-o">
          <display>(2)</display>In determining any form of custody and parent-time under Subsection (1), the court  
          <ln numlevel="1" lineno="53" slineno="1-8"/>shall consider the best interest of the child and may consider among other factors the  
          <ln numlevel="1" lineno="54" slineno="1-9"/>court finds relevant, the following for each parent:
          <subsection ssid="1-3" numlevel="1" lineno="55" slineno="1-10" dnum="a-o">
            <display>(a)</display>evidence of domestic violence, neglect, physical abuse, sexual abuse, or emotional  
            <ln numlevel="1" lineno="56" slineno="1-11"/>abuse, involving the child, the parent, or a household member of the parent;
          </subsection>
          <subsection ssid="1-4" numlevel="1" lineno="57" slineno="1-12" dnum="b-o">
            <display>(b)</display>the parent's demonstrated understanding of, responsiveness to, and ability to meet the  
            <ln numlevel="1" lineno="58" slineno="1-13"/>developmental needs of the child, including the child's:
            <subsection ssid="1-5" numlevel="1" lineno="59" slineno="1-14" dnum="i-o">
              <display>(i)</display>physical needs;
            </subsection>
            <subsection ssid="1-6" numlevel="1" lineno="60" slineno="1-15" dnum="ii-o">
              <display>(ii)</display>emotional needs;
            </subsection>
            <subsection ssid="1-7" numlevel="1" lineno="61" slineno="1-16" dnum="iii-o">
              <display>(iii)</display>educational needs;
            </subsection>
            <subsection ssid="1-8" numlevel="1" lineno="62" slineno="1-17" dnum="iv-o">
              <display>(iv)</display>medical needs; and
            </subsection>
            <subsection ssid="1-9" numlevel="1" lineno="63" slineno="1-18" dnum="v-o">
              <display>(v)</display>any special needs;
            </subsection>
          </subsection>
          <subsection ssid="1-10" numlevel="1" lineno="64" slineno="1-19" dnum="c-o">
            <display>(c)</display>the parent's capacity and willingness to function as a parent, including:
            <subsection ssid="1-11" numlevel="1" lineno="65" slineno="1-20" dnum="i-o">
              <display>(i)</display>parenting skills;
            </subsection>
            <subsection ssid="1-12" numlevel="1" lineno="66" slineno="1-21" dnum="ii-o">
              <display>(ii)</display>co-parenting skills, including:
              <subsection ssid="1-13" numlevel="1" lineno="67" slineno="1-22" dnum="A-o">
                <display>(A)</display>ability to appropriately communicate with the other parent;
              </subsection>
              <subsection ssid="1-14" numlevel="1" lineno="68" slineno="1-23" dnum="B-o">
                <display>(B)</display>ability to encourage the sharing of love and affection; and
              </subsection>
              <subsection ssid="1-15" numlevel="1" lineno="69" slineno="1-24" dnum="C-o">
                <display>(C)</display>willingness to allow frequent and continuous contact between the child and  
                <ln numlevel="1" lineno="70" slineno="1-25"/>the other parent, except that, if the court determines that the parent is acting to  
                <ln numlevel="1" lineno="71" slineno="1-26"/>protect the child from domestic violence, neglect, or abuse, the parent's  
                <ln numlevel="1" lineno="72" slineno="1-27"/>protective actions may be taken into consideration; and
              </subsection>
            </subsection>
            <subsection ssid="1-16" numlevel="1" lineno="73" slineno="1-28" dnum="iii-o">
              <display>(iii)</display>ability to provide personal care rather than surrogate care;
            </subsection>
          </subsection>
          <subsection ssid="1-17" numlevel="1" lineno="74" slineno="1-29" dnum="d-o">
            <display>(d)</display>in accordance with Subsection (10), the past conduct and demonstrated moral  
            <ln numlevel="1" lineno="75" slineno="1-30"/>character of the parent;
          </subsection>
          <subsection ssid="1-18" numlevel="1" lineno="76" slineno="1-31" dnum="e-o">
            <display>(e)</display>the emotional stability of the parent;
          </subsection>
          <subsection ssid="1-19" numlevel="1" lineno="77" slineno="1-32" dnum="f-o">
            <display>(f)</display>the parent's inability to function as a parent because of drug abuse, excessive  
            <ln numlevel="1" lineno="78" slineno="1-33"/>drinking, or other causes;
          </subsection>
          <subsection ssid="1-20" numlevel="1" lineno="79" slineno="1-34" dnum="g-o">
            <display>(g)</display>whether the parent has intentionally exposed the child to pornography or material  
            <ln numlevel="1" lineno="80" slineno="1-35"/>harmful to minors, as "material" and "harmful to minors" are defined in Section  
            <xref depth="3" refnumber="76-10-1201">
              <ln numlevel="1" lineno="81" slineno="1-36"/>76-10-1201
            </xref>;
          </subsection>
          <subsection ssid="1-21" numlevel="1" lineno="82" slineno="1-37" dnum="h-o">
            <display>(h)</display>the parent's reasons for having relinquished custody or parent-time in the past;
          </subsection>
          <subsection ssid="1-22" numlevel="1" lineno="83" slineno="1-38" dnum="i-o">
            <display>(i)</display>duration and depth of desire for custody or parent-time;
          </subsection>
          <subsection ssid="1-23" numlevel="1" lineno="84" slineno="1-39" dnum="j-o">
            <display>(j)</display>the parent's religious compatibility with the child;
          </subsection>
          <subsection ssid="1-24" numlevel="1" lineno="85" slineno="1-40" dnum="k-o">
            <display>(k)</display>the parent's financial responsibility;
          </subsection>
          <subsection ssid="1-25" numlevel="1" lineno="86" slineno="1-41" dnum="l-o">
            <display>(l)</display>the child's interaction and relationship with step-parents, extended family members of  
            <ln numlevel="1" lineno="87" slineno="1-42"/>other individuals who may significantly affect the child's best interests;
          </subsection>
          <subsection ssid="1-26" numlevel="1" lineno="88" slineno="1-43" dnum="m-o">
            <display>(m)</display>who has been the primary caretaker of the child;
          </subsection>
          <subsection ssid="1-27" numlevel="1" lineno="89" slineno="1-44" dnum="n-o">
            <display>(n)</display>previous parenting arrangements in which the child has been happy and  
            <ln numlevel="1" lineno="90" slineno="1-45"/>well-adjusted in the home, school, and community;
          </subsection>
          <subsection ssid="1-28" numlevel="1" lineno="91" slineno="1-46" dnum="o-o">
            <display>(o)</display>the relative benefit of keeping siblings together;
          </subsection>
          <subsection ssid="1-29" numlevel="1" lineno="92" slineno="1-47" dnum="p-o">
            <display>(p)</display>the stated wishes and concerns of the child, taking into consideration the child's  
            <ln numlevel="1" lineno="93" slineno="1-48"/>cognitive ability and emotional maturity;
          </subsection>
          <subsection ssid="1-30" numlevel="1" lineno="94" slineno="1-49" dnum="q-o">
            <display>(q)</display>the relative strength of the child's bond with the parent, meaning the depth, quality,  
            <ln numlevel="1" lineno="95" slineno="1-50"/>and nature of the relationship between the parent and the child; and
          </subsection>
          <subsection ssid="1-31" numlevel="1" lineno="96" slineno="1-51" dnum="r-o">
            <display>(r)</display>any other factor the court finds relevant.
          </subsection>
        </subsection>
        <subsection ssid="1-32" numlevel="1" lineno="97" slineno="1-52" dnum="3-o">
          <display>(3)</display>There is a rebuttable presumption that joint legal custody, as defined in Section  
          <xref depth="3" refnumber="30-3-10.1">
            <ln numlevel="1" lineno="98" slineno="1-53"/>30-3-10.1
          </xref>, is in the best interest of the child, except in cases when there is:
          <subsection ssid="1-33" numlevel="1" lineno="99" slineno="1-54" dnum="a-o">
            <display>(a)</display>evidence of domestic violence, neglect, physical abuse, sexual abuse, or emotional  
            <ln numlevel="1" lineno="100" slineno="1-55"/>abuse involving the child, a parent, or a household member of the parent;
          </subsection>
          <subsection ssid="1-34" numlevel="1" lineno="101" slineno="1-56" dnum="b-o">
            <display>(b)</display>special physical or mental needs of a parent or child, making joint legal custody  
            <ln numlevel="1" lineno="102" slineno="1-57"/>unreasonable;
          </subsection>
          <subsection ssid="1-35" numlevel="1" lineno="103" slineno="1-58" dnum="c-o">
            <display>(c)</display>physical distance between the residences of the parents, making joint decision  
            <ln numlevel="1" lineno="104" slineno="1-59"/>making impractical in certain circumstances; or
          </subsection>
          <subsection ssid="1-36" numlevel="1" lineno="105" slineno="1-60" dnum="d-o">
            <display>(d)</display>any other factor the court considers relevant including those listed in this section and  
            <ln numlevel="1" lineno="106" slineno="1-61"/>Section  
            <xref depth="3" refnumber="30-3-10.2">30-3-10.2</xref>.
          </subsection>
        </subsection>
        <subsection ssid="1-37" numlevel="1" lineno="107" slineno="1-62" dnum="4-o" space="false">
          <display>(4)</display>
          <subsection ssid="1-38" dnum="a-o" placement="sameline">
            <display>(a)</display>The person who desires joint legal custody shall file a proposed parenting plan in 
            <ln numlevel="1" lineno="108" slineno="1-63"/>accordance with Sections 
            <xref depth="3" refnumber="30-3-10.8">30-3-10.8</xref> and 
            <xref depth="3" refnumber="30-3-10.9">30-3-10.9</xref>.
          </subsection>
          <subsection ssid="1-39" numlevel="1" lineno="109" slineno="1-64" dnum="b-o">
            <display>(b)</display>A presumption for joint legal custody may be rebutted by a showing by a 
            <ln numlevel="1" lineno="110" slineno="1-65"/>preponderance of the evidence that it is not in the best interest of the child.
          </subsection>
        </subsection>
        <subsection ssid="1-40" numlevel="1" lineno="111" slineno="1-66" dnum="5-o" space="false">
          <display>(5)</display>
          <subsection ssid="1-41" dnum="a-o" placement="sameline">
            <display>(a)</display>A child may not be required by either party to testify unless the trier of fact 
            <ln numlevel="1" lineno="112" slineno="1-67"/>determines that extenuating circumstances exist that would necessitate the testimony 
            <ln numlevel="1" lineno="113" slineno="1-68"/>of the child be heard and there is no other reasonable method to present the child's 
            <ln numlevel="1" lineno="114" slineno="1-69"/>testimony.
          </subsection>
          <subsection ssid="1-42" numlevel="1" lineno="115" slineno="1-70" dnum="b-o" space="false">
            <display>(b)</display>
            <subsection ssid="1-43" dnum="i-o" placement="sameline">
              <display>(i)</display>The court may inquire of the child's and take into consideration the child's 
              <ln numlevel="1" lineno="116" slineno="1-71"/>desires regarding future custody or parent-time schedules, but the expressed 
              <ln numlevel="1" lineno="117" slineno="1-72"/>desires are not controlling and the court may determine the child's custody or

            </subsection>
            <subsection ssid="1-44" numlevel="1" lineno="119" slineno="1-74" dnum="ii-o">
              <display>(ii)</display>The desires of a child 14 years old or older shall be given added weight, but is not 
              <ln numlevel="1" lineno="120" slineno="1-75"/>the single controlling factor.
            </subsection>
          </subsection>
          <subsection ssid="1-45" numlevel="1" lineno="121" slineno="1-76" dnum="c-o" space="false">
            <display>(c)</display>
            <subsection ssid="1-46" dnum="i-o" placement="sameline">
              <display>(i)</display>If an interview with a child is conducted by the court pursuant to Subsection 
              <ln numlevel="1" lineno="122" slineno="1-77"/>(5)(b), the interview shall be conducted by the judge in camera.
            </subsection>
            <subsection ssid="1-47" numlevel="1" lineno="123" slineno="1-78" dnum="ii-o">
              <display>(ii)</display>The prior consent of the parties may be obtained but is not necessary if the court 
              <ln numlevel="1" lineno="124" slineno="1-79"/>finds that an interview with a child is the only method to ascertain the child's 
              <ln numlevel="1" lineno="125" slineno="1-80"/>desires regarding custody.
            </subsection>
          </subsection>
        </subsection>
        <subsection ssid="1-48" numlevel="1" lineno="126" slineno="1-81" dnum="6-o" space="false">
          <display>(6)</display>
          <subsection ssid="1-49" dnum="a-o" placement="sameline">
            <display>(a)</display>Except as provided in Subsection (6)(b), a court may not discriminate against a 
            <ln numlevel="1" lineno="127" slineno="1-82"/>parent due to a disability, as defined in Section 
            <xref depth="3" refnumber="57-21-2">57-21-2</xref>, in awarding custody or 
            <ln numlevel="1" lineno="128" slineno="1-83"/>determining whether a substantial change has occurred for the purpose of modifying 
            <ln numlevel="1" lineno="129" slineno="1-84"/>an award of custody.
          </subsection>
          <subsection ssid="1-50" numlevel="1" lineno="130" slineno="1-85" dnum="b-o">
            <display>(b)</display>The court may not consider the disability of a parent as a factor in awarding custody 
            <ln numlevel="1" lineno="131" slineno="1-86"/>or modifying an award of custody based on a determination of a substantial change in 
            <ln numlevel="1" lineno="132" slineno="1-87"/>circumstances, unless the court makes specific findings that:
            <subsection ssid="1-51" numlevel="1" lineno="133" slineno="1-88" dnum="i-o">
              <display>(i)</display>the disability significantly or substantially inhibits the parent's ability to provide 
              <ln numlevel="1" lineno="134" slineno="1-89"/>for the physical and emotional needs of the child at issue; and
            </subsection>
            <subsection ssid="1-52" numlevel="1" lineno="135" slineno="1-90" dnum="ii-o">
              <display>(ii)</display>the parent with a disability lacks sufficient human, monetary, or other resources 
              <ln numlevel="1" lineno="136" slineno="1-91"/>available to supplement the parent's ability to provide for the physical and 
              <ln numlevel="1" lineno="137" slineno="1-92"/>emotional needs of the child at issue.
            </subsection>
          </subsection>
          <subsection ssid="1-53" numlevel="1" lineno="138" slineno="1-93" dnum="c-o">
            <display>(c)</display>Nothing in this section may be construed to apply to adoption proceedings under 
            <ln numlevel="1" lineno="139" slineno="1-94"/>Title 78B, Chapter 6, Part 1, Utah Adoption Act.
          </subsection>
        </subsection>
        <subsection ssid="1-54" numlevel="1" lineno="140" slineno="1-95" dnum="7-o">
          <display>(7)</display>This section does not establish a preference for either parent solely because of the  
          <ln numlevel="1" lineno="141" slineno="1-96"/>gender of the parent.
        </subsection>
        <subsection ssid="1-55" numlevel="1" lineno="142" slineno="1-97" dnum="8-o">
          <display>(8)</display>This section establishes neither a preference nor a presumption for or against joint  
          <ln numlevel="1" lineno="143" slineno="1-98"/>physical custody or sole physical custody, but allows the court and the family the widest  
          <ln numlevel="1" lineno="144" slineno="1-99"/>discretion to choose a parenting plan that is in the best interest of the child.
        </subsection>
        <subsection ssid="1-56" numlevel="1" lineno="145" slineno="1-100" dnum="9-o">
          <display>(9)</display>When an issue before the court involves custodial responsibility in the event of a  
          <ln numlevel="1" lineno="146" slineno="1-101"/>deployment of one or both parents who are service members and the service member has  
          <ln numlevel="1" lineno="147" slineno="1-102"/>not yet been notified of deployment, the court shall resolve the issue based on the  
          <ln numlevel="1" lineno="148" slineno="1-103"/>standards in Sections  
          <xref depth="3" refnumber="78B-20-306">78B-20-306</xref> through  
          <xref depth="3" refnumber="78B-20-309">78B-20-309</xref>.
        </subsection>
        <subsection ssid="1-57" numlevel="1" lineno="149" slineno="1-104" dnum="10-o">
          <display>(10)</display>In considering the past conduct and demonstrated moral standards of each party under  
          <ln numlevel="1" lineno="150" slineno="1-105"/>Subsection (2)(d) or any other factor a court finds relevant, the court may not:
          <subsection ssid="1-58" numlevel="1" lineno="151" slineno="1-106" dnum="a-o">
            <display>(a)</display>consider or treat a parent's lawful possession or use of cannabis in a medicinal  
            <ln numlevel="1" lineno="152" slineno="1-107"/>dosage form, a cannabis product in a medicinal dosage form, or a medical cannabis  
            <ln numlevel="1" lineno="153" slineno="1-108"/>device, in accordance with Title 4, Chapter 41a, Cannabis Production Establishments  
            <ln numlevel="1" lineno="154" slineno="1-109"/>and Pharmacies, Title 26B, Chapter 4, Part 2, Cannabinoid Research and Medical  
            <ln numlevel="1" lineno="155" slineno="1-110"/>Cannabis, or Subsection  
            <xref depth="3" refnumber="58-37-3.7">58-37-3.7</xref>(2) or (3) any differently than the court would  
            <ln numlevel="1" lineno="156" slineno="1-111"/>consider or treat the lawful possession or use of any prescribed controlled substance;  
            <ln numlevel="1" lineno="157" slineno="1-112"/>or
          </subsection>
          <subsection ssid="1-59" numlevel="1" lineno="158" slineno="1-113" dnum="b-o">
            <display>(b)</display>discriminate against a parent because of the parent's status as a:
            <subsection ssid="1-60" numlevel="1" lineno="159" slineno="1-114" dnum="i-o">
              <display>(i)</display>cannabis production establishment agent, as that term is defined in Section  
              <xref depth="3" refnumber="4-41a-102">
                <ln numlevel="1" lineno="160" slineno="1-115"/>4-41a-102
              </xref>;
            </subsection>
            <subsection ssid="1-61" numlevel="1" lineno="161" slineno="1-116" dnum="ii-o">
              <display>(ii)</display>medical cannabis pharmacy agent, as that term is defined in Section  
              <xref depth="3" refnumber="26B-4-201">26B-4-201</xref>;
            </subsection>
            <subsection ssid="1-62" numlevel="1" lineno="162" slineno="1-117" dnum="iii-o">
              <display>(iii)</display>medical cannabis courier agent, as that term is defined in Section  
              <xref depth="3" refnumber="26B-4-201">26B-4-201</xref>; or
            </subsection>
            <subsection ssid="1-63" numlevel="1" lineno="163" slineno="1-118" dnum="iv-o">
              <display>(iv)</display>medical cannabis cardholder in accordance with Title 26B, Chapter 4, Part 2,  
              <ln numlevel="1" lineno="164" slineno="1-119"/>Cannabinoid Research and Medical Cannabis.
            </subsection>
          </subsection>
        </subsection>

              <ln numlevel="1" lineno="169" slineno="1-124"/>custody or parent-time and the court determines it is in the best interest of the child to  
              <ln numlevel="1" lineno="170" slineno="1-125"/>award custody or parent-time to the convicted parent; or
            </amend>
          </subsection>

            <display>(b)</display>for which a victim who is 18 years old or older at the time of the sexual assault kit

            <subsection ssid="2-6" dnum="i-o" numlevel="1" lineno="186" slineno="2-11">
              <display>(i)</display>to have his or her sexual assault kit processed; and
            </subsection>
            <subsection ssid="2-7" dnum="ii-o" numlevel="1" lineno="187" slineno="2-12">
              <display>(ii)</display>to have the sexual assault examination form shared with any entity outside of the  
              <ln numlevel="1" lineno="188" slineno="2-13"/>collection facility.
            </subsection>
          </subsection>
        </subsection>

          <display>(4)</display>"Sexual assault kit" means a package of items that is used by medical personnel to  
          <ln numlevel="1" lineno="190" slineno="2-15"/>gather and preserve biological and physical evidence following an allegation of

              <ln numlevel="1" lineno="198" slineno="2-23"/>assault or sexual abuse
            </amend>

          </subsection>

            <display>(b)</display>encourage law enforcement officers to interact with victims  
            <amendoutstart style="5"/>
            <amend anum="0" ea="erase" pairid="9" style="2" owner="jrenner" level="1" deltag="both">of sexual assault or  
              <ln numlevel="1" lineno="200" slineno="2-25"/>sexual abuse

            <amend anum="0" ea="amend" pairid="16" style="1" owner="jrenner" level="1" amendtag="end">the agency intends to dispose of the sexual assault kit before the applicable time

              <xref depth="3" refnumber="77-11c-201">77-11c-201</xref>,  
              <xref depth="3" refnumber="77-11c-301">77-11c-301</xref>, or

            </amend>
          </subsection>
          <subsection ssid="3-7" dnum="_-o:b-e" ea="amend" anum="0" owner="jrenner" style="1" numlevel="1" lineno="215" slineno="3-13">

            </amend>
          </subsection>
        </subsection>
        <subsection ssid="3-8" dnum="_-o:4-e" ea="amend" anum="0" owner="jrenner" style="1" numlevel="1" lineno="218" slineno="3-16">
          <display>
            <amend anum="0" ea="amend" pairid="45" style="1" owner="e" level="1" amendtag="start">(4)</amend>
          </display>
          <amend anum="0" ea="amend" pairid="23" style="1" owner="jrenner" level="1" amendtag="end">An agency shall send a notice of intent to dispose of a sexual assault kit to the victim:</amend>
          <subsection ssid="3-9" dnum="_-o:a-e" ea="amend" anum="0" owner="jrenner" style="1" numlevel="1" lineno="219" slineno="3-17">
            <display>
              <amend anum="0" ea="amend" pairid="46" style="1" owner="e" level="1" amendtag="start">(a)</amend>

            <amend anum="0" ea="amend" pairid="25" style="1" owner="jrenner" level="1" amendtag="end">at least 180 days before the day on which the agency intends to dispose of the sexual

            </amend>
          </subsection>
          <subsection ssid="3-10" dnum="_-o:b-e" ea="amend" anum="0" owner="jrenner" style="1" numlevel="1" lineno="221" slineno="3-19">

              <amend anum="0" ea="amend" pairid="47" style="1" owner="e" level="1" amendtag="start">(b)</amend>
            </display>

          <subsection ssid="4-8" dnum="a-o" numlevel="1" lineno="243" slineno="4-12">
            <display>(a)</display>a judgment of conviction by plea or verdict of an offense; or
          </subsection>
          <subsection ssid="4-9" dnum="b-o" numlevel="1" lineno="244" slineno="4-13">
            <display>(b)</display>an adjudication for an offense by a juvenile court under Section

          <display>(5)</display>"Appellate court" means the Utah Court of Appeals, the Utah Supreme Court, or the  
          <ln numlevel="1" lineno="247" slineno="4-16"/>United States Supreme Court.
        </subsection>
        <subsection ssid="4-12" dnum="6-o" numlevel="1" lineno="248" slineno="4-17" space="false">
          <display>(6)</display>
          <subsection ssid="4-13" dnum="a-o" placement="sameline">
            <display>(a)</display>"Biological evidence" means an item that contains blood, semen, hair, saliva, 
            <ln numlevel="1" lineno="249" slineno="4-18"/>epithelial cells, latent fingerprint evidence that may contain biological material 
            <ln numlevel="1" lineno="250" slineno="4-19"/>suitable for DNA testing, or other identifiable human biological material that:
            <subsection ssid="4-14" dnum="i-o" numlevel="1" lineno="251" slineno="4-20" tab="1">
              <display>(i)</display>is collected as part of an investigation or prosecution of a violent felony offense; 
              <ln numlevel="1" lineno="252" slineno="4-21"/>and
            </subsection>
            <subsection ssid="4-15" dnum="ii-o" numlevel="1" lineno="253" slineno="4-22" tab="1">
              <display>(ii)</display>may reasonably be used to incriminate or exculpate a person for the violent 
              <ln numlevel="1" lineno="254" slineno="4-23"/>felony offense.
            </subsection>
          </subsection>
          <subsection ssid="4-16" dnum="b-o" numlevel="1" lineno="255" slineno="4-24">
            <display>(b)</display>"Biological evidence" includes:
            <subsection ssid="4-17" dnum="i-o" numlevel="1" lineno="256" slineno="4-25">
              <display>(i)</display>material that is catalogued separately, including:
              <subsection ssid="4-18" dnum="A-o" numlevel="1" lineno="257" slineno="4-26">
                <display>(A)</display>on a slide or swab; or
              </subsection>
              <subsection ssid="4-19" dnum="B-o" numlevel="1" lineno="258" slineno="4-27">
                <display>(B)</display>inside a test tube, if the evidentiary sample that previously was inside the test 
                <ln numlevel="1" lineno="259" slineno="4-28"/>tube has been consumed by testing;
              </subsection>
            </subsection>
            <subsection ssid="4-20" dnum="ii-o" numlevel="1" lineno="260" slineno="4-29">
              <display>(ii)</display>material that is present on other evidence, including clothing, a ligature, bedding, 
              <ln numlevel="1" lineno="261" slineno="4-30"/>a drinking cup, a cigarette, or a weapon, from which a DNA profile may be 
              <ln numlevel="1" lineno="262" slineno="4-31"/>obtained;
            </subsection>
            <subsection ssid="4-21" dnum="iii-o" numlevel="1" lineno="263" slineno="4-32">
              <display>(iii)</display>the contents of a sexual assault 
              <amendoutstart style="5"/>
              <amend anum="0" ea="erase" pairid="1" style="2" owner="jrenner" level="1" deltag="both">examination</amend>
              <amendoutend style="5"/>kit; and
            </subsection>
            <subsection ssid="4-22" dnum="iv-o" numlevel="1" lineno="264" slineno="4-33">
              <display>(iv)</display>for a violent felony offense, material described in this Subsection (6) that is in 
              <ln numlevel="1" lineno="265" slineno="4-34"/>the custody of an evidence collecting or retaining entity on May 4, 2022.
            </subsection>
          </subsection>
        </subsection>
        <subsection ssid="4-23" dnum="7-o" numlevel="1" lineno="266" slineno="4-35">
          <display>(7)</display>"Claimant" means the same as that term is defined in Section  
          <xref depth="3" refnumber="77-11a-101">77-11a-101</xref>.
        </subsection>
        <subsection ssid="4-24" dnum="8-o" numlevel="1" lineno="267" slineno="4-36">
          <display>(8)</display>"Computer" means the same as that term is defined in Section  
          <xref depth="3" refnumber="77-11a-101">77-11a-101</xref>.
        </subsection>
        <subsection ssid="4-25" dnum="9-o" numlevel="1" lineno="268" slineno="4-37">
          <display>(9)</display>"Continuous chain of custody" means:
          <subsection ssid="4-26" dnum="a-o" numlevel="1" lineno="269" slineno="4-38">
            <display>(a)</display>for a law enforcement agency or a court, that legal standards regarding a continuous  
            <ln numlevel="1" lineno="270" slineno="4-39"/>chain of custody are maintained; and
          </subsection>
          <subsection ssid="4-27" dnum="b-o" numlevel="1" lineno="271" slineno="4-40">
            <display>(b)</display>for an entity that is not a law enforcement agency or a court, that the entity maintains  
            <ln numlevel="1" lineno="272" slineno="4-41"/>a record in accordance with legal standards required of the entity.
          </subsection>
        </subsection>
        <subsection ssid="4-28" dnum="10-o" numlevel="1" lineno="273" slineno="4-42">
          <display>(10)</display>"Contraband" means the same as that term is defined in Section  
          <xref depth="3" refnumber="77-11a-101">77-11a-101</xref>.
        </subsection>
        <subsection ssid="4-29" dnum="11-o" numlevel="1" lineno="274" slineno="4-43">
          <display>(11)</display>"Controlled substance" means the same as that term is defined in Section  
          <xref depth="3" refnumber="58-37-2">58-37-2</xref>.
        </subsection>
        <subsection ssid="4-30" dnum="12-o" numlevel="1" lineno="275" slineno="4-44">
          <display>(12)</display>"Court" means a municipal, county, or state court.
        </subsection>
        <subsection ssid="4-31" dnum="13-o" numlevel="1" lineno="276" slineno="4-45">
          <display>(13)</display>"DNA" means deoxyribonucleic acid.
        </subsection>
        <subsection ssid="4-32" dnum="14-o" numlevel="1" lineno="277" slineno="4-46">
          <display>(14)</display>"DNA profile" means a unique identifier of an individual derived from DNA.
        </subsection>
        <subsection ssid="4-33" dnum="15-o" numlevel="1" lineno="278" slineno="4-47">
          <display>(15)</display>"Drug paraphernalia" means the same as that term is defined in Section  
          <xref depth="3" refnumber="58-37a-3">58-37a-3</xref>.
        </subsection>
        <subsection ssid="4-34" dnum="16-o" numlevel="1" lineno="279" slineno="4-48">
          <display>(16)</display>"Evidence" means property, contraband, or an item or substance that:
          <subsection ssid="4-35" dnum="a-o" numlevel="1" lineno="280" slineno="4-49">
            <display>(a)</display>is seized or collected as part of an investigation or prosecution of an offense; and
          </subsection>
          <subsection ssid="4-36" dnum="b-o" numlevel="1" lineno="281" slineno="4-50">
            <display>(b)</display>may reasonably be used to incriminate or exculpate an individual for an offense.
          </subsection>
        </subsection>
        <subsection ssid="4-37" dnum="17-o" numlevel="1" lineno="282" slineno="4-51" space="false">

          <subsection ssid="4-38" dnum="a-o" placement="sameline">
            <display>(a)</display>"Evidence collecting or retaining entity" means an entity within the state that 
            <ln numlevel="1" lineno="283" slineno="4-52"/>collects, stores, or retrieves biological evidence.
          </subsection>
          <subsection ssid="4-39" dnum="b-o" numlevel="1" lineno="284" slineno="4-53">
            <display>(b)</display>"Evidence collecting or retaining entity" includes:
            <subsection ssid="4-40" dnum="i-o" numlevel="1" lineno="285" slineno="4-54">
              <display>(i)</display>a medical or forensic entity;
            </subsection>
            <subsection ssid="4-41" dnum="ii-o" numlevel="1" lineno="286" slineno="4-55">
              <display>(ii)</display>a law enforcement agency;
            </subsection>
            <subsection ssid="4-42" dnum="iii-o" numlevel="1" lineno="287" slineno="4-56">
              <display>(iii)</display>a court; and
            </subsection>
            <subsection ssid="4-43" dnum="iv-o" numlevel="1" lineno="288" slineno="4-57">
              <display>(iv)</display>an official, employee, or agent of an entity or agency described in this Subsection 
              <ln numlevel="1" lineno="289" slineno="4-58"/>(17).
            </subsection>
          </subsection>
          <subsection ssid="4-44" dnum="_-o:c-e" ea="amend" anum="0" owner="jrenner" style="1" numlevel="1" lineno="290" slineno="4-59">

            <amend anum="0" ea="amend" pairid="3" style="1" owner="jrenner" level="1" amendtag="end">"Evidence collecting or retaining entity" does not include a collecting facility as 
              <ln numlevel="1" lineno="291" slineno="4-60"/>defined in Section 
              <xref depth="3" refnumber="53-10-902">53-10-902</xref>.
            </amend>
          </subsection>
        </subsection>
        <subsection ssid="4-45" dnum="18-o" numlevel="1" lineno="292" slineno="4-61">
          <display>(18)</display>"Exhibit" means property, contraband, or an item or substance that is admitted into  
          <ln numlevel="1" lineno="293" slineno="4-62"/>evidence for a court proceeding.
        </subsection>
        <subsection ssid="4-46" dnum="19-o" numlevel="1" lineno="294" slineno="4-63">
          <display>(19)</display>"In custody" means an individual who:
          <subsection ssid="4-47" dnum="a-o" numlevel="1" lineno="295" slineno="4-64">
            <display>(a)</display>is incarcerated, civilly committed, on parole, or on probation; or
          </subsection>
          <subsection ssid="4-48" dnum="b-o" numlevel="1" lineno="296" slineno="4-65">
            <display>(b)</display>is required to register under Title 77, Chapter 41, Sex and Kidnap Offender Registry.
          </subsection>
        </subsection>
        <subsection ssid="4-49" dnum="20-o" numlevel="1" lineno="297" slineno="4-66">
          <display>(20)</display>"Law enforcement agency" means the same as that term is defined in Section  
          <xref depth="3" refnumber="77-11a-101">

        </subsection>

          <display>(21)</display>"Medical or forensic entity" means a private or public hospital, medical facility, or

        </subsection>

          <display>(22)</display>"Physical evidence" includes evidence that:
          <subsection ssid="4-52" dnum="a-o" numlevel="1" lineno="303" slineno="4-72">
            <display>(a)</display>is related to:
            <subsection ssid="4-53" dnum="i-o" numlevel="1" lineno="304" slineno="4-73">
              <display>(i)</display>an investigation;
            </subsection>
            <subsection ssid="4-54" dnum="ii-o" numlevel="1" lineno="305" slineno="4-74">
              <display>(ii)</display>an arrest; or
            </subsection>

            <display>(b)</display>is in the actual or constructive possession of a law enforcement agency or a court or  
            <ln numlevel="1" lineno="308" slineno="4-77"/>an agent of a law enforcement agency or a court.
          </subsection>
        </subsection>

          <display>(23)</display>"Property" means the same as that term is defined in Section

            <display>(c)</display>maintaining a written report of a chemical analysis of the controlled substance if a

            <display>(d)</display>if the controlled substance exceeds 10 pounds, retain at least one pound of the  
            <ln numlevel="1" lineno="397" slineno="6-41"/>controlled substance that is randomly selected from the controlled substance.
          </subsection>
        </subsection>

            <display>(b)</display>maintaining a written report of a chemical analysis of the drug paraphernalia if a

          </subsection>

            <display>(c)</display>taking a photographic or video record of the drug paraphernalia with identifying case

          <ln numlevel="1" lineno="427" slineno="7-9"/>offense in anticipation of possible collateral attacks upon the judgment or for use in a  
          <ln numlevel="1" lineno="428" slineno="7-10"/>potential prosecution, the prosecuting attorney may decline to authorize the disposal of

        </subsection>

          <display>(3)</display>An agency shall ensure that evidence of a felony offense is subject to a continuous chain

          <display>(4)</display>An agency shall retain and preserve biological evidence of a violent felony offense in  
          <ln numlevel="1" lineno="433" slineno="7-15"/>accordance with Part 4, Preservation of Biological Evidence for Violent Felony Offenses.
        </subsection>

            <display>(a)</display>Upon request by a defendant under Title 63G, Chapter 2, Government 
            <ln numlevel="1" lineno="468" slineno="8-27"/>Records Access and Management Act, the evidence collecting or retaining entity 
            <ln numlevel="1" lineno="469" slineno="8-28"/>shall prepare an inventory of the biological evidence preserved in connection with the 
            <ln numlevel="1" lineno="470" slineno="8-29"/>defendant's criminal case.
          </subsection>
          <subsection ssid="8-17" dnum="b-o" numlevel="1" lineno="471" slineno="8-30">
            <display>(b)</display>If the evidence collecting or retaining entity cannot locate biological evidence 
            <ln numlevel="1" lineno="472" slineno="8-31"/>requested under Subsection

            <amend anum="0" ea="amend" pairid="16" style="1" owner="jrenner" level="1" amendtag="both" space="true">(4)(a)</amend>, the custodian for the entity shall provide a

            <display>(c)</display>If the evidence collecting or retaining entity determines that retention is 
            <ln numlevel="1" lineno="534" slineno="8-93"/>impracticable, before returning or disposing of the physical evidence, the evidence 
            <ln numlevel="1" lineno="535" slineno="8-94"/>collecting or retaining entity shall:
            <subsection ssid="8-51" dnum="i-o" numlevel="1" lineno="536" slineno="8-95">
              <display>(i)</display>remove the portions of the physical evidence likely to contain biological evidence 
              <ln numlevel="1" lineno="537" slineno="8-96"/>related to the violent felony offense; and
            </subsection>

              <display>(ii)</display>preserve the removed biological evidence in a quantity sufficient to permit future

          <display>(1)</display>The bill of rights for victims and witnesses is:
          <subsection ssid="10-2" numlevel="1" lineno="575" slineno="10-4" dnum="a-o">
            <display>(a)</display>Victims and witnesses have a right to be informed as to the level of protection from  
            <ln numlevel="1" lineno="576" slineno="10-5"/>intimidation and harm available to them, and from what sources, as they participate  
            <ln numlevel="1" lineno="577" slineno="10-6"/>in criminal justice proceedings as designated by Section  
            <xref depth="3" refnumber="76-8-508">76-8-508</xref>, regarding witness  
            <ln numlevel="1" lineno="578" slineno="10-7"/>tampering, and Section  
            <xref depth="3" refnumber="76-8-509">76-8-509</xref>, regarding threats against a victim. Law  
            <ln numlevel="1" lineno="579" slineno="10-8"/>enforcement, prosecution, and corrections personnel have the duty to timely provide  
            <ln numlevel="1" lineno="580" slineno="10-9"/>this information in a form which is useful to the victim.
          </subsection>
          <subsection ssid="10-3" numlevel="1" lineno="581" slineno="10-10" dnum="b-o">
            <display>(b)</display>Victims and witnesses, including children and their guardians, have a right to be  
            <ln numlevel="1" lineno="582" slineno="10-11"/>informed and assisted as to their role in the criminal justice process. All criminal  
            <ln numlevel="1" lineno="583" slineno="10-12"/>justice agencies have the duty to provide this information and assistance.
          </subsection>
          <subsection ssid="10-4" numlevel="1" lineno="584" slineno="10-13" dnum="c-o">
            <display>(c)</display>Victims and witnesses have a right to clear explanations regarding relevant legal  
            <ln numlevel="1" lineno="585" slineno="10-14"/>proceedings; these explanations shall be appropriate to the age of child victims and  
            <ln numlevel="1" lineno="586" slineno="10-15"/>witnesses.  All criminal justice agencies have the duty to provide these explanations.
          </subsection>
          <subsection ssid="10-5" numlevel="1" lineno="587" slineno="10-16" dnum="d-o">
            <display>(d)</display>Victims and witnesses should have a secure waiting area that does not require them  
            <ln numlevel="1" lineno="588" slineno="10-17"/>to be in close proximity to defendants or the family and friends of defendants.  
            <ln numlevel="1" lineno="589" slineno="10-18"/>Agencies controlling facilities shall, whenever possible, provide this area.
          </subsection>
          <subsection ssid="10-6" numlevel="1" lineno="590" slineno="10-19" dnum="e-o">
            <display>(e)</display>Victims may seek restitution or reparations, including medical costs, as provided in  
            <ln numlevel="1" lineno="591" slineno="10-20"/>Title 63M, Chapter 7, Criminal Justice and Substance Abuse, Title 77, Chapter 38b,  
            <ln numlevel="1" lineno="592" slineno="10-21"/>Crime Victims Restitution Act, and Section  
            <xref depth="3" refnumber="80-6-710">80-6-710</xref>. State and local government  
            <ln numlevel="1" lineno="593" slineno="10-22"/>agencies that serve victims have the duty to have a functional knowledge of the  
            <ln numlevel="1" lineno="594" slineno="10-23"/>procedures established by the Crime Victim Reparations Board and to inform victims  
            <ln numlevel="1" lineno="595" slineno="10-24"/>of these procedures.
          </subsection>
          <subsection ssid="10-7" numlevel="1" lineno="596" slineno="10-25" dnum="f-o">
            <display>(f)</display>Victims and witnesses have a right to have any personal property returned as  
            <ln numlevel="1" lineno="597" slineno="10-26"/>provided in Chapter 11a, Seizure of Property and Contraband, and Chapter 11d, Lost  
            <ln numlevel="1" lineno="598" slineno="10-27"/>or Mislaid Property. Criminal justice agencies shall expeditiously return the property  
            <ln numlevel="1" lineno="599" slineno="10-28"/>when it is no longer needed for court law enforcement or prosecution purposes.
          </subsection>
          <subsection ssid="10-8" numlevel="1" lineno="600" slineno="10-29" dnum="g-o">
            <display>(g)</display>Victims and witnesses have the right to reasonable employer intercession services,  
            <ln numlevel="1" lineno="601" slineno="10-30"/>including pursuing employer cooperation in minimizing employees' loss of pay and  
            <ln numlevel="1" lineno="602" slineno="10-31"/>other benefits resulting from their participation in the criminal justice process.  
            <ln numlevel="1" lineno="603" slineno="10-32"/>Officers of the court shall provide these services and shall consider victims' and  
            <ln numlevel="1" lineno="604" slineno="10-33"/>witnesses' schedules so that activities which conflict can be avoided. Where conflicts  
            <ln numlevel="1" lineno="605" slineno="10-34"/>cannot be avoided, the victim may request that the responsible agency intercede with  
            <ln numlevel="1" lineno="606" slineno="10-35"/>employers or other parties.
          </subsection>
          <subsection ssid="10-9" numlevel="1" lineno="607" slineno="10-36" dnum="h-o">
            <display>(h)</display>Victims and witnesses, particularly children, should have a speedy disposition of the  
            <ln numlevel="1" lineno="608" slineno="10-37"/>entire criminal justice process. All involved public agencies shall establish policies  
            <ln numlevel="1" lineno="609" slineno="10-38"/>and procedures to encourage speedy disposition of criminal cases.
          </subsection>
          <subsection ssid="10-10" numlevel="1" lineno="610" slineno="10-39" dnum="i-o">
            <display>(i)</display>Victims and witnesses have the right to timely notice of judicial proceedings they are  
            <ln numlevel="1" lineno="611" slineno="10-40"/>to attend and timely notice of cancellation of any proceedings. Criminal justice  
            <ln numlevel="1" lineno="612" slineno="10-41"/>agencies have the duty to provide these notifications. Defense counsel and others  
            <ln numlevel="1" lineno="613" slineno="10-42"/>have the duty to provide timely notice to prosecution of any continuances or other  
            <ln numlevel="1" lineno="614" slineno="10-43"/>changes that may be required.
          </subsection>
          <subsection ssid="10-11" ea="erase" anum="0" owner="jrenner" style="2" numlevel="1" lineno="615" slineno="10-44" dnum="j-o:_-e">

              <ln numlevel="1" lineno="643" slineno="10-72"/>case where the identity of the perpetrator has not been confirmed, the law enforcement  
              <ln numlevel="1" lineno="644" slineno="10-73"/>agency shall notify the victim or the victim's designee.
            </amend>

              </display>
              <amend anum="0" ea="erase" pairid="41" style="2" owner="jrenner" level="1" deltag="end">If the law enforcement agency intends to destroy or dispose of rape kit evidence or 
                <ln numlevel="1" lineno="646" slineno="10-75"/>other crime scene evidence from an unsolved sexual assault case, the law enforcement 
                <ln numlevel="1" lineno="647" slineno="10-76"/>agency shall provide written notification of that intention and information on how to 
                <ln numlevel="1" lineno="648" slineno="10-77"/>appeal the decision to the victim or the victim's designee of that intention.
              </amend>

            </subsection>
            <subsection ssid="10-26" ea="erase" anum="0" owner="jrenner" style="2" numlevel="1" lineno="649" slineno="10-78" dnum="ii-o:_-e">
              <display>
                <amendoutstart style="5"/>
                <amend anum="0" ea="erase" pairid="155" style="2" owner="o" level="1" deltag="start">(ii)</amend>
              </display>
              <amend anum="0" ea="erase" pairid="44" style="2" owner="jrenner" level="1" deltag="end">Written notification under this Subsection (3) shall be made not fewer than 60 days 
                <ln numlevel="1" lineno="650" slineno="10-79"/>prior to the destruction or disposal of the rape kit evidence or other crime scene evidence.
              </amend>

            </subsection>
          </subsection>
          <subsection ssid="10-27" ea="erase" anum="0" owner="jrenner" style="2" numlevel="1" lineno="651" slineno="10-80" dnum="c-o:_-e">
            <display>

              <amend anum="0" ea="erase" pairid="156" style="2" owner="o" level="1" deltag="start">(c)</amend>
            </display>
            <amend anum="0" ea="erase" pairid="48" style="2" owner="jrenner" level="1" deltag="end">A law enforcement agency responsible for providing information under Subsections  
              <ln numlevel="1" lineno="652" slineno="10-81"/>(1)(j)(ii) through (iv), (2), and (3) shall do so in a timely manner and, upon request of the  
              <ln numlevel="1" lineno="653" slineno="10-82"/>victim or the victim's designee, shall advise the victim or the victim's designee of any  
              <ln numlevel="1" lineno="654" slineno="10-83"/>significant changes in the information of which the law enforcement agency is aware.
            </amend>

          </subsection>
          <subsection ssid="10-28" ea="erase" anum="0" owner="jrenner" style="2" numlevel="1" lineno="655" slineno="10-84" dnum="d-o:_-e">

            </display>
            <amend anum="0" ea="erase" pairid="51" style="2" owner="jrenner" level="1" deltag="end">The law enforcement agency investigating the sexual offense is responsible for  
              <ln numlevel="1" lineno="656" slineno="10-85"/>informing the victim or the victim's designee of the rights established under Subsections  
              <ln numlevel="1" lineno="657" slineno="10-86"/>(1)(j)(ii) through (iv) and (2), and this Subsection (3).
            </amend>

        </subsection>

          </subsection>
          <subsection ssid="10-32" ea="amend" anum="0" owner="jrenner" style="1" numlevel="1" lineno="664" slineno="10-93" dnum="_-e:c-e">

              <amend anum="0" ea="amend" pairid="161" style="1" owner="e" level="1" amendtag="start">(c)</amend>
            </display>
            <amend anum="0" ea="amend" pairid="63" style="1" owner="jrenner" level="1" amendtag="end">not to be prevented from, or charged for, a medical forensic examination;</amend>
          </subsection>
          <subsection ssid="10-33" ea="amend" anum="0" owner="jrenner" style="1" numlevel="1" lineno="665" slineno="10-94" dnum="_-e:d-e">

              <amend anum="0" ea="amend" pairid="162" style="1" owner="e" level="1" amendtag="start">(d)</amend>

            <amend anum="0" ea="amend" pairid="66" style="1" owner="jrenner" level="1" amendtag="end">have the evidence from a sexual assault kit, or the contents of the sexual assault kit,  
              <ln numlevel="1" lineno="666" slineno="10-95"/>preserved for the time periods described in Title 77, Chapter 11c, Retention of  
              <ln numlevel="1" lineno="667" slineno="10-96"/>Evidence, without any charge to the victim;
            </amend>
          </subsection>
          <subsection ssid="10-34" ea="amend" anum="0" owner="jrenner" style="1" numlevel="1" lineno="668" slineno="10-97" dnum="_-e:e-e">
            <display>
              <amend anum="0" ea="amend" pairid="163" style="1" owner="e" level="1" amendtag="start">(e)</amend>
            </display>
            <amend anum="0" ea="amend" pairid="69" style="1" owner="jrenner" level="1" amendtag="end">be informed whether a DNA profile was obtained from the testing of the evidence in  
              <ln numlevel="1" lineno="669" slineno="10-98"/>a sexual assault kit or from other crime scene evidence;
            </amend>
          </subsection>
          <subsection ssid="10-35" ea="amend" anum="0" owner="jrenner" style="1" numlevel="1" lineno="670" slineno="10-99" dnum="_-e:f-e">
            <display>
              <amend anum="0" ea="amend" pairid="164" style="1" owner="e" level="1" amendtag="start">(f)</amend>
            </display>
            <amend anum="0" ea="amend" pairid="72" style="1" owner="jrenner" level="1" amendtag="end">be informed whether a DNA profile developed from the evidence in a sexual assault  
              <ln numlevel="1" lineno="671" slineno="10-100"/>kit, or from other crime scene evidence, has been entered into the Utah Combined  
              <ln numlevel="1" lineno="672" slineno="10-101"/>DNA Index System;
            </amend>
          </subsection>
          <subsection ssid="10-36" ea="amend" anum="0" owner="jrenner" style="1" numlevel="1" lineno="673" slineno="10-102" dnum="_-e:g-e">
            <display>
              <amend anum="0" ea="amend" pairid="165" style="1" owner="e" level="1" amendtag="start">(g)</amend>
            </display>
            <amend anum="0" ea="amend" pairid="75" style="1" owner="jrenner" level="1" amendtag="end">be informed of any result from a sexual assault kit or from other crime scene  
              <ln numlevel="1" lineno="674" slineno="10-103"/>evidence if that disclosure would not impede or compromise an ongoing  
              <ln numlevel="1" lineno="675" slineno="10-104"/>investigation, including:
            </amend>
            <subsection ssid="10-37" ea="amend" anum="0" owner="jrenner" style="1" numlevel="1" lineno="676" slineno="10-105" dnum="_-e:i-e">
              <display>

              <amend anum="0" ea="amend" pairid="77" style="1" owner="jrenner" level="1" amendtag="end">whether there is a match between a DNA profile developed from the evidence in a  
                <ln numlevel="1" lineno="677" slineno="10-106"/>sexual assault kit, or from other crime scene evidence, and a DNA profile  
                <ln numlevel="1" lineno="678" slineno="10-107"/>contained in the Utah Combined DNA Index System; and
              </amend>
            </subsection>
            <subsection ssid="10-38" ea="amend" anum="0" owner="jrenner" style="1" numlevel="1" lineno="679" slineno="10-108" dnum="_-e:ii-e">
              <display>
                <amend anum="0" ea="amend" pairid="167" style="1" owner="e" level="1" amendtag="start">(ii)</amend>
              </display>
              <amend anum="0" ea="amend" pairid="80" style="1" owner="jrenner" level="1" amendtag="end">a toxicology result or other information that is collected from a sexual assault kit  
                <ln numlevel="1" lineno="680" slineno="10-109"/>as part of a medical forensic examination of the victim;
              </amend>
            </subsection>
          </subsection>
          <subsection ssid="10-39" ea="amend" anum="0" owner="jrenner" style="1" numlevel="1" lineno="681" slineno="10-110" dnum="_-e:h-e">
            <display>
              <amend anum="0" ea="amend" pairid="168" style="1" owner="e" level="1" amendtag="start">(h)</amend>
            </display>
            <amend anum="0" ea="amend" pairid="84" style="1" owner="jrenner" level="1" amendtag="end">be informed in writing of policies governing the collection and preservation of a  
              <ln numlevel="1" lineno="682" slineno="10-111"/>sexual assault kit;
            </amend>
          </subsection>
          <subsection ssid="10-40" ea="amend" anum="0" owner="jrenner" style="1" numlevel="1" lineno="683" slineno="10-112" dnum="_-e:i-e">

              <amend anum="0" ea="amend" pairid="169" style="1" owner="e" level="1" amendtag="start">(i)</amend>
            </display>
            <amend anum="0" ea="amend" pairid="87" style="1" owner="jrenner" level="1" amendtag="end">be informed of the status and location of a sexual assault kit;</amend>
          </subsection>
          <subsection ssid="10-41" ea="amend" anum="0" owner="jrenner" style="1" numlevel="1" lineno="684" slineno="10-113" dnum="_-e:j-e">

              <amend anum="0" ea="amend" pairid="170" style="1" owner="e" level="1" amendtag="start">(j)</amend>

            <amend anum="0" ea="amend" pairid="90" style="1" owner="jrenner" level="1" amendtag="end">upon written request by the victim, receive a notice of intent from an agency, as

              <xref depth="3" refnumber="53-10-905">53-10-905</xref>, if the agency intends to destroy or dispose of evidence

            <amend anum="0" ea="amend" pairid="93" style="1" owner="jrenner" level="1" amendtag="end">be granted further preservation of the sexual assault kit if the agency, as defined in  
              <ln numlevel="1" lineno="688" slineno="10-117"/>Section  
              <xref depth="3" refnumber="53-10-905">53-10-905</xref>, intends to destroy or dispose of evidence from a sexual assault kit  
              <ln numlevel="1" lineno="689" slineno="10-118"/>and the victim submits a written request as described in Section  
              <xref depth="3" refnumber="53-10-905">53-10-905</xref>;
            </amend>
          </subsection>
          <subsection ssid="10-43" ea="amend" anum="0" owner="jrenner" style="1" numlevel="1" lineno="690" slineno="10-119" dnum="_-e:l-e">

              <ln numlevel="1" lineno="706" slineno="10-135"/>where the identity of the perpetrator has not be confirmed;
            </amend>
          </subsection>

              <display>
                <amend anum="0" ea="amend" pairid="35" style="1" owner="e" level="1" amendtag="start">(ii)</amend>
              </display>
              <amend anum="0" ea="amend" pairid="10" style="1" owner="jrenner" level="1" amendtag="end">the offense resulted in the conception of the child; and</amend>
            </subsection>

              <amendoutend style="5"/>the parent has substantially neglected, willfully refused, or has been unable 
              <ln numlevel="1" lineno="736" slineno="11-19"/>or unwilling to remedy the circumstances that cause the child to be in an 
              <ln numlevel="1" lineno="737" slineno="11-20"/>out-of-home placement; and
            </subsection>
            <subsection ssid="11-12" dnum="iii-o" numlevel="1" lineno="738" slineno="11-21">
              <display>(iii)</display>
              <amendoutstart style="5"/>
              <amend anum="0" ea="erase" pairid="18" style="2" owner="jrenner" level="1" deltag="both">that</amend>
              <amendoutend style="5"/>there is a substantial likelihood that the parent will not be capable of 
              <ln numlevel="1" lineno="739" slineno="11-22"/>exercising proper and effective parental care in the near future;
            </subsection>
          </subsection>
          <subsection ssid="11-13" dnum="e-o:f-e" numlevel="1" lineno="740" slineno="11-23">

              <display>(iii)</display>to eliminate the risk of serious harm to the child; or
            </subsection>
            <subsection ssid="11-18" dnum="iv-o" numlevel="1" lineno="745" slineno="11-28">
              <display>(iv)</display>to avoid being an unfit parent;
            </subsection>
          </subsection>

          <display>(2)</display>The juvenile court may not terminate the parental rights of a parent because the parent  
          <ln numlevel="1" lineno="756" slineno="11-39"/>has failed to complete the requirements of a child and family plan.
        </subsection>
        <subsection ssid="11-25" dnum="3-o" numlevel="1" lineno="757" slineno="11-40" space="false">
          <display>(3)</display>
          <subsection ssid="11-26" dnum="a-o" placement="sameline">
            <display>(a)</display>Except as provided in Subsection (3)(b), in any case in which the juvenile court 
            <ln numlevel="1" lineno="758" slineno="11-41"/>has directed the division to provide reunification services to a parent, the juvenile 
            <ln numlevel="1" lineno="759" slineno="11-42"/>court must find that the division made reasonable efforts to provide those services 
            <ln numlevel="1" lineno="760" slineno="11-43"/>before the juvenile court may terminate the parent's rights under Subsection (1)(b),

            <display>(b)</display>Notwithstanding Subsection (3)(a), the juvenile court is not required to make the 
            <ln numlevel="1" lineno="763" slineno="11-46"/>finding under Subsection (3)(a) before terminating a parent's rights:
            <subsection ssid="11-28" dnum="i-o" numlevel="1" lineno="764" slineno="11-47">
              <display>(i)</display>under Subsection (1)(b), if the juvenile court finds that the abuse or neglect 
              <ln numlevel="1" lineno="765" slineno="11-48"/>occurred subsequent to adjudication; or

            <ln numlevel="1" lineno="797" slineno="14-24"/>any individual convicted of the felony offense, or a lesser included offense, are  
            <ln numlevel="1" lineno="798" slineno="14-25"/>exhausted;
            <eol numlevel="1" lineno="799" slineno="14-26"/>
            <para/>(iv) the length of time that a petition for postconviction relief, and any appeal  
            <ln numlevel="1" lineno="800" slineno="14-27"/>of the petition, is pending if an individual convicted of the felony offense files the  
            <ln numlevel="1" lineno="801" slineno="14-28"/>petition within the one-year time period described in Subsection (1)(a)(iii); or
            <eol numlevel="1" lineno="802" slineno="14-29"/>
            <para/>(v) 20 years from the day on which the evidence is collected if the evidence is  
            <ln numlevel="1" lineno="803" slineno="14-30"/>the contents of a sexual assault kit; or
            <eol numlevel="1" lineno="804" slineno="14-31"/>
            <para/>(b) at the discretion of the prosecuting attorney or federal prosecutor if the  
            <ln numlevel="1" lineno="805" slineno="14-32"/>prosecution of the felony offense resulted in an acquittal or dismissal.
          </amend>

          <amend anum="0" ea="amend" pairid="7" style="1" owner="jrenner" level="1" amendtag="both">(3) Subsection (1) does not require an agency to return or dispose of evidence

          </amend>
          <eol numlevel="1" lineno="810" slineno="14-37"/>
          <para/>(4)  An agency shall retain and preserve biological evidence of a violent felony  
          <ln numlevel="1" lineno="811" slineno="14-38"/>offense in accordance with Part 4, Preservation of Biological Evidence for Violent  
          <ln numlevel="1" lineno="812" slineno="14-39"/>Felony Offenses.
          <amend anum="0" ea="amend" pairid="8" style="1" owner="jrenner" level="1" amendtag="both">";
            <eol numlevel="1" lineno="813" slineno="14-40"/>
            <para/>(2) Section

          </amend>.  Requirements for not retaining evidence of felony offense --  
          <ln numlevel="1" lineno="815" slineno="14-42"/>Preservation of sufficient evidence.
          <eol numlevel="1" lineno="816" slineno="14-43"/>
          <para/>
          <amend anum="0" ea="amend" pairid="10" style="1" owner="jrenner" level="1" amendtag="both">(1) An agency is not required to retain evidence of a felony offense under  
            <ln numlevel="1" lineno="817" slineno="14-44"/>Section  
            <xref depth="3" refnumber="77-11c-301">77-11c-301</xref> if:
            <eol numlevel="1" lineno="818" slineno="14-45"/>
            <para/>(a) (i) the agency determines that:
            <eol numlevel="1" lineno="819" slineno="14-46"/>
            <para/>(A) the size, bulk, or physical character of the evidence renders retention  
            <ln numlevel="1" lineno="820" slineno="14-47"/>impracticable or the evidence poses a security or safety problem for the agency;  
            <ln numlevel="1" lineno="821" slineno="14-48"/>and
            <eol numlevel="1" lineno="822" slineno="14-49"/>
            <para/>(B) the evidence no longer has any significant evidentiary value;
            <eol numlevel="1" lineno="823" slineno="14-50"/>
            <para/>(ii) the agency preserves sufficient evidence from the property, contraband,  
            <ln numlevel="1" lineno="824" slineno="14-51"/>item, or substance for use as evidence in a prosecution of the offense; and
            <eol numlevel="1" lineno="825" slineno="14-52"/>
            <para/>(iii) a prosecuting attorney or a court authorizes the agency to return or dispose  
            <ln numlevel="1" lineno="826" slineno="14-53"/>of the evidence as described in Section  
            <xref depth="3" refnumber="77-11c-303">77-11c-303</xref>;
            <eol numlevel="1" lineno="827" slineno="14-54"/>
            <para/>(b) a court orders the agency to return evidence that is property to a claimant  
            <ln numlevel="1" lineno="828" slineno="14-55"/>under Section  
            <xref depth="3" refnumber="77-11a-305">77-11a-305</xref>; or
            <eol numlevel="1" lineno="829" slineno="14-56"/>
            <para/>(c) the evidence is wildlife or parts of wildlife.
            <eol numlevel="1" lineno="830" slineno="14-57"/>
            <para/>(2) Notwithstanding Subsection (1), the agency may not dispose of evidence of  
            <ln numlevel="1" lineno="831" slineno="14-58"/>a felony offense that is a sexual assault kit before the day on which the time period  
            <ln numlevel="1" lineno="832" slineno="14-59"/>described in Section  
            <xref depth="3" refnumber="77-11c-301">77-11c-301</xref> expires if:
            <eol numlevel="1" lineno="833" slineno="14-60"/>
            <para/>(a) the agency sends a notice to the victim in accordance with Section  
            <xref depth="3" refnumber="53-10-905">
              <ln numlevel="1" lineno="834" slineno="14-61"/>53-10-905
            </xref>; and
            <eol numlevel="1" lineno="835" slineno="14-62"/>
            <para/>(b) the victim submits a written request for retention of the evidence within the  
            <ln numlevel="1" lineno="836" slineno="14-63"/>180-day period described in Section  
            <xref depth="3" refnumber="53-10-905">53-10-905</xref>.
            <eol numlevel="1" lineno="837" slineno="14-64"/>
            <para/>(3) Subsection (1) does not require an agency to return or dispose of evidence  
            <ln numlevel="1" lineno="838" slineno="14-65"/>of a felony offense.
            <eol numlevel="1" lineno="839" slineno="14-66"/>
            <para/>(4) Subsection (1) does not apply to biological evidence of a violent felony  
            <ln numlevel="1" lineno="840" slineno="14-67"/>offense because an agency is required to retain biological evidence of a violent  
            <ln numlevel="1" lineno="841" slineno="14-68"/>felony offense as described in Part 4, Preservation of Biological Evidence for  
            <ln numlevel="1" lineno="842" slineno="14-69"/>Violent Felony Offenses.
            <eol numlevel="1" lineno="843" slineno="14-70"/>
            <para/>(5) If the evidence described in Subsection (1) is a controlled substance, an  
            <ln numlevel="1" lineno="844" slineno="14-71"/>agency shall preserve sufficient evidence under Subsection (1)(a)(ii) of the  
            <ln numlevel="1" lineno="845" slineno="14-72"/>controlled substance by:
            <eol numlevel="1" lineno="846" slineno="14-73"/>
            <para/>(a) collecting and preserving a sample of the controlled substance for  
            <ln numlevel="1" lineno="847" slineno="14-74"/>independent testing and use as evidence;
            <eol numlevel="1" lineno="848" slineno="14-75"/>
            <para/>(b) taking a photographic or video record of the controlled substance with  
            <ln numlevel="1" lineno="849" slineno="14-76"/>identifying case numbers;
            <eol numlevel="1" lineno="850" slineno="14-77"/>
            <para/>(c) maintaining a written report of a chemical analysis of the controlled  
            <ln numlevel="1" lineno="851" slineno="14-78"/>substance if a chemical analysis was performed by the agency;
            <eol numlevel="1" lineno="852" slineno="14-79"/>
            <para/>(d) if the controlled substance exceeds 10 pounds, retaining at least one pound  
            <ln numlevel="1" lineno="853" slineno="14-80"/>of the controlled substance that is randomly selected from the controlled  
            <ln numlevel="1" lineno="854" slineno="14-81"/>substance; and
            <eol numlevel="1" lineno="855" slineno="14-82"/>
            <para/>(e) for a violent felony offense, collecting and preserving biological evidence  
            <ln numlevel="1" lineno="856" slineno="14-83"/>from the controlled substance as described in Section  
            <xref depth="3" refnumber="77-11c-401">77-11c-401</xref>.
            <eol numlevel="1" lineno="857" slineno="14-84"/>
            <para/>(6) If the evidence described in Subsection (1) is drug paraphernalia, an agency  
            <ln numlevel="1" lineno="858" slineno="14-85"/>shall preserve sufficient evidence under Subsection (1)(a)(ii) of the drug  
            <ln numlevel="1" lineno="859" slineno="14-86"/>paraphernalia by:
            <eol numlevel="1" lineno="860" slineno="14-87"/>
            <para/>(a) collecting and preserving a sample of the controlled substance from the  
            <ln numlevel="1" lineno="861" slineno="14-88"/>drug paraphernalia for independent testing and use as evidence;
            <eol numlevel="1" lineno="862" slineno="14-89"/>
            <para/>(b) maintaining a written report of a chemical analysis of the drug  
            <ln numlevel="1" lineno="863" slineno="14-90"/>paraphernalia if a chemical analysis was performed by the agency;
            <eol numlevel="1" lineno="864" slineno="14-91"/>
            <para/>(c) taking a photographic or video record of the drug paraphernalia with  
            <ln numlevel="1" lineno="865" slineno="14-92"/>identifying case numbers; and
            <eol numlevel="1" lineno="866" slineno="14-93"/>
            <para/>(d) for a violent felony offense, collecting and preserving biological evidence  
            <ln numlevel="1" lineno="867" slineno="14-94"/>from the drug paraphernalia as described in Section  
            <xref depth="3" refnumber="77-11c-401">77-11c-401</xref>.
            <eol numlevel="1" lineno="868" slineno="14-95"/>
            <para/>(7) If the evidence described in Subsection (1) is a computer, the agency shall  
            <ln numlevel="1" lineno="869" slineno="14-96"/>preserve sufficient evidence under Subsection (1)(a)(ii) of the computer by:
            <eol numlevel="1" lineno="870" slineno="14-97"/>
            <para/>(a) extracting all data from the computer that would be evidence in a  
            <ln numlevel="1" lineno="871" slineno="14-98"/>prosecution of an individual for the offense;
            <eol numlevel="1" lineno="872" slineno="14-99"/>
            <para/>(b) taking a photographic or video record of the computer with identifying case  
            <ln numlevel="1" lineno="873" slineno="14-100"/>numbers; and
            <eol numlevel="1" lineno="874" slineno="14-101"/>
            <para/>(c) for a violent felony offense, collecting and preserving biological evidence  
            <ln numlevel="1" lineno="875" slineno="14-102"/>from the computer as described in Section  
            <xref depth="3" refnumber="77-11c-401">77-11c-401</xref>.
            <eol numlevel="1" lineno="876" slineno="14-103"/>
            <para/>(8) For any other type of evidence, the agency shall preserve sufficient  
            <ln numlevel="1" lineno="877" slineno="14-104"/>evidence under Subsection (1)(a)(ii) of the property, contraband, item, or  
            <ln numlevel="1" lineno="878" slineno="14-105"/>substance by:
            <eol numlevel="1" lineno="879" slineno="14-106"/>
            <para/>(a) taking a photographic or video record of the property, contraband, item, or  
            <ln numlevel="1" lineno="880" slineno="14-107"/>substance with identifying case numbers; and
            <eol numlevel="1" lineno="881" slineno="14-108"/>
            <para/>(b) for a violent felony offense, collecting and preserving biological evidence  
            <ln numlevel="1" lineno="882" slineno="14-109"/>as described in Section  
            <xref depth="3" refnumber="77-11c-401.&amp;quot;">77-11c-401."</xref>; and
            <eol numlevel="1" lineno="883" slineno="14-110"/>
            <para/>(3) Section  
            <xref depth="3" refnumber="77-11c-401">77-11c-401</xref> be amended to read:

          <para/>(1)  Except as provided in Section  
          <xref depth="3" refnumber="77-11c-402">77-11c-402</xref>, an evidence collecting or  
          <ln numlevel="1" lineno="887" slineno="14-114"/>retaining entity shall preserve biological evidence of a violent felony offense in  
          <ln numlevel="1" lineno="888" slineno="14-115"/>accordance with this part.
          <eol numlevel="1" lineno="889" slineno="14-116"/>
          <para/>(2)  An evidence collecting or retaining entity shall preserve biological  
          <ln numlevel="1" lineno="890" slineno="14-117"/>evidence of a violent felony offense:
          <eol numlevel="1" lineno="891" slineno="14-118"/>
          <para/>(a)  for the longer of:
          <eol numlevel="1" lineno="892" slineno="14-119"/>
          <para/>(i)  the length of the statute of limitations for the violent felony offense if:
          <eol numlevel="1" lineno="893" slineno="14-120"/>
          <para/>(A)  no charges are filed for the violent felony offense; or
          <eol numlevel="1" lineno="894" slineno="14-121"/>
          <para/>(B)  the violent felony offense remains unsolved;
          <eol numlevel="1" lineno="895" slineno="14-122"/>
          <para/>
          <amendoutstart style="5"/>
          <amend anum="0" ea="erase" pairid="11" style="2" owner="jrenner" level="1" deltag="both">(ii)  the length of time that the individual convicted of the violent felony  
            <ln numlevel="1" lineno="896" slineno="14-123"/>offense or any lesser included violent offense remains in custody; or

            <para/>(iii)  the length of time that a co-defendant remains in custody;

            <para/>(iii) one year after the day on which all direct appeals of the judgment for any  
            <ln numlevel="1" lineno="901" slineno="14-128"/>individual convicted of the violent felony offense, or a lesser included offense, are  
            <ln numlevel="1" lineno="902" slineno="14-129"/>exhausted;
            <eol numlevel="1" lineno="903" slineno="14-130"/>
            <para/>(iv) the length of time that a petition for postconviction relief, and any appeal  
            <ln numlevel="1" lineno="904" slineno="14-131"/>of the petition, is pending if an individual convicted of the violent felony offense  
            <ln numlevel="1" lineno="905" slineno="14-132"/>files the petition within the one-year time period described in Subsection  
            <ln numlevel="1" lineno="906" slineno="14-133"/>(2)(a)(iii); or
            <eol numlevel="1" lineno="907" slineno="14-134"/>
            <para/>(v) 20 years from the day on which the biological evidence is collected if the  
            <ln numlevel="1" lineno="908" slineno="14-135"/>biological evidence is the contents of a sexual assault kit; or
            <eol numlevel="1" lineno="909" slineno="14-136"/>
            <para/>(b)  at the discretion of the prosecuting attorney or federal prosecutor if the  
            <ln numlevel="1" lineno="910" slineno="14-137"/>prosecution of the violent felony offense resulted in an acquittal or dismissal.
          </amend>

            <ln numlevel="1" lineno="912" slineno="14-139"/>evidence under Subsection (2) is:
            <eol numlevel="1" lineno="913" slineno="14-140"/>
            <para/>(a) preserved
          </amend> in an amount and manner sufficient to:
          <eol numlevel="1" lineno="914" slineno="14-141"/>
          <para/>(i)  develop a DNA profile; and
          <eol numlevel="1" lineno="915" slineno="14-142"/>
          <para/>(ii)  if practicable, allow for independent testing of the biological evidence by a  
          <ln numlevel="1" lineno="916" slineno="14-143"/>defendant; and
          <eol numlevel="1" lineno="917" slineno="14-144"/>
          <para/>
          <amendoutstart style="5"/>
          <amend anum="0" ea="erase" pairid="15" style="2" owner="jrenner" level="1" deltag="both">(c) </amend>
          <amendoutend style="5"/>
          <amend anum="0" ea="amend" pairid="16" style="1" owner="jrenner" level="1" amendtag="both" space="true">(b)</amend>  subject to a continuous chain of custody.

          <amend anum="0" ea="amend" pairid="18" style="1" owner="jrenner" level="1" amendtag="both" space="true">(4)</amend> (a)  Upon request by a defendant under Title 63G, Chapter 2,  
          <ln numlevel="1" lineno="919" slineno="14-146"/>Government Records Access and Management Act, the evidence collecting or  
          <ln numlevel="1" lineno="920" slineno="14-147"/>retaining entity shall prepare an inventory of the biological evidence preserved in  
          <ln numlevel="1" lineno="921" slineno="14-148"/>connection with the defendant's criminal case.
          <eol numlevel="1" lineno="922" slineno="14-149"/>
          <para/>(b)  If the evidence collecting or retaining entity cannot locate biological  
          <ln numlevel="1" lineno="923" slineno="14-150"/>evidence requested under Subsection  
          <amendoutstart style="5"/>
          <amend anum="0" ea="erase" pairid="19" style="2" owner="jrenner" level="1" deltag="both">(3)(a) </amend>
          <amendoutend style="5"/>
          <amend anum="0" ea="amend" pairid="20" style="1" owner="jrenner" level="1" amendtag="both" space="true">(4)(a)</amend>, the custodian for the entity  
          <ln numlevel="1" lineno="924" slineno="14-151"/>shall provide a sworn affidavit to the defendant that:
          <eol numlevel="1" lineno="925" slineno="14-152"/>
          <para/>(i)  describes the efforts taken to locate the biological evidence; and
          <eol numlevel="1" lineno="926" slineno="14-153"/>
          <para/>(ii)  affirms that the biological evidence could not be located.
          <eol numlevel="1" lineno="927" slineno="14-154"/>
          <para/>
          <amendoutstart style="5"/>
          <amend anum="0" ea="erase" pairid="21" style="2" owner="jrenner" level="1" deltag="both">(4)The evidence collecting or retaining entity may dispose of biological  
            <ln numlevel="1" lineno="928" slineno="14-155"/>evidence before the day on which the period described in Subsection (2)(a)  
            <ln numlevel="1" lineno="929" slineno="14-156"/>expires if:
            <eol numlevel="1" lineno="930" slineno="14-157"/>
            <para/>(a)  no other provision of federal or state law requires the evidence collecting  
            <ln numlevel="1" lineno="931" slineno="14-158"/>or retaining entity to preserve the biological evidence;
            <eol numlevel="1" lineno="932" slineno="14-159"/>
            <para/>(b)  the evidence collecting or retaining entity sends notice in accordance with  
            <ln numlevel="1" lineno="933" slineno="14-160"/>Subsection (5); and
            <eol numlevel="1" lineno="934" slineno="14-161"/>
            <para/>(c)  an individual notified under Subsection (5)(a) does not within 180 days  
            <ln numlevel="1" lineno="935" slineno="14-162"/>after the day on which the evidence collecting or retaining entity receives proof of  
            <ln numlevel="1" lineno="936" slineno="14-163"/>delivery under Subsection (5):
            <eol numlevel="1" lineno="937" slineno="14-164"/>
            <para/>(i)  file a motion for testing of the biological evidence under Section  
            <xref depth="3" refnumber="78B-9-301">78B-9-301</xref>;  
            <ln numlevel="1" lineno="938" slineno="14-165"/>or
            <eol numlevel="1" lineno="939" slineno="14-166"/>
            <para/>(ii)  submit a written request under Subsection (5)(b)(ii).
          </amend>

          <amend anum="0" ea="amend" pairid="49" style="1" owner="jrenner" level="1" amendtag="both">(b)  An individual must file a motion, or submit a written request, described in  
            <ln numlevel="1" lineno="961" slineno="14-188"/>Subsection (5)(a)(ii) within 180 days after the day on which the evidence  
            <ln numlevel="1" lineno="962" slineno="14-189"/>collecting or retaining entity receives proof of delivery under Subsection (5)(a).
            <eol numlevel="1" lineno="963" slineno="14-190"/>
            <para/>(c)  An evidence collecting or retaining entity shall send a notice of intent to  
            <ln numlevel="1" lineno="964" slineno="14-191"/>dispose of biological evidence that is the contents of a sexual assault kit to a  
            <ln numlevel="1" lineno="965" slineno="14-192"/>victim in accordance with Section  
            <xref depth="3" refnumber="53-10-905">53-10-905</xref>.
            <eol numlevel="1" lineno="966" slineno="14-193"/>
            <para/>(6) The evidence collecting or retaining entity may not dispose of biological  
            <ln numlevel="1" lineno="967" slineno="14-194"/>evidence of a violent felony offense before the day on which the time period  
            <ln numlevel="1" lineno="968" slineno="14-195"/>described in Subsection (2) expires if:
            <eol numlevel="1" lineno="969" slineno="14-196"/>
            <para/>(a) the evidence collecting or retaining entity is required by federal or state law  
            <ln numlevel="1" lineno="970" slineno="14-197"/>to preserve the biological evidence; or
            <eol numlevel="1" lineno="971" slineno="14-198"/>
            <para/>(b) (i) the evidence collecting or retaining entity sends notice in accordance  
            <ln numlevel="1" lineno="972" slineno="14-199"/>with:
            <eol numlevel="1" lineno="973" slineno="14-200"/>
            <para/>(A) Subsection (5); and
            <eol numlevel="1" lineno="974" slineno="14-201"/>
            <para/>(B) Section  
            <xref depth="3" refnumber="53-10-905">53-10-905</xref> if the biological evidence is the contents of a sexual  
            <ln numlevel="1" lineno="975" slineno="14-202"/>assault kit; and
            <eol numlevel="1" lineno="976" slineno="14-203"/>
            <para/>(ii) an individual notified under Subsection (5)(a) or Section  
            <xref depth="3" refnumber="53-10-905">53-10-905</xref>:
            <eol numlevel="1" lineno="977" slineno="14-204"/>
            <para/>(A) files a motion for testing of the biological evidence under Section  
            <xref depth="3" refnumber="78B-9-301">
              <ln numlevel="1" lineno="978" slineno="14-205"/>78B-9-301
            </xref> within the 180-day period described in Subsection (5)(b); or
            <eol numlevel="1" lineno="979" slineno="14-206"/>
            <para/>(B) submits a written request for retention of the biological evidence within the  
            <ln numlevel="1" lineno="980" slineno="14-207"/>180-day period described in Subsection (5)(b) or Section  
            <xref depth="3" refnumber="53-10-905">53-10-905</xref>.

            <ln numlevel="1" lineno="987" slineno="14-214"/>not required to preserve physical evidence that may contain biological evidence if  
            <ln numlevel="1" lineno="988" slineno="14-215"/>the physical evidence's size, bulk, or physical character renders retention  
            <ln numlevel="1" lineno="989" slineno="14-216"/>impracticable.

            <ln numlevel="1" lineno="992" slineno="14-219"/>described in Part 3, Retention of Evidence for Felony Offenses.

          <para/>(c)  If the evidence collecting or retaining entity  
          <amendoutstart style="5"/>
          <amend anum="0" ea="erase" pairid="59" style="2" owner="jrenner" level="1" deltag="both">determines that retention is  
            <ln numlevel="1" lineno="994" slineno="14-221"/>impracticable 
          </amend>
          <amendoutend style="5"/>
          <amend anum="0" ea="amend" pairid="60" style="1" owner="jrenner" level="1" amendtag="both" space="true">is not required to retain physical evidence of the violent felony 
            <ln numlevel="1" lineno="995" slineno="14-222"/>offense under Part 3, Retention of Evidence for Felony Offenses
          </amend>, before returning  
          <ln numlevel="1" lineno="996" slineno="14-223"/>or disposing of the physical evidence, the evidence collecting or retaining entity  
          <ln numlevel="1" lineno="997" slineno="14-224"/>shall:
          <eol numlevel="1" lineno="998" slineno="14-225"/>
          <para/>(i)  remove the portions of the physical evidence likely to contain biological  
          <ln numlevel="1" lineno="999" slineno="14-226"/>evidence related to the violent felony offense; and
          <eol numlevel="1" lineno="1000" slineno="14-227"/>
          <para/>(ii)  preserve the removed biological evidence in a quantity sufficient to permit  
          <ln numlevel="1" lineno="1001" slineno="14-228"/>future DNA testing.
          <eol numlevel="1" lineno="1002" slineno="14-229"/>
          <para/>

          <amend anum="0" ea="erase" pairid="61" style="2" owner="jrenner" level="1" deltag="both">(7)</amend>
          <amendoutend style="5"/>  
          <amend anum="0" ea="amend" pairid="62" style="1" owner="jrenner" level="1" amendtag="both">(8)</amend>  To comply with the preservation requirements described in this  
          <ln numlevel="1" lineno="1003" slineno="14-230"/>section, a law enforcement agency or a court may:
          <eol numlevel="1" lineno="1004" slineno="14-231"/>
          <para/>(a)  retain the biological evidence; or
          <eol numlevel="1" lineno="1005" slineno="14-232"/>
          <para/>(b)  if a continuous chain of custody can be maintained, return the biological  
          <ln numlevel="1" lineno="1006" slineno="14-233"/>evidence to the custody of the other law enforcement agency that originally  
          <ln numlevel="1" lineno="1007" slineno="14-234"/>provided the biological evidence to the law enforcement agency.
