APPLICATION FOR WATER RIGHTS

5    AN ACT RELATING TO WATER AND IRRIGATION; ELIMINATING THE REQUIREMENT
6    OF SENDING A COPY OF A WATER RIGHT APPLICATION TO THE APPLICANT
7    UPON APPROVAL OR REJECTION; AND MAKING TECHNICAL CHANGES.
8    This act affects sections of Utah Code Annotated 1953 as follows:
9    AMENDS:
10         73-3-10, as last amended by Chapter 137, Laws of Utah 1959
11    Be it enacted by the Legislature of the state of Utah:
12        Section 1. Section 73-3-10 is amended to read:
13         73-3-10. Approval or rejection of application.
14        [The] (1) When the approval or rejection of an application [shall be endorsed thereon and]
15    is decided, a record of the decision shall be made [of such endorsement] in the state engineer's
16    office. [A copy of the application so endorsed]
17        (2) The state engineer's decision shall be [returned] mailed to the applicant[; if].
18        (3) If the application is approved, the applicant shall be authorized[, on] upon receipt
19    [thereof,] of the decision to:
20        (a) proceed with the construction of the necessary works [and];
21        (b) take [all] any steps required to apply the water to the use named in the application; and
22    [to]
23        (c) perfect the proposed [appropriation; if] application.
24        (4) If the application is rejected, the applicant shall take no steps toward the prosecution
25    of the proposed work or the diversion and use of the public water [so long as such rejection shall
26    continue in force] under the application.
27        (5) The state engineer shall state in [his endorsement of approval] any decision approving


1    an application the time within which the construction work [shall] must be completed and [the time
2    within which] the water [shall be] applied to beneficial use.
