6    AN ACT RELATING TO THE CRIMINAL CODE; AMENDING THE OFFENSE OF
7    INTERFERING WITH A PUBLIC SERVANT TO INCLUDE INTERFERING WITH THE
8    SERVICE OF PROCESS BY A PUBLIC SERVANT.
9    This act affects sections of Utah Code Annotated 1953 as follows:
10    AMENDS:
11         76-8-301, as last amended by Chapter 42, Laws of Utah 1993
12    Be it enacted by the Legislature of the state of Utah:
13        Section 1. Section 76-8-301 is amended to read:
14         76-8-301. Interference with public servant.
15        (1) A person is guilty of [a class B misdemeanor] interference with a public servant if he:
16        (a) uses force, violence, intimidation, or engages in any other unlawful act with a purpose
17    to interfere with a public servant performing or purporting to perform an official function; or
18        (b) knowingly or intentionally interferes with the lawful service of process by a public
19    servant.
20        (2) Interference with a public servant is a class B misdemeanor.
21        [(2)] (3) For purposes of this section, "public servant" does not include jurors.
