    <gdhead lineno="4">General Description:</gdhead>
    <gd numlevel="1" lineno="5" slineno="0-5">This bill amends and enacts provisions related to pharmacists and pharmacies.</gd>
    <hphead lineno="6">Highlighted Provisions:</hphead>
    <hp numlevel="1" lineno="7" slineno="0-7">This bill:
      <hl numlevel="1" lineno="8" slineno="0-8" level="1">makes technical corrections;</hl>
      <hl numlevel="1" lineno="9" slineno="0-9" level="1">defines "written communication";</hl>
      <hl numlevel="1" lineno="10" slineno="0-10" level="1">for a pharmacy other than a class D pharmacy, requires the pharmacist-in-charge, and  
        <ln numlevel="1" lineno="11" slineno="0-11"/>not each manager, to submit fingerprint cards and consent to a fingerprint background check;
      </hl>
      <hl numlevel="1" lineno="12" slineno="0-12" level="1">grants limited rulemaking authority to the Division of Professional Licensing to  
        <ln numlevel="1" lineno="13" slineno="0-13"/>prescribe a method by which a pharmacy may update the address registered to a pharmacy's  
        <ln numlevel="1" lineno="14" slineno="0-14"/>license;
      </hl>
      <hl numlevel="1" lineno="15" slineno="0-15" level="1">under certain conditions, allows a hospital pharmacy to dispense a limited supply of a  
        <ln numlevel="1" lineno="16" slineno="0-16"/>prescription drug to an individual who is no longer a patient in the hospital;
      </hl>
      <hl numlevel="1" lineno="17" slineno="0-17" level="1">modifies provisions governing patient counseling;</hl>
      <hl numlevel="1" lineno="18" slineno="0-18" level="1">allows for the delivery of medication guides and medication package inserts via written  
        <ln numlevel="1" lineno="19" slineno="0-19"/>communication, as defined;
      </hl>
      <hl numlevel="1" lineno="20" slineno="0-20" level="1">permits a pharmacy to update the address registered to a pharmacy's license, if there has  
        <ln numlevel="1" lineno="21" slineno="0-21"/>been no change in the underlying ownership or control of the pharmacy;
      </hl>
      <hl numlevel="1" lineno="22" slineno="0-22" level="1">modifies requirements related to pharmacy audits; and</hl>
      <hl numlevel="1" lineno="23" slineno="0-23" level="1">applies the provisions of Title 58, Chapter 88, Part 2, Dispensing Practice, to a physician  
        <ln numlevel="1" lineno="24" slineno="0-24"/>who dispenses a prescription drug or device to a patient for the patient's immediate needs,  
        <ln numlevel="1" lineno="25" slineno="0-25"/>subject to conditions.

          <bold>58-17b-102</bold> is amended to read:

          <bold>58-17b-102. Definitions.</bold>
        </catline>

          <tab/>In addition to the definitions in Section  
          <xref depth="3" refnumber="58-1-102">58-1-102</xref>, as used in this chapter:
        </sectionText>
        <subsection ssid="1-1" numlevel="1" lineno="47" slineno="1-4" dnum="1-o">
          <display>(1)</display>"Administering" means:
          <subsection ssid="1-2" numlevel="1" lineno="48" slineno="1-5" dnum="a-o">
            <display>(a)</display>the direct application of a prescription drug or device, whether by injection,  
            <ln numlevel="1" lineno="49" slineno="1-6"/>inhalation, ingestion, or by any other means, to the body of a human patient or  
            <ln numlevel="1" lineno="50" slineno="1-7"/>research subject by another person; or
          </subsection>
          <subsection ssid="1-3" numlevel="1" lineno="51" slineno="1-8" dnum="b-o">
            <display>(b)</display>the placement by a veterinarian with the owner or caretaker of an animal or group of  
            <ln numlevel="1" lineno="52" slineno="1-9"/>animals of a prescription drug for the purpose of injection, inhalation, ingestion, or  
            <ln numlevel="1" lineno="53" slineno="1-10"/>any other means directed to the body of the animal by the owner or caretaker in  
            <ln numlevel="1" lineno="54" slineno="1-11"/>accordance with written or verbal directions of the veterinarian.
          </subsection>
        </subsection>
        <subsection ssid="1-4" numlevel="1" lineno="55" slineno="1-12" dnum="2-o">
          <display>(2)</display>"Adulterated drug or device" means a drug or device considered adulterated under 21  
          <ln numlevel="1" lineno="56" slineno="1-13"/>U.S.C. Sec. 351 (2003).
        </subsection>
        <subsection ssid="1-5" numlevel="1" lineno="57" slineno="1-14" dnum="3-o" space="false">
          <display>(3)</display>
          <subsection ssid="1-6" dnum="a-o" placement="sameline">
            <display>(a)</display>"Analytical laboratory" means a facility in possession of prescription drugs for 
            <ln numlevel="1" lineno="58" slineno="1-15"/>the purpose of analysis.
          </subsection>
          <subsection ssid="1-7" numlevel="1" lineno="59" slineno="1-16" dnum="b-o">
            <display>(b)</display>"Analytical laboratory" does not include a laboratory possessing prescription drugs 
            <ln numlevel="1" lineno="60" slineno="1-17"/>used as standards and controls in performing drug monitoring or drug screening 
            <ln numlevel="1" lineno="61" slineno="1-18"/>analysis if the prescription drugs are prediluted in a human or animal body fluid, 
            <ln numlevel="1" lineno="62" slineno="1-19"/>human or animal body fluid components, organic solvents, or inorganic buffers at a 
            <ln numlevel="1" lineno="63" slineno="1-20"/>concentration not exceeding one milligram per milliliter when labeled or otherwise 
            <ln numlevel="1" lineno="64" slineno="1-21"/>designated as being for in vitro diagnostic use.
          </subsection>
        </subsection>
        <subsection ssid="1-8" numlevel="1" lineno="65" slineno="1-22" dnum="4-o">
          <display>(4)</display>"Animal euthanasia agency" means an agency performing euthanasia on animals by the  
          <ln numlevel="1" lineno="66" slineno="1-23"/>use of prescription drugs.
        </subsection>
        <subsection ssid="1-9" numlevel="1" lineno="67" slineno="1-24" dnum="5-o">
          <display>(5)</display>"Automated pharmacy systems" includes mechanical systems which perform operations  
          <ln numlevel="1" lineno="68" slineno="1-25"/>or activities, other than compounding or administration, relative to the storage,  
          <ln numlevel="1" lineno="69" slineno="1-26"/>packaging, dispensing, or distribution of medications, and which collect, control, and  
          <ln numlevel="1" lineno="70" slineno="1-27"/>maintain all transaction information.
        </subsection>
        <subsection ssid="1-10" numlevel="1" lineno="71" slineno="1-28" dnum="6-o">
          <display>(6)</display>"Beyond use date" means the date determined by a pharmacist and placed on a  
          <ln numlevel="1" lineno="72" slineno="1-29"/>prescription label at the time of dispensing that indicates to the patient or caregiver a  
          <ln numlevel="1" lineno="73" slineno="1-30"/>time beyond which the contents of the prescription are not recommended to be used.
        </subsection>
        <subsection ssid="1-11" numlevel="1" lineno="74" slineno="1-31" dnum="7-o">
          <display>(7)</display>"Board of pharmacy" or "board" means the Utah State Board of Pharmacy created in  
          <ln numlevel="1" lineno="75" slineno="1-32"/>Section  
          <xref depth="3" refnumber="58-17b-201">58-17b-201</xref>.
        </subsection>
        <subsection ssid="1-12" numlevel="1" lineno="76" slineno="1-33" dnum="8-o">
          <display>(8)</display>"Branch pharmacy" means a pharmacy or other facility in a rural or medically  
          <ln numlevel="1" lineno="77" slineno="1-34"/>underserved area, used for the storage and dispensing of prescription drugs, which is  
          <ln numlevel="1" lineno="78" slineno="1-35"/>dependent upon, stocked by, and supervised by a pharmacist in another licensed  
          <ln numlevel="1" lineno="79" slineno="1-36"/>pharmacy designated and approved by the division as the parent pharmacy.
        </subsection>
        <subsection ssid="1-13" numlevel="1" lineno="80" slineno="1-37" dnum="9-o">
          <display>(9)</display>"Centralized prescription processing" means the processing by a pharmacy of a request  
          <ln numlevel="1" lineno="81" slineno="1-38"/>from another pharmacy to fill or refill a prescription drug order or to perform processing  
          <ln numlevel="1" lineno="82" slineno="1-39"/>functions such as dispensing, drug utilization review, claims adjudication, refill  
          <ln numlevel="1" lineno="83" slineno="1-40"/>authorizations, and therapeutic interventions.
        </subsection>
        <subsection ssid="1-14" numlevel="1" lineno="84" slineno="1-41" dnum="10-o">
          <display>(10)</display>"Class A pharmacy" means a pharmacy located in Utah that is authorized as a retail  
          <ln numlevel="1" lineno="85" slineno="1-42"/>pharmacy to compound or dispense a drug or dispense a device to the public under a  
          <ln numlevel="1" lineno="86" slineno="1-43"/>prescription order.
        </subsection>
        <subsection ssid="1-15" numlevel="1" lineno="87" slineno="1-44" dnum="11-o">
          <display>(11)</display>"Class B pharmacy":
          <subsection ssid="1-16" numlevel="1" lineno="88" slineno="1-45" dnum="a-o">
            <display>(a)</display>means a pharmacy located in Utah:
            <subsection ssid="1-17" numlevel="1" lineno="89" slineno="1-46" dnum="i-o">
              <display>(i)</display>that is authorized to provide pharmaceutical care for patients in an institutional  
              <ln numlevel="1" lineno="90" slineno="1-47"/>setting; and
            </subsection>
            <subsection ssid="1-18" numlevel="1" lineno="91" slineno="1-48" dnum="ii-o">
              <display>(ii)</display>whose primary purpose is to provide a physical environment for patients to obtain  
              <ln numlevel="1" lineno="92" slineno="1-49"/>health care services; and
            </subsection>
          </subsection>
          <subsection ssid="1-19" numlevel="1" lineno="93" slineno="1-50" dnum="b-o" space="false">
            <display>(b)</display>
            <subsection ssid="1-20" dnum="i-o" placement="sameline">
              <display>(i)</display>includes closed-door, hospital, clinic, nuclear, and branch pharmacies; and
            </subsection>
            <subsection ssid="1-21" numlevel="1" lineno="94" slineno="1-51" dnum="ii-o">
              <display>(ii)</display>pharmaceutical administration and sterile product preparation facilities.
            </subsection>
          </subsection>
        </subsection>
        <subsection ssid="1-22" numlevel="1" lineno="95" slineno="1-52" dnum="12-o">
          <display>(12)</display>"Class C pharmacy" means a pharmacy that engages in the manufacture, production,  
          <ln numlevel="1" lineno="96" slineno="1-53"/>wholesale, or distribution of drugs or devices in Utah.
        </subsection>
        <subsection ssid="1-23" numlevel="1" lineno="97" slineno="1-54" dnum="13-o">
          <display>(13)</display>"Class D pharmacy" means a nonresident pharmacy.
        </subsection>
        <subsection ssid="1-24" numlevel="1" lineno="98" slineno="1-55" dnum="14-o">
          <display>(14)</display>"Class E pharmacy" means all other pharmacies.
        </subsection>
        <subsection ssid="1-25" numlevel="1" lineno="99" slineno="1-56" dnum="15-o" space="false">
          <display>(15)</display>
          <subsection ssid="1-26" dnum="a-o" placement="sameline">
            <display>(a)</display>"Closed-door pharmacy" means a pharmacy that:
            <subsection ssid="1-27" numlevel="1" lineno="100" slineno="1-57" dnum="i-o" tab="1">
              <display>(i)</display>provides pharmaceutical care to a defined and exclusive group of patients who 
              <ln numlevel="1" lineno="101" slineno="1-58"/>have access to the services of the pharmacy because they are treated by or have an 
              <ln numlevel="1" lineno="102" slineno="1-59"/>affiliation with a specific entity, including a health maintenance organization or an 
              <ln numlevel="1" lineno="103" slineno="1-60"/>infusion company; or
            </subsection>
            <subsection ssid="1-28" numlevel="1" lineno="104" slineno="1-61" dnum="ii-o" tab="1">
              <display>(ii)</display>engages exclusively in the practice of telepharmacy and does not serve walk-in 
              <ln numlevel="1" lineno="105" slineno="1-62"/>retail customers.
            </subsection>
          </subsection>
          <subsection ssid="1-29" numlevel="1" lineno="106" slineno="1-63" dnum="b-o">
            <display>(b)</display>"Closed-door pharmacy" does not include a hospital pharmacy, a retailer of goods to 
            <ln numlevel="1" lineno="107" slineno="1-64"/>the general public, or the office of a practitioner.
          </subsection>
        </subsection>
        <subsection ssid="1-30" numlevel="1" lineno="108" slineno="1-65" dnum="16-o">
          <display>(16)</display>"Collaborative pharmacy practice" means a practice of pharmacy whereby one or more  
          <ln numlevel="1" lineno="109" slineno="1-66"/>pharmacists have jointly agreed, on a voluntary basis, to work in conjunction with one or  
          <ln numlevel="1" lineno="110" slineno="1-67"/>more practitioners under protocol whereby the pharmacist may perform certain  
          <ln numlevel="1" lineno="111" slineno="1-68"/>pharmaceutical care functions authorized by the practitioner or practitioners under  
          <ln numlevel="1" lineno="112" slineno="1-69"/>certain specified conditions or limitations.
        </subsection>
        <subsection ssid="1-31" numlevel="1" lineno="113" slineno="1-70" dnum="17-o">
          <display>(17)</display>"Collaborative pharmacy practice agreement" means a written and signed agreement  
          <ln numlevel="1" lineno="114" slineno="1-71"/>between one or more pharmacists and one or more practitioners that provides for  
          <ln numlevel="1" lineno="115" slineno="1-72"/>collaborative pharmacy practice for the purpose of drug therapy management of patients  
          <ln numlevel="1" lineno="116" slineno="1-73"/>and prevention of disease of human subjects.
        </subsection>
        <subsection ssid="1-32" numlevel="1" lineno="117" slineno="1-74" dnum="18-o" space="false">
          <display>(18)</display>
          <subsection ssid="1-33" dnum="a-o" placement="sameline">
            <display>(a)</display>"Compounding" means the preparation, mixing, assembling, packaging, or 
            <ln numlevel="1" lineno="118" slineno="1-75"/>labeling of a limited quantity drug, sterile product, or device:
            <subsection ssid="1-34" numlevel="1" lineno="119" slineno="1-76" dnum="i-o" tab="1">
              <display>(i)</display>as the result of a practitioner's prescription order or initiative based on the 
              <ln numlevel="1" lineno="120" slineno="1-77"/>practitioner, patient, or pharmacist relationship in the course of professional 
              <ln numlevel="1" lineno="121" slineno="1-78"/>practice;
            </subsection>
            <subsection ssid="1-35" numlevel="1" lineno="122" slineno="1-79" dnum="ii-o" tab="1">
              <display>(ii)</display>for the purpose of, or as an incident to, research, teaching, or chemical analysis 
              <ln numlevel="1" lineno="123" slineno="1-80"/>and not for sale or dispensing; or
            </subsection>
            <subsection ssid="1-36" numlevel="1" lineno="124" slineno="1-81" dnum="iii-o" tab="1">
              <display>(iii)</display>in anticipation of prescription drug orders based on routine, regularly observed 
              <ln numlevel="1" lineno="125" slineno="1-82"/>prescribing patterns.
            </subsection>
          </subsection>
          <subsection ssid="1-37" numlevel="1" lineno="126" slineno="1-83" dnum="b-o">
            <display>(b)</display>"Compounding" does not include:
            <subsection ssid="1-38" numlevel="1" lineno="127" slineno="1-84" dnum="i-o">
              <display>(i)</display>the preparation of prescription drugs by a pharmacist or pharmacy intern for sale 
              <ln numlevel="1" lineno="128" slineno="1-85"/>to another pharmacist or pharmaceutical facility;
            </subsection>
            <subsection ssid="1-39" numlevel="1" lineno="129" slineno="1-86" dnum="ii-o">
              <display>(ii)</display>the preparation by a pharmacist or pharmacy intern of any prescription drug in a 
              <ln numlevel="1" lineno="130" slineno="1-87"/>dosage form which is regularly and commonly available from a manufacturer in 
              <ln numlevel="1" lineno="131" slineno="1-88"/>quantities and strengths prescribed by a practitioner; or
            </subsection>
            <subsection ssid="1-40" numlevel="1" lineno="132" slineno="1-89" dnum="iii-o">
              <display>(iii)</display>the preparation of a prescription drug, sterile product, or device which has been 
              <ln numlevel="1" lineno="133" slineno="1-90"/>withdrawn from the market for safety reasons.
            </subsection>
          </subsection>
        </subsection>
        <subsection ssid="1-41" numlevel="1" lineno="134" slineno="1-91" dnum="19-o">
          <display>(19)</display>"Confidential information" has the same meaning as "protected health information"  
          <ln numlevel="1" lineno="135" slineno="1-92"/>under the Standards for Privacy of Individually Identifiable Health Information, 45  
          <ln numlevel="1" lineno="136" slineno="1-93"/>C.F.R. Parts 160 and 164.
        </subsection>

          <ln numlevel="1" lineno="189" slineno="1-146"/>to be sold, and is intended to be provided to practitioners for the immediate needs of  
          <ln numlevel="1" lineno="190" slineno="1-147"/>patients for trial purposes or to provide the drug to the patient until a prescription can be

        </subsection>
        <subsection ssid="1-76" numlevel="1" lineno="192" slineno="1-149" dnum="29-o">
          <display>(29)</display>"Electronic signature" means a trusted, verifiable, and secure electronic sound, symbol,  
          <ln numlevel="1" lineno="193" slineno="1-150"/>or process attached to or logically associated with a record and executed or adopted by a  
          <ln numlevel="1" lineno="194" slineno="1-151"/>person with the intent to sign the record.
        </subsection>

          <ln numlevel="1" lineno="206" slineno="1-163"/>engaged in the manufacturing of drugs or devices.

            </subsection>
            <subsection ssid="1-85" numlevel="1" lineno="213" slineno="1-170" dnum="ii-o" tab="1">
              <display>(ii)</display>the promotion and marketing of such drugs or devices.
            </subsection>
          </subsection>
          <subsection ssid="1-86" numlevel="1" lineno="214" slineno="1-171" dnum="b-o">
            <display>(b)</display>"Manufacturing" includes the preparation and promotion of commercially available 
            <ln numlevel="1" lineno="215" slineno="1-172"/>products from bulk compounds for resale by pharmacies, practitioners, or other 
            <ln numlevel="1" lineno="216" slineno="1-173"/>persons.
          </subsection>
          <subsection ssid="1-87" numlevel="1" lineno="217" slineno="1-174" dnum="c-o">
            <display>(c)</display>"Manufacturing" does not include the preparation or compounding of a drug by a 
            <ln numlevel="1" lineno="218" slineno="1-175"/>pharmacist, pharmacy intern, or practitioner for that individual's own use or the 
            <ln numlevel="1" lineno="219" slineno="1-176"/>preparation, compounding, packaging, labeling of a drug, or incident to research, 
            <ln numlevel="1" lineno="220" slineno="1-177"/>teaching, or chemical analysis.
          </subsection>
        </subsection>
        <subsection ssid="1-88" numlevel="1" lineno="221" slineno="1-178" dnum="36-o">
          <display>(36)</display>"Medical order" means a lawful order of a practitioner which may include a  
          <ln numlevel="1" lineno="222" slineno="1-179"/>prescription drug order.
        </subsection>
        <subsection ssid="1-89" numlevel="1" lineno="223" slineno="1-180" dnum="37-o">
          <display>(37)</display>"Medication profile" or "profile" means a record system maintained as to drugs or  
          <ln numlevel="1" lineno="224" slineno="1-181"/>devices prescribed for a pharmacy patient to enable a pharmacist or pharmacy intern to  
          <ln numlevel="1" lineno="225" slineno="1-182"/>analyze the profile to provide pharmaceutical care.
        </subsection>
        <subsection ssid="1-90" numlevel="1" lineno="226" slineno="1-183" dnum="38-o">
          <display>(38)</display>"Misbranded drug or device" means a drug or device considered misbranded under 21  
          <ln numlevel="1" lineno="227" slineno="1-184"/>U.S.C. Sec. 352 (2003).

          </subsection>
        </subsection>

          <display>(40)</display>"Nonresident pharmacy" means a pharmacy located outside of Utah that sells to a  
          <ln numlevel="1" lineno="233" slineno="1-190"/>person in Utah.
        </subsection>
        <subsection ssid="1-97" numlevel="1" lineno="234" slineno="1-191" dnum="41-o">
          <display>(41)</display>"Nuclear pharmacy" means a pharmacy providing radio-pharmaceutical service.
        </subsection>
        <subsection ssid="1-98" numlevel="1" lineno="235" slineno="1-192" dnum="42-o">
          <display>(42)</display>"Out-of-state mail service pharmacy" means a pharmaceutical facility located outside  
          <ln numlevel="1" lineno="236" slineno="1-193"/>the state that is licensed and in good standing in another state, that:
          <subsection ssid="1-99" numlevel="1" lineno="237" slineno="1-194" dnum="a-o">
            <display>(a)</display>ships, mails, or delivers by any lawful means a dispensed legend drug to a patient in  
            <ln numlevel="1" lineno="238" slineno="1-195"/>this state pursuant to a lawfully issued prescription;
          </subsection>
          <subsection ssid="1-100" numlevel="1" lineno="239" slineno="1-196" dnum="b-o">
            <display>(b)</display>provides information to a patient in this state on drugs or devices which may include,  
            <ln numlevel="1" lineno="240" slineno="1-197"/>but is not limited to, advice relating to therapeutic values, potential hazards, and uses;  
            <ln numlevel="1" lineno="241" slineno="1-198"/>or
          </subsection>
          <subsection ssid="1-101" numlevel="1" lineno="242" slineno="1-199" dnum="c-o">
            <display>(c)</display>counsels pharmacy patients residing in this state concerning adverse and therapeutic  
            <ln numlevel="1" lineno="243" slineno="1-200"/>effects of drugs.
          </subsection>
        </subsection>
        <subsection ssid="1-102" numlevel="1" lineno="244" slineno="1-201" dnum="43-o">
          <display>(43)</display>"Patient counseling" means the written and oral communication by the pharmacist or  
          <ln numlevel="1" lineno="245" slineno="1-202"/>pharmacy intern of information, to the patient or caregiver, in order to ensure proper use  
          <ln numlevel="1" lineno="246" slineno="1-203"/>of drugs, devices, and dietary supplements.
        </subsection>
        <subsection ssid="1-103" numlevel="1" lineno="247" slineno="1-204" dnum="44-o">
          <display>(44)</display>"Pharmaceutical administration facility" means a facility, agency, or institution in  
          <ln numlevel="1" lineno="248" slineno="1-205"/>which:
          <subsection ssid="1-104" numlevel="1" lineno="249" slineno="1-206" dnum="a-o">
            <display>(a)</display>prescription drugs or devices are held, stored, or are otherwise under the control of  
            <ln numlevel="1" lineno="250" slineno="1-207"/>the facility or agency for administration to patients of that facility or agency;
          </subsection>
          <subsection ssid="1-105" numlevel="1" lineno="251" slineno="1-208" dnum="b-o">
            <display>(b)</display>prescription drugs are dispensed to the facility or agency by a licensed pharmacist or  
            <ln numlevel="1" lineno="252" slineno="1-209"/>pharmacy intern with whom the facility has established a prescription drug  
            <ln numlevel="1" lineno="253" slineno="1-210"/>supervising relationship under which the pharmacist or pharmacy intern provides  
            <ln numlevel="1" lineno="254" slineno="1-211"/>counseling to the facility or agency staff as required, and oversees drug control,  
            <ln numlevel="1" lineno="255" slineno="1-212"/>accounting, and destruction; and
          </subsection>
          <subsection ssid="1-106" numlevel="1" lineno="256" slineno="1-213" dnum="c-o">
            <display>(c)</display>prescription drugs are professionally administered in accordance with the order of a  
            <ln numlevel="1" lineno="257" slineno="1-214"/>practitioner by an employee or agent of the facility or agency.
          </subsection>
        </subsection>
        <subsection ssid="1-107" numlevel="1" lineno="258" slineno="1-215" dnum="45-o" space="false">
          <display>(45)</display>
          <subsection ssid="1-108" dnum="a-o" placement="sameline">
            <display>(a)</display>"Pharmaceutical care" means carrying out the following in collaboration with a 
            <ln numlevel="1" lineno="259" slineno="1-216"/>prescribing practitioner, and in accordance with division rule:
            <subsection ssid="1-109" numlevel="1" lineno="260" slineno="1-217" dnum="i-o" tab="1">
              <display>(i)</display>designing, implementing, and monitoring a therapeutic drug plan intended to 
              <ln numlevel="1" lineno="261" slineno="1-218"/>achieve favorable outcomes related to a specific patient for the purpose of curing 
              <ln numlevel="1" lineno="262" slineno="1-219"/>or preventing the patient's disease;
            </subsection>
            <subsection ssid="1-110" numlevel="1" lineno="263" slineno="1-220" dnum="ii-o" tab="1">
              <display>(ii)</display>eliminating or reducing a patient's symptoms; or
            </subsection>
            <subsection ssid="1-111" numlevel="1" lineno="264" slineno="1-221" dnum="iii-o" tab="1">
              <display>(iii)</display>arresting or slowing a disease process.
            </subsection>
          </subsection>
          <subsection ssid="1-112" numlevel="1" lineno="265" slineno="1-222" dnum="b-o">
            <display>(b)</display>"Pharmaceutical care" does not include prescribing of drugs without consent of a 
            <ln numlevel="1" lineno="266" slineno="1-223"/>prescribing practitioner.
          </subsection>
        </subsection>
        <subsection ssid="1-113" numlevel="1" lineno="267" slineno="1-224" dnum="46-o">
          <display>(46)</display>"Pharmaceutical facility" means a business engaged in the dispensing, delivering,  
          <ln numlevel="1" lineno="268" slineno="1-225"/>distributing, manufacturing, or wholesaling of prescription drugs or devices within or  
          <ln numlevel="1" lineno="269" slineno="1-226"/>into this state.
        </subsection>

          </subsection>

            <display>(b)</display>"Pharmaceutical wholesaler or distributor" does not include a pharmaceutical facility 
            <ln numlevel="1" lineno="275" slineno="1-232"/>carrying out the following business activities:
            <subsection ssid="1-117" numlevel="1" lineno="276" slineno="1-233" dnum="i-o">
              <display>(i)</display>intracompany sales;
            </subsection>
            <subsection ssid="1-118" numlevel="1" lineno="277" slineno="1-234" dnum="ii-o">
              <display>(ii)</display>the sale, purchase, or trade of a prescription drug or device, or an offer to sell, 
              <ln numlevel="1" lineno="278" slineno="1-235"/>purchase, or trade a prescription drug or device, if the activity is carried out 
              <ln numlevel="1" lineno="279" slineno="1-236"/>between one or more of the following entities under common ownership or 
              <ln numlevel="1" lineno="280" slineno="1-237"/>common administrative control, as defined by division rule:

              <ln numlevel="1" lineno="287" slineno="1-244"/>including supplying another pharmaceutical facility with a limited quantity of a 
              <ln numlevel="1" lineno="288" slineno="1-245"/>drug, if:
              <subsection ssid="1-124" numlevel="1" lineno="289" slineno="1-246" dnum="A-o">
                <display>(A)</display>the facility is unable to obtain the drug through a normal distribution channel 
                <ln numlevel="1" lineno="290" slineno="1-247"/>in sufficient time to eliminate the risk of harm to a patient that would result 
                <ln numlevel="1" lineno="291" slineno="1-248"/>from a delay in obtaining the drug; and
              </subsection>
              <subsection ssid="1-125" numlevel="1" lineno="292" slineno="1-249" dnum="B-o">
                <display>(B)</display>the quantity of the drug does not exceed an amount reasonably required for 
                <ln numlevel="1" lineno="293" slineno="1-250"/>immediate dispensing to eliminate the risk of harm;
              </subsection>
            </subsection>
            <subsection ssid="1-126" numlevel="1" lineno="294" slineno="1-251" dnum="iv-o">
              <display>(iv)</display>the distribution of a prescription drug or device as a sample by representatives of 
              <ln numlevel="1" lineno="295" slineno="1-252"/>a manufacturer; and
            </subsection>

              <display>(v)</display>the distribution of prescription drugs, if:

          <display>(50)</display>"Pharmacist preceptor" means a licensed pharmacist in good standing with one or

          <ln numlevel="1" lineno="308" slineno="1-265"/>professional conduct, and supervisor of interns in the professional practice of pharmacy.
        </subsection>
        <subsection ssid="1-133" numlevel="1" lineno="309" slineno="1-266" dnum="51-o">
          <display>(51)</display>"Pharmacy" means any place where:
          <subsection ssid="1-134" numlevel="1" lineno="310" slineno="1-267" dnum="a-o">
            <display>(a)</display>drugs are dispensed;
          </subsection>
          <subsection ssid="1-135" numlevel="1" lineno="311" slineno="1-268" dnum="b-o">
            <display>(b)</display>pharmaceutical care is provided;
          </subsection>
          <subsection ssid="1-136" numlevel="1" lineno="312" slineno="1-269" dnum="c-o">
            <display>(c)</display>drugs are processed or handled for eventual use by a patient; or
          </subsection>

          <ln numlevel="1" lineno="315" slineno="1-272"/>pharmacy benefits management service as defined in Section  
          <xref depth="3" refnumber="31A-46-102">31A-46-102</xref> on behalf of a  
          <ln numlevel="1" lineno="316" slineno="1-273"/>self-insured employer, insurance company, health maintenance organization, or other  
          <ln numlevel="1" lineno="317" slineno="1-274"/>plan sponsor, as defined by rule.
        </subsection>
        <subsection ssid="1-139" numlevel="1" lineno="318" slineno="1-275" dnum="53-o">
          <display>(53)</display>"Pharmacy intern" means an individual licensed by this state to engage in practice as a  
          <ln numlevel="1" lineno="319" slineno="1-276"/>pharmacy intern.
        </subsection>

          <display>(54)</display>"Pharmacy manager" means:

          <display>(57)</display>"Practice as a licensed pharmacy technician" means engaging in practice as a  
          <ln numlevel="1" lineno="342" slineno="1-299"/>pharmacy technician under the general supervision of a licensed pharmacist and in

          <display>(58)</display>"Practice of pharmacy" includes the following:

            <display>(a)</display>providing pharmaceutical care;
          </subsection>
          <subsection ssid="1-156" numlevel="1" lineno="347" slineno="1-304" dnum="b-o">
            <display>(b)</display>collaborative pharmacy practice in accordance with a collaborative pharmacy  
            <ln numlevel="1" lineno="348" slineno="1-305"/>practice agreement;
          </subsection>

            <display>(c)</display>compounding, packaging, labeling, dispensing, administering, and the coincident

              <display>(i)</display>pursuant to a lawful order of a practitioner when one is required by law; and
            </subsection>
            <subsection ssid="1-159" numlevel="1" lineno="353" slineno="1-310" dnum="ii-o">
              <display>(ii)</display>in accordance with written guidelines or protocols:

                <display>(B)</display>approved by the division, in collaboration with the board and, when

                <ln numlevel="1" lineno="358" slineno="1-315"/>the prescription drug or device is to be administered on an outpatient basis

            <display>(h)</display>providing drug product equivalents;
          </subsection>
          <subsection ssid="1-167" numlevel="1" lineno="367" slineno="1-324" dnum="i-o">
            <display>(i)</display>supervising pharmacist's supportive personnel, pharmacy interns, and pharmacy  
            <ln numlevel="1" lineno="368" slineno="1-325"/>technicians;
          </subsection>
          <subsection ssid="1-168" numlevel="1" lineno="369" slineno="1-326" dnum="j-o">
            <display>(j)</display>providing patient counseling, including adverse and therapeutic effects of drugs;
          </subsection>
          <subsection ssid="1-169" numlevel="1" lineno="370" slineno="1-327" dnum="k-o">
            <display>(k)</display>providing emergency refills as defined by rule;
          </subsection>
          <subsection ssid="1-170" numlevel="1" lineno="371" slineno="1-328" dnum="l-o">

            <display>(m)</display>formulary management intervention;
          </subsection>
          <subsection ssid="1-172" numlevel="1" lineno="373" slineno="1-330" dnum="n-o">
            <display>(n)</display>prescribing and dispensing a self-administered hormonal contraceptive in accordance  
            <ln numlevel="1" lineno="374" slineno="1-331"/>with Title 26B, Chapter 4, Part 5, Treatment Access; and
          </subsection>
          <subsection ssid="1-173" numlevel="1" lineno="375" slineno="1-332" dnum="o-o">
            <display>(o)</display>issuing a prescription in accordance with Section

          <display>(59)</display>"Practice of telepharmacy" means the practice of pharmacy through the use of  
          <ln numlevel="1" lineno="377" slineno="1-334"/>telecommunications and information technologies.
        </subsection>
        <subsection ssid="1-175" numlevel="1" lineno="378" slineno="1-335" dnum="60-o">
          <display>(60)</display>"Practice of telepharmacy across state lines" means the practice of pharmacy through  
          <ln numlevel="1" lineno="379" slineno="1-336"/>the use of telecommunications and information technologies that occurs when the  
          <ln numlevel="1" lineno="380" slineno="1-337"/>patient is physically located within one jurisdiction and the pharmacist is located in  
          <ln numlevel="1" lineno="381" slineno="1-338"/>another jurisdiction.
        </subsection>
        <subsection ssid="1-176" numlevel="1" lineno="382" slineno="1-339" dnum="61-o">
          <display>(61)</display>"Practitioner" means an individual currently licensed, registered, or otherwise  
          <ln numlevel="1" lineno="383" slineno="1-340"/>authorized by the appropriate jurisdiction to prescribe and administer drugs in the course  
          <ln numlevel="1" lineno="384" slineno="1-341"/>of professional practice.
        </subsection>
        <subsection ssid="1-177" numlevel="1" lineno="385" slineno="1-342" dnum="62-o">
          <display>(62)</display>"Prescribe" means to issue a prescription:
          <subsection ssid="1-178" numlevel="1" lineno="386" slineno="1-343" dnum="a-o">
            <display>(a)</display>orally or in writing; or
          </subsection>

          <display>(64)</display>"Prescription device" means an instrument, apparatus, implement, machine,  
          <ln numlevel="1" lineno="395" slineno="1-352"/>contrivance, implant, in vitro reagent, or other similar or related article, and any  
          <ln numlevel="1" lineno="396" slineno="1-353"/>component part or accessory, which is required under federal or state law to be  
          <ln numlevel="1" lineno="397" slineno="1-354"/>prescribed by a practitioner and dispensed by or through a person or entity licensed  
          <ln numlevel="1" lineno="398" slineno="1-355"/>under this chapter or exempt from licensure under this chapter.
        </subsection>
        <subsection ssid="1-184" numlevel="1" lineno="399" slineno="1-356" dnum="65-o">
          <display>(65)</display>"Prescription drug" means a drug that is required by federal or state law or rule to be  
          <ln numlevel="1" lineno="400" slineno="1-357"/>dispensed only by prescription or is restricted to administration only by practitioners.
        </subsection>

          </subsection>
          <subsection ssid="1-192" numlevel="1" lineno="414" slineno="1-371" dnum="b-o">
            <display>(b)</display>requiring the use of a controlled substance, prescription drug, or prescription device;
          </subsection>
          <subsection ssid="1-193" numlevel="1" lineno="415" slineno="1-372" dnum="c-o">
            <display>(c)</display>that uses the controlled substance, prescription drug, or prescription device in  
            <ln numlevel="1" lineno="416" slineno="1-373"/>accordance with standard research protocols and techniques, including, if required,  
            <ln numlevel="1" lineno="417" slineno="1-374"/>those approved by an institutional review committee; and
          </subsection>
          <subsection ssid="1-194" numlevel="1" lineno="418" slineno="1-375" dnum="d-o">
            <display>(d)</display>that includes any documentation required for the conduct of the research and the  
            <ln numlevel="1" lineno="419" slineno="1-376"/>handling of the controlled substance, prescription drug, or prescription device.
          </subsection>
        </subsection>
        <subsection ssid="1-195" numlevel="1" lineno="420" slineno="1-377" dnum="68-o">
          <display>(68)</display>"Retail pharmacy" means a pharmaceutical facility dispensing prescription drugs and  
          <ln numlevel="1" lineno="421" slineno="1-378"/>devices to the general public.
        </subsection>

            <ln numlevel="1" lineno="435" slineno="1-392"/>pharmacy technician in nonjudgmental duties not included in the definition of the  
            <ln numlevel="1" lineno="436" slineno="1-393"/>practice of pharmacy, practice of a pharmacy intern, or practice of a licensed  
            <ln numlevel="1" lineno="437" slineno="1-394"/>pharmacy technician, and as those duties may be further defined by division rule  
            <ln numlevel="1" lineno="438" slineno="1-395"/>adopted in collaboration with the board; and
          </subsection>
          <subsection ssid="1-204" numlevel="1" lineno="439" slineno="1-396" dnum="b-o">
            <display>(b)</display>are supervised by a pharmacist in accordance with rules adopted by the division in

          </subsection>
          <subsection ssid="2-14" numlevel="1" lineno="487" slineno="2-34" dnum="e-o">
            <display>(e)</display>for each pharmacy manager, submit fingerprint cards and consent to a fingerprint  
            <ln numlevel="1" lineno="488" slineno="2-35"/>background check in accordance with Section  
            <xref depth="3" refnumber="58-17b-307">58-17b-307</xref>;
          </subsection>
          <subsection ssid="2-15" numlevel="1" lineno="489" slineno="2-36" dnum="f-o">
            <display>(f)</display>provide a statement of the scope of pharmacy services that will be provided and a  
            <ln numlevel="1" lineno="490" slineno="2-37"/>detailed description of the protocol as described by rule by which pharmacy care will  
            <ln numlevel="1" lineno="491" slineno="2-38"/>be provided, including any collaborative practice arrangements with other health care  
            <ln numlevel="1" lineno="492" slineno="2-39"/>practitioners;
          </subsection>
          <subsection ssid="2-16" numlevel="1" lineno="493" slineno="2-40" dnum="g-o">
            <display>(g)</display>sign an affidavit attesting that any healthcare practitioners employed by the applicant  
            <ln numlevel="1" lineno="494" slineno="2-41"/>and physically located in Utah have the appropriate license issued by the division and  
            <ln numlevel="1" lineno="495" slineno="2-42"/>in good standing;
          </subsection>
          <subsection ssid="2-17" numlevel="1" lineno="496" slineno="2-43" dnum="h-o">
            <display>(h)</display>sign an affidavit attesting that the applicant will abide by the pharmacy laws and  
            <ln numlevel="1" lineno="497" slineno="2-44"/>regulations of the jurisdiction in which the pharmacy is located; and
          </subsection>

            <display>(i)</display>if an applicant engages in compounding, submit the most recent inspection report:

            <display>(a)</display>delivers the prescription in person to the pharmacist or pharmacy intern; or

          <subsection ssid="5-3" dnum="b-o" numlevel="1" lineno="555" slineno="5-7">
            <display>(b)</display>receives the drug in person at the time it is dispensed at the pharmacy facility.
          </subsection>
        </subsection>
        <subsection ssid="5-4" dnum="2-o" numlevel="1" lineno="556" slineno="5-8">
          <display>(2)</display>A pharmacist or pharmacy intern at a pharmacy that receives a prescription from a  
          <ln numlevel="1" lineno="557" slineno="5-9"/>patient by means other than personal delivery, and that dispenses

          <amend anum="0" ea="erase" pairid="1" style="2" owner="ahaskell" level="1" deltag="both">prescription drugs</amend>

          <display>(3)</display>Notwithstanding the provisions of Subsections (1) and (2), a pharmacist or a pharmacy

              <display>(i)</display>a permanent closure of the pharmacy facility;

              <display>(ii)</display>a change of
              <amend anum="0" ea="amend" pairid="1" style="1" owner="ahaskell" level="1" amendtag="both"> business</amend> name or ownership of the pharmacy facility;

            <subsection ssid="6-5" numlevel="1" lineno="581" slineno="6-7" dnum="iii-o">
              <display>(iii)</display>a change of location of the pharmacy facility;
            </subsection>
            <subsection ssid="6-6" numlevel="1" lineno="582" slineno="6-8" dnum="iv-o">
              <display>(iv)</display>a sale or transfer of any controlled substance as a result of the permanent closing  
              <ln numlevel="1" lineno="583" slineno="6-9"/>or change of ownership of the pharmacy facility; or

            <subsection ssid="6-7" numlevel="1" lineno="584" slineno="6-10" dnum="v-o">
              <display>(v)</display>any matter or occurrence that the division requires by rule to be reported; or
            </subsection>
          </subsection>
          <subsection ssid="6-8" numlevel="1" lineno="585" slineno="6-11" dnum="b-o">
            <display>(b)</display>after the day on which:
            <subsection ssid="6-9" numlevel="1" lineno="586" slineno="6-12" dnum="i-o">
              <display>(i)</display>a final administrative disciplinary order is issued against the pharmacy license  
              <ln numlevel="1" lineno="587" slineno="6-13"/>holder by the regulatory or licensing agency of the state in which the pharmacy is  
              <ln numlevel="1" lineno="588" slineno="6-14"/>located if the pharmacy is a class D pharmacy;

              <display>(ii)</display>a final order against a pharmacist is issued who is designated as the  
              <ln numlevel="1" lineno="590" slineno="6-16"/>pharmacist-in-charge of the pharmacy by the regulatory or licensing agency of the  
              <ln numlevel="1" lineno="591" slineno="6-17"/>state in which the pharmacy is located if the pharmacy is a class D pharmacy; or
            </subsection>
            <subsection ssid="6-11" numlevel="1" lineno="592" slineno="6-18" dnum="iii-o">
              <display>(iii)</display>any matter or occurrence that the division requires by rule to be reported.
            </subsection>
          </subsection>
        </subsection>
        <subsection ssid="6-12" ea="amend" anum="0" owner="ahaskell" style="1" numlevel="1" lineno="593" slineno="6-19" dnum="_-e:2-e">

            <ln numlevel="1" lineno="595" slineno="6-21"/>control of the pharmacy since the last time the business name of the pharmacy was  
            <ln numlevel="1" lineno="596" slineno="6-22"/>registered or changed.
          </amend>
        </subsection>
        <subsection ssid="6-13" numlevel="1" lineno="597" slineno="6-23" dnum="2-o:3-e">
          <display>
            <amendoutstart style="5"/>

          </display>A pharmacy shall report in writing to the division a disaster, accident, or

          <ln numlevel="1" lineno="599" slineno="6-25"/>material used in the diagnosis or treatment of injury, illness, or disease immediately  
          <ln numlevel="1" lineno="600" slineno="6-26"/>upon the occurrence of the disaster, accident, or emergency as defined by rule.
        </subsection>
        <subsection ssid="6-14" numlevel="1" lineno="601" slineno="6-27" dnum="3-o:4-e">

          </display>A reporting pharmacy shall maintain a copy of any notification required by this

          <display>(1)</display>For purposes of this section:
          <subsection ssid="7-2" dnum="a-o" numlevel="1" lineno="607" slineno="7-5">
            <display>(a)</display>"Audit" means a review of the records of a pharmacy by or on behalf of an entity that  
            <ln numlevel="1" lineno="608" slineno="7-6"/>finances or reimburses the cost of health care services or pharmaceutical products.
          </subsection>
          <subsection ssid="7-3" dnum="b-o" numlevel="1" lineno="609" slineno="7-7">
            <display>(b)</display>"Audit completion date" means:
            <subsection ssid="7-4" dnum="i-o" numlevel="1" lineno="610" slineno="7-8">
              <display>(i)</display>for an audit that does not require an on-site visit at the pharmacy, the date on  
              <ln numlevel="1" lineno="611" slineno="7-9"/>which the pharmacy, in response to the initial audit request, submits records or  
              <ln numlevel="1" lineno="612" slineno="7-10"/>other documents to the entity conducting the audit, as determined by:
              <subsection ssid="7-5" dnum="A-o" numlevel="1" lineno="613" slineno="7-11">
                <display>(A)</display>postmark or other evidence of the date of mailing; or
              </subsection>
              <subsection ssid="7-6" dnum="B-o" numlevel="1" lineno="614" slineno="7-12">
                <display>(B)</display>the date of transmission if the records or other documents are transmitted  
                <ln numlevel="1" lineno="615" slineno="7-13"/>electronically; and
              </subsection>
            </subsection>
            <subsection ssid="7-7" dnum="ii-o" numlevel="1" lineno="616" slineno="7-14">
              <display>(ii)</display>for an audit that requires an on-site visit at a pharmacy, the date on which the  
              <ln numlevel="1" lineno="617" slineno="7-15"/>auditing entity completes the on-site visit, including any follow-up visits or  
              <ln numlevel="1" lineno="618" slineno="7-16"/>analysis which shall be completed within 60 days after the day on which the  
              <ln numlevel="1" lineno="619" slineno="7-17"/>on-site visit begins.
            </subsection>
          </subsection>
          <subsection ssid="7-8" dnum="c-o" numlevel="1" lineno="620" slineno="7-18">
            <display>(c)</display>"Entity" includes:
            <subsection ssid="7-9" dnum="i-o" numlevel="1" lineno="621" slineno="7-19">
              <display>(i)</display>a pharmacy benefits manager or coordinator;
            </subsection>
            <subsection ssid="7-10" dnum="ii-o" numlevel="1" lineno="622" slineno="7-20">
              <display>(ii)</display>a health benefit plan;
            </subsection>
            <subsection ssid="7-11" dnum="iii-o" numlevel="1" lineno="623" slineno="7-21">
              <display>(iii)</display>a third party administrator as defined in Section  
              <xref depth="3" refnumber="31A-1-301">31A-1-301</xref>;
            </subsection>
            <subsection ssid="7-12" dnum="iv-o" numlevel="1" lineno="624" slineno="7-22">
              <display>(iv)</display>a state agency; or
            </subsection>
            <subsection ssid="7-13" dnum="v-o" numlevel="1" lineno="625" slineno="7-23">
              <display>(v)</display>a company, group, or agent that represents, or is engaged by, one of the entities  
              <ln numlevel="1" lineno="626" slineno="7-24"/>described in Subsections (1)(c)(i) through (iv).
            </subsection>
          </subsection>

              <ln numlevel="1" lineno="629" slineno="7-27"/>group of insurance claims.
            </amend>
          </subsection>

              <display>(i)</display>a health benefit plan as defined in Section  
              <xref depth="3" refnumber="31A-1-301">31A-1-301</xref>; or
            </subsection>
            <subsection ssid="7-18" dnum="ii-o" numlevel="1" lineno="634" slineno="7-32">
              <display>(ii)</display>a health, dental, medical, Medicare supplement, or conversion program offered  
              <ln numlevel="1" lineno="635" slineno="7-33"/>under Title 49, Chapter 20, Public Employees' Benefit and Insurance Program Act.
            </subsection>
          </subsection>
        </subsection>
        <subsection ssid="7-19" dnum="2-o" numlevel="1" lineno="636" slineno="7-34" space="false">
          <display>(2)</display>
          <subsection ssid="7-20" dnum="a-o" placement="sameline">
            <display>(a)</display>Except as provided in Subsection (2)(b), this section applies to:
            <subsection ssid="7-21" dnum="i-o" numlevel="1" lineno="637" slineno="7-35" tab="1">
              <display>(i)</display>a contract for the audit of a pharmacy entered into, amended, or renewed on or 
              <ln numlevel="1" lineno="638" slineno="7-36"/>after July 1, 2012; and

            <subsection ssid="7-22" dnum="ii-o" numlevel="1" lineno="639" slineno="7-37" tab="1">
              <display>(ii)</display>an entity that conducts an audit of the pharmacy records of a pharmacy licensed 
              <ln numlevel="1" lineno="640" slineno="7-38"/>under this chapter.
            </subsection>
          </subsection>
          <subsection ssid="7-23" dnum="b-o" numlevel="1" lineno="641" slineno="7-39">
            <display>(b)</display>This section does not apply to an audit of pharmacy records:
            <subsection ssid="7-24" dnum="i-o" numlevel="1" lineno="642" slineno="7-40">
              <display>(i)</display>for a federally funded prescription drug program, including:
              <subsection ssid="7-25" dnum="A-o" numlevel="1" lineno="643" slineno="7-41">
                <display>(A)</display>the state Medicaid program;
              </subsection>
              <subsection ssid="7-26" dnum="B-o" numlevel="1" lineno="644" slineno="7-42">
                <display>(B)</display>the Medicare Part D program;
              </subsection>
              <subsection ssid="7-27" dnum="C-o" numlevel="1" lineno="645" slineno="7-43">
                <display>(C)</display>a Department of Defense prescription drug program; and
              </subsection>
              <subsection ssid="7-28" dnum="D-o" numlevel="1" lineno="646" slineno="7-44">
                <display>(D)</display>a Veterans Affairs prescription drug program; or
              </subsection>
            </subsection>
            <subsection ssid="7-29" dnum="ii-o" numlevel="1" lineno="647" slineno="7-45">
              <display>(ii)</display>when fraud or other intentional and willful misrepresentation is alleged and the 
              <ln numlevel="1" lineno="648" slineno="7-46"/>pharmacy audit entity has evidence that the pharmacy's actions reasonably 
              <ln numlevel="1" lineno="649" slineno="7-47"/>indicate fraud or intentional and willful misrepresentation.
            </subsection>
          </subsection>
        </subsection>
        <subsection ssid="7-30" dnum="3-o" numlevel="1" lineno="650" slineno="7-48" space="false">
          <display>(3)</display>
          <subsection ssid="7-31" dnum="a-o" placement="sameline">
            <display>(a)</display>An audit that involves clinical or professional judgment shall be conducted by or 
            <ln numlevel="1" lineno="651" slineno="7-49"/>in consultation with a pharmacist who is employed by or working with the auditing 
            <ln numlevel="1" lineno="652" slineno="7-50"/>entity and who is licensed in the state or another state.
          </subsection>
          <subsection ssid="7-32" dnum="b-o" numlevel="1" lineno="653" slineno="7-51">
            <display>(b)</display>If an audit is conducted on site at a pharmacy, the entity conducting the audit:
            <subsection ssid="7-33" dnum="i-o" numlevel="1" lineno="654" slineno="7-52">
              <display>(i)</display>shall give the pharmacy 10 days advanced written notice of:
              <subsection ssid="7-34" dnum="A-o" numlevel="1" lineno="655" slineno="7-53">
                <display>(A)</display>the audit; and
              </subsection>
              <subsection ssid="7-35" dnum="B-o" numlevel="1" lineno="656" slineno="7-54">
                <display>(B)</display>the range of prescription numbers or a date range included in the audit; and
              </subsection>
            </subsection>
            <subsection ssid="7-36" dnum="ii-o" numlevel="1" lineno="657" slineno="7-55">
              <display>(ii)</display>may not audit a pharmacy during the first five business days of the month, unless 
              <ln numlevel="1" lineno="658" slineno="7-56"/>the pharmacy agrees to the timing of the audit.
            </subsection>
          </subsection>
          <subsection ssid="7-37" dnum="c-o" numlevel="1" lineno="659" slineno="7-57">
            <display>(c)</display>An entity may not audit claims:
            <subsection ssid="7-38" dnum="i-o" numlevel="1" lineno="660" slineno="7-58">
              <display>(i)</display>submitted more than 18 months prior to the audit, unless:
              <subsection ssid="7-39" dnum="A-o" numlevel="1" lineno="661" slineno="7-59">
                <display>(A)</display>required by federal law; or
              </subsection>
              <subsection ssid="7-40" dnum="B-o" numlevel="1" lineno="662" slineno="7-60">
                <display>(B)</display>the originating prescription is dated in the preceding six months; or
              </subsection>
            </subsection>
            <subsection ssid="7-41" dnum="ii-o" numlevel="1" lineno="663" slineno="7-61">
              <display>(ii)</display>that exceed 200 selected prescription claims
              <amend anum="0" ea="amend" pairid="4" style="1" owner="ahaskell" level="1" amendtag="both">annually</amend>.
            </subsection>
          </subsection>
          <subsection ssid="7-42" dnum="_-o:d-e" ea="amend" anum="0" owner="ahaskell" style="1" numlevel="1" lineno="664" slineno="7-62">
            <display>

            </display>
            <amend anum="0" ea="amend" pairid="6" style="1" owner="ahaskell" level="1" amendtag="end">Subsection (3)(c)(ii) does not apply to any investigative audit that involves fraud, 
              <ln numlevel="1" lineno="665" slineno="7-63"/>waste, abuse, or willful misrepresentation.
            </amend>
          </subsection>
        </subsection>
        <subsection ssid="7-43" dnum="4-o" numlevel="1" lineno="666" slineno="7-64" space="false">
          <display>(4)</display>
          <subsection ssid="7-44" dnum="a-o" placement="sameline">
            <display>(a)</display>An entity may not:
            <subsection ssid="7-45" dnum="i-o" numlevel="1" lineno="667" slineno="7-65" tab="1">
              <display>(i)</display>include dispensing fees in the calculations of overpayments unless the prescription 
              <ln numlevel="1" lineno="668" slineno="7-66"/>is considered a misfill;
            </subsection>
            <subsection ssid="7-46" dnum="ii-o" numlevel="1" lineno="669" slineno="7-67" tab="1">
              <display>(ii)</display>recoup funds for prescription clerical or recordkeeping errors, including 
              <ln numlevel="1" lineno="670" slineno="7-68"/>typographical errors, scrivener's errors, and computer errors on a required 
              <ln numlevel="1" lineno="671" slineno="7-69"/>document or record unless the audit entity is alleging fraud or other intentional or 
              <ln numlevel="1" lineno="672" slineno="7-70"/>willful misrepresentation and the audit entity has evidence that the pharmacy's 
              <ln numlevel="1" lineno="673" slineno="7-71"/>actions reasonably indicate fraud or intentional and willful misrepresentation;
            </subsection>
            <subsection ssid="7-47" dnum="iii-o" numlevel="1" lineno="674" slineno="7-72" tab="1">
              <display>(iii)</display>recoup funds for refills dispensed in accordance with Section 
              <xref depth="3" refnumber="58-17b-608.1">58-17b-608.1</xref>, 
              <ln numlevel="1" lineno="675" slineno="7-73"/>unless the health benefit plan does not cover the prescription drug dispensed by 
              <ln numlevel="1" lineno="676" slineno="7-74"/>the pharmacy;
            </subsection>
            <subsection ssid="7-48" dnum="iv-o" numlevel="1" lineno="677" slineno="7-75" tab="1">
              <display>(iv)</display>collect any funds, charge-backs, or penalties until the audit and all appeals are 
              <ln numlevel="1" lineno="678" slineno="7-76"/>final, unless the audit entity is alleging fraud or other intentional or willful 
              <ln numlevel="1" lineno="679" slineno="7-77"/>misrepresentation and the audit entity has evidence that the pharmacy's actions 
              <ln numlevel="1" lineno="680" slineno="7-78"/>reasonably indicate fraud or intentional and willful misrepresentation; or
            </subsection>
            <subsection ssid="7-49" dnum="v-o" numlevel="1" lineno="681" slineno="7-79" tab="1">
              <display>(v)</display>recoup funds or collect any funds, charge-backs, or penalties from a pharmacy in 
              <ln numlevel="1" lineno="682" slineno="7-80"/>response to a request for audit unless the pharmacy confirms to the entity the date 
              <ln numlevel="1" lineno="683" slineno="7-81"/>on which the pharmacy received the request for audit.
            </subsection>
          </subsection>
          <subsection ssid="7-50" dnum="b-o" numlevel="1" lineno="684" slineno="7-82">
            <display>(b)</display>Auditors shall only have access to previous audit reports on a particular pharmacy if 
            <ln numlevel="1" lineno="685" slineno="7-83"/>the previous audit was conducted by the same entity except as required for 
            <ln numlevel="1" lineno="686" slineno="7-84"/>compliance with state or federal law.
          </subsection>
        </subsection>
        <subsection ssid="7-51" dnum="5-o" numlevel="1" lineno="687" slineno="7-85">
          <display>(5)</display>A pharmacy subject to an audit:
          <subsection ssid="7-52" dnum="a-o" numlevel="1" lineno="688" slineno="7-86">
            <display>(a)</display>may use one or more of the following to validate a claim for a prescription, refill, or  
            <ln numlevel="1" lineno="689" slineno="7-87"/>change in a prescription:
            <subsection ssid="7-53" dnum="i-o" numlevel="1" lineno="690" slineno="7-88">
              <display>(i)</display>electronic or physical copies of records of a health care facility, or a health care  
              <ln numlevel="1" lineno="691" slineno="7-89"/>provider with prescribing authority;
            </subsection>
            <subsection ssid="7-54" dnum="ii-o" numlevel="1" lineno="692" slineno="7-90">
              <display>(ii)</display>any prescription that complies with state law;
            </subsection>
            <subsection ssid="7-55" dnum="iii-o" numlevel="1" lineno="693" slineno="7-91">
              <display>(iii)</display>the pharmacy's own physical or electronic records; or
            </subsection>
            <subsection ssid="7-56" dnum="iv-o" numlevel="1" lineno="694" slineno="7-92">
              <display>(iv)</display>the physical or electronic records, or valid copies of the physical or electronic  
              <ln numlevel="1" lineno="695" slineno="7-93"/>records, of a practitioner or health care facility as defined in Section  
              <xref depth="3" refnumber="26B-2-201">26B-2-201</xref>;  
              <ln numlevel="1" lineno="696" slineno="7-94"/>and
            </subsection>
          </subsection>
          <subsection ssid="7-57" dnum="b-o" numlevel="1" lineno="697" slineno="7-95">
            <display>(b)</display>may not be required to provide the following records to validate a claim for a  
            <ln numlevel="1" lineno="698" slineno="7-96"/>prescription, refill, or change in a prescription:
            <subsection ssid="7-58" dnum="i-o" numlevel="1" lineno="699" slineno="7-97">
              <display>(i)</display>if the prescription was handwritten, the physical handwritten version of the  
              <ln numlevel="1" lineno="700" slineno="7-98"/>prescription; or
            </subsection>
            <subsection ssid="7-59" dnum="ii-o" numlevel="1" lineno="701" slineno="7-99">
              <display>(ii)</display>a note from the practitioner regarding the patient or the prescription that is not  
              <ln numlevel="1" lineno="702" slineno="7-100"/>otherwise required for a prescription under state or federal law.
            </subsection>
          </subsection>
        </subsection>
        <subsection ssid="7-60" dnum="6-o" numlevel="1" lineno="703" slineno="7-101" space="false">
          <display>(6)</display>
          <subsection ssid="7-61" dnum="a-o" placement="sameline" space="false">
            <display>(a)</display>
            <subsection ssid="7-62" dnum="i-o" tab="1" placement="sameline">
              <display>(i)</display>An entity that audits a pharmacy shall establish:
              <subsection ssid="7-63" dnum="A-o" numlevel="1" lineno="704" slineno="7-102" tab="2">
                <display>(A)</display>a maximum time for the pharmacy to submit records or other documents to 
                <ln numlevel="1" lineno="705" slineno="7-103"/>the entity following receipt of an audit request for records or documents; and
              </subsection>
              <subsection ssid="7-64" dnum="B-o" numlevel="1" lineno="706" slineno="7-104" tab="2">
                <display>(B)</display>a maximum time for the entity to provide the pharmacy with a preliminary 
                <ln numlevel="1" lineno="707" slineno="7-105"/>audit report following submission of records under Subsection (6)(a)(i)(A).
              </subsection>
            </subsection>
            <subsection ssid="7-65" dnum="ii-o" numlevel="1" lineno="708" slineno="7-106" tab="1">
              <display>(ii)</display>The time limits established under Subsections (6)(a)(i)(A) and (B):
              <subsection ssid="7-66" dnum="A-o" numlevel="1" lineno="709" slineno="7-107">
                <display>(A)</display>shall be identical; and
              </subsection>
              <subsection ssid="7-67" dnum="B-o" numlevel="1" lineno="710" slineno="7-108">
                <display>(B)</display>may not be less than seven days or more than 60 days.
              </subsection>
            </subsection>
            <subsection ssid="7-68" dnum="iii-o" numlevel="1" lineno="711" slineno="7-109" tab="1">
              <display>(iii)</display>An entity that audits a pharmacy may not, after the audit completion date, 
              <ln numlevel="1" lineno="712" slineno="7-110"/>request additional records or other documents from the pharmacy to complete the 
              <ln numlevel="1" lineno="713" slineno="7-111"/>preliminary audit report described in Subsection (6)(b).
            </subsection>
          </subsection>
          <subsection ssid="7-69" dnum="b-o" numlevel="1" lineno="714" slineno="7-112">
            <display>(b)</display>An entity that audits a pharmacy shall provide the pharmacy with a preliminary audit 
            <ln numlevel="1" lineno="715" slineno="7-113"/>report
            <amendoutstart style="5"/>
            <amend anum="0" ea="erase" pairid="8" style="2" owner="ahaskell" level="1" deltag="both">,</amend>
            <amendoutend style="5"/>
            <amend anum="0" ea="amend" pairid="9" style="1" owner="ahaskell" level="1" amendtag="both" space="true">:</amend>
            <subsection ssid="7-70" dnum="_-o:i-e" ea="amend" anum="0" owner="ahaskell" style="1" numlevel="1" lineno="716" slineno="7-114">
              <display>
                <amend anum="0" ea="amend" pairid="107" style="1" owner="e" level="1" amendtag="both">(i)</amend>
              </display>delivered to the pharmacy or its corporate office of record, within the time limit 
              <ln numlevel="1" lineno="717" slineno="7-115"/>established under Subsection (6)(a)(i)(B)
              <amendoutstart style="5"/>
              <amend anum="0" ea="erase" pairid="11" style="2" owner="ahaskell" level="1" deltag="both">.</amend>
              <amendoutend style="5"/>
              <amend anum="0" ea="amend" pairid="12" style="1" owner="ahaskell" level="1" amendtag="both" space="true">; and</amend>
            </subsection>
            <subsection ssid="7-71" dnum="_-o:ii-e" ea="amend" anum="0" owner="ahaskell" style="1" numlevel="1" lineno="718" slineno="7-116">
              <display>
                <amend anum="0" ea="amend" pairid="108" style="1" owner="e" level="1" amendtag="start">(ii)</amend>
              </display>
              <amend anum="0" ea="amend" pairid="15" style="1" owner="ahaskell" level="1" amendtag="end">that includes a notation and detailed explanation for each suspected error.</amend>
            </subsection>
          </subsection>
          <subsection ssid="7-72" dnum="c-o" numlevel="1" lineno="719" slineno="7-117" space="false">
            <display>(c)</display>
            <subsection ssid="7-73" dnum="i-o" placement="sameline">
              <display>(i)</display>Except as provided in Subsection (6)(c)(ii), a pharmacy has 30 days following 
              <ln numlevel="1" lineno="720" slineno="7-118"/>receipt of the preliminary audit report to respond to questions, provide additional 
              <ln numlevel="1" lineno="721" slineno="7-119"/>documentation, and comment on and clarify findings of the audit.
            </subsection>
            <subsection ssid="7-74" dnum="ii-o" numlevel="1" lineno="722" slineno="7-120">
              <display>(ii)</display>An entity may grant a reasonable extension under Subsection (6)(c)(i) upon 
              <ln numlevel="1" lineno="723" slineno="7-121"/>request by the pharmacy.
            </subsection>
            <subsection ssid="7-75" dnum="iii-o" numlevel="1" lineno="724" slineno="7-122">
              <display>(iii)</display>Receipt of the report under Subsection (6)(c)(i) shall be determined by:
              <subsection ssid="7-76" dnum="A-o" numlevel="1" lineno="725" slineno="7-123">
                <display>(A)</display>postmark or other evidence of the date of mailing; or
              </subsection>
              <subsection ssid="7-77" dnum="B-o" numlevel="1" lineno="726" slineno="7-124">
                <display>(B)</display>the date of transmission if the report is transmitted electronically.
              </subsection>
            </subsection>
            <subsection ssid="7-78" dnum="iv-o" numlevel="1" lineno="727" slineno="7-125">
              <display>(iv)</display>If a dispute exists between the records of the auditing entity and the pharmacy, 
              <ln numlevel="1" lineno="728" slineno="7-126"/>the records maintained by the pharmacy shall be presumed valid for the purpose 
              <ln numlevel="1" lineno="729" slineno="7-127"/>of the audit.
            </subsection>
          </subsection>
        </subsection>
        <subsection ssid="7-79" dnum="7-o" numlevel="1" lineno="730" slineno="7-128">
          <display>(7)</display>If an audit results in the dispute or denial of a claim, the entity conducting the audit shall  
          <ln numlevel="1" lineno="731" slineno="7-129"/>allow
          <amend anum="0" ea="amend" pairid="17" style="1" owner="ahaskell" level="1" amendtag="both"> any of the following</amend>:
          <subsection ssid="7-80" dnum="a-o" numlevel="1" lineno="732" slineno="7-130">
            <display>(a)</display>the pharmacy to resubmit a claim using any commercially reasonable method,  
            <ln numlevel="1" lineno="733" slineno="7-131"/>including fax, mail, or electronic claims submission  
            <amendoutstart style="5"/>
            <amend anum="0" ea="erase" pairid="18" style="2" owner="ahaskell" level="1" deltag="both">provided that the period of time  
              <ln numlevel="1" lineno="734" slineno="7-132"/>when a claim may be resubmitted has not expired under the rules of the plan sponsor;  
              <ln numlevel="1" lineno="735" slineno="7-133"/>and
            </amend>
            <amendoutend style="5"/>
            <amend anum="0" ea="amend" pairid="19" style="1" owner="ahaskell" level="1" amendtag="both" space="true">within 30 days from the day on which the audit report is received by the 
              <ln numlevel="1" lineno="736" slineno="7-134"/>pharmacy; or
            </amend>
          </subsection>
          <subsection ssid="7-81" dnum="b-o" numlevel="1" lineno="737" slineno="7-135">
            <display>(b)</display>the health benefit plan or other entity that finances or reimburses the cost of health  
            <ln numlevel="1" lineno="738" slineno="7-136"/>care services or pharmaceutical products to rerun the claim if the health benefit plan  
            <ln numlevel="1" lineno="739" slineno="7-137"/>or other entity chooses to rerun the claim at no cost to the pharmacy.
          </subsection>
        </subsection>
        <subsection ssid="7-82" dnum="8-o" numlevel="1" lineno="740" slineno="7-138" space="false">
          <display>(8)</display>
          <subsection ssid="7-83" dnum="a-o" placement="sameline">
            <display>(a)</display>Within 60 days after the completion of the appeals process under Subsection (9), 
            <ln numlevel="1" lineno="741" slineno="7-139"/>a final audit report shall be delivered to the pharmacy or its corporate office of record.
          </subsection>
          <subsection ssid="7-84" dnum="b-o" numlevel="1" lineno="742" slineno="7-140">
            <display>(b)</display>The final audit report shall include
            <amend anum="0" ea="amend" pairid="38" style="1" owner="ahaskell" level="1" amendtag="both">:</amend>  
            <subsection ssid="7-85" dnum="_-o:i-e" ea="amend" anum="0" owner="ahaskell" style="1" numlevel="1" lineno="743" slineno="7-141">
              <display>
                <amend anum="0" ea="amend" pairid="122" style="1" owner="e" level="1" amendtag="both">(i)</amend>
              </display>a disclosure of any money recovered by the entity that conducted the audit
              <amendoutstart style="5"/>
              <amend anum="0" ea="erase" pairid="22" style="2" owner="ahaskell" level="1" deltag="both">.</amend>
              <amendoutend style="5"/>
              <amend anum="0" ea="amend" pairid="23" style="1" owner="ahaskell" level="1" amendtag="both" space="true">; and</amend>
            </subsection>
            <subsection ssid="7-86" dnum="_-o:ii-e" ea="amend" anum="0" owner="ahaskell" style="1" numlevel="1" lineno="744" slineno="7-142">
              <display>
                <amend anum="0" ea="amend" pairid="123" style="1" owner="e" level="1" amendtag="start">(ii)</amend>
              </display>
              <amend anum="0" ea="amend" pairid="26" style="1" owner="ahaskell" level="1" amendtag="end">legal or contractual information supporting any money recovered, recoupments, 
                <ln numlevel="1" lineno="745" slineno="7-143"/>or penalties included in the report.
              </amend>
            </subsection>
          </subsection>
        </subsection>
        <subsection ssid="7-87" dnum="9-o" numlevel="1" lineno="746" slineno="7-144" space="false">
          <display>(9)</display>
          <subsection ssid="7-88" dnum="a-o" placement="sameline">
            <display>(a)</display>An entity that audits a pharmacy shall establish a written appeals process for 
            <ln numlevel="1" lineno="747" slineno="7-145"/>appealing a preliminary audit report and a final audit report, and shall provide the 
            <ln numlevel="1" lineno="748" slineno="7-146"/>pharmacy with notice of the written appeals process.
          </subsection>
          <subsection ssid="7-89" dnum="b-o" numlevel="1" lineno="749" slineno="7-147">
            <display>(b)</display>If the pharmacy benefit manager's contract or provider manual contains the 
            <ln numlevel="1" lineno="750" slineno="7-148"/>information required by this Subsection (9), the requirement for notice is met.
          </subsection>
        </subsection>
        <subsection ssid="7-90" dnum="_-o:10-e" ea="amend" anum="0" owner="ahaskell" style="1" numlevel="1" lineno="751" slineno="7-149">

            <amend anum="0" ea="amend" pairid="34" style="1" owner="ahaskell" level="1" amendtag="end">compensate an employee or contractor participating in the audit in a manner that is  
              <ln numlevel="1" lineno="756" slineno="7-154"/>based on the amount claimed or the actual amount recouped from the pharmacy being

              <display>(iii)</display>a pharmacy licensed under Chapter 17b, Pharmacy Practice Act;
            </subsection>
          </subsection>

            <display>(b)</display>dispensed:
            <subsection ssid="8-7" numlevel="1" lineno="768" slineno="8-11" dnum="i-o">
              <display>(i)</display>at a licensed dispensing practice at which the dispensing practitioner regularly

            <ln numlevel="1" lineno="774" slineno="8-17"/>practitioner on the same day on which the dispensing practitioner dispenses the drug.
          </subsection>
        </subsection>
        <subsection ssid="8-11" numlevel="1" lineno="775" slineno="8-18" dnum="2-o">
          <display>(2)</display>A dispensing practitioner may not dispense:
          <subsection ssid="8-12" numlevel="1" lineno="776" slineno="8-19" dnum="a-o">
            <display>(a)</display>a controlled substance as defined in Section  
            <xref depth="3" refnumber="58-37-2">58-37-2</xref>;
          </subsection>
          <subsection ssid="8-13" numlevel="1" lineno="777" slineno="8-20" dnum="b-o">
            <display>(b)</display>a drug or class of drugs that is designated by the division under Subsection  
            <xref depth="3" refnumber="58-88-205">58-88-205</xref>
            <ln numlevel="1" lineno="778" slineno="8-21"/>(2);
          </subsection>
          <subsection ssid="8-14" numlevel="1" lineno="779" slineno="8-22" dnum="c-o">
            <display>(c)</display>gabapentin; or
          </subsection>
          <subsection ssid="8-15" numlevel="1" lineno="780" slineno="8-23" dnum="d-o">
            <display>(d)</display>a supply of a drug under this part that exceeds a 30-day supply.
          </subsection>
        </subsection>
        <subsection ssid="8-16" numlevel="1" lineno="781" slineno="8-24" dnum="3-o">
          <display>(3)</display>A dispensing practitioner may not make a claim against workers' compensation or  
          <ln numlevel="1" lineno="782" slineno="8-25"/>automobile insurance for a drug dispensed under this part for outpatient use unless the  
          <ln numlevel="1" lineno="783" slineno="8-26"/>dispensing practitioner is contracted with a pharmacy network established by the claim  
          <ln numlevel="1" lineno="784" slineno="8-27"/>payor.
        </subsection>
        <subsection ssid="8-17" numlevel="1" lineno="785" slineno="8-28" dnum="4-o">
          <display>(4)</display>When a dispensing practitioner dispenses a drug to the patient under this part, a  
          <ln numlevel="1" lineno="786" slineno="8-29"/>dispensing practitioner shall:
          <subsection ssid="8-18" numlevel="1" lineno="787" slineno="8-30" dnum="a-o">
            <display>(a)</display>disclose to the patient verbally and in writing that the patient is not required to fill the  
            <ln numlevel="1" lineno="788" slineno="8-31"/>prescription through the licensed dispensing practice and that the patient has a right  
            <ln numlevel="1" lineno="789" slineno="8-32"/>to fill the prescription through a pharmacy; and
          </subsection>
          <subsection ssid="8-19" numlevel="1" lineno="790" slineno="8-33" dnum="b-o">
            <display>(b)</display>if the patient will be responsible to pay cash for the drug, disclose:
            <subsection ssid="8-20" numlevel="1" lineno="791" slineno="8-34" dnum="i-o">
              <display>(i)</display>that the patient will be responsible to pay cash for the drug; and
            </subsection>
            <subsection ssid="8-21" numlevel="1" lineno="792" slineno="8-35" dnum="ii-o">
              <display>(ii)</display>the amount that the patient will be charged by the licensed dispensing practice for  
              <ln numlevel="1" lineno="793" slineno="8-36"/>the drug.
            </subsection>
          </subsection>
        </subsection>
        <subsection ssid="8-22" numlevel="1" lineno="794" slineno="8-37" dnum="5-o">
          <display>(5)</display>This part does not:
          <subsection ssid="8-23" numlevel="1" lineno="795" slineno="8-38" dnum="a-o">
            <display>(a)</display>require a dispensing practitioner to dispense a drug under this part;
          </subsection>
          <subsection ssid="8-24" numlevel="1" lineno="796" slineno="8-39" dnum="b-o">
            <display>(b)</display>limit a health care prescriber from dispensing under Chapter 17b, Part 8, Dispensing  
            <ln numlevel="1" lineno="797" slineno="8-40"/>Medical Practitioner and Dispensing Medical Practitioner Clinic Pharmacy; or
          </subsection>
          <subsection ssid="8-25" numlevel="1" lineno="798" slineno="8-41" dnum="c-o">
            <display>(c)</display>apply to a physician who dispenses:
            <subsection ssid="8-26" numlevel="1" lineno="799" slineno="8-42" dnum="i-o">
              <display>(i)</display>a drug sample, as defined in Section  
              <xref depth="3" refnumber="58-17b-102">58-17b-102</xref>, to a patient in accordance with  
              <ln numlevel="1" lineno="800" slineno="8-43"/>Section  
              <xref depth="3" refnumber="58-1-501.3">58-1-501.3</xref> or Section  
              <xref depth="3" refnumber="58-17b-610">58-17b-610</xref>;
              <amend anum="0" ea="amend" pairid="1" style="1" owner="ahaskell" level="1" amendtag="both"> or</amend>
            </subsection>
            <subsection ssid="8-27" ea="erase" anum="0" owner="ahaskell" style="2" numlevel="1" lineno="801" slineno="8-44" dnum="ii-o:_-e">
              <display>
