    <gdhead lineno="4">General Description:</gdhead>
    <gd numlevel="1" lineno="5" slineno="0-5">This bill modifies provisions relating to the retail sale of electronic cigarettes and other  
      <ln numlevel="1" lineno="6" slineno="0-6"/>nicotine products. 
    </gd>
    <hphead lineno="7">Highlighted Provisions:</hphead>
    <hp numlevel="1" lineno="8" slineno="0-8">This bill:
      <hl numlevel="1" lineno="9" slineno="0-9" level="1">requires the State Tax Commission to report suspected sales of illegal electronic  
        <ln numlevel="1" lineno="10" slineno="0-10"/>cigarette products or nicotine products to the local health department, the Department of  
        <ln numlevel="1" lineno="11" slineno="0-11"/>Health and Human Services, and the Department of Public Safety;
      </hl>
      <hl numlevel="1" lineno="12" slineno="0-12" level="1">requires the local health department to investigate whether the sale is illegal;</hl>
      <hl numlevel="1" lineno="13" slineno="0-13" level="1">requires the State Tax Commission to maintain and publish a list of all persons licensed  
        <ln numlevel="1" lineno="14" slineno="0-14"/>to distribute an electronic cigarette product or a nicotine product in the state;
      </hl>
      <hl numlevel="1" lineno="15" slineno="0-15" level="1">requires an electronic cigarette product or a nicotine product retailer to purchase the  
        <ln numlevel="1" lineno="16" slineno="0-16"/>products from a distributor that is licensed in the state;
      </hl>
      <hl numlevel="1" lineno="17" slineno="0-17" level="1">requires the State Tax Commission to impose a penalty upon a retailer that purchases an  
        <ln numlevel="1" lineno="18" slineno="0-18"/>electronic cigarette product or nicotine product from a person other than a licensed distributor;  
        <ln numlevel="1" lineno="19" slineno="0-19"/>and
      </hl>
      <hl numlevel="1" lineno="20" slineno="0-20" level="1">makes technical and conforming changes.</hl>

        <secline lineno="39">Section 1, Section  
          <bold>26A-1-114</bold> is amended to read:
        </secline>
        <catline lineno="40">
          <bold>26A-1-114. Powers and duties of departments.</bold>
        </catline>
        <subsection ssid="1-1" dnum="1-o" numlevel="1" lineno="41" slineno="1-3" placement="noreturn">
          <display>(1)</display>Subject to Subsections (7), (8), and (11), a local health department may:
          <subsection ssid="1-2" dnum="a-o" numlevel="1" lineno="42" slineno="1-4">
            <display>(a)</display>subject to the provisions in Section  
            <xref depth="3" refnumber="26A-1-108">26A-1-108</xref>, enforce state laws, local ordinances,  
            <ln numlevel="1" lineno="43" slineno="1-5"/>department rules, and local health department standards and regulations relating to  
            <ln numlevel="1" lineno="44" slineno="1-6"/>public health and sanitation, including the plumbing code administered by the  
            <ln numlevel="1" lineno="45" slineno="1-7"/>Division of Professional Licensing under Title 15A, Chapter 1, Part 2, State  
            <ln numlevel="1" lineno="46" slineno="1-8"/>Construction Code Administration Act, and under Title 26B, Chapter 7, Part 4,  
            <ln numlevel="1" lineno="47" slineno="1-9"/>General Sanitation and Food Safety , in all incorporated and unincorporated areas  
            <ln numlevel="1" lineno="48" slineno="1-10"/>served by the local health department;
          </subsection>
          <subsection ssid="1-3" dnum="b-o" numlevel="1" lineno="49" slineno="1-11">
            <display>(b)</display>establish, maintain, and enforce isolation and quarantine, and exercise physical  
            <ln numlevel="1" lineno="50" slineno="1-12"/>control over property and over individuals as the local health department finds  
            <ln numlevel="1" lineno="51" slineno="1-13"/>necessary for the protection of the public health;
          </subsection>
          <subsection ssid="1-4" dnum="c-o" numlevel="1" lineno="52" slineno="1-14">
            <display>(c)</display>establish and maintain medical, environmental, occupational, and other laboratory  
            <ln numlevel="1" lineno="53" slineno="1-15"/>services considered necessary or proper for the protection of the public health;
          </subsection>
          <subsection ssid="1-5" dnum="d-o" numlevel="1" lineno="54" slineno="1-16">
            <display>(d)</display>establish and operate reasonable health programs or measures not in conflict with  
            <ln numlevel="1" lineno="55" slineno="1-17"/>state law which:
            <subsection ssid="1-6" dnum="i-o" numlevel="1" lineno="56" slineno="1-18">
              <display>(i)</display>are necessary or desirable for the promotion or protection of the public health and  
              <ln numlevel="1" lineno="57" slineno="1-19"/>the control of disease; or
            </subsection>
            <subsection ssid="1-7" dnum="ii-o" numlevel="1" lineno="58" slineno="1-20">
              <display>(ii)</display>may be necessary to ameliorate the major risk factors associated with the major  
              <ln numlevel="1" lineno="59" slineno="1-21"/>causes of injury, sickness, death, and disability in the state;
            </subsection>
          </subsection>
          <subsection ssid="1-8" dnum="e-o" numlevel="1" lineno="60" slineno="1-22">
            <display>(e)</display>close theaters, schools, and other public places and prohibit gatherings of people  
            <ln numlevel="1" lineno="61" slineno="1-23"/>when necessary to protect the public health;
          </subsection>
          <subsection ssid="1-9" dnum="f-o" numlevel="1" lineno="62" slineno="1-24">
            <display>(f)</display>abate nuisances or eliminate sources of filth and infectious and communicable  
            <ln numlevel="1" lineno="63" slineno="1-25"/>diseases affecting the public health and bill the owner or other person in charge of the  
            <ln numlevel="1" lineno="64" slineno="1-26"/>premises upon which this nuisance occurs for the cost of abatement;
          </subsection>
          <subsection ssid="1-10" dnum="g-o" numlevel="1" lineno="65" slineno="1-27">
            <display>(g)</display>make necessary sanitary and health investigations and inspections on the local health  
            <ln numlevel="1" lineno="66" slineno="1-28"/>department's own initiative or in cooperation with the Department of Health and  
            <ln numlevel="1" lineno="67" slineno="1-29"/>Human Services or the Department of Environmental Quality, or both, as to any  
            <ln numlevel="1" lineno="68" slineno="1-30"/>matters affecting the public health;
          </subsection>
          <subsection ssid="1-11" dnum="h-o" numlevel="1" lineno="69" slineno="1-31">
            <display>(h)</display>pursuant to county ordinance or interlocal agreement:
            <subsection ssid="1-12" dnum="i-o" numlevel="1" lineno="70" slineno="1-32">
              <display>(i)</display>establish and collect appropriate fees for the performance of services and  
              <ln numlevel="1" lineno="71" slineno="1-33"/>operation of authorized or required programs and duties;
            </subsection>
            <subsection ssid="1-13" dnum="ii-o" numlevel="1" lineno="72" slineno="1-34">
              <display>(ii)</display>accept, use, and administer all federal, state, or private donations or grants of  
              <ln numlevel="1" lineno="73" slineno="1-35"/>funds, property, services, or materials for public health purposes; and
            </subsection>
            <subsection ssid="1-14" dnum="iii-o" numlevel="1" lineno="74" slineno="1-36">
              <display>(iii)</display>make agreements not in conflict with state law which are conditional to receiving  
              <ln numlevel="1" lineno="75" slineno="1-37"/>a donation or grant;
            </subsection>
          </subsection>
          <subsection ssid="1-15" dnum="i-o" numlevel="1" lineno="76" slineno="1-38">
            <display>(i)</display>prepare, publish, and disseminate information necessary to inform and advise the  
            <ln numlevel="1" lineno="77" slineno="1-39"/>public concerning:
            <subsection ssid="1-16" dnum="i-o" numlevel="1" lineno="78" slineno="1-40">
              <display>(i)</display>the health and wellness of the population, specific hazards, and risk factors that  
              <ln numlevel="1" lineno="79" slineno="1-41"/>may adversely affect the health and wellness of the population; and
            </subsection>
            <subsection ssid="1-17" dnum="ii-o" numlevel="1" lineno="80" slineno="1-42">
              <display>(ii)</display>specific activities individuals and institutions can engage in to promote and  
              <ln numlevel="1" lineno="81" slineno="1-43"/>protect the health and wellness of the population;
            </subsection>
          </subsection>
          <subsection ssid="1-18" dnum="j-o" numlevel="1" lineno="82" slineno="1-44">
            <display>(j)</display>investigate the causes of morbidity and mortality;
          </subsection>
          <subsection ssid="1-19" dnum="k-o" numlevel="1" lineno="83" slineno="1-45">
            <display>(k)</display>issue notices and orders necessary to carry out this part;
          </subsection>
          <subsection ssid="1-20" dnum="l-o" numlevel="1" lineno="84" slineno="1-46">
            <display>(l)</display>conduct studies to identify injury problems, establish injury control systems, develop  
            <ln numlevel="1" lineno="85" slineno="1-47"/>standards for the correction and prevention of future occurrences, and provide public  
            <ln numlevel="1" lineno="86" slineno="1-48"/>information and instruction to special high risk groups;
          </subsection>
          <subsection ssid="1-21" dnum="m-o" numlevel="1" lineno="87" slineno="1-49">
            <display>(m)</display>cooperate with boards created under Section  
            <xref depth="3" refnumber="19-1-106">19-1-106</xref> to enforce laws and rules  
            <ln numlevel="1" lineno="88" slineno="1-50"/>within the jurisdiction of the boards;
          </subsection>
          <subsection ssid="1-22" dnum="n-o" numlevel="1" lineno="89" slineno="1-51">
            <display>(n)</display>cooperate with the state health department, the Department of Corrections, the  
            <ln numlevel="1" lineno="90" slineno="1-52"/>Administrative Office of the Courts, the Division of Juvenile Justice and Youth  
            <ln numlevel="1" lineno="91" slineno="1-53"/>Services, and the Crime Victim Reparations Board to conduct testing for HIV  
            <ln numlevel="1" lineno="92" slineno="1-54"/>infection of alleged sexual offenders, convicted sexual offenders, and any victims of  
            <ln numlevel="1" lineno="93" slineno="1-55"/>a sexual offense;
          </subsection>
          <subsection ssid="1-23" dnum="o-o" numlevel="1" lineno="94" slineno="1-56">
            <display>(o)</display>investigate suspected bioterrorism and disease pursuant to Section  
            <xref depth="3" refnumber="26B-7-321">26B-7-321</xref>; and
          </subsection>
          <subsection ssid="1-24" dnum="p-o" numlevel="1" lineno="95" slineno="1-57">
            <display>(p)</display>provide public health assistance in response to a national, state, or local emergency, a  
            <ln numlevel="1" lineno="96" slineno="1-58"/>public health emergency as defined in Section  
            <xref depth="3" refnumber="26B-7-301">26B-7-301</xref>, or a declaration by the  
            <ln numlevel="1" lineno="97" slineno="1-59"/>President of the United States or other federal official requesting public health-related  
            <ln numlevel="1" lineno="98" slineno="1-60"/>activities.
          </subsection>
        </subsection>
        <subsection ssid="1-25" dnum="2-o" numlevel="1" lineno="99" slineno="1-61">
          <display>(2)</display>The local health department shall:
          <subsection ssid="1-26" dnum="a-o" numlevel="1" lineno="100" slineno="1-62">
            <display>(a)</display>establish programs or measures to promote and protect the health and general  
            <ln numlevel="1" lineno="101" slineno="1-63"/>wellness of the people within the boundaries of the local health department;
          </subsection>
          <subsection ssid="1-27" dnum="b-o" numlevel="1" lineno="102" slineno="1-64">
            <display>(b)</display>investigate infectious and other diseases of public health importance and implement  
            <ln numlevel="1" lineno="103" slineno="1-65"/>measures to control the causes of epidemic and communicable diseases and other  
            <ln numlevel="1" lineno="104" slineno="1-66"/>conditions significantly affecting the public health which may include involuntary  
            <ln numlevel="1" lineno="105" slineno="1-67"/>testing of alleged sexual offenders for the HIV infection pursuant to Section  
            <xref depth="3" refnumber="53-10-802">
              <ln numlevel="1" lineno="106" slineno="1-68"/>53-10-802
            </xref>  and voluntary testing of victims of sexual offenses for HIV infection  
            <ln numlevel="1" lineno="107" slineno="1-69"/>pursuant to Section  
            <xref depth="3" refnumber="53-10-803">53-10-803</xref>;
          </subsection>
          <subsection ssid="1-28" dnum="c-o" numlevel="1" lineno="108" slineno="1-70">
            <display>(c)</display>cooperate with the department in matters pertaining to the public health and in the  
            <ln numlevel="1" lineno="109" slineno="1-71"/>administration of state health laws;

            <amend anum="0" ea="erase" pairid="1" style="2" owner="avarthur" level="1" deltag="end">and</amend>

          </subsection>
          <subsection ssid="1-29" dnum="d-o" numlevel="1" lineno="110" slineno="1-72">
            <display>(d)</display>coordinate implementation of environmental programs to maximize efficient use of  
            <ln numlevel="1" lineno="111" slineno="1-73"/>resources by developing with the Department of Environmental Quality a  
            <ln numlevel="1" lineno="112" slineno="1-74"/>Comprehensive Environmental Service Delivery Plan which:
            <subsection ssid="1-30" dnum="i-o" numlevel="1" lineno="113" slineno="1-75">
              <display>(i)</display>recognizes that the Department of Environmental Quality and local health  
              <ln numlevel="1" lineno="114" slineno="1-76"/>departments are the foundation for providing environmental health programs in  
              <ln numlevel="1" lineno="115" slineno="1-77"/>the state;
            </subsection>
            <subsection ssid="1-31" dnum="ii-o" numlevel="1" lineno="116" slineno="1-78">
              <display>(ii)</display>delineates the responsibilities of the department and each local health department  
              <ln numlevel="1" lineno="117" slineno="1-79"/>for the efficient delivery of environmental programs using federal, state, and local  
              <ln numlevel="1" lineno="118" slineno="1-80"/>authorities, responsibilities, and resources;
            </subsection>
            <subsection ssid="1-32" dnum="iii-o" numlevel="1" lineno="119" slineno="1-81">
              <display>(iii)</display>provides for the delegation of authority and pass through of funding to local  
              <ln numlevel="1" lineno="120" slineno="1-82"/>health departments for environmental programs, to the extent allowed by  
              <ln numlevel="1" lineno="121" slineno="1-83"/>applicable law, identified in the plan, and requested by the local health  
              <ln numlevel="1" lineno="122" slineno="1-84"/>department; and
            </subsection>
            <subsection ssid="1-33" dnum="iv-o" numlevel="1" lineno="123" slineno="1-85">
              <display>(iv)</display>is reviewed and updated annually
              <amendoutstart style="5"/>

              <amend anum="0" ea="amend" pairid="3" style="1" owner="avarthur" level="1" amendtag="both" space="true">; and</amend>
            </subsection>
          </subsection>
          <subsection ssid="1-34" dnum="_-o:e-e" ea="amend" anum="0" owner="avarthur" style="1" numlevel="1" lineno="124" slineno="1-86">
            <display>
              <amend anum="0" ea="amend" pairid="40" style="1" owner="e" level="1" amendtag="start">(e)</amend>
            </display>
            <amend anum="0" ea="amend" pairid="5" style="1" owner="avarthur" level="1" amendtag="end">investigate a report made in accordance with Section  
              <xref depth="3" refnumber="59-14-810">59-14-810</xref> to determine  
              <ln numlevel="1" lineno="125" slineno="1-87"/>whether a product is sold in violation of law.
            </amend>
          </subsection>
        </subsection>
        <subsection ssid="1-35" dnum="3-o" numlevel="1" lineno="126" slineno="1-88">
          <display>(3)</display>The local health department has the following duties regarding public and private  
          <ln numlevel="1" lineno="127" slineno="1-89"/>schools within the local health department's boundaries:
          <subsection ssid="1-36" dnum="a-o" numlevel="1" lineno="128" slineno="1-90">
            <display>(a)</display>enforce all ordinances, standards, and regulations pertaining to the public health of  
            <ln numlevel="1" lineno="129" slineno="1-91"/>persons attending public and private schools;
          </subsection>
          <subsection ssid="1-37" dnum="b-o" numlevel="1" lineno="130" slineno="1-92">
            <display>(b)</display>exclude from school attendance any person, including teachers, who is suffering  
            <ln numlevel="1" lineno="131" slineno="1-93"/>from any communicable or infectious disease, whether acute or chronic, if the person  
            <ln numlevel="1" lineno="132" slineno="1-94"/>is likely to convey the disease to those in attendance; and
          </subsection>
          <subsection ssid="1-38" dnum="c-o" numlevel="1" lineno="133" slineno="1-95" space="false">
            <display>(c)</display>
            <subsection ssid="1-39" dnum="i-o" placement="sameline">
              <display>(i)</display>make regular inspections of the health-related condition of all school buildings 
              <ln numlevel="1" lineno="134" slineno="1-96"/>and premises;
            </subsection>
            <subsection ssid="1-40" dnum="ii-o" numlevel="1" lineno="135" slineno="1-97">
              <display>(ii)</display>report the inspections on forms furnished by the department to those responsible 
              <ln numlevel="1" lineno="136" slineno="1-98"/>for the condition and provide instructions for correction of any conditions that 
              <ln numlevel="1" lineno="137" slineno="1-99"/>impair or endanger the health or life of those attending the schools; and
            </subsection>
            <subsection ssid="1-41" dnum="iii-o" numlevel="1" lineno="138" slineno="1-100">
              <display>(iii)</display>provide a copy of the report to the department at the time the report is made.
            </subsection>
          </subsection>
        </subsection>
        <subsection ssid="1-42" dnum="4-o" numlevel="1" lineno="139" slineno="1-101">
          <display>(4)</display>If those responsible for the health-related condition of the school buildings and premises  
          <ln numlevel="1" lineno="140" slineno="1-102"/>do not carry out any instructions for corrections provided in a report in Subsection  
          <ln numlevel="1" lineno="141" slineno="1-103"/>(3)(c), the local health board shall cause the conditions to be corrected at the expense of  
          <ln numlevel="1" lineno="142" slineno="1-104"/>the persons responsible.
        </subsection>
        <subsection ssid="1-43" dnum="5-o" numlevel="1" lineno="143" slineno="1-105">
          <display>(5)</display>The local health department may exercise incidental authority as necessary to carry out  
          <ln numlevel="1" lineno="144" slineno="1-106"/>the provisions and purposes of this part.
        </subsection>
        <subsection ssid="1-44" dnum="6-o" numlevel="1" lineno="145" slineno="1-107">
          <display>(6)</display>Nothing in this part may be construed to authorize a local health department to enforce  
          <ln numlevel="1" lineno="146" slineno="1-108"/>an ordinance, rule, or regulation requiring the installation or maintenance of a carbon  
          <ln numlevel="1" lineno="147" slineno="1-109"/>monoxide detector in a residential dwelling against anyone other than the occupant of  
          <ln numlevel="1" lineno="148" slineno="1-110"/>the dwelling.
        </subsection>
        <subsection ssid="1-45" dnum="7-o" numlevel="1" lineno="149" slineno="1-111" space="false">
          <display>(7)</display>
          <subsection ssid="1-46" dnum="a-o" placement="sameline">
            <display>(a)</display>Except as provided in Subsection (7)(c), a local health department may not 
            <ln numlevel="1" lineno="150" slineno="1-112"/>declare a public health emergency or issue an order of constraint until the local health 
            <ln numlevel="1" lineno="151" slineno="1-113"/>department has provided notice of the proposed action to the chief executive officer 
            <ln numlevel="1" lineno="152" slineno="1-114"/>of the relevant county no later than 24 hours before the local health department issues 
            <ln numlevel="1" lineno="153" slineno="1-115"/>the order or declaration.
          </subsection>
          <subsection ssid="1-47" dnum="b-o" numlevel="1" lineno="154" slineno="1-116">
            <display>(b)</display>The local health department:
            <subsection ssid="1-48" dnum="i-o" numlevel="1" lineno="155" slineno="1-117">
              <display>(i)</display>shall provide the notice required by Subsection (7)(a) using the best available 
              <ln numlevel="1" lineno="156" slineno="1-118"/>method under the circumstances as determined by the local health department;
            </subsection>
            <subsection ssid="1-49" dnum="ii-o" numlevel="1" lineno="157" slineno="1-119">
              <display>(ii)</display>may provide the notice required by Subsection (7)(a) in electronic format; and
            </subsection>
            <subsection ssid="1-50" dnum="iii-o" numlevel="1" lineno="158" slineno="1-120">
              <display>(iii)</display>shall provide the notice in written form, if practicable.
            </subsection>
          </subsection>
          <subsection ssid="1-51" dnum="c-o" numlevel="1" lineno="159" slineno="1-121" space="false">
            <display>(c)</display>
            <subsection ssid="1-52" dnum="i-o" placement="sameline">
              <display>(i)</display>Notwithstanding Subsection (7)(a), a local health department may declare a 
              <ln numlevel="1" lineno="160" slineno="1-122"/>public health emergency or issue an order of constraint without approval of the 
              <ln numlevel="1" lineno="161" slineno="1-123"/>chief executive officer of the relevant county if the passage of time necessary to 
              <ln numlevel="1" lineno="162" slineno="1-124"/>obtain approval of the chief executive officer of the relevant county as required in 
              <ln numlevel="1" lineno="163" slineno="1-125"/>Subsection (7)(a) would substantially increase the likelihood of loss of life due to 
              <ln numlevel="1" lineno="164" slineno="1-126"/>an imminent threat.
            </subsection>
            <subsection ssid="1-53" dnum="ii-o" numlevel="1" lineno="165" slineno="1-127">
              <display>(ii)</display>If a local health department declares a public health emergency or issues an order 
              <ln numlevel="1" lineno="166" slineno="1-128"/>of constraint as described in Subsection (7)(c)(i), the local health department shall 
              <ln numlevel="1" lineno="167" slineno="1-129"/>notify the chief executive officer of the relevant county before issuing the order of 
              <ln numlevel="1" lineno="168" slineno="1-130"/>constraint.
            </subsection>
            <subsection ssid="1-54" dnum="iii-o" numlevel="1" lineno="169" slineno="1-131">
              <display>(iii)</display>The chief executive officer of the relevant county may terminate a declaration of 
              <ln numlevel="1" lineno="170" slineno="1-132"/>a public health emergency or an order of constraint issued as described in 
              <ln numlevel="1" lineno="171" slineno="1-133"/>Subsection (7)(c)(i) within 72 hours of declaration of the public health emergency 
              <ln numlevel="1" lineno="172" slineno="1-134"/>or issuance of the order of constraint.
            </subsection>
          </subsection>
          <subsection ssid="1-55" dnum="d-o" numlevel="1" lineno="173" slineno="1-135" space="false">
            <display>(d)</display>
            <subsection ssid="1-56" dnum="i-o" placement="sameline">
              <display>(i)</display>The relevant county governing body may at any time terminate a public health 
              <ln numlevel="1" lineno="174" slineno="1-136"/>emergency or an order of constraint issued by the local health department by 
              <ln numlevel="1" lineno="175" slineno="1-137"/>majority vote of the county governing body in response to a declared public health 
              <ln numlevel="1" lineno="176" slineno="1-138"/>emergency.
            </subsection>
            <subsection ssid="1-57" dnum="ii-o" numlevel="1" lineno="177" slineno="1-139">
              <display>(ii)</display>A vote by the relevant county governing body to terminate a public health 
              <ln numlevel="1" lineno="178" slineno="1-140"/>emergency or an order of constraint as described in Subsection (7)(d)(i) is not 
              <ln numlevel="1" lineno="179" slineno="1-141"/>subject to veto by the relevant chief executive officer.
            </subsection>
          </subsection>
        </subsection>
        <subsection ssid="1-58" dnum="8-o" numlevel="1" lineno="180" slineno="1-142" space="false">

          <subsection ssid="1-59" dnum="a-o" placement="sameline">
            <display>(a)</display>Except as provided in Subsection (8)(b), a public health emergency declared by a 
            <ln numlevel="1" lineno="181" slineno="1-143"/>local health department expires at the earliest of:
            <subsection ssid="1-60" dnum="i-o" numlevel="1" lineno="182" slineno="1-144" tab="1">
              <display>(i)</display>the local health department or the chief executive officer of the relevant county

          <subsection ssid="1-63" dnum="b-o" numlevel="1" lineno="189" slineno="1-151" space="false">
            <display>(b)</display>
            <subsection ssid="1-64" dnum="i-o" placement="sameline">
              <display>(i)</display>The relevant county legislative body, by majority vote, may extend a public 
              <ln numlevel="1" lineno="190" slineno="1-152"/>health emergency for a time period designated by the county legislative body.
            </subsection>
            <subsection ssid="1-65" dnum="ii-o" numlevel="1" lineno="191" slineno="1-153">
              <display>(ii)</display>If the county legislative body extends a public health emergency as described in 
              <ln numlevel="1" lineno="192" slineno="1-154"/>Subsection (8)(b)(i), the public health emergency expires on the date designated 
              <ln numlevel="1" lineno="193" slineno="1-155"/>by the county legislative body.
            </subsection>
          </subsection>
          <subsection ssid="1-66" dnum="c-o" numlevel="1" lineno="194" slineno="1-156">
            <display>(c)</display>Except as provided in Subsection (8)(d), if a public health emergency declared by a 
            <ln numlevel="1" lineno="195" slineno="1-157"/>local health department expires as described in Subsection (8)(a), the local health 
            <ln numlevel="1" lineno="196" slineno="1-158"/>department may not declare a public health emergency for the same illness or 
            <ln numlevel="1" lineno="197" slineno="1-159"/>occurrence that precipitated the previous public health emergency declaration.
          </subsection>
          <subsection ssid="1-67" dnum="d-o" numlevel="1" lineno="198" slineno="1-160" space="false">
            <display>(d)</display>
            <subsection ssid="1-68" dnum="i-o" placement="sameline">
              <display>(i)</display>Notwithstanding Subsection (8)(c), subject to Subsection (8)(f), if the local 
              <ln numlevel="1" lineno="199" slineno="1-161"/>health department finds that exigent circumstances exist, after providing notice to 
              <ln numlevel="1" lineno="200" slineno="1-162"/>the county legislative body, the department may declare a new public health 
              <ln numlevel="1" lineno="201" slineno="1-163"/>emergency for the same illness or occurrence that precipitated a previous public 
              <ln numlevel="1" lineno="202" slineno="1-164"/>health emergency declaration.
            </subsection>
            <subsection ssid="1-69" dnum="ii-o" numlevel="1" lineno="203" slineno="1-165">
              <display>(ii)</display>A public health emergency declared as described in Subsection (8)(d)(i) expires 
              <ln numlevel="1" lineno="204" slineno="1-166"/>in accordance with Subsection (8)(a) or (b).
            </subsection>
          </subsection>
          <subsection ssid="1-70" dnum="e-o" numlevel="1" lineno="205" slineno="1-167">
            <display>(e)</display>For a public health emergency declared by a local health department under this 
            <ln numlevel="1" lineno="206" slineno="1-168"/>chapter or under Title 26B, Chapter 7, Part 3, Treatment, Isolation, and Quarantine 
            <ln numlevel="1" lineno="207" slineno="1-169"/>Procedures for Communicable Diseases, the Legislature may terminate by joint 
            <ln numlevel="1" lineno="208" slineno="1-170"/>resolution a public health emergency that was declared based on exigent 
            <ln numlevel="1" lineno="209" slineno="1-171"/>circumstances or that has been in effect for more than 30 days.
          </subsection>
          <subsection ssid="1-71" dnum="f-o" numlevel="1" lineno="210" slineno="1-172">
            <display>(f)</display>If the Legislature or county legislative body terminates a public health emergency 
            <ln numlevel="1" lineno="211" slineno="1-173"/>declared due to exigent circumstances as described in Subsection (8)(d)(i), the local 
            <ln numlevel="1" lineno="212" slineno="1-174"/>health department may not declare a new public health emergency for the same 
            <ln numlevel="1" lineno="213" slineno="1-175"/>illness, occurrence, or exigent circumstances.
          </subsection>
        </subsection>
        <subsection ssid="1-72" dnum="9-o" numlevel="1" lineno="214" slineno="1-176" space="false">
          <display>(9)</display>
          <subsection ssid="1-73" dnum="a-o" placement="sameline">
            <display>(a)</display>During a public health emergency declared under this chapter or under Title 26B, 
            <ln numlevel="1" lineno="215" slineno="1-177"/>Chapter 7, Part 3, Treatment, Isolation, and Quarantine Procedures for 
            <ln numlevel="1" lineno="216" slineno="1-178"/>Communicable Diseases:
            <subsection ssid="1-74" dnum="i-o" numlevel="1" lineno="217" slineno="1-179" tab="1">
              <display>(i)</display>except as provided in Subsection (9)(b), a local health department may not issue 
              <ln numlevel="1" lineno="218" slineno="1-180"/>an order of constraint without approval of the chief executive officer of the 
              <ln numlevel="1" lineno="219" slineno="1-181"/>relevant county;
            </subsection>
            <subsection ssid="1-75" dnum="ii-o" numlevel="1" lineno="220" slineno="1-182" tab="1">
              <display>(ii)</display>the Legislature may at any time terminate by joint resolution an order of 
              <ln numlevel="1" lineno="221" slineno="1-183"/>constraint issued by a local health department in response to a declared public 
              <ln numlevel="1" lineno="222" slineno="1-184"/>health emergency that has been in effect for more than 30 days; and
            </subsection>
            <subsection ssid="1-76" dnum="iii-o" numlevel="1" lineno="223" slineno="1-185" tab="1">
              <display>(iii)</display>a county governing body may at any time terminate by majority vote of the 
              <ln numlevel="1" lineno="224" slineno="1-186"/>governing body an order of constraint issued by a local health department in 
              <ln numlevel="1" lineno="225" slineno="1-187"/>response to a declared public health emergency.
            </subsection>
          </subsection>
          <subsection ssid="1-77" dnum="b-o" numlevel="1" lineno="226" slineno="1-188" space="false">
            <display>(b)</display>
            <subsection ssid="1-78" dnum="i-o" placement="sameline">
              <display>(i)</display>Notwithstanding Subsection (9)(a)(i), a local health department may issue an 
              <ln numlevel="1" lineno="227" slineno="1-189"/>order of constraint without approval of the chief executive officer of the relevant 
              <ln numlevel="1" lineno="228" slineno="1-190"/>county if the passage of time necessary to obtain approval of the chief executive 
              <ln numlevel="1" lineno="229" slineno="1-191"/>officer of the relevant county as required in Subsection (9)(a)(i) would 
              <ln numlevel="1" lineno="230" slineno="1-192"/>substantially increase the likelihood of loss of life due to an imminent threat.
            </subsection>
            <subsection ssid="1-79" dnum="ii-o" numlevel="1" lineno="231" slineno="1-193">
              <display>(ii)</display>If a local health department issues an order of constraint as described in 
              <ln numlevel="1" lineno="232" slineno="1-194"/>Subsection (9)(b), the local health department shall notify the chief executive 
              <ln numlevel="1" lineno="233" slineno="1-195"/>officer of the relevant county before issuing the order of constraint.
            </subsection>
            <subsection ssid="1-80" dnum="iii-o" numlevel="1" lineno="234" slineno="1-196">
              <display>(iii)</display>The chief executive officer of the relevant county may terminate an order of 
              <ln numlevel="1" lineno="235" slineno="1-197"/>constraint issued as described in Subsection (9)(b) within 72 hours of issuance of 
              <ln numlevel="1" lineno="236" slineno="1-198"/>the order of constraint.
            </subsection>
          </subsection>
          <subsection ssid="1-81" dnum="c-o" numlevel="1" lineno="237" slineno="1-199" space="false">
            <display>(c)</display>
            <subsection ssid="1-82" dnum="i-o" placement="sameline">
              <display>(i)</display>For a local health department that serves more than one county, the approval 
              <ln numlevel="1" lineno="238" slineno="1-200"/>described in Subsection (9)(a)(i) is required for the chief executive officer for 
              <ln numlevel="1" lineno="239" slineno="1-201"/>which the order of constraint is applicable.
            </subsection>
            <subsection ssid="1-83" dnum="ii-o" numlevel="1" lineno="240" slineno="1-202">
              <display>(ii)</display>For a local health department that serves more than one county, a county 
              <ln numlevel="1" lineno="241" slineno="1-203"/>governing body may only terminate an order of constraint as described in 
              <ln numlevel="1" lineno="242" slineno="1-204"/>Subsection (9)(a)(iii) for the county served by the county governing body.
            </subsection>
          </subsection>
        </subsection>
        <subsection ssid="1-84" dnum="10-o" numlevel="1" lineno="243" slineno="1-205" space="false">
          <display>(10)</display>
          <subsection ssid="1-85" dnum="a-o" placement="sameline">
            <display>(a)</display>During a public health emergency declared as described in this title:
            <subsection ssid="1-86" dnum="i-o" numlevel="1" lineno="244" slineno="1-206" tab="1">
              <display>(i)</display>the department or a local health department may not impose an order of constraint 
              <ln numlevel="1" lineno="245" slineno="1-207"/>on a religious gathering that is more restrictive than an order of constraint that 
              <ln numlevel="1" lineno="246" slineno="1-208"/>applies to any other relevantly similar gathering; and
            </subsection>
            <subsection ssid="1-87" dnum="ii-o" numlevel="1" lineno="247" slineno="1-209" tab="1">
              <display>(ii)</display>an individual, while acting or purporting to act within the course and scope of the 
              <ln numlevel="1" lineno="248" slineno="1-210"/>individual's official department or local health department capacity, may not:
              <subsection ssid="1-88" dnum="A-o" numlevel="1" lineno="249" slineno="1-211">
                <display>(A)</display>prevent a religious gathering that is held in a manner consistent with any order 
                <ln numlevel="1" lineno="250" slineno="1-212"/>of constraint issued pursuant to this title; or
              </subsection>
              <subsection ssid="1-89" dnum="B-o" numlevel="1" lineno="251" slineno="1-213">
                <display>(B)</display>impose a penalty for a previous religious gathering that was held in a manner 
                <ln numlevel="1" lineno="252" slineno="1-214"/>consistent with any order of constraint issued pursuant to this title.
              </subsection>
            </subsection>
          </subsection>
          <subsection ssid="1-90" dnum="b-o" numlevel="1" lineno="253" slineno="1-215">
            <display>(b)</display>Upon proper grounds, a court of competent jurisdiction may grant an injunction to 
            <ln numlevel="1" lineno="254" slineno="1-216"/>prevent the violation of this Subsection (10).
          </subsection>
          <subsection ssid="1-91" dnum="c-o" numlevel="1" lineno="255" slineno="1-217">
            <display>(c)</display>During a public health emergency declared as described in this title, the department 
            <ln numlevel="1" lineno="256" slineno="1-218"/>or a local health department shall not issue a public health order or impose or 
            <ln numlevel="1" lineno="257" slineno="1-219"/>implement a regulation that substantially burdens an individual's exercise of religion 
            <ln numlevel="1" lineno="258" slineno="1-220"/>unless the department or local health department demonstrates that the application of 
            <ln numlevel="1" lineno="259" slineno="1-221"/>the burden to the individual:
            <subsection ssid="1-92" dnum="i-o" numlevel="1" lineno="260" slineno="1-222">
              <display>(i)</display>is in furtherance of a compelling government interest; and
            </subsection>
            <subsection ssid="1-93" dnum="ii-o" numlevel="1" lineno="261" slineno="1-223">
              <display>(ii)</display>is the least restrictive means of furthering that compelling government interest.
            </subsection>
          </subsection>
          <subsection ssid="1-94" dnum="d-o" numlevel="1" lineno="262" slineno="1-224">
            <display>(d)</display>Notwithstanding Subsections (8)(a) and (c), the department or a local health 
            <ln numlevel="1" lineno="263" slineno="1-225"/>department shall allow reasonable accommodations for an individual to perform or 
            <ln numlevel="1" lineno="264" slineno="1-226"/>participate in a religious practice or rite.
          </subsection>
        </subsection>
        <subsection ssid="1-95" dnum="11-o" numlevel="1" lineno="265" slineno="1-227">
          <display>(11)</display>An order of constraint issued by a local health department pursuant to a declared  
          <ln numlevel="1" lineno="266" slineno="1-228"/>public health emergency does not apply to a facility, property, or area owned or leased  
          <ln numlevel="1" lineno="267" slineno="1-229"/>by the state, including the capitol hill complex, as that term is defined in Section  
          <xref depth="3" refnumber="63C-9-102">
            <ln numlevel="1" lineno="268" slineno="1-230"/>63C-9-102
          </xref>.
        </subsection>
        <subsection ssid="1-96" dnum="12-o" numlevel="1" lineno="269" slineno="1-231">
          <display>(12)</display>A local health department may not:
          <subsection ssid="1-97" dnum="a-o" numlevel="1" lineno="270" slineno="1-232">
            <display>(a)</display>require a person to obtain an inspection, license, or permit from the local health  
            <ln numlevel="1" lineno="271" slineno="1-233"/>department to engage in a practice described in Subsection  
            <xref depth="3" refnumber="58-11a-304">58-11a-304</xref>(5); or
          </subsection>
          <subsection ssid="1-98" dnum="b-o" numlevel="1" lineno="272" slineno="1-234">
            <display>(b)</display>prevent or limit a person's ability to engage in a practice described in Subsection

            <subsection ssid="1-99" dnum="i-o" numlevel="1" lineno="274" slineno="1-236">
              <display>(i)</display>requiring the person to engage in the practice at a specific location or at a  
              <ln numlevel="1" lineno="275" slineno="1-237"/>particular type of facility or location; or
            </subsection>
            <subsection ssid="1-100" dnum="ii-o" numlevel="1" lineno="276" slineno="1-238">
              <display>(ii)</display>enforcing a regulation applicable to a facility or location where the person  
              <ln numlevel="1" lineno="277" slineno="1-239"/>chooses to engage in the practice.
            </subsection>

            <ln numlevel="1" lineno="297" slineno="3-4"/>is being sold in the state in violation of a law other than a law described in this part,  
            <ln numlevel="1" lineno="298" slineno="3-5"/>the commission shall report the name of the seller, the type of product, and the  
            <ln numlevel="1" lineno="299" slineno="3-6"/>county where the product was sold:
