5    AN ACT RELATING TO HIGHER EDUCATION; PROVIDING FOR THE ESTABLISHMENT
6    OF SNOW COLLEGE SOUTH IN RICHFIELD, UTAH, AS AN INTEGRATED PART OF
7    SNOW COLLEGE; PROVIDING FOR ADMINISTRATION OF THE INSTITUTION BY
8    SNOW COLLEGE; REQUIRING THE STATE BOARD OF REGENTS TAKE
9    APPROPRIATE ACTION TO ENSURE A SUCCESSFUL TRANSITION OF THE SEVIER
10    VALLEY APPLIED TECHNOLOGY CENTER INTO SNOW COLLEGE SOUTH;
11    PROVIDING FOR THE INSTITUTION'S ROLE; AND PROVIDING AN EFFECTIVE
12    DATE.
13    This act affects sections of Utah Code Annotated 1953 as follows:
14    ENACTS:
15         53B-16-205, Utah Code Annotated 1953
16    This act enacts uncodified material.
17    Be it enacted by the Legislature of the state of Utah:
18        Section 1. Section 53B-16-205 is enacted to read:
19         53B-16-205. Establishment of Snow College South -- Supervision and administration
20     -- Transition -- Institutional mission.
21        (1) There is hereby established a higher education institution in Richfield, Utah, hereafter
22    referred to as Snow College South.
23        (2) Snow College shall administer the institution under the general control and supervision
24    of the State Board of Regents as an integrated part of Snow College's mission, programs, and
25    curriculum.
26        (3) (a) In conjunction with the establishment of Snow College South, the facilities, staff,
27    and programs at the Sevier Valley Applied Technology Center in Richfield shall become a part


1    of the state system of higher education and the structure from which Snow College South shall
2    begin its operations.
3        (b) The State Board of Regents shall take the appropriate action required to assure the
4    successful transition of the applied technology center and its faculty and staff into the state system
5    of higher education, including, if necessary:
6        (i) creating and recording any conveyances needed for the transfer of property; and
7        (ii) providing procedures for assimilating the center's faculty into the rank and tenure
8    structure of Snow College.
9        (4) (a) Snow College South maintains a strong curriculum in applied technology and
10    technical courses of a general nature which can be transferred to other institutions within the
11    higher education system, together with lower division courses of a general nature and courses
12    required for associate degrees in science, arts, and applied science.
13        (b) The institution may confer certificates of completion and degrees as determined by the
14    State Board of Regents within the parameters referred to in Subsection (4)(a).
15        Section 2. Funding for Snow College South.
16        (1) The budgetary appropriation traditionally made for the Sevier Valley Applied
17    Technology Center shall be transitioned to Snow College South for the fiscal year beginning July
18    1, 1998.
19        (2) For the fiscal year beginning July 1, 1999, and for each fiscal year thereafter the
20    appropriation to fund Snow College South shall be a line item appropriation under higher
21    education in the Appropriations Act.
22        Section 3. Effective date.
23        This act takes effect on July 1, 1998.
