6    AN ACT RELATING TO OCCUPATIONS AND PROFESSIONS; PERMITTING A
7    GEOLOGIST TO PRACTICE GEOLOGY; AND DEFINING TERMS.
8    This act affects sections of Utah Code Annotated 1953 as follows:
9    ENACTS:
10         58-74-101, Utah Code Annotated 1953
11         58-74-102, Utah Code Annotated 1953
12         58-74-103, Utah Code Annotated 1953
13    Be it enacted by the Legislature of the state of Utah:
14        Section 1. Section 58-74-101 is enacted to read:

CHAPTER 74. PRACTICE OF GEOLOGY

16         58-74-101. Short title.
17        This chapter is known as the "Practice of Geology Act."
18        Section 2. Section 58-74-102 is enacted to read:
19         58-74-102. Definitions.
20        As used in this chapter:
21        (1) "Geologist" means a person who is a graduate of an accredited institution of higher
22    learning who has successfully completed a minimum of 30 semester or 45 quarter hours of
23    coursework in geology.
24        (2) "Geologist's seal" means the seal a geologist affixes to maps, drawings, plans,
25    specifications, plats, and other similar documents required by law or otherwise.
26        (3) "Geology" means:
27        (a) the science which treats of the earth in general, the earth's processes, and its history;


1        (b) investigation of the earth's crust and the rocks and other materials which compose it;
2    and
3        (c) the applied science of utilizing knowledge of the earth's history, processes, constituent
4    rocks, minerals, liquids, gases, measurements, volumes, and other materials for the use of
5    mankind.
6        (4) "Practice of Geology" means performing or offering to perform geological service or
7    work, including:
8        (a) consulting, investigating, evaluating, planning, mapping, and inspecting geological
9    work;
10        (b) affixing a geologist's seal; and
11        (c) research and teaching at a college or university.
12        Section 3. Section 58-74-103 is enacted to read:
13         58-74-103. Practice of geology.
14        A geologist may practice geology without a license issued under this title.
