Terms of Use

The information made available at a web site maintained by the staff offices of the Utah State Legislature ("legislative web site") is made available on the web site as a public service. Use of a legislative web site is subject to the following statement of terms of use.

1. No Warranties/Assumption of the Risk

The Utah State Legislature, its offices, its employees, and its agents ("Legislature") attempt to ensure that the information made available on a legislative web site is accurate and complete. However, the public is given access to information on a legislative web site on a strictly "as is" basis. The Legislature disclaims any express or implied warranties related to making a legislative web site available for public use or to any materials, information, graphics, products, or processes contained within the legislative web site. The Legislature makes no warranty, express or implied, nor assumes any responsibility for the use of information on a legislative web site or for a legislative web site's fitness for any general or particular purpose. The Legislature does not warrant that the use of information on a legislative web site will not infringe or violate the rights of others. The Legislature is not responsible for the conduct of the users of a legislative web site.

The Legislature disclaims legal responsibility for the personal opinions of individuals posted on any site, regardless of whether the Legislature operates the site, unless the personal opinions are official opinions issued by the Utah State Legislature. No other sections of this statement of terms of use are applicable to external sites.

4. Copyright Limitations

The Legislature makes no warranty that information on a legislative web site is free from copyright claims or other restrictions or limitations on free use or display. The Legislature disclaims any liability for the improper or incorrect use of information obtained from a legislative web site. The Legislature cannot guarantee against unauthorized modifications of information or errors made in inputting or posting data.

5. Monitoring and Protecting the System

Legislative web sites are subject to monitoring to assure proper functioning of the sites and to provide security for the operation of legislative computer systems. By using a legislative web site, you are consenting to this monitoring. The Legislature reserves the right to use any legally appropriate measures to prevent and investigate anyone attempting to modify, deface, delete, or otherwise tamper with or abuse a legislative web site, server, database, information system, or other legislative technology asset.

6. Privacy

The "Utah State Legislature Web Site -- Privacy Policy" is incorporated by reference into this statement of terms of use for a legislative web site. The policy is generally available on a legislative web site.

7. Utah Law and Jurisdiction

The information made available for public use on a legislative web site is from computer systems located within Utah and are for the use and benefit of the Legislature and general public. Any person who uses a legislative web site or attempts to gain access to information on legislative computer systems is subject to Utah jurisdiction. Any dispute arising from the use or attempt to use information on a legislative web site shall be determined in accordance with Utah laws and in the courts of Utah.

Privacy Policy

The Utah State Legislature ("Legislature") is committed to protecting the privacy of those accessing a legislative web site. This policy is intended to inform those accessing a legislative website about the collection and use of the personally identifiable information. For the purposes of this policy:

1. Collection of Information

1.1 Information Automatically Collected

Information may be automatically collected and retained if you look at, search through, or download information from a legislative website, including the following:

Information that is automatically collected may be used to develop statistical analysis about the use of legislative websites so that the Legislature may continue to improve the design and access to online services. The Legislature does not use the information automatically collected to ascertain personally identifiable information.

The Legislature generally does not use cookies (files or file entries placed on a hard drive by a website) that allow monitoring of use of a legislative website. However, the Legislature does use cookies to maintain personal preferences for settings used in certain services provided by a legislative website such as the Bill Browser/Floor Calendar or bill tracking services. Also, some activities, such as certain search features of legislative websites, require the use of transient cookies. For example, transient cookies may be used to keep track of user selections so that new requests can be created more efficiently.

1.2 Personally Identifiable Information

Unless you choose to make your personally identifiable information available to us, the Legislature does not collect from you any personally identifiable information. The Legislature does not attempt to gain personally identifiable information about individual users and associate it with an IP address. Except when specified, you do not have to provide personally identifiable information to visit or download information from a legislative website.

The Legislature may ask for personally identifiable information from you in order to perform specialized services you request from a legislative web site such a listserv or a webwatch maintained by a staff office of the Legislature. Also, e-mail or other information requests sent to a legislative website may be saved for a period of time and used to respond to the request, forward the request to the appropriate agency, communicate updates to a legislative website, or provide the web designer of a legislative web site customer feedback to assist in improving the website.

2. Use and Sharing of Information

2.1 Personally Identifiable Information May Constitute a Public Record

Information provided to or collected by a legislative web site may be subject to disclosure under Utah Code, Title 63, Chapter 2, Government Records Access and Management Act (GRAMA). All records that are prepared, owned, received, or retained by a governmental entity that may be reproduced are considered public, unless they are private, controlled, or protected records as outlined under GRAMA or are records to which access is restricted according to court federal laws or regulations, state laws other than GRAMA, or court rules.

2.2 Personally Identifiable Information Is Not Sold or Leased

Personally identifiable information provided to a legislative website or by e-mail is not sold or leased to private companies or political organizations for marketing purposes.

3. Other Related Issues

3.1 Data Security and Quality

The Legislature is committed to data security and the data integrity of personally identifiable information available from or collected by legislative web sites. The Legislature has taken precautions to protect personally identifiable information from loss, misuse, or alteration. Any authorized third parties responsible for this information are committed to the same principles, and are required by contract to follow the same policies and guidelines as the Legislature in protecting this information. Visitors should be aware, however, that even though protections are in place, the Legislature cannot guarantee against the occurrence of hardware failure, unauthorized intrusion, or other technical problems.

The Legislature reserves the right to use any legally appropriate measures to prevent, monitor, and investigate any attempt to deface, delete, or otherwise tamper with or abuse a legislative website, server, database, information system, or other legislative technology asset.

3.2 External Links

Visitors may link to various websites from a legislative web page. The Legislature is not responsible for the privacy practices or content of external sites.

3.3 Changes to this Privacy Policy

This privacy policy may be changed at any time; any changes will be posted on this web page. The version number and date the policy was last revised will be noted on the policy. Information collected while a particular version of this policy is in effect will be handled in accordance with that version.
