First Substitute H.B. 32

Representative Jordan Tanner proposes to substitute the following bill:

1 DISCLOSURE OF TOBACCO INGREDIENTS
2 1998 GENERAL SESSION
3 STATE OF UTAH
4 Sponsor: Jordan Tanner
5 AN ACT RELATING TO HEALTH; REQUIRING THE DEPARTMENT OF HEALTH TO
6 OBTAIN CERTAIN INFORMATION REGARDING CIGARETTES AND TOBACCO
7 PRODUCTS AND TO MAKE SUCH INFORMATION AVAILABLE TO THE PUBLIC;
8 AND PROVIDING AN EFFECTIVE DATE.
9 This act affects sections of Utah Code Annotated 1953 as follows:
10 ENACTS:
11 26-40-101, Utah Code Annotated 1953
12 26-40-102, Utah Code Annotated 1953
13 26-40-103, Utah Code Annotated 1953
14 Be it enacted by the Legislature of the state of Utah:
15 Section 1. Section 26-40-101 is enacted to read:
16 CHAPTER 40. DISCLOSURE OF INGREDIENTS IN CIGARETTE
17 AND TOBACCO PRODUCTS ACT
18 26-40-101. Title.
19 This chapter shall be known as the "Disclosure of Ingredients in Cigarette and Tobacco
20 Products Act."
21 Section 2. Section 26-40-102 is enacted to read:
22 26-40-102. Gathering of information.
23 The department shall obtain annually publicly available information regarding cigarettes
24 and tobacco products from other states and sources concerning:
25 (1) the presence of the following substances in detectable levels in a burned state and, if

1 the cigarette or tobacco product is typically burned when consumed in a burned state:
2 (a) ammonia or ammonia compounds;
3 (b) arsenic;
4 (c) cadmium;
5 (d) formaldehyde; and
6 (e) lead; and
7 (2) a nicotine yield rating for the cigarette or tobacco product for which a rating has been
8 developed.
9 Section 3. Section 26-40-103 is enacted to read:
10 26-40-103. Disclosure of information.
11 Information obtained by the department under this chapter is a public record and may be
12 disclosed in accordance with Section 63-2-201 and disseminated generally by the department.
13 Section 4. Effective date.
14 This act takes effect on January 1, 1999.
