5    AN ACT RELATING TO HUMAN SERVICES; ESTABLISHING AN ORDER OF PRIORITY
6    FOR THE COLLECTION OF CHILD SUPPORT BY THE OFFICE OF RECOVERY
7    SERVICES.
8    This act affects sections of Utah Code Annotated 1953 as follows:
9    AMENDS:
10         62A-11-104, as last amended by Chapter 258, Laws of Utah 1995
11    Be it enacted by the Legislature of the state of Utah:
12        Section 1. Section 62A-11-104 is amended to read:
13         62A-11-104. Duties of office.
14        The office has the following duties:
15        (1) to collect child support, in the following order of priority, from an obligor if the
16    department has:
17        (a) provided public assistance;
18        (b) contracted to collect support; or
19        (c) received an application for child support services;
20        (2) to carry out the obligations of the department contained in this chapter, in Title 78,
21    Chapters 45 and 45a, and in Title 77, Chapter 31, for the purpose of collecting child support;
22        (3) to recover public assistance provided to persons for which they were ineligible;
23        (4) to collect money due the department which could act to offset expenditures by the
24    state;
25        (5) to cooperate with the federal government in programs designed to recover health and
26    social service funds;
27        (6) to collect civil or criminal assessments, fines, fees, amounts awarded as restitution, and


1    reimbursable expenses owed to the state or any of its political subdivisions, if the office has
2    contracted to provide collection services;
3        (7) to implement income withholding for collection of child support in accordance with
4    Part 4 of this chapter; and
5        (8) to finance any costs incurred from collections, fees, General Fund appropriation,
6    contracts, and federal financial participation.
