State Impact:
It is estimated that the State's Risk Management Agency will investigate about 25 or more additional cases per year as a result of this legislation. The cost to the
Risk Management Pool for the investigation and the defense of the employee (if it is found the State is not immune) is estimated at $500,000 annually. Since liability
premiums for FY 2002 have already been set by the Legislature, Risk Management will need an appropriation of $500,000 from the General Fund for that year. For FY2003
and subsequent years, the additional cost would become part of the agencies' premiums. The Department of Human Services will bear about 55 percent of the premium
increase. In addition, the cost to the Attorney General's Office is estimated at $340,000 in FY 2002, and $328,600 in subsequent years.
