    <gd numlevel="1" lineno="5" slineno="0-5">This bill amends provisions regarding mandatory courses in family law actions.</gd>
    <hphead lineno="6">Highlighted Provisions:</hphead>
    <hp numlevel="1" lineno="7" slineno="0-7">This bill:
      <hl numlevel="1" lineno="8" slineno="0-8" level="1">clarifies the requirements for mandatory courses in temporary separation, divorce, and  
        <ln numlevel="1" lineno="9" slineno="0-9"/>parentage actions;
      </hl>
      <hl numlevel="1" lineno="10" slineno="0-10" level="1">clarifies the requirements for the divorce orientation course in a temporary separation  
        <ln numlevel="1" lineno="11" slineno="0-11"/>action;
      </hl>
      <hl numlevel="1" lineno="12" slineno="0-12" level="1">addresses a waiver of a mandatory course requirement by the court in a temporary

          <subsection ssid="1-5" dnum="a-o" placement="sameline">
            <display>(a)</display>The complaint shall be in writing and signed by the petitioner or petitioner's 
            <ln numlevel="1" lineno="42" slineno="1-8"/>attorney.
          </subsection>
          <subsection ssid="1-6" numlevel="1" lineno="43" slineno="1-9" dnum="b-o">
            <display>(b)</display>A decree of divorce may not be granted upon default or otherwise except upon legal 
            <ln numlevel="1" lineno="44" slineno="1-10"/>evidence taken in the cause. If the decree is to be entered upon the default of the 
            <ln numlevel="1" lineno="45" slineno="1-11"/>respondent, evidence to support the decree may be submitted upon the affidavit of the 
            <ln numlevel="1" lineno="46" slineno="1-12"/>petitioner with the approval of the court.
          </subsection>
          <subsection ssid="1-7" ea="erase" anum="0" owner="jcarlton" style="2" numlevel="1" lineno="47" slineno="1-13" dnum="c-o:_-e">
            <display>

              <amend anum="0" ea="erase" pairid="61" style="2" owner="o" level="1" deltag="start">(c)</amend>
            </display>
            <amend anum="0" ea="erase" pairid="11" style="2" owner="jcarlton" level="1" deltag="end">If the petitioner and the respondent have a child or children, a decree of divorce 
              <ln numlevel="1" lineno="48" slineno="1-14"/>may not be granted until both parties have attended the mandatory course described 
              <ln numlevel="1" lineno="49" slineno="1-15"/>in Section 
              <xref depth="3" refnumber="30-3-11.3">30-3-11.3</xref> or 
              <xref depth="3" refnumber="30-3-11.4">30-3-11.4</xref>, and have presented a certificate of course 
              <ln numlevel="1" lineno="50" slineno="1-16"/>completion to the court. The court may waive this requirement, on its own motion or 
              <ln numlevel="1" lineno="51" slineno="1-17"/>on the motion of one of the parties, if it determines course attendance and completion 
              <ln numlevel="1" lineno="52" slineno="1-18"/>are not necessary, appropriate, feasible, or in the best interest of the parties.

          </subsection>
          <subsection ssid="1-8" numlevel="1" lineno="53" slineno="1-19" dnum="d-o:c-e">

              <amendoutend style="5"/>
              <amend anum="0" ea="amend" pairid="63" style="1" owner="e" level="1" amendtag="both" space="true">(c)</amend>
            </display>All hearings and trials for divorce shall be held before the court or the court 
            <ln numlevel="1" lineno="54" slineno="1-20"/>commissioner as provided by Section 
            <xref depth="3" refnumber="78A-5-107">78A-5-107</xref> and rules of the Judicial Council. 
            <ln numlevel="1" lineno="55" slineno="1-21"/>The court or the commissioner in all divorce cases shall enter the decree upon the 
            <ln numlevel="1" lineno="56" slineno="1-22"/>evidence or, in the case of a decree after default of the respondent, upon the 
            <ln numlevel="1" lineno="57" slineno="1-23"/>petitioner's affidavit.
          </subsection>
        </subsection>
        <subsection ssid="1-9" ea="amend" anum="0" owner="jcarlton" style="1" numlevel="1" lineno="58" slineno="1-24" dnum="_-e:3-e" space="false">
          <display>
            <amend anum="0" ea="amend" pairid="63" style="1" owner="e" level="1" amendtag="start">(3)</amend>
          </display>
          <subsection ssid="1-10" ea="amend" anum="0" owner="jcarlton" style="1" dnum="_-e:a-e" placement="sameline">
            <display>
              <amend anum="0" ea="amend" pairid="64" style="1" owner="e" level="1">(a)</amend>
            </display>
            <amend anum="0" ea="amend" pairid="15" style="1" owner="jcarlton" level="1" amendtag="end">If the parties to the divorce action have a child, the parties shall attend the 
              <ln numlevel="1" lineno="59" slineno="1-25"/>mandatory courses:
            </amend>
            <subsection ssid="1-11" ea="amend" anum="0" owner="jcarlton" style="1" numlevel="1" lineno="60" slineno="1-26" dnum="_-e:i-e" tab="1">
              <display>
                <amend anum="0" ea="amend" pairid="65" style="1" owner="e" level="1" amendtag="start">(i)</amend>
              </display>
              <amend anum="0" ea="amend" pairid="17" style="1" owner="jcarlton" level="1" amendtag="end">for the petitioner, within 60 days after the day on which the petition is filed; and</amend>
            </subsection>
            <subsection ssid="1-12" ea="amend" anum="0" owner="jcarlton" style="1" numlevel="1" lineno="61" slineno="1-27" dnum="_-e:ii-e" tab="1">
              <display>
                <amend anum="0" ea="amend" pairid="66" style="1" owner="e" level="1" amendtag="start">(ii)</amend>
              </display>
              <amend anum="0" ea="amend" pairid="20" style="1" owner="jcarlton" level="1" amendtag="end">for the respondent, within 30 days after the day on which the respondent is served.</amend>
            </subsection>
          </subsection>
          <subsection ssid="1-13" ea="amend" anum="0" owner="jcarlton" style="1" numlevel="1" lineno="62" slineno="1-28" dnum="_-e:b-e">
            <display>
              <amend anum="0" ea="amend" pairid="67" style="1" owner="e" level="1" amendtag="start">(b)</amend>
            </display>
            <amend anum="0" ea="amend" pairid="24" style="1" owner="jcarlton" level="1" amendtag="end">If the parties to a divorce action do not have a child, the parties may choose to attend 
              <ln numlevel="1" lineno="63" slineno="1-29"/>the divorce orientation course described in Section 
              <xref depth="3" refnumber="30-3-11.4">30-3-11.4</xref>.
            </amend>
          </subsection>
          <subsection ssid="1-14" ea="amend" anum="0" owner="jcarlton" style="1" numlevel="1" lineno="64" slineno="1-30" dnum="_-e:c-e">
            <display>
              <amend anum="0" ea="amend" pairid="68" style="1" owner="e" level="1" amendtag="start">(c)</amend>
            </display>
            <amend anum="0" ea="amend" pairid="27" style="1" owner="jcarlton" level="1" amendtag="end">The clerk of the court shall provide notice to a petitioner of the requirement for the 
              <ln numlevel="1" lineno="65" slineno="1-31"/>mandatory courses.
            </amend>
          </subsection>
          <subsection ssid="1-15" ea="amend" anum="0" owner="jcarlton" style="1" numlevel="1" lineno="66" slineno="1-32" dnum="_-e:d-e">
            <display>
              <amend anum="0" ea="amend" pairid="69" style="1" owner="e" level="1" amendtag="start">(d)</amend>
            </display>
            <amend anum="0" ea="amend" pairid="30" style="1" owner="jcarlton" level="1" amendtag="end">A petition shall include information regarding the mandatory courses when the 
              <ln numlevel="1" lineno="67" slineno="1-33"/>petition is served on the respondent.
            </amend>
          </subsection>
        </subsection>
        <subsection ssid="1-16" ea="amend" anum="0" owner="jcarlton" style="1" numlevel="1" lineno="68" slineno="1-34" dnum="_-e:4-e">
          <display>
            <amend anum="0" ea="amend" pairid="70" style="1" owner="e" level="1" amendtag="start">(4)</amend>
          </display>
          <amend anum="0" ea="amend" pairid="34" style="1" owner="jcarlton" level="1" amendtag="end">For a party that is unable to pay the costs of the mandatory courses, and before the court  
            <ln numlevel="1" lineno="69" slineno="1-35"/>enters a decree of divorce in the action, the court shall:
          </amend>
          <subsection ssid="1-17" ea="amend" anum="0" owner="jcarlton" style="1" numlevel="1" lineno="70" slineno="1-36" dnum="_-e:a-e">
            <display>
              <amend anum="0" ea="amend" pairid="71" style="1" owner="e" level="1" amendtag="start">(a)</amend>
            </display>
            <amend anum="0" ea="amend" pairid="36" style="1" owner="jcarlton" level="1" amendtag="end">make a final determination of indigency; and</amend>
          </subsection>
          <subsection ssid="1-18" ea="amend" anum="0" owner="jcarlton" style="1" numlevel="1" lineno="71" slineno="1-37" dnum="_-e:b-e">
            <display>
              <amend anum="0" ea="amend" pairid="72" style="1" owner="e" level="1" amendtag="start">(b)</amend>
            </display>
            <amend anum="0" ea="amend" pairid="39" style="1" owner="jcarlton" level="1" amendtag="end">order the party to pay the costs of the mandatory courses if the court determines the  
              <ln numlevel="1" lineno="72" slineno="1-38"/>party is not indigent.
            </amend>
          </subsection>
        </subsection>
        <subsection ssid="1-19" ea="amend" anum="0" owner="jcarlton" style="1" numlevel="1" lineno="73" slineno="1-39" dnum="_-e:5-e" space="false">
          <display>
            <amend anum="0" ea="amend" pairid="73" style="1" owner="e" level="1" amendtag="start">(5)</amend>
          </display>
          <subsection ssid="1-20" ea="amend" anum="0" owner="jcarlton" style="1" dnum="_-e:a-e" placement="sameline">
            <display>
              <amend anum="0" ea="amend" pairid="74" style="1" owner="e" level="1">(a)</amend>
            </display>
            <amend anum="0" ea="amend" pairid="44" style="1" owner="jcarlton" level="1" amendtag="end">Except for a temporary restraining order under Rule 65 of the Utah Rules of Civil 
              <ln numlevel="1" lineno="74" slineno="1-40"/>Procedure, a party may file, but the court may not hear, a motion for an order related 
              <ln numlevel="1" lineno="75" slineno="1-41"/>to the divorce until the moving party completes the mandatory courses.
            </amend>
          </subsection>
          <subsection ssid="1-21" ea="amend" anum="0" owner="jcarlton" style="1" numlevel="1" lineno="76" slineno="1-42" dnum="_-e:b-e">
            <display>
              <amend anum="0" ea="amend" pairid="75" style="1" owner="e" level="1" amendtag="start">(b)</amend>
            </display>
            <amend anum="0" ea="amend" pairid="47" style="1" owner="jcarlton" level="1" amendtag="end">It is an affirmative defense in a divorce action that a party has not completed the 
              <ln numlevel="1" lineno="77" slineno="1-43"/>mandatory courses and the action may not continue until a party has complied with 
              <ln numlevel="1" lineno="78" slineno="1-44"/>the mandatory courses.
            </amend>
          </subsection>
        </subsection>
        <subsection ssid="1-22" ea="amend" anum="0" owner="jcarlton" style="1" numlevel="1" lineno="79" slineno="1-45" dnum="_-e:6-e" space="false">
          <display>
            <amend anum="0" ea="amend" pairid="76" style="1" owner="e" level="1" amendtag="start">(6)</amend>
          </display>
          <subsection ssid="1-23" ea="amend" anum="0" owner="jcarlton" style="1" dnum="_-e:a-e" placement="sameline">
            <display>
              <amend anum="0" ea="amend" pairid="77" style="1" owner="e" level="1">(a)</amend>
            </display>
            <amend anum="0" ea="amend" pairid="52" style="1" owner="jcarlton" level="1" amendtag="end">Notwithstanding Subsections (3) and (5)(b), the court may waive the requirement 
              <ln numlevel="1" lineno="80" slineno="1-46"/>that the parties attend the mandatory courses, on the court's own motion or on the 
              <ln numlevel="1" lineno="81" slineno="1-47"/>motion of one of the parties, if the court determines course attendance and 
              <ln numlevel="1" lineno="82" slineno="1-48"/>completion are not necessary, appropriate, or feasible, or in the best interest of the 
              <ln numlevel="1" lineno="83" slineno="1-49"/>parties.
            </amend>
          </subsection>
          <subsection ssid="1-24" ea="amend" anum="0" owner="jcarlton" style="1" numlevel="1" lineno="84" slineno="1-50" dnum="_-e:b-e">
            <display>

            </display>
            <amend anum="0" ea="amend" pairid="55" style="1" owner="jcarlton" level="1" amendtag="end">If the requirement is waived, the court may permit the divorce action to proceed.</amend>
          </subsection>
        </subsection>

            <display>(a)</display>A party to an action brought under this title or to an action under Title 78B, 
            <ln numlevel="1" lineno="86" slineno="1-52"/>Chapter 12, Utah Child Support Act, Title 78B, Chapter 13, Utah Uniform Child 
            <ln numlevel="1" lineno="87" slineno="1-53"/>Custody Jurisdiction and Enforcement Act, Title 78B, Chapter 14, Utah Uniform

          <subsection ssid="1-27" numlevel="1" lineno="91" slineno="1-57" dnum="b-o">
            <display>(b)</display>If the court finds that there are substantial interests favoring restricting access that 
            <ln numlevel="1" lineno="92" slineno="1-58"/>clearly outweigh the interests favoring access, the court may classify the file, or any 
            <ln numlevel="1" lineno="93" slineno="1-59"/>part thereof other than the final order, judgment, or decree, as private. An order 
            <ln numlevel="1" lineno="94" slineno="1-60"/>classifying part of the file as private does not apply to subsequent filings.
          </subsection>
          <subsection ssid="1-28" numlevel="1" lineno="95" slineno="1-61" dnum="c-o">
            <display>(c)</display>The record is private until the judge determines it is possible to release the record 
            <ln numlevel="1" lineno="96" slineno="1-62"/>without prejudice to the interests that justified the closure. Any interested person 
            <ln numlevel="1" lineno="97" slineno="1-63"/>may petition the court to permit access to a record classified as private under this 
            <ln numlevel="1" lineno="98" slineno="1-64"/>section. The petition shall be served on the parties to the closure order.
          </subsection>

            <display>(a)</display>the petitioner is lawfully married to the respondent; and
          </subsection>

            <display>(b)</display>both parties are residents of the state for at least 90 days prior to the date of filing.

            </display>
            <amend anum="0" ea="amend" pairid="18" style="1" owner="jcarlton" level="1" amendtag="end">The clerk of the court shall provide notice to a petitioner of the divorce orientation

            </amend>
          </subsection>

            </display>
            <amend anum="0" ea="amend" pairid="21" style="1" owner="jcarlton" level="1" amendtag="end">A petition shall include information regarding the divorce orientation course 
              <ln numlevel="1" lineno="126" slineno="2-28"/>requirement when the petition is served on the respondent.
            </amend>
          </subsection>
        </subsection>
        <subsection ssid="2-16" ea="amend" anum="0" owner="jcarlton" style="1" numlevel="1" lineno="127" slineno="2-29" dnum="_-e:5-e">
          <display>
            <amend anum="0" ea="amend" pairid="61" style="1" owner="e" level="1" amendtag="start">(5)</amend>
          </display>
          <amend anum="0" ea="amend" pairid="25" style="1" owner="jcarlton" level="1" amendtag="end">For a party that is unable to pay the costs of the divorce orientation course, and before  
            <ln numlevel="1" lineno="128" slineno="2-30"/>the court enters a decree of divorce in the action, the court shall:
          </amend>

              <amend anum="0" ea="amend" pairid="66" style="1" owner="e" level="1" amendtag="start">(b)</amend>
            </display>
            <amend anum="0" ea="amend" pairid="38" style="1" owner="jcarlton" level="1" amendtag="end">It is an affirmative defense in a temporary separation action that a party has not 
              <ln numlevel="1" lineno="137" slineno="2-39"/>completed the divorce orientation course and the action may not continue until a 
              <ln numlevel="1" lineno="138" slineno="2-40"/>party has complied with the divorce orientation course.
            </amend>
          </subsection>
        </subsection>
        <subsection ssid="2-22" ea="amend" anum="0" owner="jcarlton" style="1" numlevel="1" lineno="139" slineno="2-41" dnum="_-e:7-e" space="false">
          <display>

            </display>
            <amend anum="0" ea="amend" pairid="46" style="1" owner="jcarlton" level="1" amendtag="end">If the requirement is waived, the court may permit the temporary separation action to

          </display>An order of joint legal or physical custody shall provide terms the court determines  
          <ln numlevel="1" lineno="159" slineno="3-8"/>appropriate, which may include specifying:

            <display>(a)</display>either the county of residence of the child, until altered by further order of the court,  
            <ln numlevel="1" lineno="161" slineno="3-10"/>or the custodian who has the sole legal right to determine the residence of the child;

          <subsection ssid="3-4" numlevel="1" lineno="162" slineno="3-11" dnum="b-o">
            <display>(b)</display>that the parents shall exchange information concerning the health, education, and  
            <ln numlevel="1" lineno="163" slineno="3-12"/>welfare of the child, and where possible, confer before making decisions concerning  
            <ln numlevel="1" lineno="164" slineno="3-13"/>any of these areas;
          </subsection>
          <subsection ssid="3-5" numlevel="1" lineno="165" slineno="3-14" dnum="c-o">
            <display>(c)</display>the rights and duties of each parent regarding the child's present and future physical  
            <ln numlevel="1" lineno="166" slineno="3-15"/>care, support, and education;
          </subsection>
          <subsection ssid="3-6" numlevel="1" lineno="167" slineno="3-16" dnum="d-o">
            <display>(d)</display>provisions to minimize disruption of the child's attendance at school and other  
            <ln numlevel="1" lineno="168" slineno="3-17"/>activities, his daily routine, and his association with friends; and
          </subsection>
          <subsection ssid="3-7" numlevel="1" lineno="169" slineno="3-18" dnum="e-o">
            <display>(e)</display>as necessary, the remaining parental rights, privileges, duties, and powers to be  
            <ln numlevel="1" lineno="170" slineno="3-19"/>exercised by the parents solely, concurrently, or jointly.
          </subsection>
        </subsection>
        <subsection ssid="3-8" numlevel="1" lineno="171" slineno="3-20" dnum="3-o:2-e">

            <display>(b)</display>before seeking enforcement or modification of the terms and conditions of the order  
            <ln numlevel="1" lineno="185" slineno="3-34"/>of joint legal or physical custody through litigation, except in emergency situations  
            <ln numlevel="1" lineno="186" slineno="3-35"/>requiring ex parte orders to protect the child.
          </subsection>
        </subsection>

        </catline>
        <subsection ssid="4-1" numlevel="1" lineno="189" slineno="4-3" dnum="1-o" placement="noreturn">
          <display>(1)</display>On the petition of one or both of the parents, or the joint legal or physical custodians if  
          <ln numlevel="1" lineno="190" slineno="4-4"/>they are not the parents, the court may, after a hearing, modify or terminate an order that  
          <ln numlevel="1" lineno="191" slineno="4-5"/>established joint legal custody or joint physical custody if:
          <subsection ssid="4-2" numlevel="1" lineno="192" slineno="4-6" dnum="a-o">
            <display>(a)</display>the verified petition or accompanying affidavit initially alleges that admissible  
            <ln numlevel="1" lineno="193" slineno="4-7"/>evidence will show that the circumstances of the child or one or both parents or joint  
            <ln numlevel="1" lineno="194" slineno="4-8"/>legal or physical custodians have materially and substantially changed since the entry  
            <ln numlevel="1" lineno="195" slineno="4-9"/>of the order to be modified;
          </subsection>
          <subsection ssid="4-3" numlevel="1" lineno="196" slineno="4-10" dnum="b-o">
            <display>(b)</display>a modification of the terms and conditions of the order would be an improvement for  
            <ln numlevel="1" lineno="197" slineno="4-11"/>and in the best interest of the child; and
          </subsection>
          <subsection ssid="4-4" numlevel="1" lineno="198" slineno="4-12" dnum="c-o" space="false">
            <display>(c)</display>
            <subsection ssid="4-5" dnum="i-o" placement="sameline">
              <display>(i)</display>both parents have complied in good faith with the dispute resolution procedure 
              <ln numlevel="1" lineno="199" slineno="4-13"/>in accordance with Subsection 
              <amendoutstart style="5"/>
              <amend anum="0" ea="erase" pairid="1" style="2" owner="jcarlton" level="1" deltag="both">
                <xref depth="3" refnumber="30-3-10.3">30-3-10.3</xref>(7)
              </amend>
              <amendoutend style="5"/>

            </subsection>
            <subsection ssid="4-6" numlevel="1" lineno="200" slineno="4-14" dnum="ii-o">
              <display>(ii)</display>if no dispute resolution procedure is contained in the order that established joint 
              <ln numlevel="1" lineno="201" slineno="4-15"/>legal custody or joint physical custody, the court orders the parents to participate 
              <ln numlevel="1" lineno="202" slineno="4-16"/>in a dispute resolution procedure in accordance with Subsection 
              <xref depth="3" refnumber="30-3-10.2">30-3-10.2</xref>(5) 
              <ln numlevel="1" lineno="203" slineno="4-17"/>unless the parents certify that, in good faith, they have used a dispute resolution 
              <ln numlevel="1" lineno="204" slineno="4-18"/>procedure to resolve their dispute.
            </subsection>
          </subsection>
        </subsection>
        <subsection ssid="4-7" numlevel="1" lineno="205" slineno="4-19" dnum="2-o" space="false">
          <display>(2)</display>
          <subsection ssid="4-8" dnum="a-o" placement="sameline">
            <display>(a)</display>In determining whether the best interest of a child will be served by either 
            <ln numlevel="1" lineno="206" slineno="4-20"/>modifying or terminating the joint legal custody or joint physical custody order, the 
            <ln numlevel="1" lineno="207" slineno="4-21"/>court shall, in addition to other factors the court considers relevant, consider the 
            <ln numlevel="1" lineno="208" slineno="4-22"/>factors outlined in Section 
            <xref depth="3" refnumber="30-3-10">30-3-10</xref> and Subsection 
            <xref depth="3" refnumber="30-3-10.2">30-3-10.2</xref>(2).
          </subsection>
          <subsection ssid="4-9" numlevel="1" lineno="209" slineno="4-23" dnum="b-o">
            <display>(b)</display>A court order modifying or terminating an existing joint legal custody or joint 
            <ln numlevel="1" lineno="210" slineno="4-24"/>physical custody order shall contain written findings that:
            <subsection ssid="4-10" numlevel="1" lineno="211" slineno="4-25" dnum="i-o">
              <display>(i)</display>a material and substantial change of circumstance has occurred; and
            </subsection>
            <subsection ssid="4-11" numlevel="1" lineno="212" slineno="4-26" dnum="ii-o">
              <display>(ii)</display>a modification of the terms and conditions of the order would be an improvement 
              <ln numlevel="1" lineno="213" slineno="4-27"/>for and in the best interest of the child.
            </subsection>
          </subsection>
          <subsection ssid="4-12" numlevel="1" lineno="214" slineno="4-28" dnum="c-o">
            <display>(c)</display>The court shall give substantial weight to the existing joint legal custody or joint 
            <ln numlevel="1" lineno="215" slineno="4-29"/>physical custody order when the child is thriving, happy, and well-adjusted.
          </subsection>
        </subsection>
        <subsection ssid="4-13" numlevel="1" lineno="216" slineno="4-30" dnum="3-o">
          <display>(3)</display>The court shall, in every case regarding a petition for termination of a joint legal  
          <ln numlevel="1" lineno="217" slineno="4-31"/>custody or joint physical custody order, consider reasonable alternatives to preserve the  
          <ln numlevel="1" lineno="218" slineno="4-32"/>existing order in accordance with Subsection  
          <xref depth="3" refnumber="30-3-10">30-3-10</xref>(3).  The court may modify the  
          <ln numlevel="1" lineno="219" slineno="4-33"/>terms and conditions of the existing order in accordance with Subsection  
          <xref depth="3" refnumber="30-3-10">30-3-10</xref>(8) and  
          <ln numlevel="1" lineno="220" slineno="4-34"/>may order the parents to file a parenting plan in accordance with this chapter.
        </subsection>
        <subsection ssid="4-14" numlevel="1" lineno="221" slineno="4-35" dnum="4-o">
          <display>(4)</display>A parent requesting a modification from sole custody to joint legal custody or joint  
          <ln numlevel="1" lineno="222" slineno="4-36"/>physical custody or both, or any other type of shared parenting arrangement, shall file  
          <ln numlevel="1" lineno="223" slineno="4-37"/>and serve a proposed parenting plan with the petition to modify in accordance with  
          <ln numlevel="1" lineno="224" slineno="4-38"/>Section  
          <xref depth="3" refnumber="30-3-10.8">30-3-10.8</xref>.
        </subsection>
        <subsection ssid="4-15" numlevel="1" lineno="225" slineno="4-39" dnum="5-o">
          <display>(5)</display>If the court finds that an action under this section is filed or answered frivolously and in  
          <ln numlevel="1" lineno="226" slineno="4-40"/>a manner designed to harass the other party, the court shall assess attorney fees as costs  
          <ln numlevel="1" lineno="227" slineno="4-41"/>against the offending party.
        </subsection>
        <subsection ssid="4-16" numlevel="1" lineno="228" slineno="4-42" dnum="6-o">
          <display>(6)</display>If an issue before the court involves custodial responsibility in the event of deployment  
          <ln numlevel="1" lineno="229" slineno="4-43"/>of one or both parents who are service members, and the service member has not yet  
          <ln numlevel="1" lineno="230" slineno="4-44"/>been notified of deployment, the court shall resolve the issue based on the standards in  
          <ln numlevel="1" lineno="231" slineno="4-45"/>Sections  
          <xref depth="3" refnumber="78B-20-306">78B-20-306</xref> through  
          <xref depth="3" refnumber="78B-20-309">78B-20-309</xref>.
        </subsection>
      </section>

          <bold>30-3-10.9. Parenting plan -- Objectives -- Required provisions -- Dispute  
            <ln numlevel="1" lineno="234" slineno="5-3"/>resolution -- Education plan.
          </bold>
        </catline>
        <subsection ssid="5-1" numlevel="1" lineno="235" slineno="5-4" dnum="1-o" placement="noreturn">
          <display>(1)</display>The objectives of a parenting plan are to:
          <subsection ssid="5-2" numlevel="1" lineno="236" slineno="5-5" dnum="a-o">
            <display>(a)</display>provide for the child's physical care;
          </subsection>
          <subsection ssid="5-3" numlevel="1" lineno="237" slineno="5-6" dnum="b-o">
            <display>(b)</display>maintain the child's emotional stability;
          </subsection>
          <subsection ssid="5-4" numlevel="1" lineno="238" slineno="5-7" dnum="c-o">
            <display>(c)</display>provide for the child's changing needs as the child grows and matures in a way that  
            <ln numlevel="1" lineno="239" slineno="5-8"/>minimizes the need for future modifications to the parenting plan;
          </subsection>
          <subsection ssid="5-5" numlevel="1" lineno="240" slineno="5-9" dnum="d-o">
            <display>(d)</display>set forth the authority and responsibilities of each parent with respect to the child  
            <ln numlevel="1" lineno="241" slineno="5-10"/>consistent with the definitions outlined in this chapter;
          </subsection>
          <subsection ssid="5-6" numlevel="1" lineno="242" slineno="5-11" dnum="e-o">
            <display>(e)</display>minimize the child's exposure to harmful parental conflict;
          </subsection>
          <subsection ssid="5-7" numlevel="1" lineno="243" slineno="5-12" dnum="f-o">
            <display>(f)</display>encourage the parents, where appropriate, to meet the responsibilities to their minor  
            <ln numlevel="1" lineno="244" slineno="5-13"/>children through agreements in the parenting plan rather than relying on judicial  
            <ln numlevel="1" lineno="245" slineno="5-14"/>intervention; and
          </subsection>
          <subsection ssid="5-8" numlevel="1" lineno="246" slineno="5-15" dnum="g-o">
            <display>(g)</display>protect the best interests of the child.
          </subsection>
        </subsection>
        <subsection ssid="5-9" numlevel="1" lineno="247" slineno="5-16" dnum="2-o">
          <display>(2)</display>The parenting plan shall contain provisions for resolution of future disputes between the  
          <ln numlevel="1" lineno="248" slineno="5-17"/>parents, allocation of decision-making authority, and residential provisions for the child,  
          <ln numlevel="1" lineno="249" slineno="5-18"/>and provisions addressing notice and parent-time responsibilities in the event of the  
          <ln numlevel="1" lineno="250" slineno="5-19"/>relocation of either party.  It may contain other provisions comparable to those in  
          <ln numlevel="1" lineno="251" slineno="5-20"/>Sections  
          <xref depth="3" refnumber="30-3-5">30-3-5</xref> and  
          <xref depth="3" refnumber="30-3-10.3">30-3-10.3</xref> regarding the welfare of the child.
        </subsection>
        <subsection ssid="5-10" numlevel="1" lineno="252" slineno="5-21" dnum="3-o">
          <display>(3)</display>A process for resolving disputes shall be provided unless precluded or limited by  
          <ln numlevel="1" lineno="253" slineno="5-22"/>statute.  A dispute resolution process may include:
          <subsection ssid="5-11" numlevel="1" lineno="254" slineno="5-23" dnum="a-o">
            <display>(a)</display>counseling;
          </subsection>
          <subsection ssid="5-12" numlevel="1" lineno="255" slineno="5-24" dnum="b-o">
            <display>(b)</display>mediation or arbitration by a specified individual or agency; or
          </subsection>
          <subsection ssid="5-13" numlevel="1" lineno="256" slineno="5-25" dnum="c-o">
            <display>(c)</display>court action.
          </subsection>
        </subsection>
        <subsection ssid="5-14" numlevel="1" lineno="257" slineno="5-26" dnum="4-o">
          <display>(4)</display>In the dispute resolution process:
          <subsection ssid="5-15" numlevel="1" lineno="258" slineno="5-27" dnum="a-o">
            <display>(a)</display>preference shall be given to the provisions in the parenting plan;
          </subsection>
          <subsection ssid="5-16" numlevel="1" lineno="259" slineno="5-28" dnum="b-o">
            <display>(b)</display>parents shall use the designated process to resolve disputes relating to  
            <ln numlevel="1" lineno="260" slineno="5-29"/>implementation of the plan, except those related to financial support, unless an  
            <ln numlevel="1" lineno="261" slineno="5-30"/>emergency exists;
          </subsection>
          <subsection ssid="5-17" numlevel="1" lineno="262" slineno="5-31" dnum="c-o">
            <display>(c)</display>a written record shall be prepared of any agreement reached in counseling or  
            <ln numlevel="1" lineno="263" slineno="5-32"/>mediation and provided to each party;
          </subsection>
          <subsection ssid="5-18" numlevel="1" lineno="264" slineno="5-33" dnum="d-o">
            <display>(d)</display>if arbitration becomes necessary, a written record shall be prepared and a copy of the  
            <ln numlevel="1" lineno="265" slineno="5-34"/>arbitration award shall be provided to each party;
          </subsection>
          <subsection ssid="5-19" numlevel="1" lineno="266" slineno="5-35" dnum="e-o">
            <display>(e)</display>if the court finds that a parent has used or frustrated the dispute resolution process  
            <ln numlevel="1" lineno="267" slineno="5-36"/>without good reason, the court may award attorney fees and financial sanctions to the  
            <ln numlevel="1" lineno="268" slineno="5-37"/>prevailing parent;
          </subsection>
          <subsection ssid="5-20" numlevel="1" lineno="269" slineno="5-38" dnum="f-o">
            <display>(f)</display>the district court has the right of review from the dispute resolution process; and
          </subsection>
          <subsection ssid="5-21" numlevel="1" lineno="270" slineno="5-39" dnum="g-o">
            <display>(g)</display>the provisions of this Subsection (4) shall be set forth in any final decree or order.
          </subsection>
        </subsection>
        <subsection ssid="5-22" numlevel="1" lineno="271" slineno="5-40" dnum="5-o" space="false">
          <display>(5)</display>
          <subsection ssid="5-23" dnum="a-o" placement="sameline">
            <display>(a)</display>Subject to the other provisions of this Subsection (5), the parenting plan shall 
            <ln numlevel="1" lineno="272" slineno="5-41"/>allocate decision-making authority to one or both parties regarding the child's 
            <ln numlevel="1" lineno="273" slineno="5-42"/>education, healthcare, and religious upbringing. The parties may incorporate an 
            <ln numlevel="1" lineno="274" slineno="5-43"/>agreement related to the care and growth of the child in these specified areas or in 
            <ln numlevel="1" lineno="275" slineno="5-44"/>other areas into the plan, consistent with the criteria outlined in Subsection 
            <xref depth="3" refnumber="30-3-10.7">30-3-10.7</xref>
            <ln numlevel="1" lineno="276" slineno="5-45"/>(2) and Subsection (1). Regardless of the allocation of decision-making in the 
            <ln numlevel="1" lineno="277" slineno="5-46"/>parenting plan, either parent may make emergency decisions affecting the health or 
            <ln numlevel="1" lineno="278" slineno="5-47"/>safety of the child.
          </subsection>
          <subsection ssid="5-24" numlevel="1" lineno="279" slineno="5-48" dnum="b-o">
            <display>(b)</display>A child's education plan shall designate the following:
            <subsection ssid="5-25" numlevel="1" lineno="280" slineno="5-49" dnum="i-o">
              <display>(i)</display>the home residence for purposes of identifying the appropriate school or another 
              <ln numlevel="1" lineno="281" slineno="5-50"/>specific plan that provides for where the child will attend school;
            </subsection>
            <subsection ssid="5-26" numlevel="1" lineno="282" slineno="5-51" dnum="ii-o">
              <display>(ii)</display>which parent has authority to make education decisions for the child if the parents 
              <ln numlevel="1" lineno="283" slineno="5-52"/>cannot agree; and
            </subsection>
            <subsection ssid="5-27" numlevel="1" lineno="284" slineno="5-53" dnum="iii-o">
              <display>(iii)</display>whether one or both parents have access to the child during school and authority 
              <ln numlevel="1" lineno="285" slineno="5-54"/>to check the child out of school.
            </subsection>
          </subsection>
          <subsection ssid="5-28" numlevel="1" lineno="286" slineno="5-55" dnum="c-o">
            <display>(c)</display>If no education provision is included in the parent plan:
            <subsection ssid="5-29" numlevel="1" lineno="287" slineno="5-56" dnum="i-o">
              <display>(i)</display>a parent with sole physical custody shall make the decisions listed in Subsection 
              <ln numlevel="1" lineno="288" slineno="5-57"/>(5)(b);
            </subsection>
            <subsection ssid="5-30" numlevel="1" lineno="289" slineno="5-58" dnum="ii-o">
              <display>(ii)</display>in the event of joint physical custody when one parent has custody a majority of 
              <ln numlevel="1" lineno="290" slineno="5-59"/>the time, pursuant to Subsection 
              <amendoutstart style="5"/>
              <amend anum="0" ea="erase" pairid="1" style="2" owner="jcarlton" level="1" deltag="both">
                <xref depth="3" refnumber="30-3-10.3">30-3-10.3</xref>(4)
              </amend>
              <amendoutend style="5"/>
              <amend anum="0" ea="amend" pairid="2" style="1" owner="jcarlton" level="1" amendtag="both" space="true">
                <xref depth="3" refnumber="30-3-10.3">30-3-10.3</xref>(3)
              </amend>:
              <subsection ssid="5-31" numlevel="1" lineno="291" slineno="5-60" dnum="A-o">
                <display>(A)</display>the parent having the child the majority of the time shall make the decisions 
                <ln numlevel="1" lineno="292" slineno="5-61"/>listed in Subsections (5)(b)(i) and (ii); and
              </subsection>
              <subsection ssid="5-32" numlevel="1" lineno="293" slineno="5-62" dnum="B-o">
                <display>(B)</display>both parents with joint physical custody shall have access to the child during 
                <ln numlevel="1" lineno="294" slineno="5-63"/>school and authority to check the child out of school; or
              </subsection>
            </subsection>
            <subsection ssid="5-33" numlevel="1" lineno="295" slineno="5-64" dnum="iii-o">
              <display>(iii)</display>in the event of joint physical custody when the parents have custody an equal 
              <ln numlevel="1" lineno="296" slineno="5-65"/>amount of time:
              <subsection ssid="5-34" numlevel="1" lineno="297" slineno="5-66" dnum="A-o">
                <display>(A)</display>the court shall determine how the decisions listed in Subsections (5)(b)(i) and 
                <ln numlevel="1" lineno="298" slineno="5-67"/>(ii) are made; and
              </subsection>
              <subsection ssid="5-35" numlevel="1" lineno="299" slineno="5-68" dnum="B-o">
                <display>(B)</display>both parents with joint physical custody shall have access to the child during 
                <ln numlevel="1" lineno="300" slineno="5-69"/>school and authority to check the child out of school.
              </subsection>
            </subsection>
          </subsection>
        </subsection>
        <subsection ssid="5-36" numlevel="1" lineno="301" slineno="5-70" dnum="6-o">
          <display>(6)</display>Each parent may make decisions regarding the day-to-day care and control of the child  
          <ln numlevel="1" lineno="302" slineno="5-71"/>while the child is residing with that parent.
        </subsection>
        <subsection ssid="5-37" numlevel="1" lineno="303" slineno="5-72" dnum="7-o">
          <display>(7)</display>When mutual decision-making is designated but cannot be achieved, the parties shall  
          <ln numlevel="1" lineno="304" slineno="5-73"/>make a good faith effort to resolve the issue through the dispute resolution process.
        </subsection>
        <subsection ssid="5-38" numlevel="1" lineno="305" slineno="5-74" dnum="8-o">
          <display>(8)</display>The plan shall include a residential schedule that designates in which parent's home  
          <ln numlevel="1" lineno="306" slineno="5-75"/>each minor child shall reside on given days of the year, including provisions for  
          <ln numlevel="1" lineno="307" slineno="5-76"/>holidays, birthdays of family members, vacations, and other special occasions.
        </subsection>
        <subsection ssid="5-39" numlevel="1" lineno="308" slineno="5-77" dnum="9-o">
          <display>(9)</display>If a parent fails to comply with a provision of the parenting plan or a child support  
          <ln numlevel="1" lineno="309" slineno="5-78"/>order, the other parent's obligations under the parenting plan or the child support order  
          <ln numlevel="1" lineno="310" slineno="5-79"/>are not affected.  Failure to comply with a provision of the parenting plan or a child  
          <ln numlevel="1" lineno="311" slineno="5-80"/>support order may result in a finding of contempt of court.
        </subsection>
        <subsection ssid="5-40" numlevel="1" lineno="312" slineno="5-81" dnum="10-o" space="false">
          <display>(10)</display>
          <subsection ssid="5-41" dnum="a-o" placement="sameline">
            <display>(a)</display>When one or both parents are servicemembers, the parenting plan shall contain 
            <ln numlevel="1" lineno="313" slineno="5-82"/>provisions that address the foreseeable parenting and custodial issues likely to arise 
            <ln numlevel="1" lineno="314" slineno="5-83"/>in the event of notification of deployment or other contingency, including long-term 
            <ln numlevel="1" lineno="315" slineno="5-84"/>deployments, short-term deployments, death, incapacity, and noncombatant 
            <ln numlevel="1" lineno="316" slineno="5-85"/>evacuation operations.
          </subsection>
          <subsection ssid="5-42" numlevel="1" lineno="317" slineno="5-86" dnum="b-o">
            <display>(b)</display>The provisions in the parenting plan described in Subsection (10)(a) shall comport 
            <ln numlevel="1" lineno="318" slineno="5-87"/>substantially with the requirements of an agreement made pursuant to Section 
            <xref depth="3" refnumber="78B-20-201">
              <ln numlevel="1" lineno="319" slineno="5-88"/>78B-20-201
            </xref>.
          </subsection>
        </subsection>

            <ln numlevel="1" lineno="372" slineno="6-53"/>indigency as evidenced by an affidavit of indigency filed in the district court in 
            <ln numlevel="1" lineno="373" slineno="6-54"/>accordance with Section 
            <xref depth="3" refnumber="78A-2-302">78A-2-302</xref>.

            <amend anum="0" ea="erase" pairid="65" style="2" owner="jcarlton" level="1" deltag="both">In those situations, the independent contractor

              <ln numlevel="1" lineno="378" slineno="6-59"/>of the costs if so determined.

            <display>(b)</display>resources available from courts and administrative agencies for resolving custody  
            <ln numlevel="1" lineno="418" slineno="7-29"/>and support issues without filing for divorce;
          </subsection>
          <subsection ssid="7-14" dnum="c-o" numlevel="1" lineno="419" slineno="7-30">
            <display>(c)</display>resources available to improve or strengthen the marriage;
          </subsection>
          <subsection ssid="7-15" dnum="d-o" numlevel="1" lineno="420" slineno="7-31">
            <display>(d)</display>a discussion of the positive and negative consequences of divorce;
          </subsection>
          <subsection ssid="7-16" dnum="e-o" numlevel="1" lineno="421" slineno="7-32">
            <display>(e)</display>a discussion of the process of divorce;
          </subsection>
          <subsection ssid="7-17" dnum="f-o" numlevel="1" lineno="422" slineno="7-33">
            <display>(f)</display>options available for proceeding with a divorce, including:
            <subsection ssid="7-18" dnum="i-o" numlevel="1" lineno="423" slineno="7-34">
              <display>(i)</display>mediation;
            </subsection>
            <subsection ssid="7-19" dnum="ii-o" numlevel="1" lineno="424" slineno="7-35">
              <display>(ii)</display>collaborative law; and
            </subsection>
            <subsection ssid="7-20" dnum="iii-o" numlevel="1" lineno="425" slineno="7-36">
              <display>(iii)</display>litigation; and
            </subsection>
          </subsection>
          <subsection ssid="7-21" dnum="g-o" numlevel="1" lineno="426" slineno="7-37">
            <display>(g)</display>a discussion of post-divorce resources.
          </subsection>
        </subsection>

            <amend anum="0" ea="amend" pairid="60" style="1" owner="jcarlton" level="1" amendtag="both">,</amend> upon a prima facie showing of indigency as 
            <ln numlevel="1" lineno="456" slineno="7-67"/>evidenced by an affidavit of indigency filed in the district court in accordance with 
            <ln numlevel="1" lineno="457" slineno="7-68"/>Section 
            <xref depth="3" refnumber="78A-2-302">78A-2-302</xref>. 
            <amendoutstart style="5"/>
            <amend anum="0" ea="erase" pairid="61" style="2" owner="jcarlton" level="1" deltag="both">The independent contractor shall be reimbursed for the 
              <ln numlevel="1" lineno="458" slineno="7-69"/>independent contractor's costs by the Administrative Office of the Courts. A 
              <ln numlevel="1" lineno="459" slineno="7-70"/>petitioner who is later determined not to meet the qualifications for indigency may be 
              <ln numlevel="1" lineno="460" slineno="7-71"/>ordered to pay the costs of the course.

              <ln numlevel="1" lineno="463" slineno="7-74"/>party who is unable to pay for the divorce orientation course under Subsection (7)(f).

              <display>(ii)</display>each parent has been actively involved in the child's life; and
            </subsection>
            <subsection ssid="8-5" numlevel="1" lineno="485" slineno="8-7" dnum="iii-o" tab="1">
              <display>(iii)</display>each parent can effectively facilitate the equal parent-time schedule.
            </subsection>
          </subsection>
          <subsection ssid="8-6" numlevel="1" lineno="486" slineno="8-8" dnum="b-o">
            <display>(b)</display>To determine whether each parent has been actively involved in the child's life, the 
            <ln numlevel="1" lineno="487" slineno="8-9"/>court shall consider:
            <subsection ssid="8-7" numlevel="1" lineno="488" slineno="8-10" dnum="i-o">
              <display>(i)</display>each parent's demonstrated responsibility in caring for the child;
            </subsection>
            <subsection ssid="8-8" numlevel="1" lineno="489" slineno="8-11" dnum="ii-o">
              <display>(ii)</display>each parent's involvement in child care;
            </subsection>
            <subsection ssid="8-9" numlevel="1" lineno="490" slineno="8-12" dnum="iii-o">
              <display>(iii)</display>each parent's presence or volunteer efforts in the child's school and at 
              <ln numlevel="1" lineno="491" slineno="8-13"/>extracurricular activities;
            </subsection>
            <subsection ssid="8-10" numlevel="1" lineno="492" slineno="8-14" dnum="iv-o">
              <display>(iv)</display>each parent's assistance with the child's homework;
            </subsection>
            <subsection ssid="8-11" numlevel="1" lineno="493" slineno="8-15" dnum="v-o">
              <display>(v)</display>each parent's involvement in preparation of meals, bath time, and bedtime for the 
              <ln numlevel="1" lineno="494" slineno="8-16"/>child;
            </subsection>
            <subsection ssid="8-12" numlevel="1" lineno="495" slineno="8-17" dnum="vi-o">
              <display>(vi)</display>each parent's bond with the child; and
            </subsection>
            <subsection ssid="8-13" numlevel="1" lineno="496" slineno="8-18" dnum="vii-o">
              <display>(vii)</display>any other factor the court considers relevant.
            </subsection>
          </subsection>
          <subsection ssid="8-14" numlevel="1" lineno="497" slineno="8-19" dnum="c-o">
            <display>(c)</display>To determine whether each parent can effectively facilitate the equal parent-time 
            <ln numlevel="1" lineno="498" slineno="8-20"/>schedule, the court shall consider:
            <subsection ssid="8-15" numlevel="1" lineno="499" slineno="8-21" dnum="i-o">
              <display>(i)</display>the geographic distance between the residence of each parent and the distance 
              <ln numlevel="1" lineno="500" slineno="8-22"/>between each residence and the child's school;
            </subsection>
            <subsection ssid="8-16" numlevel="1" lineno="501" slineno="8-23" dnum="ii-o">
              <display>(ii)</display>each parent's ability to assist with the child's after school care;
            </subsection>
            <subsection ssid="8-17" numlevel="1" lineno="502" slineno="8-24" dnum="iii-o">
              <display>(iii)</display>the health of the child and each parent, consistent with Subsection 
              <xref depth="3" refnumber="30-3-10">30-3-10</xref>(6);
            </subsection>
            <subsection ssid="8-18" numlevel="1" lineno="503" slineno="8-25" dnum="iv-o">
              <display>(iv)</display>the flexibility of each parent's employment or other schedule;
            </subsection>
            <subsection ssid="8-19" numlevel="1" lineno="504" slineno="8-26" dnum="v-o">
              <display>(v)</display>each parent's ability to provide appropriate playtime with the child;
            </subsection>
            <subsection ssid="8-20" numlevel="1" lineno="505" slineno="8-27" dnum="vi-o">
              <display>(vi)</display>each parent's history and ability to implement a flexible schedule for the child;
            </subsection>
            <subsection ssid="8-21" numlevel="1" lineno="506" slineno="8-28" dnum="vii-o">
              <display>(vii)</display>physical facilities of each parent's residence; and
            </subsection>
            <subsection ssid="8-22" numlevel="1" lineno="507" slineno="8-29" dnum="viii-o">
              <display>(viii)</display>any other factor the court considers relevant.
            </subsection>
          </subsection>
        </subsection>
        <subsection ssid="8-23" numlevel="1" lineno="508" slineno="8-30" dnum="2-o" space="false">
          <display>(2)</display>
          <subsection ssid="8-24" dnum="a-o" placement="sameline">
            <display>(a)</display>If the parties agree to or the court orders the equal parent-time schedule described 
            <ln numlevel="1" lineno="509" slineno="8-31"/>in this section, a parenting plan in accordance with Sections 
            <xref depth="3" refnumber="30-3-10.7">30-3-10.7</xref> through 
            <xref depth="3" refnumber="30-3-10.10">
              <ln numlevel="1" lineno="510" slineno="8-32"/>30-3-10.10
            </xref> shall be filed with an order incorporating the equal parent-time schedule.
          </subsection>
          <subsection ssid="8-25" numlevel="1" lineno="511" slineno="8-33" dnum="b-o">
            <display>(b)</display>An order under this section shall result in 182 overnights per year for one parent, and 
            <ln numlevel="1" lineno="512" slineno="8-34"/>183 overnights per year for the other parent.
          </subsection>
          <subsection ssid="8-26" numlevel="1" lineno="513" slineno="8-35" dnum="c-o">
            <display>(c)</display>Under the equal parent-time schedule, neither parent is considered to have the child 
            <ln numlevel="1" lineno="514" slineno="8-36"/>the majority of the time for the purposes of Subsection

            <subsection ssid="8-29" dnum="i-o" placement="sameline">
              <display>(i)</display>A court shall determine which parent receives 182 overnights and which parent 
              <ln numlevel="1" lineno="519" slineno="8-41"/>receives 183 overnights for parent-time.
            </subsection>
            <subsection ssid="8-30" numlevel="1" lineno="520" slineno="8-42" dnum="ii-o">
              <display>(ii)</display>For the purpose of calculating child support under Section 
              <xref depth="3" refnumber="78B-12-208">78B-12-208</xref>, the 
              <ln numlevel="1" lineno="521" slineno="8-43"/>amount of time to be spent with the parent who has the lower gross monthly 
              <ln numlevel="1" lineno="522" slineno="8-44"/>income is considered 183 overnights, regardless of whether the parent receives 
              <ln numlevel="1" lineno="523" slineno="8-45"/>182 overnights or 183 overnights under Subsection (2)(e)(i).
            </subsection>
          </subsection>
        </subsection>
        <subsection ssid="8-31" numlevel="1" lineno="524" slineno="8-46" dnum="3-o" space="false">
          <display>(3)</display>
          <subsection ssid="8-32" dnum="a-o" placement="sameline">
            <display>(a)</display>Unless the parents agree otherwise and subject to a holiday, the equal parent-time 
            <ln numlevel="1" lineno="525" slineno="8-47"/>schedule is as follows:
            <subsection ssid="8-33" numlevel="1" lineno="526" slineno="8-48" dnum="i-o" tab="1">
              <display>(i)</display>one parent shall exercise parent-time starting Monday morning and ending 
              <ln numlevel="1" lineno="527" slineno="8-49"/>Wednesday morning;
            </subsection>
            <subsection ssid="8-34" numlevel="1" lineno="528" slineno="8-50" dnum="ii-o" tab="1">
              <display>(ii)</display>the other parent shall exercise parent-time starting Wednesday morning and 
              <ln numlevel="1" lineno="529" slineno="8-51"/>ending Friday morning; and
            </subsection>
            <subsection ssid="8-35" numlevel="1" lineno="530" slineno="8-52" dnum="iii-o" tab="1">
              <display>(iii)</display>each parent shall alternate weeks exercising parent-time starting Friday morning 
              <ln numlevel="1" lineno="531" slineno="8-53"/>and ending Monday morning.
            </subsection>
          </subsection>
          <subsection ssid="8-36" numlevel="1" lineno="532" slineno="8-54" dnum="b-o">
            <display>(b)</display>The child exchange shall take place:
            <subsection ssid="8-37" numlevel="1" lineno="533" slineno="8-55" dnum="i-o">
              <display>(i)</display>at the time the child's school begins; or
            </subsection>
            <subsection ssid="8-38" numlevel="1" lineno="534" slineno="8-56" dnum="ii-o">
              <display>(ii)</display>if school is not in session, at 9 a.m.
            </subsection>
          </subsection>
        </subsection>
        <subsection ssid="8-39" numlevel="1" lineno="535" slineno="8-57" dnum="4-o" space="false">
          <display>(4)</display>
          <subsection ssid="8-40" dnum="a-o" placement="sameline">
            <display>(a)</display>The parents may create a holiday schedule.
          </subsection>
          <subsection ssid="8-41" numlevel="1" lineno="536" slineno="8-58" dnum="b-o">
            <display>(b)</display>If the parents are unable to create a holiday schedule under Subsection (4)(a), the 
            <ln numlevel="1" lineno="537" slineno="8-59"/>court shall:
            <subsection ssid="8-42" numlevel="1" lineno="538" slineno="8-60" dnum="i-o">
              <display>(i)</display>order the holiday schedule described in Section 
              <xref depth="3" refnumber="30-3-35">30-3-35</xref>; and
            </subsection>
            <subsection ssid="8-43" numlevel="1" lineno="539" slineno="8-61" dnum="ii-o">
              <display>(ii)</display>designate which parent shall exercise parent-time for each holiday described in 
              <ln numlevel="1" lineno="540" slineno="8-62"/>Section 
              <xref depth="3" refnumber="30-3-35">30-3-35</xref>.
            </subsection>
          </subsection>
        </subsection>
        <subsection ssid="8-44" numlevel="1" lineno="541" slineno="8-63" dnum="5-o" space="false">
          <display>(5)</display>
          <subsection ssid="8-45" dnum="a-o" placement="sameline">
            <display>(a)</display>Each year, a parent may designate two consecutive weeks to exercise 
            <ln numlevel="1" lineno="542" slineno="8-64"/>uninterrupted parent-time during the summer when school is not in session.
          </subsection>
          <subsection ssid="8-46" numlevel="1" lineno="543" slineno="8-65" dnum="b-o" space="false">
            <display>(b)</display>
            <subsection ssid="8-47" dnum="i-o" placement="sameline">
              <display>(i)</display>One parent may make a designation at any time and the other parent may make 
              <ln numlevel="1" lineno="544" slineno="8-66"/>a designation after May 1.
            </subsection>
            <subsection ssid="8-48" numlevel="1" lineno="545" slineno="8-67" dnum="ii-o">
              <display>(ii)</display>A parent shall make a designation at least 30 days before the day on which the 
              <ln numlevel="1" lineno="546" slineno="8-68"/>designated two-week period begins.
            </subsection>
          </subsection>
          <subsection ssid="8-49" numlevel="1" lineno="547" slineno="8-69" dnum="c-o">
            <display>(c)</display>The court shall designate which parent may make the earlier designation described in 
            <ln numlevel="1" lineno="548" slineno="8-70"/>Subsection (5)(b)(i) for an even numbered year with the other parent allowed to make 
            <ln numlevel="1" lineno="549" slineno="8-71"/>the earlier designation in an odd numbered year.
          </subsection>
          <subsection ssid="8-50" numlevel="1" lineno="550" slineno="8-72" dnum="d-o">
            <display>(d)</display>The two consecutive weeks described in Subsection (5)(a) take precedence over all 
            <ln numlevel="1" lineno="551" slineno="8-73"/>holidays except for Mother's Day and Father's Day.
          </subsection>
        </subsection>

            <display>(a)</display>The Legislature shall appropriate money from the account for the administrative

            </subsection>
          </subsection>
          <subsection ssid="9-11" numlevel="1" lineno="573" slineno="9-22" dnum="b-o">
            <display>(b)</display>The Children's Legal Defense Account may not be used to supplant funding for the 
            <ln numlevel="1" lineno="574" slineno="9-23"/>guardian ad litem program under Section 
            <xref depth="3" refnumber="78A-2-803">78A-2-803</xref>.
          </subsection>
        </subsection>
        <subsection ssid="9-12" numlevel="1" lineno="575" slineno="9-24" dnum="4-o">
          <display>(4)</display>The following withheld fees shall be allocated only to the Children's Legal Defense  
          <ln numlevel="1" lineno="576" slineno="9-25"/>Account and used only for the purposes provided in Subsections (3)(a)(i) through (v):
          <subsection ssid="9-13" numlevel="1" lineno="577" slineno="9-26" dnum="a-o">
            <display>(a)</display>the additional $10 fee withheld on every marriage license issued in the state of Utah  
            <ln numlevel="1" lineno="578" slineno="9-27"/>as provided in Section  
            <xref depth="3" refnumber="17-16-21">17-16-21</xref>; and
          </subsection>
          <subsection ssid="9-14" numlevel="1" lineno="579" slineno="9-28" dnum="b-o">
            <display>(b)</display>a fee of $4 shall be withheld from the existing civil filing fee collected on any  
            <ln numlevel="1" lineno="580" slineno="9-29"/>complaint, affidavit, or petition in a civil, probate, or adoption matter in every court  
            <ln numlevel="1" lineno="581" slineno="9-30"/>of record.
          </subsection>
        </subsection>
        <subsection ssid="9-15" numlevel="1" lineno="582" slineno="9-31" dnum="5-o">
          <display>(5)</display>The Division of Finance shall allocate the money described in Subsection (4) from the  
          <ln numlevel="1" lineno="583" slineno="9-32"/>General Fund to the Children's Legal Defense Account.
        </subsection>
        <subsection ssid="9-16" numlevel="1" lineno="584" slineno="9-33" dnum="6-o">
          <display>(6)</display>Any funds in excess of $200,000 remaining in the restricted account as of June 30 of  
          <ln numlevel="1" lineno="585" slineno="9-34"/>any fiscal year shall lapse into the General Fund.
        </subsection>

              <amend anum="0" ea="amend" pairid="45" style="1" owner="e" level="1">(a)</amend>
            </display>
            <amend anum="0" ea="amend" pairid="3" style="1" owner="jcarlton" level="1" amendtag="end">If a parentage action is determining issues of custody or parent-time for a child 
              <ln numlevel="1" lineno="600" slineno="10-15"/>and the parents of the child are not married, the parties shall attend the mandatory 
              <ln numlevel="1" lineno="601" slineno="10-16"/>parenting course described in Subsection 
              <xref depth="3" refnumber="30-3-11.3">30-3-11.3</xref>(1)(b) within:
            </amend>
            <subsection ssid="10-6" ea="amend" anum="0" owner="jcarlton" style="1" numlevel="1" lineno="602" slineno="10-17" dnum="_-e:i-e" tab="1">
              <display>
                <amend anum="0" ea="amend" pairid="46" style="1" owner="e" level="1" amendtag="start">(i)</amend>
              </display>
              <amend anum="0" ea="amend" pairid="5" style="1" owner="jcarlton" level="1" amendtag="end">for the petitioner, 60 days after the day on which the petition is filed; and</amend>
            </subsection>
            <subsection ssid="10-7" ea="amend" anum="0" owner="jcarlton" style="1" numlevel="1" lineno="603" slineno="10-18" dnum="_-e:ii-e" tab="1">
              <display>
                <amend anum="0" ea="amend" pairid="47" style="1" owner="e" level="1" amendtag="start">(ii)</amend>
              </display>
              <amend anum="0" ea="amend" pairid="8" style="1" owner="jcarlton" level="1" amendtag="end">for the respondent, 30 days after the day on which the respondent is served.</amend>
            </subsection>
          </subsection>
          <subsection ssid="10-8" ea="amend" anum="0" owner="jcarlton" style="1" numlevel="1" lineno="604" slineno="10-19" dnum="_-e:b-e">
            <display>
              <amend anum="0" ea="amend" pairid="48" style="1" owner="e" level="1" amendtag="start">(b)</amend>
            </display>
            <amend anum="0" ea="amend" pairid="12" style="1" owner="jcarlton" level="1" amendtag="end">The clerk of the court shall provide notice to a petitioner that the petitioner is 
              <ln numlevel="1" lineno="605" slineno="10-20"/>required to attend the parenting course.
            </amend>
          </subsection>
          <subsection ssid="10-9" ea="amend" anum="0" owner="jcarlton" style="1" numlevel="1" lineno="606" slineno="10-21" dnum="_-e:c-e">
            <display>
              <amend anum="0" ea="amend" pairid="49" style="1" owner="e" level="1" amendtag="start">(c)</amend>
            </display>
            <amend anum="0" ea="amend" pairid="15" style="1" owner="jcarlton" level="1" amendtag="end">A petition shall include information regarding the parenting course when the petition 
              <ln numlevel="1" lineno="607" slineno="10-22"/>is served on the respondent.
            </amend>
          </subsection>
          <subsection ssid="10-10" ea="amend" anum="0" owner="jcarlton" style="1" numlevel="1" lineno="608" slineno="10-23" dnum="_-e:d-e">
            <display>
              <amend anum="0" ea="amend" pairid="50" style="1" owner="e" level="1" amendtag="start">(d)</amend>
            </display>
            <amend anum="0" ea="amend" pairid="18" style="1" owner="jcarlton" level="1" amendtag="end">The court may not grant a final custody or parent-time order in a parentage action 
              <ln numlevel="1" lineno="609" slineno="10-24"/>until:
            </amend>
            <subsection ssid="10-11" ea="amend" anum="0" owner="jcarlton" style="1" numlevel="1" lineno="610" slineno="10-25" dnum="_-e:i-e">
              <display>
                <amend anum="0" ea="amend" pairid="51" style="1" owner="e" level="1" amendtag="start">(i)</amend>
              </display>
              <amend anum="0" ea="amend" pairid="20" style="1" owner="jcarlton" level="1" amendtag="end">both parties have attended the parenting course; and</amend>
            </subsection>
            <subsection ssid="10-12" ea="amend" anum="0" owner="jcarlton" style="1" numlevel="1" lineno="611" slineno="10-26" dnum="_-e:ii-e">
              <display>
                <amend anum="0" ea="amend" pairid="52" style="1" owner="e" level="1" amendtag="start">(ii)</amend>
              </display>
              <amend anum="0" ea="amend" pairid="23" style="1" owner="jcarlton" level="1" amendtag="end">both parties have presented a certificate of course completion to the court.</amend>
            </subsection>
          </subsection>
        </subsection>
        <subsection ssid="10-13" ea="amend" anum="0" owner="jcarlton" style="1" numlevel="1" lineno="612" slineno="10-27" dnum="_-e:5-e">
          <display>
            <amend anum="0" ea="amend" pairid="53" style="1" owner="e" level="1" amendtag="start">(5)</amend>
          </display>
          <amend anum="0" ea="amend" pairid="28" style="1" owner="jcarlton" level="1" amendtag="end">For a party that is unable to pay the costs of the parenting course, and before the court  
            <ln numlevel="1" lineno="613" slineno="10-28"/>enters an order for custody or parent-time in the parentage action, the court shall:
          </amend>
          <subsection ssid="10-14" ea="amend" anum="0" owner="jcarlton" style="1" numlevel="1" lineno="614" slineno="10-29" dnum="_-e:a-e">
            <display>
              <amend anum="0" ea="amend" pairid="54" style="1" owner="e" level="1" amendtag="start">(a)</amend>
            </display>
            <amend anum="0" ea="amend" pairid="30" style="1" owner="jcarlton" level="1" amendtag="end">make a final determination of indigency; and</amend>
          </subsection>
          <subsection ssid="10-15" ea="amend" anum="0" owner="jcarlton" style="1" numlevel="1" lineno="615" slineno="10-30" dnum="_-e:b-e">
            <display>
              <amend anum="0" ea="amend" pairid="55" style="1" owner="e" level="1" amendtag="start">(b)</amend>
            </display>
            <amend anum="0" ea="amend" pairid="33" style="1" owner="jcarlton" level="1" amendtag="end">order the party to pay the costs of the parenting course if the court determines the  
              <ln numlevel="1" lineno="616" slineno="10-31"/>party is not indigent.
            </amend>
          </subsection>
        </subsection>
        <subsection ssid="10-16" ea="amend" anum="0" owner="jcarlton" style="1" numlevel="1" lineno="617" slineno="10-32" dnum="_-e:6-e" space="false">

            <amend anum="0" ea="amend" pairid="56" style="1" owner="e" level="1" amendtag="start">(6)</amend>
          </display>
          <subsection ssid="10-17" ea="amend" anum="0" owner="jcarlton" style="1" dnum="_-e:a-e" placement="sameline">
            <display>
              <amend anum="0" ea="amend" pairid="57" style="1" owner="e" level="1">(a)</amend>
            </display>
            <amend anum="0" ea="amend" pairid="38" style="1" owner="jcarlton" level="1" amendtag="end">Notwithstanding Subsection (4), the court may waive the requirement that the 
              <ln numlevel="1" lineno="618" slineno="10-33"/>parties attend the parenting course, on the court's own motion or on the motion of one 
              <ln numlevel="1" lineno="619" slineno="10-34"/>of the parties, if the court determines course attendance and completion are not 
              <ln numlevel="1" lineno="620" slineno="10-35"/>necessary, appropriate, or feasible, or in the best interest of the parties.
            </amend>
          </subsection>
          <subsection ssid="10-18" ea="amend" anum="0" owner="jcarlton" style="1" numlevel="1" lineno="621" slineno="10-36" dnum="_-e:b-e">
            <display>
              <amend anum="0" ea="amend" pairid="58" style="1" owner="e" level="1" amendtag="start">(b)</amend>
            </display>
            <amend anum="0" ea="amend" pairid="41" style="1" owner="jcarlton" level="1" amendtag="end">If the requirement is waived, the court may proceed with entering a final custody or 
              <ln numlevel="1" lineno="622" slineno="10-37"/>parent-time order.
            </amend>
          </subsection>
