5    AN ACT RELATING TO MOTOR VEHICLES; DEFINING INATTENTIVE DRIVING;
6    PROVIDING PENALTIES IN CERTAIN CIRCUMSTANCES.
7    This act affects sections of Utah Code Annotated 1953 as follows:
8    ENACTS:
9         41-6-154.25, Utah Code Annotated 1953
10    Be it enacted by the Legislature of the state of Utah:
11        Section 1. Section 41-6-154.25 is enacted to read:
12         41-6-154.25. Inattentive driving -- Defined -- Penalty.
13        (1) As used in this section "inattentive driving" means operating a motor vehicle on a
14    highway while using a telephone, two-way radio, computer, facsimile, compact disc, tape, or other
15    device which requires holding the device or portion of the device during the use.
16        (2) In addition to any other penalty, a person who causes a collision or accident due to
17    inattentive driving is guilty of a class C misdemeanor.
