    <gdhead lineno="4">General Description:</gdhead>
    <gd numlevel="1" lineno="5" slineno="0-5">This bill modifies provisions related to state legal actions.</gd>
    <hphead lineno="6">Highlighted Provisions:</hphead>
    <hp numlevel="1" lineno="7" slineno="0-7">This bill:
      <hl numlevel="1" lineno="8" slineno="0-8" level="1">modifies the Government Records Access and Management Act to address information  
        <ln numlevel="1" lineno="9" slineno="0-9"/>regarding imminent or pending litigation shared among certain state entities;
      </hl>
      <hl numlevel="1" lineno="10" slineno="0-10" level="1">amends the state settlement approval process by:
        <hl numlevel="1" lineno="11" slineno="0-11" level="2">directing the attorney general to share with the approving person any information  
          <ln numlevel="1" lineno="12" slineno="0-12"/>relevant to a recommended settlement; and
        </hl>
        <hl numlevel="1" lineno="13" slineno="0-13" level="2">clarifying that the cost to implement an action settlement agreement includes the cost  
          <ln numlevel="1" lineno="14" slineno="0-14"/>of monetary and non-monetary terms;
        </hl>
      </hl>
      <hl numlevel="1" lineno="15" slineno="0-15" level="1">provides the attorney general's authority to take certain enforcement action against  
        <ln numlevel="1" lineno="16" slineno="0-16"/>charter schools;
      </hl>
      <hl numlevel="1" lineno="17" slineno="0-17" level="1">addresses the sharing of information between the attorney general and the Legislature  
        <ln numlevel="1" lineno="18" slineno="0-18"/>relating to state settlements and anticipated or pending state litigation; and

          <bold>63G-2-103</bold> is amended to read:

          <bold>63G-2-103. Definitions.</bold>
        </catline>

          <tab/>As used in this chapter:
        </sectionText>
        <subsection ssid="1-1" numlevel="1" lineno="43" slineno="1-4" dnum="1-o">
          <display>(1)</display>"Audit" means:
          <subsection ssid="1-2" numlevel="1" lineno="44" slineno="1-5" dnum="a-o">
            <display>(a)</display>a systematic examination of financial, management, program, and related records for  
            <ln numlevel="1" lineno="45" slineno="1-6"/>the purpose of determining the fair presentation of financial statements, adequacy of  
            <ln numlevel="1" lineno="46" slineno="1-7"/>internal controls, or compliance with laws and regulations; or
          </subsection>
          <subsection ssid="1-3" numlevel="1" lineno="47" slineno="1-8" dnum="b-o">
            <display>(b)</display>a systematic examination of program procedures and operations for the purpose of  
            <ln numlevel="1" lineno="48" slineno="1-9"/>determining their effectiveness, economy, efficiency, and compliance with statutes  
            <ln numlevel="1" lineno="49" slineno="1-10"/>and regulations.
          </subsection>
        </subsection>
        <subsection ssid="1-4" numlevel="1" lineno="50" slineno="1-11" dnum="2-o">
          <display>(2)</display>"Chronological logs" mean the regular and customary summary records of law  
          <ln numlevel="1" lineno="51" slineno="1-12"/>enforcement agencies and other public safety agencies that show:
          <subsection ssid="1-5" numlevel="1" lineno="52" slineno="1-13" dnum="a-o">
            <display>(a)</display>the time and general nature of police, fire, and paramedic calls made to the agency;  
            <ln numlevel="1" lineno="53" slineno="1-14"/>and
          </subsection>
          <subsection ssid="1-6" numlevel="1" lineno="54" slineno="1-15" dnum="b-o">
            <display>(b)</display>any arrests or jail bookings made by the agency.
          </subsection>
        </subsection>
        <subsection ssid="1-7" numlevel="1" lineno="55" slineno="1-16" dnum="3-o">
          <display>(3)</display>"Classification," "classify," and their derivative forms mean determining whether a  
          <ln numlevel="1" lineno="56" slineno="1-17"/>record series, record, or information within a record is public, private, controlled,  
          <ln numlevel="1" lineno="57" slineno="1-18"/>protected, or exempt from disclosure under Subsection  
          <xref depth="3" refnumber="63G-2-201">63G-2-201</xref>(3)(b).
        </subsection>
        <subsection ssid="1-8" numlevel="1" lineno="58" slineno="1-19" dnum="4-o" space="false">
          <display>(4)</display>
          <subsection ssid="1-9" dnum="a-o" placement="sameline">
            <display>(a)</display>"Computer program" means:
            <subsection ssid="1-10" numlevel="1" lineno="59" slineno="1-20" dnum="i-o" tab="1">
              <display>(i)</display>a series of instructions or statements that permit the functioning of a computer 
              <ln numlevel="1" lineno="60" slineno="1-21"/>system in a manner designed to provide storage, retrieval, and manipulation of 
              <ln numlevel="1" lineno="61" slineno="1-22"/>data from the computer system; and
            </subsection>
            <subsection ssid="1-11" numlevel="1" lineno="62" slineno="1-23" dnum="ii-o" tab="1">
              <display>(ii)</display>any associated documentation and source material that explain how to operate the 
              <ln numlevel="1" lineno="63" slineno="1-24"/>computer program.
            </subsection>
          </subsection>
          <subsection ssid="1-12" numlevel="1" lineno="64" slineno="1-25" dnum="b-o">
            <display>(b)</display>"Computer program" does not mean:
            <subsection ssid="1-13" numlevel="1" lineno="65" slineno="1-26" dnum="i-o">
              <display>(i)</display>the original data, including numbers, text, voice, graphics, and images;
            </subsection>
            <subsection ssid="1-14" numlevel="1" lineno="66" slineno="1-27" dnum="ii-o">
              <display>(ii)</display>analysis, compilation, and other manipulated forms of the original data produced 
              <ln numlevel="1" lineno="67" slineno="1-28"/>by use of the program; or
            </subsection>
            <subsection ssid="1-15" numlevel="1" lineno="68" slineno="1-29" dnum="iii-o">
              <display>(iii)</display>the mathematical or statistical formulas, excluding the underlying mathematical 
              <ln numlevel="1" lineno="69" slineno="1-30"/>algorithms contained in the program, that would be used if the manipulated forms 
              <ln numlevel="1" lineno="70" slineno="1-31"/>of the original data were to be produced manually.
            </subsection>
          </subsection>
        </subsection>
        <subsection ssid="1-16" numlevel="1" lineno="71" slineno="1-32" dnum="5-o" space="false">
          <display>(5)</display>
          <subsection ssid="1-17" dnum="a-o" placement="sameline">
            <display>(a)</display>"Contractor" means:
            <subsection ssid="1-18" numlevel="1" lineno="72" slineno="1-33" dnum="i-o" tab="1">
              <display>(i)</display>any person who contracts with a governmental entity to provide goods or services 
              <ln numlevel="1" lineno="73" slineno="1-34"/>directly to a governmental entity; or
            </subsection>
            <subsection ssid="1-19" numlevel="1" lineno="74" slineno="1-35" dnum="ii-o" tab="1">
              <display>(ii)</display>any private, nonprofit organization that receives funds from a governmental entity.
            </subsection>
          </subsection>
          <subsection ssid="1-20" numlevel="1" lineno="75" slineno="1-36" dnum="b-o">
            <display>(b)</display>"Contractor" does not mean a private provider.
          </subsection>
        </subsection>
        <subsection ssid="1-21" numlevel="1" lineno="76" slineno="1-37" dnum="6-o">
          <display>(6)</display>"Controlled record" means a record containing data on individuals that is controlled as  
          <ln numlevel="1" lineno="77" slineno="1-38"/>provided by Section  
          <xref depth="3" refnumber="63G-2-304">63G-2-304</xref>.
        </subsection>
        <subsection ssid="1-22" numlevel="1" lineno="78" slineno="1-39" dnum="7-o">
          <display>(7)</display>"Designation," "designate," and their derivative forms mean indicating, based on a  
          <ln numlevel="1" lineno="79" slineno="1-40"/>governmental entity's familiarity with a record series or based on a governmental entity's  
          <ln numlevel="1" lineno="80" slineno="1-41"/>review of a reasonable sample of a record series, the primary classification that a  
          <ln numlevel="1" lineno="81" slineno="1-42"/>majority of records in a record series would be given if classified and the classification  
          <ln numlevel="1" lineno="82" slineno="1-43"/>that other records typically present in the record series would be given if classified.
        </subsection>
        <subsection ssid="1-23" numlevel="1" lineno="83" slineno="1-44" dnum="8-o">
          <display>(8)</display>"Elected official" means each person elected to a state office, county office, municipal  
          <ln numlevel="1" lineno="84" slineno="1-45"/>office, school board or school district office, special district office, or special service  
          <ln numlevel="1" lineno="85" slineno="1-46"/>district office, but does not include judges.
        </subsection>
        <subsection ssid="1-24" numlevel="1" lineno="86" slineno="1-47" dnum="9-o">
          <display>(9)</display>"Explosive" means a chemical compound, device, or mixture:
          <subsection ssid="1-25" numlevel="1" lineno="87" slineno="1-48" dnum="a-o">
            <display>(a)</display>commonly used or intended for the purpose of producing an explosion; and
          </subsection>
          <subsection ssid="1-26" numlevel="1" lineno="88" slineno="1-49" dnum="b-o">
            <display>(b)</display>that contains oxidizing or combustive units or other ingredients in proportions,  
            <ln numlevel="1" lineno="89" slineno="1-50"/>quantities, or packing so that:
            <subsection ssid="1-27" numlevel="1" lineno="90" slineno="1-51" dnum="i-o">
              <display>(i)</display>an ignition by fire, friction, concussion, percussion, or detonator of any part of the  
              <ln numlevel="1" lineno="91" slineno="1-52"/>compound or mixture may cause a sudden generation of highly heated gases; and
            </subsection>
            <subsection ssid="1-28" numlevel="1" lineno="92" slineno="1-53" dnum="ii-o">
              <display>(ii)</display>the resultant gaseous pressures are capable of:
              <subsection ssid="1-29" numlevel="1" lineno="93" slineno="1-54" dnum="A-o">
                <display>(A)</display>producing destructive effects on contiguous objects; or
              </subsection>
              <subsection ssid="1-30" numlevel="1" lineno="94" slineno="1-55" dnum="B-o">
                <display>(B)</display>causing death or serious bodily injury.
              </subsection>
            </subsection>
          </subsection>
        </subsection>
        <subsection ssid="1-31" numlevel="1" lineno="95" slineno="1-56" dnum="10-o">
          <display>(10)</display>"Government audit agency" means any governmental entity that conducts an audit.
        </subsection>
        <subsection ssid="1-32" numlevel="1" lineno="96" slineno="1-57" dnum="11-o" space="false">
          <display>(11)</display>
          <subsection ssid="1-33" dnum="a-o" placement="sameline">
            <display>(a)</display>"Governmental entity" means:
            <subsection ssid="1-34" numlevel="1" lineno="97" slineno="1-58" dnum="i-o" tab="1">
              <display>(i)</display>executive department agencies of the state, the offices of the governor, lieutenant 
              <ln numlevel="1" lineno="98" slineno="1-59"/>governor, state auditor, attorney general, and state treasurer, the Board of Pardons 
              <ln numlevel="1" lineno="99" slineno="1-60"/>and Parole, the Board of Examiners, the National Guard, the Career Service 
              <ln numlevel="1" lineno="100" slineno="1-61"/>Review Office, the State Board of Education, the Utah Board of Higher 
              <ln numlevel="1" lineno="101" slineno="1-62"/>Education, and the State Archives;
            </subsection>
            <subsection ssid="1-35" numlevel="1" lineno="102" slineno="1-63" dnum="ii-o" tab="1">
              <display>(ii)</display>the Office of the Legislative Auditor General, Office of the Legislative Fiscal 
              <ln numlevel="1" lineno="103" slineno="1-64"/>Analyst, Office of Legislative Research and General Counsel, the Legislature, and 
              <ln numlevel="1" lineno="104" slineno="1-65"/>legislative committees, except any political party, group, caucus, or rules or sifting 
              <ln numlevel="1" lineno="105" slineno="1-66"/>committee of the Legislature;
            </subsection>
            <subsection ssid="1-36" numlevel="1" lineno="106" slineno="1-67" dnum="iii-o" tab="1">
              <display>(iii)</display>courts, the Judicial Council, the Administrative Office of the Courts, and similar 
              <ln numlevel="1" lineno="107" slineno="1-68"/>administrative units in the judicial branch;
            </subsection>
            <subsection ssid="1-37" numlevel="1" lineno="108" slineno="1-69" dnum="iv-o" tab="1">
              <display>(iv)</display>any state-funded institution of higher education or public education; or
            </subsection>
            <subsection ssid="1-38" numlevel="1" lineno="109" slineno="1-70" dnum="v-o" tab="1">
              <display>(v)</display>any political subdivision of the state, but, if a political subdivision has adopted an 
              <ln numlevel="1" lineno="110" slineno="1-71"/>ordinance or a policy relating to information practices pursuant to Section 
              <xref depth="3" refnumber="63G-2-701">
                <ln numlevel="1" lineno="111" slineno="1-72"/>63G-2-701
              </xref>, this chapter shall apply to the political subdivision to the extent 
              <ln numlevel="1" lineno="112" slineno="1-73"/>specified in Section 
              <xref depth="3" refnumber="63G-2-701">63G-2-701</xref> or as specified in any other section of this chapter 
              <ln numlevel="1" lineno="113" slineno="1-74"/>that specifically refers to political subdivisions.
            </subsection>
          </subsection>
          <subsection ssid="1-39" numlevel="1" lineno="114" slineno="1-75" dnum="b-o">
            <display>(b)</display>"Governmental entity" also means:
            <subsection ssid="1-40" numlevel="1" lineno="115" slineno="1-76" dnum="i-o">
              <display>(i)</display>every office, agency, board, bureau, committee, department, advisory board, or 
              <ln numlevel="1" lineno="116" slineno="1-77"/>commission of an entity listed in Subsection (11)(a) that is funded or established 
              <ln numlevel="1" lineno="117" slineno="1-78"/>by the government to carry out the public's business;
            </subsection>
            <subsection ssid="1-41" numlevel="1" lineno="118" slineno="1-79" dnum="ii-o">
              <display>(ii)</display>as defined in Section 
              <xref depth="3" refnumber="11-13-103">11-13-103</xref>, an interlocal entity or joint or cooperative 
              <ln numlevel="1" lineno="119" slineno="1-80"/>undertaking;
            </subsection>
            <subsection ssid="1-42" numlevel="1" lineno="120" slineno="1-81" dnum="iii-o">
              <display>(iii)</display>as defined in Section 
              <xref depth="3" refnumber="11-13a-102">11-13a-102</xref>, a governmental nonprofit corporation;
            </subsection>
            <subsection ssid="1-43" numlevel="1" lineno="121" slineno="1-82" dnum="iv-o">
              <display>(iv)</display>an association as defined in Section 
              <xref depth="3" refnumber="53G-7-1101">53G-7-1101</xref>;
            </subsection>
            <subsection ssid="1-44" numlevel="1" lineno="122" slineno="1-83" dnum="v-o">
              <display>(v)</display>the Utah Independent Redistricting Commission; and
            </subsection>
            <subsection ssid="1-45" numlevel="1" lineno="123" slineno="1-84" dnum="vi-o">
              <display>(vi)</display>a law enforcement agency, as defined in Section 
              <xref depth="3" refnumber="53-1-102">53-1-102</xref>, that employs one or 
              <ln numlevel="1" lineno="124" slineno="1-85"/>more law enforcement officers, as defined in Section 
              <xref depth="3" refnumber="53-13-103">53-13-103</xref>.
            </subsection>
          </subsection>
          <subsection ssid="1-46" numlevel="1" lineno="125" slineno="1-86" dnum="c-o">
            <display>(c)</display>"Governmental entity" does not include the Utah Educational Savings Plan created in 
            <ln numlevel="1" lineno="126" slineno="1-87"/>Section 
            <xref depth="3" refnumber="53B-8a-103">53B-8a-103</xref>.
          </subsection>
        </subsection>
        <subsection ssid="1-47" numlevel="1" lineno="127" slineno="1-88" dnum="12-o">
          <display>(12)</display>"Gross compensation" means every form of remuneration payable for a given period to

              <display>(ii)</display>names of victims;
            </subsection>
            <subsection ssid="1-53" numlevel="1" lineno="138" slineno="1-99" dnum="iii-o" tab="1">
              <display>(iii)</display>the nature or general scope of the agency's initial actions taken in response to the

            </subsection>

              <display>(iv)</display>the general nature of any injuries or estimate of damages sustained in the incident;

            <display>(b)</display>Initial contact reports do not include follow-up or investigative reports prepared after

          <ln numlevel="1" lineno="314" slineno="4-18"/>the president of the Senate, the speaker of the House of Representatives, and the director  
          <ln numlevel="1" lineno="315" slineno="4-19"/>of the Office of Legislative Research and General Counsel within three business days of  
          <ln numlevel="1" lineno="316" slineno="4-20"/>executing the agreement.
        </subsection>

                <ln numlevel="1" lineno="323" slineno="5-7"/>material to the settlement,
              </amend> to the governor for the governor's approval or rejection 
              <ln numlevel="1" lineno="324" slineno="5-8"/>as required by Section 
              <xref depth="3" refnumber="63G-10-302">63G-10-302</xref>; and
            </subsection>
            <subsection ssid="5-4" numlevel="1" lineno="325" slineno="5-9" dnum="ii-o" tab="1">
              <display>(ii)</display>if the governor approves the action settlement agreement, submit the action 
              <ln numlevel="1" lineno="326" slineno="5-10"/>settlement agreement to the Legislative Management Committee for its review 
              <ln numlevel="1" lineno="327" slineno="5-11"/>and recommendations.
            </subsection>
          </subsection>
          <subsection ssid="5-5" numlevel="1" lineno="328" slineno="5-12" dnum="b-o">
            <display>(b)</display>The Legislative Management Committee shall review the action settlement 
            <ln numlevel="1" lineno="329" slineno="5-13"/>agreement and may:
            <subsection ssid="5-6" numlevel="1" lineno="330" slineno="5-14" dnum="i-o">
              <display>(i)</display>recommend that the agency execute the settlement agreement;
            </subsection>
            <subsection ssid="5-7" numlevel="1" lineno="331" slineno="5-15" dnum="ii-o">
              <display>(ii)</display>recommend that the agency reject the settlement agreement; or
            </subsection>
            <subsection ssid="5-8" numlevel="1" lineno="332" slineno="5-16" dnum="iii-o">
              <display>(iii)</display>recommend to the governor that the governor call a special session of the 
              <ln numlevel="1" lineno="333" slineno="5-17"/>Legislature to review and approve or reject the settlement agreement.
            </subsection>
          </subsection>
        </subsection>
        <subsection ssid="5-9" numlevel="1" lineno="334" slineno="5-18" dnum="2-o" space="false">
          <display>(2)</display>
          <subsection ssid="5-10" dnum="a-o" placement="sameline">
            <display>(a)</display>Before legally binding the state by executing an action settlement agreement that 
            <ln numlevel="1" lineno="335" slineno="5-19"/>might cost government entities more than $2,000,000 to implement, an agency shall:
            <subsection ssid="5-11" numlevel="1" lineno="336" slineno="5-20" dnum="i-o" tab="1">
              <display>(i)</display>submit the proposed action settlement agreement
              <amend anum="0" ea="amend" pairid="3" style="1" owner="admin" level="1" amendtag="both">, including all terms that are 
                <ln numlevel="1" lineno="337" slineno="5-21"/>material to the settlement,
              </amend> to the governor for the governor's approval or rejection 
              <ln numlevel="1" lineno="338" slineno="5-22"/>as required by Section 
              <xref depth="3" refnumber="63G-10-302">63G-10-302</xref>; and
            </subsection>
            <subsection ssid="5-12" numlevel="1" lineno="339" slineno="5-23" dnum="ii-o" tab="1">
              <display>(ii)</display>if the governor approves the action settlement agreement, submit the action 
              <ln numlevel="1" lineno="340" slineno="5-24"/>settlement agreement to the Legislature for its approval in an annual general 
              <ln numlevel="1" lineno="341" slineno="5-25"/>session or a special session.
            </subsection>
          </subsection>
          <subsection ssid="5-13" numlevel="1" lineno="342" slineno="5-26" dnum="b-o" space="false">
            <display>(b)</display>

              <display>(i)</display>If the Legislature approves the action settlement agreement, the agency may

          <subsection ssid="7-9" dnum="a-o" placement="sameline">
            <display>(a)</display>The risk manager shall, upon initiation of negotiations that the risk manager 
            <ln numlevel="1" lineno="383" slineno="7-20"/>reasonably believes to have the potential to lead to a settlement requiring approval 
            <ln numlevel="1" lineno="384" slineno="7-21"/>under Subsection (1)(d) or (e):
            <subsection ssid="7-10" numlevel="1" lineno="385" slineno="7-22" dnum="i-o" tab="1">
              <display>(i)</display>notify the Legislature's general counsel that negotiations have commenced;
            </subsection>
            <subsection ssid="7-11" numlevel="1" lineno="386" slineno="7-23" dnum="ii-o" tab="1">
              <display>(ii)</display>continue to keep the Legislature's general counsel informed of material 
              <ln numlevel="1" lineno="387" slineno="7-24"/>developments in the negotiation process; and
            </subsection>
            <subsection ssid="7-12" numlevel="1" lineno="388" slineno="7-25" dnum="iii-o" tab="1">
              <display>(iii)</display>permit the Legislature's general counsel to attend negotiations.
            </subsection>
          </subsection>
          <subsection ssid="7-13" numlevel="1" lineno="389" slineno="7-26" dnum="b-o">
            <display>(b)</display>The information that the risk manager shall provide to the Legislature's general 
            <ln numlevel="1" lineno="390" slineno="7-27"/>counsel under Subsection 
            <amendoutstart style="5"/>
            <amend anum="0" ea="erase" pairid="4" style="2" owner="admin" level="1" deltag="both">(2)(a)</amend>
            <amendoutend style="5"/>
            <amend anum="0" ea="amend" pairid="5" style="1" owner="admin" level="1" amendtag="both" space="true">(3)(a)</amend> includes:
            <subsection ssid="7-14" numlevel="1" lineno="391" slineno="7-28" dnum="i-o">
              <display>(i)</display>the nature of the claim that is the subject of the settlement negotiations;
            </subsection>

              <display>(ii)</display>the known facts that support the claim and the known facts that controvert the

            <display>(c)</display>A document, paper, electronic data, communication, or other material that the risk 
            <ln numlevel="1" lineno="396" slineno="7-33"/>manager provides to legislative general counsel in the discharge of the risk manager's 
            <ln numlevel="1" lineno="397" slineno="7-34"/>responsibility under
            <amend anum="0" ea="amend" pairid="6" style="1" owner="admin" level="1" amendtag="both">this</amend> Subsection 
            <amendoutstart style="5"/>

          <ln numlevel="1" lineno="411" slineno="7-48"/>settlement to the Legislative Management Committee by sending a settlement agreement  
          <ln numlevel="1" lineno="412" slineno="7-49"/>report to the president of the Senate, the speaker of the House of Representatives, and  
          <ln numlevel="1" lineno="413" slineno="7-50"/>the director of the Office of Legislative Research and General Counsel within three  
          <ln numlevel="1" lineno="414" slineno="7-51"/>business days of executing the agreement.
        </subsection>

                <ln numlevel="1" lineno="423" slineno="8-9"/>opportunity to cure the violation not to exceed 30 calendar days; and

          </subsection>
          <subsection ssid="8-6" ea="amend" anum="0" owner="admin" style="1" numlevel="1" lineno="424" slineno="8-10" dnum="_-e:c-e">
            <display>

            <display>(c)</display>abide by the officer's or designee's decisions concerning the objectives of the

            <ln numlevel="1" lineno="469" slineno="10-12"/>are to be pursued; and
          </subsection>
          <subsection ssid="10-5" numlevel="1" lineno="470" slineno="10-13" dnum="d-o">
            <display>(d)</display>jointly by agreement, establish protocols with the officer to facilitate  
            <ln numlevel="1" lineno="471" slineno="10-14"/>communications and working relationships with the officer or agencies under the  
            <ln numlevel="1" lineno="472" slineno="10-15"/>officer's supervision.
          </subsection>
        </subsection>
        <subsection ssid="10-6" numlevel="1" lineno="473" slineno="10-16" dnum="2-o">
          <display>(2)</display>Nothing in Subsection (1) modifies or supercedes any independent legal authority  
          <ln numlevel="1" lineno="474" slineno="10-17"/>granted specifically by statute to the attorney general.
        </subsection>

          <display>(3)</display>When the attorney general institutes or maintains a civil enforcement action on behalf of

            <display>(a)</display>fully advise the governor, as the officer in whom the executive authority of the state  
            <ln numlevel="1" lineno="478" slineno="10-21"/>is vested, before instituting the action, entering into a settlement or consent decree, or  
            <ln numlevel="1" lineno="479" slineno="10-22"/>taking an appeal; and
          </subsection>
          <subsection ssid="10-9" numlevel="1" lineno="480" slineno="10-23" dnum="b-o">
            <display>(b)</display>keep the governor reasonably informed about the status of the matter and promptly  
            <ln numlevel="1" lineno="481" slineno="10-24"/>comply with reasonable requests for information.
          </subsection>
        </subsection>
        <subsection ssid="10-10" numlevel="1" lineno="482" slineno="10-25" dnum="4-o">
          <display>(4)</display>In a civil action not covered under Subsection (1) or (3), the attorney general shall:
          <subsection ssid="10-11" numlevel="1" lineno="483" slineno="10-26" dnum="a-o">
            <display>(a)</display>keep the governor reasonably informed about the status of the matter and promptly  
            <ln numlevel="1" lineno="484" slineno="10-27"/>comply with reasonable requests for information;
          </subsection>
          <subsection ssid="10-12" numlevel="1" lineno="485" slineno="10-28" dnum="b-o">
            <display>(b)</display>explain the matter to the extent reasonably necessary to enable the governor to make  
            <ln numlevel="1" lineno="486" slineno="10-29"/>informed decisions regarding the representation; and
          </subsection>
          <subsection ssid="10-13" numlevel="1" lineno="487" slineno="10-30" dnum="c-o">
            <display>(c)</display>abide by the governor's decisions concerning the objectives of the representation and  
            <ln numlevel="1" lineno="488" slineno="10-31"/>consult with the governor as to the means by which they are to be pursued.
          </subsection>
        </subsection>
        <subsection ssid="10-14" numlevel="1" lineno="489" slineno="10-32" dnum="5-o">
          <display>(5)</display>The governor may appear in any civil legal action involving the state and appoint legal  
          <ln numlevel="1" lineno="490" slineno="10-33"/>counsel to advise or appear on behalf of the governor.  The court shall allow the  
          <ln numlevel="1" lineno="491" slineno="10-34"/>governor's appearance.
        </subsection>

            <amend anum="0" ea="amend" pairid="3" style="1" owner="admin" level="1" amendtag="end">As used in this section, "cooperative state litigation" means:</amend>
            <subsection ssid="10-17" ea="amend" anum="0" owner="admin" style="1" numlevel="1" lineno="493" slineno="10-36" dnum="_-e:i-e" tab="1">
              <display>
                <amend anum="0" ea="amend" pairid="34" style="1" owner="e" level="1" amendtag="start">(i)</amend>
              </display>
              <amend anum="0" ea="amend" pairid="5" style="1" owner="admin" level="1" amendtag="end">an anticipated or pending settlement that may require approval by the Legislature 
                <ln numlevel="1" lineno="494" slineno="10-37"/>or the Legislative Management Committee in accordance with Title 63G, Chapter 
                <ln numlevel="1" lineno="495" slineno="10-38"/>10, State Settlement Agreements Act; or
              </amend>
            </subsection>
            <subsection ssid="10-18" ea="amend" anum="0" owner="admin" style="1" numlevel="1" lineno="496" slineno="10-39" dnum="_-e:ii-e" tab="1">
              <display>
                <amend anum="0" ea="amend" pairid="35" style="1" owner="e" level="1" amendtag="start">(ii)</amend>
              </display>
              <amend anum="0" ea="amend" pairid="8" style="1" owner="admin" level="1" amendtag="end">anticipated or pending litigation in which:</amend>
              <subsection ssid="10-19" ea="amend" anum="0" owner="admin" style="1" numlevel="1" lineno="497" slineno="10-40" dnum="_-e:A-e">
                <display>
                  <amend anum="0" ea="amend" pairid="36" style="1" owner="e" level="1" amendtag="start">(A)</amend>
                </display>
                <amend anum="0" ea="amend" pairid="10" style="1" owner="admin" level="1" amendtag="end">a party challenges the constitutionality of a state law; or</amend>
              </subsection>
              <subsection ssid="10-20" ea="amend" anum="0" owner="admin" style="1" numlevel="1" lineno="498" slineno="10-41" dnum="_-e:B-e">
                <display>
                  <amend anum="0" ea="amend" pairid="37" style="1" owner="e" level="1" amendtag="start">(B)</amend>
                </display>
                <amend anum="0" ea="amend" pairid="13" style="1" owner="admin" level="1" amendtag="end">the state challenges a federal law or regulation.</amend>
              </subsection>

            <amend anum="0" ea="amend" pairid="18" style="1" owner="admin" level="1" amendtag="end">When the Office of the Attorney General discusses or shares with persons within the 
              <ln numlevel="1" lineno="500" slineno="10-43"/>legislative branch documents or information related to cooperative state litigation, the 
              <ln numlevel="1" lineno="501" slineno="10-44"/>sharing is in furtherance of matters of common interest between the represented 
              <ln numlevel="1" lineno="502" slineno="10-45"/>parties.
