          <tab/>The state board shall:

          <display>(1)</display>create, maintain, and review on a regular basis a statewide, comprehensive multi-year  
          <ln numlevel="1" lineno="30" slineno="1-5"/>strategic plan that includes long-term goals for improved student outcomes; and
        </subsection>
        <subsection ssid="1-2" numlevel="1" lineno="31" slineno="1-6" dnum="2-o">
          <display>(2)</display>report annually to the Education Interim Committee on or before  
          <amendoutstart style="5"/>
          <amend anum="0" ea="erase" pairid="1" style="2" owner="admin" level="1" deltag="both">the committee's  
            <ln numlevel="1" lineno="32" slineno="1-7"/>November meeting
          </amend>

          <bold>53F-7-203</bold> is amended to read:
        </secline>

          <bold>53F-7-203. Paid professional hours for educators.</bold>
        </catline>
        <subsection ssid="2-1" numlevel="1" lineno="36" slineno="2-3" dnum="1-o" placement="noreturn">
          <display>(1)</display>Subject to legislative appropriations, the state board shall provide funding to each LEA  
          <ln numlevel="1" lineno="37" slineno="2-4"/>to provide additional paid professional hours to the following educators in accordance  
          <ln numlevel="1" lineno="38" slineno="2-5"/>with this section:
          <subsection ssid="2-2" numlevel="1" lineno="39" slineno="2-6" dnum="a-o">
            <display>(a)</display>general education and special education teachers;
          </subsection>
          <subsection ssid="2-3" numlevel="1" lineno="40" slineno="2-7" dnum="b-o">
            <display>(b)</display>counselors;
          </subsection>
          <subsection ssid="2-4" numlevel="1" lineno="41" slineno="2-8" dnum="c-o">
            <display>(c)</display>school administration;
          </subsection>
          <subsection ssid="2-5" numlevel="1" lineno="42" slineno="2-9" dnum="d-o">
            <display>(d)</display>school specialists;
          </subsection>
          <subsection ssid="2-6" numlevel="1" lineno="43" slineno="2-10" dnum="e-o">
            <display>(e)</display>student support;
          </subsection>
          <subsection ssid="2-7" numlevel="1" lineno="44" slineno="2-11" dnum="f-o">
            <display>(f)</display>school psychologists;
          </subsection>
          <subsection ssid="2-8" numlevel="1" lineno="45" slineno="2-12" dnum="g-o">
            <display>(g)</display>speech language pathologists; and
          </subsection>
          <subsection ssid="2-9" numlevel="1" lineno="46" slineno="2-13" dnum="h-o">
            <display>(h)</display>audiologists.
          </subsection>
        </subsection>
        <subsection ssid="2-10" numlevel="1" lineno="47" slineno="2-14" dnum="2-o">
          <display>(2)</display>The state board shall distribute funds appropriated to the state board under Subsection  
          <xref depth="3" refnumber="53F-9-204">
            <ln numlevel="1" lineno="48" slineno="2-15"/>53F-9-204
          </xref>(6) to each LEA in proportion to the number of educators described in  
          <ln numlevel="1" lineno="49" slineno="2-16"/>Subsection (1) within the LEA.
        </subsection>
        <subsection ssid="2-11" numlevel="1" lineno="50" slineno="2-17" dnum="3-o">
          <display>(3)</display>An LEA shall use funding under this section to provide paid professional hours that:
          <subsection ssid="2-12" numlevel="1" lineno="51" slineno="2-18" dnum="a-o">
            <display>(a)</display>provide educators with the knowledge and skills necessary to enable students to  
            <ln numlevel="1" lineno="52" slineno="2-19"/>succeed in a well-rounded education and to meet the challenging state academic  
            <ln numlevel="1" lineno="53" slineno="2-20"/>standards; and
          </subsection>
          <subsection ssid="2-13" numlevel="1" lineno="54" slineno="2-21" dnum="b-o">
            <display>(b)</display>may include activities that:
            <subsection ssid="2-14" numlevel="1" lineno="55" slineno="2-22" dnum="i-o">
              <display>(i)</display>improve and increase an educator's:
              <subsection ssid="2-15" numlevel="1" lineno="56" slineno="2-23" dnum="A-o">
                <display>(A)</display>knowledge of the academic subjects the educator teaches;
              </subsection>
              <subsection ssid="2-16" numlevel="1" lineno="57" slineno="2-24" dnum="B-o">
                <display>(B)</display>time to plan and prepare daily lessons based on student needs;
              </subsection>
              <subsection ssid="2-17" numlevel="1" lineno="58" slineno="2-25" dnum="C-o">
                <display>(C)</display>understanding of how students learn; and
              </subsection>
              <subsection ssid="2-18" numlevel="1" lineno="59" slineno="2-26" dnum="D-o">
                <display>(D)</display>ability to analyze student work and achievement from multiple sources,  
                <ln numlevel="1" lineno="60" slineno="2-27"/>including how to adjust instructional strategies, assessments, and materials  
                <ln numlevel="1" lineno="61" slineno="2-28"/>based on the analysis;
              </subsection>
            </subsection>
            <subsection ssid="2-19" numlevel="1" lineno="62" slineno="2-29" dnum="ii-o">
              <display>(ii)</display>are an integral part of broad school-wide and LEA-wide educational improvement  
              <ln numlevel="1" lineno="63" slineno="2-30"/>plans;
            </subsection>
            <subsection ssid="2-20" numlevel="1" lineno="64" slineno="2-31" dnum="iii-o">
              <display>(iii)</display>allow personalized plans for each educator to address the educator's specific  
              <ln numlevel="1" lineno="65" slineno="2-32"/>needs identified in observation or other feedback;
            </subsection>
            <subsection ssid="2-21" numlevel="1" lineno="66" slineno="2-33" dnum="iv-o">
              <display>(iv)</display>advance educator understanding of:
              <subsection ssid="2-22" numlevel="1" lineno="67" slineno="2-34" dnum="A-o">
                <display>(A)</display>effective and evidence-based instructional strategies; and
              </subsection>
              <subsection ssid="2-23" numlevel="1" lineno="68" slineno="2-35" dnum="B-o">
                <display>(B)</display>strategies for improving student academic achievement or substantially  
                <ln numlevel="1" lineno="69" slineno="2-36"/>increasing the knowledge and teaching skills of educators;
              </subsection>
            </subsection>
            <subsection ssid="2-24" numlevel="1" lineno="70" slineno="2-37" dnum="v-o">
              <display>(v)</display>are aligned with, and directly related to, academic goals of the school or LEA; and
            </subsection>
            <subsection ssid="2-25" numlevel="1" lineno="71" slineno="2-38" dnum="vi-o">
              <display>(vi)</display>include instruction in the use of data and assessments to inform and instruct  
              <ln numlevel="1" lineno="72" slineno="2-39"/>classroom practice.
            </subsection>
          </subsection>
        </subsection>
        <subsection ssid="2-26" numlevel="1" lineno="73" slineno="2-40" dnum="4-o" space="false">
          <display>(4)</display>
          <subsection ssid="2-27" dnum="a-o" placement="sameline">
            <display>(a)</display>An educator shall:
            <subsection ssid="2-28" numlevel="1" lineno="74" slineno="2-41" dnum="i-o" tab="1">
              <display>(i)</display>on or before 
              <amendoutstart style="5"/>
              <amend anum="0" ea="erase" pairid="1" style="2" owner="admin" level="1" deltag="both">the fifth day of instruction in a given school year</amend>
              <amendoutend style="5"/>
              <amend anum="0" ea="amend" pairid="2" style="1" owner="admin" level="1" amendtag="both" space="true">September 30</amend>, 
              <ln numlevel="1" lineno="75" slineno="2-42"/>create a plan, in consultation with the educator's principal, on how the educator 
              <ln numlevel="1" lineno="76" slineno="2-43"/>plans to use paid professional hours provided under this section during the school 
              <ln numlevel="1" lineno="77" slineno="2-44"/>year; and
            </subsection>
            <subsection ssid="2-29" numlevel="1" lineno="78" slineno="2-45" dnum="ii-o" tab="1">
              <display>(ii)</display>before the end of a given school year, provide a written statement to the 
              <ln numlevel="1" lineno="79" slineno="2-46"/>educator's principal of how the educator used paid professional hours provided 
              <ln numlevel="1" lineno="80" slineno="2-47"/>under this section during the school year.
            </subsection>
          </subsection>
          <subsection ssid="2-30" numlevel="1" lineno="81" slineno="2-48" dnum="b-o" space="false">
            <display>(b)</display>
            <subsection ssid="2-31" dnum="i-o" placement="sameline">
              <display>(i)</display>Subsection (4)(a)(i) does not limit an educator who begins employment after 
              <amendoutstart style="5"/>
              <amend anum="0" ea="erase" pairid="3" style="2" owner="admin" level="1" deltag="both">
                <ln numlevel="1" lineno="82" slineno="2-49"/>the fifth day of instruction in a given year
              </amend>
              <amendoutend style="5"/>
              <amend anum="0" ea="amend" pairid="4" style="1" owner="admin" level="1" amendtag="both" space="true">September 30</amend> from receiving paid 
              <ln numlevel="1" lineno="83" slineno="2-50"/>professional hours under this section.
            </subsection>
            <subsection ssid="2-32" numlevel="1" lineno="84" slineno="2-51" dnum="ii-o">
              <display>(ii)</display>An LEA may prorate the paid professional hours of an educator who begins 
              <ln numlevel="1" lineno="85" slineno="2-52"/>employment after 
              <amendoutstart style="5"/>
              <amend anum="0" ea="erase" pairid="5" style="2" owner="admin" level="1" deltag="both">the fifth day of instruction in a given year</amend>
              <amendoutend style="5"/>
              <amend anum="0" ea="amend" pairid="6" style="1" owner="admin" level="1" amendtag="both" space="true">September 30</amend>
              <ln numlevel="1" lineno="86" slineno="2-53"/> according to the portion of the school year for which the LEA employs the 
              <ln numlevel="1" lineno="87" slineno="2-54"/>educator.
            </subsection>
          </subsection>
        </subsection>
      </section>

          <bold>53G-9-207. Child sexual abuse prevention.</bold>
        </catline>
        <subsection ssid="3-1" numlevel="1" lineno="90" slineno="3-3" dnum="1-o" placement="noreturn">
          <display>(1)</display>As used in this section, "school personnel" means the same as that term is defined in  
          <ln numlevel="1" lineno="91" slineno="3-4"/>Section  
          <xref depth="3" refnumber="53G-9-203">53G-9-203</xref>.
        </subsection>
        <subsection ssid="3-2" numlevel="1" lineno="92" slineno="3-5" dnum="2-o">
          <display>(2)</display>The state board shall approve, in partnership with the Department of Human Services,  
          <ln numlevel="1" lineno="93" slineno="3-6"/>age-appropriate instructional materials for the training and instruction described in  
          <ln numlevel="1" lineno="94" slineno="3-7"/>Subsections (3)(a) and (4).
        </subsection>
        <subsection ssid="3-3" numlevel="1" lineno="95" slineno="3-8" dnum="3-o" space="false">
          <display>(3)</display>
          <subsection ssid="3-4" dnum="a-o" placement="sameline">
            <display>(a)</display>A school district or charter school shall provide, 
            <amendoutstart style="5"/>
            <amend anum="0" ea="erase" pairid="1" style="2" owner="admin" level="1" deltag="both">every other year</amend>
            <amendoutend style="5"/>
            <amend anum="0" ea="amend" pairid="2" style="1" owner="admin" level="1" amendtag="both" space="true">once every 
              <ln numlevel="1" lineno="96" slineno="3-9"/>three years
            </amend>, training and instruction on child sexual abuse and human trafficking 
            <ln numlevel="1" lineno="97" slineno="3-10"/>prevention and awareness to:
            <subsection ssid="3-5" numlevel="1" lineno="98" slineno="3-11" dnum="i-o" tab="1">
              <display>(i)</display>school personnel in elementary and secondary schools on:
              <subsection ssid="3-6" numlevel="1" lineno="99" slineno="3-12" dnum="A-o">
                <display>(A)</display>responding to a disclosure of child sexual abuse in a supportive, appropriate 
                <ln numlevel="1" lineno="100" slineno="3-13"/>manner;
              </subsection>
              <subsection ssid="3-7" numlevel="1" lineno="101" slineno="3-14" dnum="B-o">
                <display>(B)</display>identifying children who are victims or may be at risk of becoming victims of 
                <ln numlevel="1" lineno="102" slineno="3-15"/>human trafficking or commercial sexual exploitation; and
              </subsection>
              <subsection ssid="3-8" numlevel="1" lineno="103" slineno="3-16" dnum="C-o">
                <display>(C)</display>the mandatory reporting requirements described in Sections 
                <xref depth="3" refnumber="53E-6-701">53E-6-701</xref> and 
                <xref depth="3" refnumber="80-2-602">
                  <ln numlevel="1" lineno="104" slineno="3-17"/>80-2-602
                </xref>; and
              </subsection>
            </subsection>
            <subsection ssid="3-9" numlevel="1" lineno="105" slineno="3-18" dnum="ii-o" tab="1">
              <display>(ii)</display>parents of elementary school students on:
              <subsection ssid="3-10" numlevel="1" lineno="106" slineno="3-19" dnum="A-o">
                <display>(A)</display>recognizing warning signs of a child who is being sexually abused or who is a 
                <ln numlevel="1" lineno="107" slineno="3-20"/>victim or may be at risk of becoming a victim of human trafficking or 
                <ln numlevel="1" lineno="108" slineno="3-21"/>commercial sexual exploitation; and
              </subsection>
              <subsection ssid="3-11" numlevel="1" lineno="109" slineno="3-22" dnum="B-o">
                <display>(B)</display>effective, age-appropriate methods for discussing the topic of child sexual 
                <ln numlevel="1" lineno="110" slineno="3-23"/>abuse with a child.
              </subsection>
            </subsection>
          </subsection>
          <subsection ssid="3-12" numlevel="1" lineno="111" slineno="3-24" dnum="b-o">
            <display>(b)</display>A school district or charter school shall use the instructional materials approved by 
            <ln numlevel="1" lineno="112" slineno="3-25"/>the state board under Subsection (2) to provide the training and instruction to school 
            <ln numlevel="1" lineno="113" slineno="3-26"/>personnel and parents under Subsection (3)(a).
          </subsection>
        </subsection>
        <subsection ssid="3-13" numlevel="1" lineno="114" slineno="3-27" dnum="4-o" space="false">
          <display>(4)</display>
          <subsection ssid="3-14" dnum="a-o" placement="sameline">
            <display>(a)</display>In accordance with Subsections (4)(b) and (5), a school district or charter school 
            <ln numlevel="1" lineno="115" slineno="3-28"/>may provide instruction on child sexual abuse and human trafficking prevention and 
            <ln numlevel="1" lineno="116" slineno="3-29"/>awareness to elementary school students using age-appropriate curriculum.
          </subsection>
          <subsection ssid="3-15" numlevel="1" lineno="117" slineno="3-30" dnum="b-o">
            <display>(b)</display>A school district or charter school that provides the instruction described in 
            <ln numlevel="1" lineno="118" slineno="3-31"/>Subsection (4)(a) shall use the instructional materials approved by the state board 
            <ln numlevel="1" lineno="119" slineno="3-32"/>under Subsection (2) to provide the instruction.
          </subsection>
        </subsection>
        <subsection ssid="3-16" numlevel="1" lineno="120" slineno="3-33" dnum="5-o" space="false">
          <display>(5)</display>
          <subsection ssid="3-17" dnum="a-o" placement="sameline">
            <display>(a)</display>An elementary school student may not be given the instruction described in 
            <ln numlevel="1" lineno="121" slineno="3-34"/>Subsection (4) unless the parent of the student is:
            <subsection ssid="3-18" numlevel="1" lineno="122" slineno="3-35" dnum="i-o" tab="1">
              <display>(i)</display>notified in advance of the:

              </subsection>

                <display>(B)</display>parent's right to have the student excused from the instruction;
              </subsection>
            </subsection>
            <subsection ssid="3-21" numlevel="1" lineno="125" slineno="3-38" dnum="ii-o" tab="1">
              <display>(ii)</display>given an opportunity to review the instructional materials before the instruction 
              <ln numlevel="1" lineno="126" slineno="3-39"/>occurs; and
            </subsection>

              <display>(iii)</display>allowed to be present when the instruction is delivered.

          <display>(7)</display>Upon request of the state board, a school district or charter school shall provide

              <display>(i)</display>a teacher who teaches a student who has informed the student's school or teacher 
              <ln numlevel="1" lineno="141" slineno="4-6"/>that the student has epilepsy or a similar seizure disorder; and
            </subsection>
            <subsection ssid="4-4" numlevel="1" lineno="142" slineno="4-7" dnum="ii-o" tab="1">
              <display>(ii)</display>an administrator at the school where the student described in Subsection (1)(a)(i) 
              <ln numlevel="1" lineno="143" slineno="4-8"/>attends.
            </subsection>
          </subsection>
          <subsection ssid="4-5" numlevel="1" lineno="144" slineno="4-9" dnum="b-o">
            <display>(b)</display>The training shall:
            <subsection ssid="4-6" numlevel="1" lineno="145" slineno="4-10" dnum="i-o">
              <display>(i)</display>be offered 
              <amendoutstart style="5"/>
              <amend anum="0" ea="erase" pairid="1" style="2" owner="admin" level="1" deltag="both">every two</amend>
              <amendoutend style="5"/>
              <amend anum="0" ea="amend" pairid="2" style="1" owner="admin" level="1" amendtag="both" space="true">once every three</amend> years; and
            </subsection>
            <subsection ssid="4-7" numlevel="1" lineno="146" slineno="4-11" dnum="ii-o">
              <display>(ii)</display>include:
              <subsection ssid="4-8" numlevel="1" lineno="147" slineno="4-12" dnum="A-o">
                <display>(A)</display>recognizing signs and symptoms of seizures; and
              </subsection>
              <subsection ssid="4-9" numlevel="1" lineno="148" slineno="4-13" dnum="B-o">
                <display>(B)</display>appropriate steps for seizure first aid.
              </subsection>
            </subsection>
          </subsection>
        </subsection>
        <subsection ssid="4-10" numlevel="1" lineno="149" slineno="4-14" dnum="2-o">
          <display>(2)</display>Beginning with the 2023-24 school year, an LEA shall provide, as described in  
          <ln numlevel="1" lineno="150" slineno="4-15"/>Subsection (1)(b) and subject to Subsection (3), training to administrators, teachers,  
          <ln numlevel="1" lineno="151" slineno="4-16"/>classroom aides, and other individuals who interact with or supervise students.
        </subsection>
        <subsection ssid="4-11" numlevel="1" lineno="152" slineno="4-17" dnum="3-o" space="false">
          <display>(3)</display>
          <subsection ssid="4-12" dnum="a-o" placement="sameline">
            <display>(a)</display>The state board shall adopt guidelines for the training described in Subsections 
            <ln numlevel="1" lineno="153" slineno="4-18"/>(1)(a) and (2).
          </subsection>
          <subsection ssid="4-13" numlevel="1" lineno="154" slineno="4-19" dnum="b-o">
            <display>(b)</display>The guidelines shall be consistent with programs and guidelines developed by the 
            <ln numlevel="1" lineno="155" slineno="4-20"/>Epilepsy Foundation of America or another national nonprofit organization that 
            <ln numlevel="1" lineno="156" slineno="4-21"/>supports individuals with epilepsy and seizure disorders.
          </subsection>
        </subsection>
        <subsection ssid="4-14" numlevel="1" lineno="157" slineno="4-22" dnum="4-o">
          <display>(4)</display>A training offered under this section may not require a person to provide first aid to a  
          <ln numlevel="1" lineno="158" slineno="4-23"/>student experiencing or showing symptoms of a seizure.
        </subsection>
      </section>

              <display>(i)</display>a physician and surgeon licensed under Title 58, Chapter 67, Utah Medical  
              <ln numlevel="1" lineno="165" slineno="5-7"/>Practice Act;
            </subsection>
            <subsection ssid="5-4" numlevel="1" lineno="166" slineno="5-8" dnum="ii-o">
              <display>(ii)</display>an osteopathic physician and surgeon licensed under Title 58, Chapter 68, Utah  
              <ln numlevel="1" lineno="167" slineno="5-9"/>Osteopathic Medical Practice Act;
            </subsection>
            <subsection ssid="5-5" numlevel="1" lineno="168" slineno="5-10" dnum="iii-o">
              <display>(iii)</display>an advanced practice registered nurse licensed under Title 58, Chapter 31b,  
              <ln numlevel="1" lineno="169" slineno="5-11"/>Nurse Practice Act; or
            </subsection>
            <subsection ssid="5-6" numlevel="1" lineno="170" slineno="5-12" dnum="iv-o">
              <display>(iv)</display>a physician assistant licensed under Title 58, Chapter 70a, Utah Physician  
              <ln numlevel="1" lineno="171" slineno="5-13"/>Assistant Act.
            </subsection>
          </subsection>
          <subsection ssid="5-7" numlevel="1" lineno="172" slineno="5-14" dnum="b-o">
            <display>(b)</display>"Seizure rescue authorization" means a student's Section 504 accommodation plan  
            <ln numlevel="1" lineno="173" slineno="5-15"/>that:
            <subsection ssid="5-8" numlevel="1" lineno="174" slineno="5-16" dnum="i-o">
              <display>(i)</display>certifies that:
              <subsection ssid="5-9" numlevel="1" lineno="175" slineno="5-17" dnum="A-o">
                <display>(A)</display>a prescribing health care professional has prescribed a seizure rescue  
                <ln numlevel="1" lineno="176" slineno="5-18"/>medication for the student;
              </subsection>
              <subsection ssid="5-10" numlevel="1" lineno="177" slineno="5-19" dnum="B-o">
                <display>(B)</display>the student's parent has previously administered the student's seizure rescue  
                <ln numlevel="1" lineno="178" slineno="5-20"/>medication in a nonmedically-supervised setting without a complication; and
              </subsection>
              <subsection ssid="5-11" numlevel="1" lineno="179" slineno="5-21" dnum="C-o">
                <display>(C)</display>the student has previously ceased having full body prolonged or convulsive  
                <ln numlevel="1" lineno="180" slineno="5-22"/>seizure activity as a result of receiving the seizure rescue medication;
              </subsection>
            </subsection>
            <subsection ssid="5-12" numlevel="1" lineno="181" slineno="5-23" dnum="ii-o">
              <display>(ii)</display>describes the specific seizure rescue medication authorized for the student,  
              <ln numlevel="1" lineno="182" slineno="5-24"/>including the indicated dose, and instructions for administration;
            </subsection>
            <subsection ssid="5-13" numlevel="1" lineno="183" slineno="5-25" dnum="iii-o">
              <display>(iii)</display>requests that the student's public school identify and train school employees who  
              <ln numlevel="1" lineno="184" slineno="5-26"/>are willing to volunteer to receive training to administer a seizure rescue  
              <ln numlevel="1" lineno="185" slineno="5-27"/>medication in accordance with this section; and
            </subsection>
            <subsection ssid="5-14" numlevel="1" lineno="186" slineno="5-28" dnum="iv-o">
              <display>(iv)</display>authorizes a trained school employee volunteer to administer a seizure rescue  
              <ln numlevel="1" lineno="187" slineno="5-29"/>medication in accordance with this section.
            </subsection>
          </subsection>
          <subsection ssid="5-15" numlevel="1" lineno="188" slineno="5-30" dnum="c-o" space="false">
            <display>(c)</display>
            <subsection ssid="5-16" dnum="i-o" placement="sameline">
              <display>(i)</display>"Seizure rescue medication" means a medication, prescribed by a prescribing 
              <ln numlevel="1" lineno="189" slineno="5-31"/>health care professional, to be administered as described in a student's seizure 
              <ln numlevel="1" lineno="190" slineno="5-32"/>rescue authorization, while the student experiences seizure activity.
            </subsection>
            <subsection ssid="5-17" numlevel="1" lineno="191" slineno="5-33" dnum="ii-o">
              <display>(ii)</display>A seizure rescue medication does not include a medication administered 
              <ln numlevel="1" lineno="192" slineno="5-34"/>intravenously or intramuscularly.
            </subsection>
          </subsection>
          <subsection ssid="5-18" numlevel="1" lineno="193" slineno="5-35" dnum="d-o">
            <display>(d)</display>"Trained school employee volunteer" means an individual who:
            <subsection ssid="5-19" numlevel="1" lineno="194" slineno="5-36" dnum="i-o">
              <display>(i)</display>is an employee of a public school where at least one student has a seizure rescue  
              <ln numlevel="1" lineno="195" slineno="5-37"/>authorization;
            </subsection>
            <subsection ssid="5-20" numlevel="1" lineno="196" slineno="5-38" dnum="ii-o">
              <display>(ii)</display>is at least 18 years old; and
            </subsection>
            <subsection ssid="5-21" numlevel="1" lineno="197" slineno="5-39" dnum="iii-o">
              <display>(iii)</display>as described in this section:
              <subsection ssid="5-22" numlevel="1" lineno="198" slineno="5-40" dnum="A-o">
                <display>(A)</display>volunteers to receive training in the administration of a seizure rescue  
                <ln numlevel="1" lineno="199" slineno="5-41"/>medication;
              </subsection>
              <subsection ssid="5-23" numlevel="1" lineno="200" slineno="5-42" dnum="B-o">
                <display>(B)</display>completes a training program described in this section;
              </subsection>
              <subsection ssid="5-24" numlevel="1" lineno="201" slineno="5-43" dnum="C-o">
                <display>(C)</display>demonstrates competency on an assessment; and
              </subsection>
              <subsection ssid="5-25" numlevel="1" lineno="202" slineno="5-44" dnum="D-o">
                <display>(D)</display>completes annual refresher training each year that the individual intends to  
                <ln numlevel="1" lineno="203" slineno="5-45"/>remain a trained school employee volunteer.
              </subsection>
            </subsection>
          </subsection>
        </subsection>
        <subsection ssid="5-26" numlevel="1" lineno="204" slineno="5-46" dnum="2-o" space="false">
          <display>(2)</display>
          <subsection ssid="5-27" dnum="a-o" placement="sameline">
            <display>(a)</display>The Department of Health
            <amend anum="0" ea="amend" pairid="1" style="1" owner="admin" level="1" amendtag="both">and Human Services</amend> shall, with input from the state 
            <ln numlevel="1" lineno="205" slineno="5-47"/>board and a children's hospital, develop a training program for trained school 
            <ln numlevel="1" lineno="206" slineno="5-48"/>employee volunteers in the administration of seizure rescue medications that includes:
            <subsection ssid="5-28" numlevel="1" lineno="207" slineno="5-49" dnum="i-o" tab="1">
              <display>(i)</display>techniques to recognize symptoms that warrant the administration of a seizure 
              <ln numlevel="1" lineno="208" slineno="5-50"/>rescue medication;
            </subsection>
            <subsection ssid="5-29" numlevel="1" lineno="209" slineno="5-51" dnum="ii-o" tab="1">
              <display>(ii)</display>standards and procedures for the storage of a seizure rescue medication;
            </subsection>
            <subsection ssid="5-30" numlevel="1" lineno="210" slineno="5-52" dnum="iii-o" tab="1">
              <display>(iii)</display>procedures, in addition to administering a seizure rescue medication, in the event 
              <ln numlevel="1" lineno="211" slineno="5-53"/>that a student requires administration of the seizure rescue medication, including:
              <subsection ssid="5-31" numlevel="1" lineno="212" slineno="5-54" dnum="A-o">
                <display>(A)</display>calling 911; and
              </subsection>
              <subsection ssid="5-32" numlevel="1" lineno="213" slineno="5-55" dnum="B-o">
                <display>(B)</display>contacting the student's parent;
              </subsection>
            </subsection>
            <subsection ssid="5-33" numlevel="1" lineno="214" slineno="5-56" dnum="iv-o" tab="1">
              <display>(iv)</display>an assessment to determine if an individual is competent to administer a seizure 
              <ln numlevel="1" lineno="215" slineno="5-57"/>rescue medication;
            </subsection>
            <subsection ssid="5-34" numlevel="1" lineno="216" slineno="5-58" dnum="v-o" tab="1">
              <display>(v)</display>an annual refresher training component; and
            </subsection>
            <subsection ssid="5-35" numlevel="1" lineno="217" slineno="5-59" dnum="vi-o" tab="1">
              <display>(vi)</display>written materials describing the information required under this Subsection (2)(a).
            </subsection>
          </subsection>
          <subsection ssid="5-36" numlevel="1" lineno="218" slineno="5-60" dnum="b-o">
            <display>(b)</display>A public school shall retain for reference the written materials described in 
            <ln numlevel="1" lineno="219" slineno="5-61"/>Subsection (2)(a)(vi).
          </subsection>
          <subsection ssid="5-37" numlevel="1" lineno="220" slineno="5-62" dnum="c-o">
            <display>(c)</display>The following individuals may provide the training described in Subsection (2)(a):
            <subsection ssid="5-38" numlevel="1" lineno="221" slineno="5-63" dnum="i-o">
              <display>(i)</display>a school nurse; or
            </subsection>
            <subsection ssid="5-39" numlevel="1" lineno="222" slineno="5-64" dnum="ii-o">
              <display>(ii)</display>a licensed heath care professional.
            </subsection>
          </subsection>
        </subsection>
        <subsection ssid="5-40" numlevel="1" lineno="223" slineno="5-65" dnum="3-o" space="false">
          <display>(3)</display>
          <subsection ssid="5-41" dnum="a-o" placement="sameline">
            <display>(a)</display>A public school shall, after receiving a seizure rescue authorization:
            <subsection ssid="5-42" numlevel="1" lineno="224" slineno="5-66" dnum="i-o" tab="1">
              <display>(i)</display>inform school employees of the opportunity to be a school employee volunteer; 
              <ln numlevel="1" lineno="225" slineno="5-67"/>and
            </subsection>
            <subsection ssid="5-43" numlevel="1" lineno="226" slineno="5-68" dnum="ii-o" tab="1">
              <display>(ii)</display>subject to Subsection (3)(b)(ii), provide training, to each school employee who 
              <ln numlevel="1" lineno="227" slineno="5-69"/>volunteers, using the training program described in Subsection (2)(a).
            </subsection>
          </subsection>
          <subsection ssid="5-44" numlevel="1" lineno="228" slineno="5-70" dnum="b-o">
            <display>(b)</display>A public school may not:
            <subsection ssid="5-45" numlevel="1" lineno="229" slineno="5-71" dnum="i-o">
              <display>(i)</display>obstruct the identification or training of a trained school employee volunteer; or
            </subsection>
            <subsection ssid="5-46" numlevel="1" lineno="230" slineno="5-72" dnum="ii-o">
              <display>(ii)</display>compel a school employee to become a trained school employee volunteer.
            </subsection>
          </subsection>
        </subsection>
        <subsection ssid="5-47" numlevel="1" lineno="231" slineno="5-73" dnum="4-o">
          <display>(4)</display>A trained school employee volunteer may possess or store a prescribed rescue seizure  
          <ln numlevel="1" lineno="232" slineno="5-74"/>medication, in accordance with this section.
        </subsection>
        <subsection ssid="5-48" numlevel="1" lineno="233" slineno="5-75" dnum="5-o">
          <display>(5)</display>A trained school employee volunteer may administer a seizure rescue medication to a  
          <ln numlevel="1" lineno="234" slineno="5-76"/>student with a seizure rescue authorization if:
          <subsection ssid="5-49" numlevel="1" lineno="235" slineno="5-77" dnum="a-o">
            <display>(a)</display>the student is exhibiting a symptom, described on the student's seizure rescue  
            <ln numlevel="1" lineno="236" slineno="5-78"/>authorization, that warrants the administration of a seizure rescue medication; and
          </subsection>
          <subsection ssid="5-50" numlevel="1" lineno="237" slineno="5-79" dnum="b-o">
            <display>(b)</display>a licensed health care professional is not immediately available to administer the  
            <ln numlevel="1" lineno="238" slineno="5-80"/>seizure rescue medication.
          </subsection>
        </subsection>
        <subsection ssid="5-51" numlevel="1" lineno="239" slineno="5-81" dnum="6-o">
          <display>(6)</display>A trained school employee volunteer who administers a seizure rescue medication shall  
          <ln numlevel="1" lineno="240" slineno="5-82"/>direct an individual to call 911 and take other appropriate actions in accordance with the  
          <ln numlevel="1" lineno="241" slineno="5-83"/>training described in Subsection (2).
        </subsection>
        <subsection ssid="5-52" numlevel="1" lineno="242" slineno="5-84" dnum="7-o">
          <display>(7)</display>A trained school employee volunteer who administers a seizure rescue medication in  
          <ln numlevel="1" lineno="243" slineno="5-85"/>accordance with this section in good faith is not liable in a civil or criminal action for an  
          <ln numlevel="1" lineno="244" slineno="5-86"/>act taken or not taken under this section.
        </subsection>
        <subsection ssid="5-53" numlevel="1" lineno="245" slineno="5-87" dnum="8-o">
          <display>(8)</display>Section  
          <xref depth="3" refnumber="53G-9-502">53G-9-502</xref> does not apply to the administration of a seizure rescue medication.
        </subsection>
        <subsection ssid="5-54" numlevel="1" lineno="246" slineno="5-88" dnum="9-o">
          <display>(9)</display>Section  
          <xref depth="3" refnumber="53G-8-205">53G-8-205</xref> does not apply to the possession of a seizure rescue medication in

            <display>(a)</display>The unlawful or unprofessional conduct provisions of Title 58, Occupations and 
            <ln numlevel="1" lineno="249" slineno="5-91"/>Professions, do not apply to a person licensed as a health care professional under 
            <ln numlevel="1" lineno="250" slineno="5-92"/>Title 58, Occupations and Professions, including a nurse, physician, physician 
            <ln numlevel="1" lineno="251" slineno="5-93"/>assistant, or pharmacist for, in good faith, training a nonlicensed school employee 
            <ln numlevel="1" lineno="252" slineno="5-94"/>who volunteers to administer a seizure rescue medication in accordance with this 
            <ln numlevel="1" lineno="253" slineno="5-95"/>section.
          </subsection>
          <subsection ssid="5-57" numlevel="1" lineno="254" slineno="5-96" dnum="b-o">
            <display>(b)</display>Allowing a trained school employee volunteer to administer a seizure rescue 
            <ln numlevel="1" lineno="255" slineno="5-97"/>medication in accordance with this section does not constitute unlawful or 
            <ln numlevel="1" lineno="256" slineno="5-98"/>inappropriate delegation under Title 58, Occupations and Professions.
          </subsection>
        </subsection>

          <display>(2)</display>The state board shall:
          <subsection ssid="6-3" numlevel="1" lineno="263" slineno="6-7" dnum="a-o">
            <display>(a)</display>develop or adopt sample materials to be used by a school district or charter school for

            <display>(b)</display>if the agency plans to save all or a portion of the agency's nonlapsing appropriations

          </subsection>

            <display>(b)</display>annually submit to the Office of the Legislative Fiscal Analyst a report that contains:
            <subsection ssid="8-11" numlevel="1" lineno="315" slineno="8-23" dnum="i-o">
              <display>(i)</display>any recommendations for legislative changes for the next fiscal year to the  
              <ln numlevel="1" lineno="316" slineno="8-24"/>agency's previously adopted performance measures; and
            </subsection>

            <display>(c)</display>provide the lists described in this subsection to each executive department agency.
          </subsection>
        </subsection>

            <ln numlevel="1" lineno="349" slineno="8-57"/>Planning and Budget and the Office of the Legislative Fiscal Analyst shall review the 
            <ln numlevel="1" lineno="350" slineno="8-58"/>proposed performance measures and, if necessary, coordinate with the executive 
            <ln numlevel="1" lineno="351" slineno="8-59"/>department agency to modify and finalize the performance measures.
          </subsection>
          <subsection ssid="8-30" numlevel="1" lineno="352" slineno="8-60" dnum="b-o">
            <display>(b)</display>The Governor's Office of Planning and Budget, the Office of the Legislative Fiscal 
            <ln numlevel="1" lineno="353" slineno="8-61"/>Analyst, and the executive department agency shall finalize each proposed 
            <ln numlevel="1" lineno="354" slineno="8-62"/>performance measure before July 1.
          </subsection>
        </subsection>
        <subsection ssid="8-31" numlevel="1" lineno="355" slineno="8-63" dnum="7-o:9-e">
          <display>

          </display>The Governor's Office of Planning and Budget shall:
          <subsection ssid="8-33" numlevel="1" lineno="360" slineno="8-68" dnum="a-o">
            <display>(a)</display>review at least 20% of the performance measures described in Subsection (2)  
            <ln numlevel="1" lineno="361" slineno="8-69"/>annually; and
          </subsection>
          <subsection ssid="8-34" numlevel="1" lineno="362" slineno="8-70" dnum="b-o">
            <display>(b)</display>ensure that the Governor's Office of Planning and Budget reviews each performance  
            <ln numlevel="1" lineno="363" slineno="8-71"/>measure described in Subsection (2) at least once every five years.
          </subsection>
        </subsection>
        <subsection ssid="8-35" numlevel="1" lineno="364" slineno="8-72" dnum="9-o:11-e">
          <display>

            <ln numlevel="1" lineno="369" slineno="8-77"/>Appropriations Committee and the appropriations subcommittees, as appropriate.
          </subsection>
          <subsection ssid="8-38" numlevel="1" lineno="370" slineno="8-78" dnum="b-o">
            <display>(b)</display>The Governor's Office of Planning and Budget shall report the relevant performance

          </display>Each executive department agency, when the agency's budget is subject to a

            <display>(a)</display>conduct a thorough evaluation of the agency's performance measures, internal budget  
            <ln numlevel="1" lineno="375" slineno="8-83"/>process, and budget controls; and
          </subsection>
          <subsection ssid="8-41" numlevel="1" lineno="376" slineno="8-84" dnum="b-o">
            <display>(b)</display>submit the results of the evaluation to the legislative appropriations subcommittee.
