    <gdhead lineno="4">General Description:</gdhead>
    <gd numlevel="1" lineno="5" slineno="0-5">This bill modifies provisions relating to the disclosure of an image taken during the process  
      <ln numlevel="1" lineno="6" slineno="0-6"/>of booking an individual into jail.
    </gd>
    <hphead lineno="7">Highlighted Provisions:</hphead>
    <hp numlevel="1" lineno="8" slineno="0-8">This bill:
      <hl numlevel="1" lineno="9" slineno="0-9" level="1">permits an alleged victim of a crime, or their representative in certain cases, to view a  
        <ln numlevel="1" lineno="10" slineno="0-10"/>booking photo of a person who has been charged with a crime in relation to that victim; and
      </hl>
      <hl numlevel="1" lineno="11" slineno="0-11" level="1">modifies relevant provisions in the Government Records Management and Access Act.</hl>

          <bold>17-22-30</bold> is amended to read:

        <subsection ssid="1-1" dnum="1-o" numlevel="1" lineno="26" slineno="1-5" placement="noreturn">
          <display>(1)</display>As used in this section:
          <subsection ssid="1-2" dnum="a-o" numlevel="1" lineno="27" slineno="1-6">
            <display>(a)</display>"Booking photograph" means a photograph or image of an individual that is  
            <ln numlevel="1" lineno="28" slineno="1-7"/>generated:
            <subsection ssid="1-3" dnum="i-o" numlevel="1" lineno="29" slineno="1-8">
              <display>(i)</display>for identification purposes; and
            </subsection>
            <subsection ssid="1-4" dnum="ii-o" numlevel="1" lineno="30" slineno="1-9">
              <display>(ii)</display>when the individual is booked into a county jail.
            </subsection>
          </subsection>
          <subsection ssid="1-5" dnum="b-o" numlevel="1" lineno="31" slineno="1-10">
            <display>(b)</display>"Publish-for-pay publication" or "publish-for-pay website" means a publication or  
            <ln numlevel="1" lineno="32" slineno="1-11"/>website that requires the payment of a fee or other consideration in order to remove  
            <ln numlevel="1" lineno="33" slineno="1-12"/>or delete a booking photograph from the publication or website.
          </subsection>
        </subsection>
        <subsection ssid="1-6" dnum="2-o" numlevel="1" lineno="34" slineno="1-13" space="false">
          <display>(2)</display>
          <subsection ssid="1-7" dnum="_-o:a-e" ea="amend" anum="0" owner="eweeks" style="1" placement="sameline">
            <display>
              <amend anum="0" ea="amend" pairid="33" style="1" owner="e" level="1" amendtag="both">(a)</amend>
            </display>A sheriff may not provide a copy of a booking photograph in any format to a 
            <ln numlevel="1" lineno="35" slineno="1-14"/>person requesting a copy of the booking photograph if:

              </display>the booking photograph will be placed in a publish-for-pay publication or 
              <ln numlevel="1" lineno="37" slineno="1-16"/>posted to a publish-for-pay website; or
            </subsection>
            <subsection ssid="1-9" dnum="b-o:ii-e" numlevel="1" lineno="38" slineno="1-17" tab="1">

              </display>the booking photograph is a protected record under Subsection 
              <xref depth="3" refnumber="63G-2-305">63G-2-305</xref>

            </subsection>
          </subsection>

            </display>

              </display>
              <amend anum="0" ea="amend" pairid="5" style="1" owner="eweeks" level="1" amendtag="end">A sheriff shall display a copy of a booking photograph to a person requesting 
                <ln numlevel="1" lineno="41" slineno="1-20"/>to view the booking photograph if the person making the request:
              </amend>

                  <amend anum="0" ea="amend" pairid="38" style="1" owner="e" level="1" amendtag="start">(A)</amend>
                </display>
                <subsection ssid="1-13" dnum="_-o:I-e" ea="amend" anum="0" owner="eweeks" style="1" placement="sameline">
                  <display>
                    <amend anum="0" ea="amend" pairid="39" style="1" owner="e" level="1">(I)</amend>
                  </display>
                  <amend anum="0" ea="amend" pairid="8" style="1" owner="eweeks" level="1" amendtag="end">is an alleged victim of a crime that resulted in the creation of the 
                    <ln numlevel="1" lineno="43" slineno="1-22"/>booking photograph; and
                  </amend>
                </subsection>
                <subsection ssid="1-14" dnum="_-o:II-e" ea="amend" anum="0" owner="eweeks" style="1" numlevel="1" lineno="44" slineno="1-23">
                  <display>
                    <amend anum="0" ea="amend" pairid="40" style="1" owner="e" level="1" amendtag="start">(II)</amend>
                  </display>
                  <amend anum="0" ea="amend" pairid="11" style="1" owner="eweeks" level="1" amendtag="end">subject to Utah Rules of Evidence, Rule 617, the prosecuting agency with 
                    <ln numlevel="1" lineno="45" slineno="1-24"/>jurisdiction consents; or
                  </amend>
                </subsection>
              </subsection>
              <subsection ssid="1-15" dnum="_-o:B-e" ea="amend" anum="0" owner="eweeks" style="1" numlevel="1" lineno="46" slineno="1-25" tab="1">
                <display>
                  <amend anum="0" ea="amend" pairid="41" style="1" owner="e" level="1" amendtag="start">(B)</amend>
                </display>
                <amend anum="0" ea="amend" pairid="15" style="1" owner="eweeks" level="1" amendtag="end">if an alleged victim is deceased or incapacitated, is an immediate family 
                  <ln numlevel="1" lineno="47" slineno="1-26"/>member, guardian, or conservator of an alleged victim of the crime that 
                  <ln numlevel="1" lineno="48" slineno="1-27"/>resulted in the creation of the booking photograph.
                </amend>
              </subsection>
            </subsection>
            <subsection ssid="1-16" dnum="_-o:ii-e" ea="amend" anum="0" owner="eweeks" style="1" numlevel="1" lineno="49" slineno="1-28">
              <display>
                <amend anum="0" ea="amend" pairid="42" style="1" owner="e" level="1" amendtag="start">(ii)</amend>
              </display>
              <amend anum="0" ea="amend" pairid="19" style="1" owner="eweeks" level="1" amendtag="end">A person entitled to view a booking photograph under Subsection (2)(b)(i) is not 
                <ln numlevel="1" lineno="50" slineno="1-29"/>permitted to:
              </amend>
              <subsection ssid="1-17" dnum="_-o:A-e" ea="amend" anum="0" owner="eweeks" style="1" numlevel="1" lineno="51" slineno="1-30">
                <display>
                  <amend anum="0" ea="amend" pairid="43" style="1" owner="e" level="1" amendtag="start">(A)</amend>
                </display>
                <amend anum="0" ea="amend" pairid="21" style="1" owner="eweeks" level="1" amendtag="end">retain the booking photograph;</amend>
              </subsection>
              <subsection ssid="1-18" dnum="_-o:B-e" ea="amend" anum="0" owner="eweeks" style="1" numlevel="1" lineno="52" slineno="1-31">
                <display>
                  <amend anum="0" ea="amend" pairid="44" style="1" owner="e" level="1" amendtag="start">(B)</amend>
                </display>
                <amend anum="0" ea="amend" pairid="24" style="1" owner="eweeks" level="1" amendtag="end">make a copy, take a picture of, or otherwise reproduce the booking 
                  <ln numlevel="1" lineno="53" slineno="1-32"/>photograph; or
                </amend>
              </subsection>
              <subsection ssid="1-19" dnum="_-o:C-e" ea="amend" anum="0" owner="eweeks" style="1" numlevel="1" lineno="54" slineno="1-33">
                <display>
                  <amend anum="0" ea="amend" pairid="45" style="1" owner="e" level="1" amendtag="start">(C)</amend>
                </display>
                <amend anum="0" ea="amend" pairid="27" style="1" owner="eweeks" level="1" amendtag="end">disseminate or distribute the booking photograph.</amend>
              </subsection>
            </subsection>
          </subsection>
        </subsection>
        <subsection ssid="1-20" dnum="3-o" numlevel="1" lineno="55" slineno="1-34" space="false">
          <display>(3)</display>
          <subsection ssid="1-21" dnum="a-o" placement="sameline">
            <display>(a)</display>A person who requests a copy of a booking photograph from a sheriff shall, at the 
            <ln numlevel="1" lineno="56" slineno="1-35"/>time of making the request, submit a statement signed by the person affirming that 
            <ln numlevel="1" lineno="57" slineno="1-36"/>the booking photograph will not be placed in a publish-for-pay publication or posted 
            <ln numlevel="1" lineno="58" slineno="1-37"/>to a publish-for-pay website.
          </subsection>
          <subsection ssid="1-22" dnum="b-o" numlevel="1" lineno="59" slineno="1-38">
            <display>(b)</display>A person who submits a false statement under Subsection (3)(a) is subject to criminal 
            <ln numlevel="1" lineno="60" slineno="1-39"/>liability as provided in Section 
            <xref depth="3" refnumber="76-8-504">76-8-504</xref>.
          </subsection>
        </subsection>
        <subsection ssid="1-23" dnum="4-o" numlevel="1" lineno="61" slineno="1-40" space="false">
          <display>(4)</display>
          <subsection ssid="1-24" dnum="a-o" placement="sameline">
            <display>(a)</display>Except as provided in Subsection (5), a publish-for-pay publication or a 
            <ln numlevel="1" lineno="62" slineno="1-41"/>publish-for-pay website shall remove and destroy a booking photograph of an 
            <ln numlevel="1" lineno="63" slineno="1-42"/>individual who submits a request for removal and destruction within 30 calendar days 
            <ln numlevel="1" lineno="64" slineno="1-43"/>after the day on which the individual makes the request.
          </subsection>
          <subsection ssid="1-25" dnum="b-o" numlevel="1" lineno="65" slineno="1-44">
            <display>(b)</display>A publish-for-pay publication or publish-for-pay website described in Subsection 
            <ln numlevel="1" lineno="66" slineno="1-45"/>(4)(a) may not condition removal or destruction of the booking photograph on the 
            <ln numlevel="1" lineno="67" slineno="1-46"/>payment of a fee in an amount greater than $50.
          </subsection>
          <subsection ssid="1-26" dnum="c-o" numlevel="1" lineno="68" slineno="1-47">
            <display>(c)</display>If the publish-for-pay publication or publish-for-pay website described in Subsection 
            <ln numlevel="1" lineno="69" slineno="1-48"/>(4)(a) does not remove and destroy the booking photograph in accordance with 
            <ln numlevel="1" lineno="70" slineno="1-49"/>Subsection (4)(a), the publish-for-pay publication or publish-for-pay website is liable 
            <ln numlevel="1" lineno="71" slineno="1-50"/>for:
            <subsection ssid="1-27" dnum="i-o" numlevel="1" lineno="72" slineno="1-51">
              <display>(i)</display>all costs, including reasonable attorney fees, resulting from any legal action the 
              <ln numlevel="1" lineno="73" slineno="1-52"/>individual brings in relation to the failure of the publish-for-pay publication or 
              <ln numlevel="1" lineno="74" slineno="1-53"/>publish-for-pay website to remove and destroy the booking photograph; and
            </subsection>
            <subsection ssid="1-28" dnum="ii-o" numlevel="1" lineno="75" slineno="1-54">
              <display>(ii)</display>a civil penalty of $50 per day for each day after the 30-day deadline described in 
              <ln numlevel="1" lineno="76" slineno="1-55"/>Subsection (4)(a) on which the booking photograph is visible or publicly 
              <ln numlevel="1" lineno="77" slineno="1-56"/>accessible in the publish-for-pay publication or on the publish-for-pay website.
            </subsection>
          </subsection>
        </subsection>
        <subsection ssid="1-29" dnum="5-o" numlevel="1" lineno="78" slineno="1-57" space="false">
          <display>(5)</display>
          <subsection ssid="1-30" dnum="a-o" placement="sameline">
            <display>(a)</display>A publish-for-pay publication or a publish-for-pay website shall remove and 
            <ln numlevel="1" lineno="79" slineno="1-58"/>destroy a booking photograph of an individual who submits a request for removal and 
            <ln numlevel="1" lineno="80" slineno="1-59"/>destruction within seven calendar days after the day on which the individual makes 
            <ln numlevel="1" lineno="81" slineno="1-60"/>the request if:
            <subsection ssid="1-31" dnum="i-o" numlevel="1" lineno="82" slineno="1-61" tab="1">
              <display>(i)</display>the booking photograph relates to a criminal charge:
              <subsection ssid="1-32" dnum="A-o" numlevel="1" lineno="83" slineno="1-62">
                <display>(A)</display>on which the individual was acquitted or not prosecuted; or
              </subsection>
              <subsection ssid="1-33" dnum="B-o" numlevel="1" lineno="84" slineno="1-63">
                <display>(B)</display>that was expunged, vacated, or pardoned; and
              </subsection>
            </subsection>
            <subsection ssid="1-34" dnum="ii-o" numlevel="1" lineno="85" slineno="1-64" tab="1">
              <display>(ii)</display>the individual submits, in relation to the request, evidence of a disposition 
              <ln numlevel="1" lineno="86" slineno="1-65"/>described in Subsection (5)(a)(i).
            </subsection>
          </subsection>
          <subsection ssid="1-35" dnum="b-o" numlevel="1" lineno="87" slineno="1-66">
            <display>(b)</display>If the publish-for-pay publication or publish-for-pay website described in Subsection 
            <ln numlevel="1" lineno="88" slineno="1-67"/>(5)(a) does not remove and destroy the booking photograph in accordance with 
            <ln numlevel="1" lineno="89" slineno="1-68"/>Subsection (5)(a), the publish-for-pay publication or publish-for-pay website is liable 
            <ln numlevel="1" lineno="90" slineno="1-69"/>for:
            <subsection ssid="1-36" dnum="i-o" numlevel="1" lineno="91" slineno="1-70">
              <display>(i)</display>all costs, including reasonable attorney fees, resulting from any legal action that 
              <ln numlevel="1" lineno="92" slineno="1-71"/>the individual brings in relation to the failure of the publish-for-pay publication or 
              <ln numlevel="1" lineno="93" slineno="1-72"/>publish-for-pay website to remove and destroy the booking photograph; and
            </subsection>
            <subsection ssid="1-37" dnum="ii-o" numlevel="1" lineno="94" slineno="1-73">
              <display>(ii)</display>a civil penalty of $100 per day for each day after the seven-day deadline 
              <ln numlevel="1" lineno="95" slineno="1-74"/>described in Subsection (5)(a) on which the booking photograph is visible or 
              <ln numlevel="1" lineno="96" slineno="1-75"/>publicly accessible in the publish-for-pay publication or on the publish-for-pay 
              <ln numlevel="1" lineno="97" slineno="1-76"/>website.
            </subsection>
          </subsection>
          <subsection ssid="1-38" dnum="c-o" numlevel="1" lineno="98" slineno="1-77">
            <display>(c)</display>An act of a publish-for-pay publication or publish-for-pay website described in 
            <ln numlevel="1" lineno="99" slineno="1-78"/>Subsection (5)(a) that seeks to condition removal or destruction of the booking 
            <ln numlevel="1" lineno="100" slineno="1-79"/>photograph on the payment of any fee or amount constitutes theft by extortion under 
            <ln numlevel="1" lineno="101" slineno="1-80"/>Section 
            <xref depth="3" refnumber="76-6-406">76-6-406</xref>.
          </subsection>
        </subsection>

          <bold>63G-2-305</bold> is amended to read:

          <bold>63G-2-305. Protected records.</bold>
        </catline>
        <sectionText lineno="104">
          <tab/>The following records are protected if properly classified by a governmental entity:
        </sectionText>
        <subsection ssid="2-1" dnum="1-o" numlevel="1" lineno="105" slineno="2-4">
          <display>(1)</display>trade secrets as defined in Section  
          <xref depth="3" refnumber="13-24-2">13-24-2</xref> if the person submitting the trade secret has  
          <ln numlevel="1" lineno="106" slineno="2-5"/>provided the governmental entity with the information specified in Section  
          <xref depth="3" refnumber="63G-2-309">63G-2-309</xref>;
        </subsection>
        <subsection ssid="2-2" dnum="2-o" numlevel="1" lineno="107" slineno="2-6">
          <display>(2)</display>commercial information or nonindividual financial information obtained from a person  
          <ln numlevel="1" lineno="108" slineno="2-7"/>if:
          <subsection ssid="2-3" dnum="a-o" numlevel="1" lineno="109" slineno="2-8">
            <display>(a)</display>disclosure of the information could reasonably be expected to result in unfair  
            <ln numlevel="1" lineno="110" slineno="2-9"/>competitive injury to the person submitting the information or would impair the  
            <ln numlevel="1" lineno="111" slineno="2-10"/>ability of the governmental entity to obtain necessary information in the future;
          </subsection>
          <subsection ssid="2-4" dnum="b-o" numlevel="1" lineno="112" slineno="2-11">
            <display>(b)</display>the person submitting the information has a greater interest in prohibiting access than  
            <ln numlevel="1" lineno="113" slineno="2-12"/>the public in obtaining access; and
          </subsection>
          <subsection ssid="2-5" dnum="c-o" numlevel="1" lineno="114" slineno="2-13">
            <display>(c)</display>the person submitting the information has provided the governmental entity with the  
            <ln numlevel="1" lineno="115" slineno="2-14"/>information specified in Section  
            <xref depth="3" refnumber="63G-2-309">63G-2-309</xref>;
          </subsection>
        </subsection>
        <subsection ssid="2-6" dnum="3-o" numlevel="1" lineno="116" slineno="2-15">
          <display>(3)</display>commercial or financial information acquired or prepared by a governmental entity to  
          <ln numlevel="1" lineno="117" slineno="2-16"/>the extent that disclosure would lead to financial speculations in currencies, securities, or  
          <ln numlevel="1" lineno="118" slineno="2-17"/>commodities that will interfere with a planned transaction by the governmental entity or  
          <ln numlevel="1" lineno="119" slineno="2-18"/>cause substantial financial injury to the governmental entity or state economy;
        </subsection>
        <subsection ssid="2-7" dnum="4-o" numlevel="1" lineno="120" slineno="2-19">
          <display>(4)</display>records, the disclosure of which could cause commercial injury to, or confer a  
          <ln numlevel="1" lineno="121" slineno="2-20"/>competitive advantage upon a potential or actual competitor of, a commercial project  
          <ln numlevel="1" lineno="122" slineno="2-21"/>entity as defined in Subsection  
          <xref depth="3" refnumber="11-13-103">11-13-103</xref>(4);
        </subsection>
        <subsection ssid="2-8" dnum="5-o" numlevel="1" lineno="123" slineno="2-22">
          <display>(5)</display>test questions and answers to be used in future license, certification, registration,

            <display>(b)</display>an unsolicited proposal, as defined in Section  
            <xref depth="3" refnumber="63G-6a-712">63G-6a-712</xref>;
          </subsection>
        </subsection>
        <subsection ssid="2-17" dnum="7-o" numlevel="1" lineno="138" slineno="2-37">
          <display>(7)</display>information submitted to or by a governmental entity in response to a request for  
          <ln numlevel="1" lineno="139" slineno="2-38"/>information, except, subject to Subsections (1) and (2), that this Subsection (7) does not

            <display>(c)</display>in the case of records that would identify property, potential sellers of the described  
            <ln numlevel="1" lineno="155" slineno="2-54"/>property have already learned of the governmental entity's plans to acquire the

          </subsection>
          <subsection ssid="2-26" dnum="d-o" numlevel="1" lineno="157" slineno="2-56">
            <display>(d)</display>in the case of records that would identify the appraisal or estimated value of  
            <ln numlevel="1" lineno="158" slineno="2-57"/>property, the potential sellers have already learned of the governmental entity's  
            <ln numlevel="1" lineno="159" slineno="2-58"/>estimated value of the property; or
          </subsection>
          <subsection ssid="2-27" dnum="e-o" numlevel="1" lineno="160" slineno="2-59">
            <display>(e)</display>the property under consideration for public acquisition is a single family residence  
            <ln numlevel="1" lineno="161" slineno="2-60"/>and the governmental entity seeking to acquire the property has initiated negotiations  
            <ln numlevel="1" lineno="162" slineno="2-61"/>to acquire the property as required under Section  
            <xref depth="3" refnumber="78B-6-505">78B-6-505</xref>;
          </subsection>
        </subsection>
        <subsection ssid="2-28" dnum="9-o" numlevel="1" lineno="163" slineno="2-62">
          <display>(9)</display>records prepared in contemplation of sale, exchange, lease, rental, or other compensated  
          <ln numlevel="1" lineno="164" slineno="2-63"/>transaction of real or personal property including intellectual property, which, if  
          <ln numlevel="1" lineno="165" slineno="2-64"/>disclosed prior to completion of the transaction, would reveal the appraisal or estimated  
          <ln numlevel="1" lineno="166" slineno="2-65"/>value of the subject property, unless:
          <subsection ssid="2-29" dnum="a-o" numlevel="1" lineno="167" slineno="2-66">
            <display>(a)</display>the public interest in access is greater than or equal to the interests in restricting  
            <ln numlevel="1" lineno="168" slineno="2-67"/>access, including the governmental entity's interest in maximizing the financial

          </subsection>

            <display>(b)</display>when prepared by or on behalf of a governmental entity, appraisals or estimates of

          <display>(10)</display>records created or maintained for civil, criminal, or administrative enforcement

            <display>(b)</display>reasonably could be expected to interfere with audits, disciplinary, or enforcement  
            <ln numlevel="1" lineno="179" slineno="2-78"/>proceedings;
          </subsection>
          <subsection ssid="2-34" dnum="c-o" numlevel="1" lineno="180" slineno="2-79">
            <display>(c)</display>would create a danger of depriving a person of a right to a fair trial or impartial  
            <ln numlevel="1" lineno="181" slineno="2-80"/>hearing;
          </subsection>

            <display>(d)</display>reasonably could be expected to disclose the identity of a source who is not generally

          </subsection>

            <display>(e)</display>reasonably could be expected to disclose investigative or audit techniques,
