6 AN ACT RELATING TO INSURANCE; PERMITTING A WOMAN TO SELECT AN
7 OBSTETRICIAN/GYNECOLOGIST AS A PRIMARY CARE PHYSICIAN OR TO REFER
8 ONESELF DIRECTLY TO SUCH A PHYSICIAN FOR CARE; REPEALING EXISTING
9 LAW; AND PROVIDING AN EFFECTIVE DATE.
10 This act affects sections of Utah Code Annotated 1953 as follows:
11 ENACTS:
12 31A-22-623, Utah Code Annotated 1953
13 REPEALS:
14 31A-8-105.5, as last amended by Chapter 10, Laws of Utah 1997
15 Be it enacted by the Legislature of the state of Utah:
16 Section 1. Section 31A-22-623 is enacted to read:
17 31A-22-623. Primary care physician.
18 A disability insurance policy that requires an insured to select a primary care physician to
19 receive optimum coverage:
20 (1) shall permit a female insured to:
21 (a) select a participating provider who is an obstetrician/gynecologist and is willing to
22 provide primary care services, as defined by the policy, as the insured's provider from whom
23 primary care services are received; or
24 (b) refer oneself directly for obstetrical and gynecological services to a participating
25 provider who is an obstetrician/gynecologist without any form of preauthorization, preapproval,
26 or referral from a primary care physician if the insured has not selected the option available under
27 Subsection (1)(a);
1 (2) shall clearly state in literature explaining the policy the options available to female
2 insureds under Subsection (1); and
3 (3) may not impose a higher premium, higher copayment requirement, or any other
4 additional expense on an insured by virtue of the insured selecting a primary care physician or
5 receiving care in accordance with Subsection (1).
6 Section 2. Repealer.
7 This act repeals:
8 Section 31A-8-105.5, Primary care physicians.
9 Section 3. Effective date.
10 This act takes effect on July 1, 1998.
