6    AN ACT RELATING TO CITIES AND TOWNS; MODIFYING THE PROVISIONS
7    RELATING TO THE FILLING OF A POSITION IN THE CLASSIFIED CIVIL SERVICE;
8    AND MAKING TECHNICAL CHANGES.
9    This act affects sections of Utah Code Annotated 1953 as follows:
10    AMENDS:
11         10-3-1009, as last amended by Chapter 29, Laws of Utah 1983
12    Be it enacted by the Legislature of the state of Utah:
13        Section 1. Section 10-3-1009 is amended to read:
14         10-3-1009. Certification of applicants for position -- Number -- Eligible lists,
15     removal.
16        [Whenever] (1) If a position in the classified civil service is to be filled, the civil service
17    commission shall as soon as possible certify to the appointing power the names of [five persons
18    to fill such position from those persons having]:
19        (a) ten persons, if the position to be filled is entry level; or
20        (b) five persons, if the position to be filled is other than entry level.
21        (2) Persons certified under Subsection (1) shall have the highest standing in the eligible
22    list, but a lesser number may be certified [when there is not] if the required number is not on the
23    eligible list.
24        (3) If more than one position is available in the same department, the civil service
25    commission shall also certify to the appointing power one additional name for each additional
26    position to be filled.
27        (4) (a) All persons not appointed shall be restored to their relative positions on the eligible


1    list.
2        (b) All persons who have been on the eligible list for two years without appointment shall
3    be removed [therefrom] from the list and [can only] may be returned [thereto] to it only upon
4    regular examination.
