8    A JOINT RESOLUTION OF THE LEGISLATURE MODIFYING LEGISLATIVE TRAVEL
9    AND LODGING EXPENSE REQUIREMENTS; MAKING TECHNICAL CORRECTIONS;
10    AND PROVIDING AN EFFECTIVE DATE.
11    This resolution affects legislative rules as follows:
12    AMENDS:
13         JR-15.02
14         JR-15.03
15    Be it resolved by the Legislature of the state of Utah:
16        Section 1. JR-15.02 is amended to read:
17         JR-15.02. Expenses While in Session.
18        The following rules govern legislative expenses when the Legislature is in annual general
19    session, veto override session, or special session:
20        (1) Each legislator shall receive a subsistence allowance of $35 per day for each calendar
21    day of the session.
22        (2) (a) Each legislator shall receive transportation costs to and from the session.
23        (b) These costs shall be computed on the basis of actual mileage for private automobile
24    use or the actual cost of alternative commercial transportation.
25        [(3) During the session, legislators residing in Salt Lake County or Davis County shall
26    receive actual mileage between their places of residence and the state capitol.]
27        [(4) During] (3) For each day during the session, legislators [residing outside of Salt Lake


1    County or Davis County] shall receive either:
2        (a) actual mileage between their places of residence and the state capitol; or
3        (b) a lodging allowance at the rates established by the Division of Finance under Sections
4    63A-3-106 and 63A-3-107 for each calendar day of the session.
5        [(5)] (4) (a) In making the daily election under Subsection [(4)] (3), each legislator [is
6    required to] shall affirm in writing that the legislator:
7        (i) has either actually commuted or has actually obtained lodging; and
8        (ii) is being reimbursed only for the option the legislator has selected.
9        (b) The Legislative Expenses Oversight Committee established in JR-15.05, [is
10    responsible for insuring] shall ensure that legislators do not receive duplicate or improper
11    reimbursements.
12        [(6)] (5) (a) In addition to actual transportation or actual lodging allowance, each legislator
13    is also entitled to a travel budget equal to the cost of one weekly round trip between the state
14    capitol and the legislator's place of residence.
15        (b) Transportation costs shall be computed on the basis of actual mileage or the actual cost
16    of alternative commercial transportation.
17        [(7) In emergency situations, including inclement weather, the presiding officer and the
18    majority and minority leaders of each house may authorize a lodging allowance at the rates
19    established by the Division of Finance under Sections 63A-3-106 and 63A-3-107 for legislators
20    residing in Salt Lake County or Davis County who actually incur that expense.]
21        Section 2. JR-15.03 is amended to read:
22         JR-15.03. Expenses While Not in Session.
23        The following rules govern legislative expenses for attendance at authorized legislative
24    meetings when the Legislature is not in session:
25        (1) Authorized legislative meetings include interim committees and subcommittees,
26    management committee and subcommittees, and the meetings of any other body where legislative
27    participation is required by law or authorized by the Legislative Management Committee.
28        (2) Each legislator shall receive a subsistence allowance of $35 per day for each day that
29    the legislator attends an authorized legislative meeting.
30        (3) (a) Each legislator shall receive transportation costs to and from the authorized
31    legislative committee meeting. [These]

1        (b) Transportation costs shall be computed on the basis of actual mileage for private
2    automobile use or the actual cost of alternative commercial transportation.
3        (4) (a) If the authorized legislative committee meeting exceeds one day, or attendance at
4    the meeting necessitates overnight accommodations, [expenses shall be provided as follows]
5    legislators shall receive either:
6        [(a) If the meeting is held in Salt Lake County or Davis County, legislators residing in Salt
7    Lake County or Davis County shall also receive actual mileage between their places of residence
8    and the location of the meeting.]
9        [(b) If the meeting is held in Salt Lake County or Davis County, legislators residing
10    outside of Salt Lake County or Davis County shall also receive either:]
11        (i) actual mileage between their places of residence and the location of the meeting; or
12        (ii) a lodging allowance at the rates established by the Division of Finance under Section
13    63A-3-106 and 63A-3-107 for each day the legislator attends the authorized legislative meeting.
14        [(c)] (b) (i) In making the election under Subsection (4)[(b)] (a), each legislator [is required
15    to] shall affirm in writing that [he] the legislator:
16        (A) has either actually commuted or obtained lodging; and
17        (B) is being reimbursed only for the option the legislator has selected.
18        (ii) The Legislative Expenses Oversight Committee established in JR-15.05 [is responsible
19    for insuring] shall ensure that legislators do not receive duplicate or improper reimbursements.
20        [(d) If the authorized legislative meeting is held at a location outside of Salt Lake County
21    or Davis County, all legislators residing outside of the county where the meeting is held are
22    entitled to the expenses outlined in Subsection (4)(b). Legislators residing in the county where the
23    meeting is held are entitled to the expenses outlined in Subsection (4)(a).]
24        Section 3. Effective date.
25        This resolution takes effect upon approval by a constitutional majority vote of all members
26    of the Senate and House of Representatives.
