6    AN ACT RELATING TO STATE AFFAIRS IN GENERAL; MODIFYING REQUIREMENTS
7    RELATED TO PROVISION OF TELECOMMUNICATIONS SERVICES; AND MAKING
8    TECHNICAL CORRECTIONS.
9    This act affects sections of Utah Code Annotated 1953 as follows:
10    AMENDS:
11         63A-6-106, as renumbered and amended by Chapter 212, Laws of Utah 1993
12    Be it enacted by the Legislature of the state of Utah:
13        Section 1. Section 63A-6-106 is amended to read:
14         63A-6-106. Subscription by state agencies and institutions.
15        (1) As used in this section:
16        (a) "Telecommunications" means the transmission or reception of signs, signals, writing,
17    images, sounds, messages, data, or other information of any nature by wire, radio, light waves, or
18    other electromagnetic means.
19        (b) "Telecommunications services and support" means providing the hardware, software,
20    maintenance, and upkeep of equipment used in telecommunications.
21        [(1) All] (2) Except as provided in Subsection (3), all state agencies shall subscribe to the
22    telecommunications services provided by the Division of Information Technology Services unless

23         h (a) h the state agency or department complies with the requirements of Section 63A-6-104
23a     h [. ] ;OR h

24         h [(3) Notwithstanding the requirements of Subsection (2), any state agency may contract
25    with any provider of their choosing for telecommunications service and support.

2 5a           h (b) THE STATE AGENCY PERFORMS A THOROUGH COST/BENEFIT ANALYSIS
2 5b      AND DETERMINES, WITH THE RECOMMENDATION OF THE GOVERNOR OR HIS DESIGNEE, THAT
2 5c      ALTERNATE PROVIDERS ARE AVAILABLE THAT CAN PROVIDE SERVICE THAT:
25d          (i) IS OF EQUAL OR BETTER QUALITY; AND
25e          (ii) MEETS THE UNIFORM STANDARDS AND PROTOCOLS ESTABLISHED BY THE CHIEF
2 5f      INFORMATION OFFICER UNDER 63A-6-302. h
26        [(2)] (4) An institution of higher education may subscribe to the services provided by the
27    division if:

1        (a) the president of the institution recommends that the institution subscribe to the services
2    of the division; and
3        (b) the Board of Regents determines that subscription to the services of the division will
4    result in cost savings or increased efficiency to the institution.
