5 AN ACT RELATING TO SPECIAL DISTRICTS; AUTHORIZING CERTAIN PUBLIC
6 TRANSIT DISTRICT SERVICES OUTSIDE OF A DISTRICT'S AREA; AND
7 RESTRICTING THE NAMES OF PUBLIC TRANSIT DISTRICTS.
8 This act affects sections of Utah Code Annotated 1953 as follows:
9 AMENDS:
10 17A-2-1004, as last amended by Chapter 79, Laws of Utah 1996
11 ENACTS:
12 17A-2-1060, Utah Code Annotated 1953
13 17A-2-1061, Utah Code Annotated 1953
14 Be it enacted by the Legislature of the state of Utah:
15 Section 1. Section 17A-2-1004 is amended to read:
16 17A-2-1004. Definitions.
17 As used in this part:
18 (1) "District" means a public transit district organized under this part.
19 [
20 (3) "Public agency" includes the state of Utah and any county, city, town, district, or other
21 public agency or entity created under the laws of this state, the federal government, and any agency
22 thereof.

24 baggage by means other than chartered bus, sightseeing bus, taxi, or other vehicle not on an
25 individual passenger fare paying basis. [

9 Section 2. Section 17A-2-1060 is enacted to read:
10 17A-2-1060. Transit district special services.
11 (1) As used in this section, "bureau" means a recreational, tourist, or convention bureau
12 established under Section 17-31-2.
13 (2) (a) A district may lease its buses to private certified public carriers or operate transit
14 services requested by a governmental entity when a bureau certifies that privately owned carriers
15 furnishing like services or operating like equipment within the area served by the bureau have
16 declined to provide the service or do not have the equipment necessary to provide the service.
17 (b) A district may lease its buses or operate services as authorized under Subsection (2)(a)
18 outside of the area served by the district.
19 (3) A district may provide school bus services for transportation of pupils and supervisory
20 personnel between homes and school and other related school activities within the area served by
21 the district, or may provide the transportation of passengers covered by an elderly or handicapped
22 program within the district where all or part of the transportation services are paid for by public
23 funds.
24 Section 3. Section 17A-2-1061 is enacted to read:
25 17A-2-1061. Transit district name restrictions.
26 Beginning January 1, 1998, a district may not use the words "state" or "Utah" in its name.
