5 AN ACT RELATING TO THE CRIMINAL CODE; CREATING ASSAULT AGAINST
6 HEALTH CARE PROVIDERS AND BASIC LIFE SUPPORT PERSONNEL; AND
7 PROVIDING A PENALTY.
8 This act affects sections of Utah Code Annotated 1953 as follows:
9 ENACTS:
10 76-5-102.7, Utah Code Annotated 1953
11 Be it enacted by the Legislature of the state of Utah:
12 Section 1. Section 76-5-102.7 is enacted to read:
13 76-5-102.7. Assault against health care provider and basic life support worker --
14 Penalty.
15 (1) A person who assaults a health care provider or basic life support worker is guilty of
16 a class A misdemeanor if:
17 (a) the person knew that the victim was a health care provider or basic life support worker;
18 and
19 (b) the health care provider or basic life support worker was performing emergency or life
20 saving duties within the scope of his authority at the time of the assault.
21 (2) As used in this section:
22 (a) "Basic life support worker" has the same meaning as "basic life support personnel"
23 provided in Section 26-8-2.
24 (b) "Health care provider" has the meaning as provided in Section 78-14-3.
