5 AN ACT RELATING TO HIGHWAYS; PROVIDING FOR PUBLIC SAFETY PROGRAM
6 SIGNS ON CERTAIN HIGHWAYS; PROVIDING A DEFINITION; AND REQUIRING
7 CERTAIN RULEMAKING.
8 This act affects sections of Utah Code Annotated 1953 as follows:
9 ENACTS:
10 27-12-134.5, Utah Code Annotated 1953
11 Be it enacted by the Legislature of the state of Utah:
12 Section 1. Section 27-12-134.5 is enacted to read:
13 27-12-134.5. Public safety program signs -- Permits.
14 (1) As used in this section "public safety program sign" means a sign, placed on or
15 adjacent to a highway, that is promoting a public safety program or safety practice, or a crime or
16 drug abuse prevention program that is being sponsored by the department, the Department of
17 Public Safety or a local law enforcement agency.
18 (2) In accordance with Title 63, Chapter 46a, Utah Administrative Rulemaking Act, the
19 department shall make rules to allow public safety program signs on state highways by permit.
20 The rules shall contain reasonable terms and conditions:
21 (a) that are no more restrictive than motorist service signing requirements of the Manual
22 on Uniform Traffic Control Devices for Streets and Highways adapted under Section 41-6-20; and
23 (b) for granting and maintaining a permit.
24 (3) A local highway authority shall allow public safety program signs on county roads and
25 municipal streets under their jurisdiction in a manner that is no more restrictive than the rules
26 established by the department under this section.
