6    AN ACT RELATING TO APPROPRIATIONS; PROVIDING AN APPROPRIATION OF
7    $1,100,000 FROM THE GENERAL FUND FOR FISCAL YEAR 1997 TO THE
8    DEPARTMENT OF ECONOMIC DEVELOPMENT TO BE ALLOCATED TO THE
9    SPRINGVILLE MUSEUM OF ART ON A MATCHING BASIS FOR A CHILDREN'S ART
10    FACILITY EXPANSION; AND PROVIDING AN EFFECTIVE DATE.
11    This act enacts uncodified material.
12    Be it enacted by the Legislature of the state of Utah:
13        Section 1. Appropriation.
14        (1) There is appropriated $1,100,000 from the General Fund for fiscal year 1997-98 to the
15    Department of Community and Economic Development for the Springville Museum of Art.
16        (2) The funds appropriated under Subsection (1) shall be:
17        (a) distributed on a matching basis with every state dollar being matched with two dollars
18    raised by the Springville Museum of Art from any other source; and
19        (b) used to benefit Utah students, teachers, and families in furtherance of the state's interest
20    in preserving and displaying Utah's rich cultural heritage of fine arts, expanding creative and
21    educational horizons, promoting travel and tourism, and sustaining the educational and cultural
22    mission of the Springville Museum of Art through:
23        (i) a 16,500 square foot expansion of the museum for:
24        (A) a gallery dedicated to the annual Utah All-State High School Exhibition and other
25    western regional exhibitions of children's art;
26        (B) a gallery dedicated to children's art by prominent Utah artists;
27        (C) an instructional gallery to teach Utah students about art;


1        (D) a center for the statewide partnership of Utah art educators to promote Utah school
2    district collections and the evening for educators program; and
3        (E) increased exhibition space for Utah art and improved preservation of Utah
4    masterpieces; and
5        (ii) upgrading the structure of the museum to meet:
6        (A) the American Association of Museums Accreditation Standards;
7        (B) the Americans' with Disabilities Act, 42 U.S.C. Sec. 12101 et seq.; and
8        (C) applicable building codes.
9        Section 2. Effective date.
10        This act takes effect on July 1, 1997.

This bill raises the following constitutional or statutory concerns:

    
Article XIII, Section 5 of the Utah Constitution prohibits the Legislature from imposing a tax
for the purpose of any county, city, town or other municipal corporation. The bill does not
violate Article XIII, Section 5 to the extent that the Springville Museum of Art can be
considered as operating for a statewide purpose instead of a local purpose.
