6 AN ACT RELATING TO THE CRIMINAL CODE; MAKING IT A CRIME TO OBSTRUCT
7 OR IMPEDE THE LAWFUL MANAGEMENT OF FOREST, MINING, OR
8 AGRICULTURAL ACTIVITIES OR TO SOLICIT OR CONSPIRE WITH ANYONE TO DO
9 SO; AND PROVIDING A PENALTY.
10 This act affects sections of Utah Code Annotated 1953 as follows:
11 ENACTS:
12 76-4-205, Utah Code Annotated 1953
13 76-6-108, Utah Code Annotated 1953
14 Be it enacted by the Legislature of the state of Utah:
15 Section 1. Section 76-4-205 is enacted to read:
16 76-4-205. Conspiracy or solicitation to halt or impede forest, mining, or agricultural
17 practices.
18 A person who solicits or conspires with any other person to commit any crime against
19 property or person with the specific intent to halt, impede, obstruct, or interfere with the lawful
20 management, cultivation, or harvesting of trees or timber, or the management or operations of
21 agricultural or mining industries is guilty of a third degree felony.
22 Section 2. Section 76-6-108 is enacted to read:
23 76-6-108. Obstruction of forest, mining, or agricultural activities.
24 (1) A person who commits any crime against property or persons with the specific intent
25 to halt, impede, obstruct, or interfere with the lawful management, cultivation, or harvesting of
26 trees or timber, or the management or operation of agricultural or mining industries is guilty of a
27 third degree felony.
1 (2) A peaceful demonstration, not involving civil disobedience or criminal action, is not
2 a violation of this section.
