First Substitute H.B. 86

Representative Judy Ann Buffmire proposes to substitute the following bill:

             6      AN ACT RELATING TO INSURANCE; PERMITTING A WOMAN TO SELECT AN
             7      OBSTETRICIAN/GYNECOLOGIST AS A PRIMARY CARE PHYSICIAN; AND
             8      PROVIDING AN EFFECTIVE DATE.
             9      This act affects sections of Utah Code Annotated 1953 as follows:
             10      ENACTS:
             11          31A-22-623, Utah Code Annotated 1953
             12      Be it enacted by the Legislature of the state of Utah:
             13          Section 1. Section 31A-22-623 is enacted to read:
             14          31A-22-623. Primary care physician.
             15          A disability insurance policy that requires an insured to select a primary care physician to
             16      receive optimum coverage:
             17          (1) shall permit a female insured to select a participating provider who is an
             18      obstetrician/gynecologist and is qualified and willing to provide primary care services, as defined
             19      by the health care plan, as the insured's provider from whom primary care services are received;
             20          (2) shall clearly state in literature explaining the policy the option available to female
             21      insureds under Subsection (1); and
             22          (3) may not impose a higher premium, higher copayment requirement, or any other
             23      additional expense on an insured by virtue of the insured selecting a primary care physician in
             24      accordance with Subsection (1).
             25          Section 3. Effective date.


             1          This act takes effect on July 1, 1998.
