8 REPEALING THE REQUIREMENT THAT DEPARTMENTS AND DIVISIONS ARE
9 SUBJECT TO SUNSET; REVISING THE AGENCIES SUBJECT TO REVIEW; PROVIDING
10 A DISCRETIONARY REVIEW PROCESS; AND PROVIDING AN EFFECTIVE DATE.

17 Be it enacted by the Legislature of the state of Utah:
18 Section 1. Section 63-55-101 is amended to read:
19 63-55-101. Title.
20 This chapter is known as the "[Utah] Legislative Oversight and Sunset Act."
21 Section 2. Section 63-55-102 is amended to read:
22 63-55-102. Agency defined -- Periodic termination of statutes and agencies --
23 Legislative review.
24 (1) As used in this chapter, "agency" means any state authority, board, commission,
25 department, division, office, or other agency, and the statute [or rule] that established it.
26 (2) The Legislature finds that the state should not regulate any area unless the regulation
27 is necessary to protect the health, safety, and welfare of the public.
28 (3) In order to make state government more productive and responsive to the people, it is
29 necessary to place many of the statutes and agencies of state government under Part 2 of this
30 chapter on a reauthorization schedule. Any statute or agency scheduled for termination under this
31 chapter is terminated unless the Legislature through affirmative act reauthorizes its existence. The

1 continued existence of a statute or agency subject to this chapter may not be reauthorized for a
2 period of more than ten years.
3 (4) It is the purpose of this chapter to terminate any statute or agency that is not meeting
4 a clear public purpose, and to improve the ability of state government to meet and fulfill legitimate
5 public purposes.
6 Section 3. Section 63-55-103 is amended to read:
7 63-55-103. Guidelines for conduct of review.
8 [Committees assigned by the Legislative Management Committee shall review each]
9 (1) Any statute or [state] agency scheduled for termination may be reviewed by an interim
10 committee at the direction of:
11 (a) Legislative Management Committee;
12 (b) the chairs of an interim committee; or
13 (c) an interim committee as approved by motion and majority vote of its membership. The
14 review shall begin not later than one year before scheduled termination and end before January 1
15 of the year in which termination is scheduled.
16 (2) In determining whether to reauthorize the statute or agency, the [interim committee]
17 agency overseeing the statute or agency scheduled for termination shall clearly identify for the
18 interim committee the public purpose and interest for which each statute or agency was originally
19 created and clearly identify whether that public purpose and interest is still relevant.
20 (3) The interim committee shall then consider:
21 [(1)] (a) the extent to which the statute or agency has operated in the public interest and
22 any areas in which the statute or agency needs to improve its ability to operate in the public
23 interest;
24 [(2)] (b) the extent to which existing statutes interfere with or assist the legitimate
25 functions of the statute or agency, and any other circumstances including budgetary, resource, and
26 personnel matters that have a bearing on the capacity of the statute or agency to serve the public
27 interest;
28 [(3)] (c) the extent to which the public has been encouraged to participate in the adoption
29 of the rules established in connection with the statute or agency;
30 [(4)] (d) the extent to which the statute's provisions or agency's programs and services are
31 duplicative of those offered by other statutes or state agencies;

1 [(5)] (e) the extent to which the objectives of the statute or agency have been accomplished
2 and their public benefit;
3 [(6)] (f) the adverse effect on the public of termination of the statute or agency; and
4 [(7)] (g) any other matter relevant to the review.
5 (4) It is the responsibility of any agency scheduled for termination or any agency which
6 has oversight responsibilities for a statute scheduled for termination to seek its reauthorization with
7 the Legislature.
8 Section 4. Section 63-55-204 is amended to read:
9 63-55-204. Repeal dates, Title 4.
10 [(1) The following divisions of the Department of Agriculture, created under the authority
11 of Section 4-2-4, are repealed on the following dates:]
12 [(a) The Division of Agricultural Development and Conservation is repealed July 1, 1997.]
13 [(b) Under the Division of Animal Industry:]
14 [(i) the Animal Identification Program is repealed July 1, 1997;]
15 [(ii) the Animal Health Program is repealed July 1, 1999; and]
16 [(iii) the Meat Inspection Program is repealed July 1, 1999.]
17 [(c) The Division of Food and Dairy, Weights and Measures, is repealed July 1, 2000.]
18 [(d) The Division of Marketing and Promotion is repealed July 1, 2002.]
